fire. as we said, several people are being helped by the red cross right now to help find housing this morning. here is a live look at the scene. the flames are out. crews are still there mopping up and keeping an eye on any hot spots. also building inspectors are there. they are a bit worried about some of the walls collapsing. we'll have a live report in the next half hour. right now 6:00 a.m. let's get you out the dwoor a look at weather and traffic. >> good morning. plenty of clouds and a full moon. exactly 100% full at 5:33. you probably noticed you can kind of tell when that is happening out there. despite the cloud cover. no rain drops yet but we are anticipating a couple of showers here and there. as you head on out you may want to grab the umbrella. if you're new to the coast you'll be spending time there. we're in the 50s and by the afternoon with cloud cover and the possibility of a shower, high temperatures in the mid 50s. taking you to the bay it is a

golden gate field. university avenue into the berkeley curve and as we make our way to the toll plaza no metering lights yet. minor backup for the cash lane. fast track lanes getting through nicely. 6:02 now. happening now with less than an hour from the start of oral arguments at the u.s. supreme court on the defense of marriage act following arguments yesterday on california's proposition 8. we'll go live outside the supreme court in washington, d.c. for the latest. good morning. >> reporter: good morning. today the nine justices will consider a case of life-long love. the story of an 83-year-old widow and her partner of 42 years. the supreme court's look at same sex marriage today turns to couples who are already wed. couples like edie windsor and her late wife, thea spire. >> it is a marriage anybody would want gay or straight. we had a wonderful life

together. >> reporter: when spire died in 2009 windsor got socked with a $360,000 estate tax, money she wouldn't owe the irs if her spouse had been male. the 1996 defense of marriage act limits federal tax and entitlement benefits to heterosexual couples. now the big question for the justices -- >> can the federal government deny to those legally married couples benefits available to heterosexual couples? >> reporter: before it can weigh in the court must decide whether the group defending the law led by house republicans has the authority to make the case. it is no sure bet. the meaning of marriage has ignited a debate outside the high court. yesterday for the first time justices considered whether gays and lesbians have a fundamental right to marry. >> can you think of any other rational basis for a state using sexual orientation as a factor in denying homosexuals benefits?

>> you want us to step in and render a decision based on an assessment of the effects of this institution which is newer than cell phones or the internet? >> reporter: just 16 years a the defense of marriage act passed congress with a large majority but now many lawmakers are having second thoughts. five u.s. sitting senators have changed their minds since sunday. >> before you get away, let me ask you this. what is at stake really for gay couples with doma? what does it do? >> reporter: -- accept the federal definition for marriage, in this case a man and a woman, some 1,000 regulations use marital status to determine which benefits they'll give. it's exemptions for estate taxes, insurance, social

security survivor benefits, all of those things use the federal definition. if the court decides to strike down that portion of the defense of marriage act, it'll mean that heterosexual couples will be able to be joined by homosexual couples in receiving those benefits. >> all right. live from washington, d.c., thank you so much. now we go to washington, d.c. with carolyn tyler also covering the hearings. she is in line to go into the supreme court chambers and we'll have live reports this afternoon on abc 7 at 4:00. carolyn is also tweeting updates from her twitter account at c tyler abc 7. happening now at the golden gate bridge, human toll takers are gone and a new all electronic system is in. a new era began at midnight. abc 7 goes live to the bridge. how is the commute going with this change? >> reporter: this morning the word is so far so good from mary

curry the spokeswoman for the golden gate bridge. she is joining me here live burning the midnight oil so to speak. she was here last night and is back out here. what are you predicting this morning for the commute? >> the morning commute will go very well. 86% of the customers are on fast track so we shouldn't see much difference except for the 25-mile-per-hour speed limits people seem to be at least complying or exceeding that, perhaps. we might start to see some bumps as we get into the daytime traffic that normally pays with cash or more cash payors but right now everything is going very, very well. >> reporter: while you're talking i want to also roll some video so people can see what happened last night at midnight. you had the vintage packard, the same car that crossed on opening day in 1937 crossing last night at midnight so that was a sentimental moment. no more human toll takers though. you have people out here. what's going to happen in case there is trouble with people stopping at the plaza? >> we have a couple things people can do if they start to slow down and are confused. we have a speaker system to

good wednesday morning to you. as you head outside temperatures are very mild. we have a good deal of cloud cover. numbers have dropped to the low 40s in napa. elsewhere with upper 40s and

here. 64 in palo alto. 67 in concord. a chance of showers lingers throughout much of the rest of the work week and even march. i'll explain coming up a bit later. thank you so much. it is 6:15. happening now supporters and opponents of same sex marriage are gathering on the steps outside the u.s. supreme court in washington, d.c. here is a live picture where things are about to get busy. we told you earlier in less than one hour, 7:00 exactly, oral arguments will begin in the case centered around the leelt of a defense of marriage act this time or doma. you can see a lot of people out there. some waving flags. there are police there as well. the justices inside heard arguments yesterday on california's prop 8, which banned same sex marriages here. a decision on both cases expected in june. as the supreme court justices get ready to decide on doma and prop 8 house minority leader nancy pelosi of san francisco is making a new call

for their repeal. in a new op-ed in "usa today", the congresswoman here writes, quote, doma and prop 8 are unconstitutional. neither measure meets the standards of our founding principles. both deserve to take their rightful place in history. it is 6:17 now. we're hearing of a policy from former cia director david patraeus regarding the extra marital affair that led to his resignation. >> how deeply i regret and apologize for the circumstances that led to my resignation from the cia and caused such pain for my family, friends, and supporters. >> petraeus spoke before the reserve officer training corps in los angeles last night. he told the crowd that he knows he's seen in a different light now but will try to move forward with stronger values and make it up to loved ones. petraeus resigned in november after an affair with his biographer became public knowledge. well the nation is about to

get its first female secret service director. the president selected julia pearson for the post. she is a 30 y-year veteran and currently serves as chief of staff. it is hoped that she'll change the reputation of the u.s. secret service. outside we don't see much fog. nothing to obscure the view of that gorgeous moon. >> even with the cloud cover it's definitely bright. beautiful with some cloudy skies throughout the day and mild temperatures. live doppler 7 hd showing that mask surrounding the bay but no rain yet. we're looking at a couple weak upper level disturbances that will visit us throughout the afternoon and evening hours. here is a look from our camera, good visibility with upper 40s. santa rosa 43. good morning, livermore. 48 degrees with 50 in the east bay. los gatos 48. that is one of the cooler locations and a live look at 8 o right now jam packed. temperatures pretty nice.

51 san francisco. 53 in oakland. 54 san carlos with upper 40s. san jose. 50 on the coast. 49 santa cruz. so here is a look at your forecast. just a chance of sprinkles throughout the day today. mainly in the higher elevations where it provides that lift and we will look for the showers to continue into tomorrow. that system just a little bit stronger. we do have a cut-off low aimed right at northern and central california over the weekend. mainly saturday. and, unfortunately, on easter and that will give us the best chance of showers. even so we're not talking a lot of rain at all. you know we are about 6 inches below where we should be for this time in terms of our rainfall season. not only in san francisco but many locations across the bay. these two weak impulses not going to make much of a dent in our deficit but they continue their track to the south and east. we have a broad south flow so that temporarily brings us some mild conditions. through the afternoon, notice the cloud cover. a couple areas of green popping

up by 4:00 in the afternoon from parts of the south bay and east bay. lake county could get wet. also the coast could see some mist and drizzle. we're taking you through thursday afternoon right now. look at all the cloud cover. in terms of rain, well, there is just a little bit here and there. you can see if you look quickly. and it pushes off to the east. by friday we're dry. temperatures today 50 in the city. 56 in fremont. the look ahead a chance of showers tomorrow. wra warmer and sunnier friday but cooler and showers for the weekend. dry into next week. and the flip of a switch at the metering lights and check it out. now we are back beyond the west grand overcresting and a grind getting to the toll plaza and metering lights. once past that it looks like things are moving nicely into san francisco on the upper deck from the east bay. back to livermore we have this accident in the slow lane. look at the slow traffic out of the central valley up and over the altamont toward the scene and then, fortunately, when you get to the pleasanton

interchange westbound 580 things improve a bit. we have very slow traffic, a grind out of antioch fairly typical to railroad avenue and things pick up through pittsburgh and into concord. a quick look at your drive times now. 22 minutes from antioch into concord. 34 getting to the 680 dublin interchange on westbound 580. if you're traveling southbound out of petaluma just about 30 minutes into novato. thank you so much. this next story makes me a little nervous. >> yeah. a california restaurant shams customers who don't show up for their reservations. we'll tell you how it works. and a popular american car gets a major

good morning. a live look here at the golden gate bridge. headlights heading into san francisco where they will not be paying tolls to human toll takers. as of midnight all electronic. so far the reports are that things are going well. we'll check weather and traffic shortly. >> not a single driver on your screen pulled out any money to hand to a toll taker. a head shaker out of philadelphia. a mother and daughter are accused of trying to cheat the transit system and in the process leaving baby behind. new surveillance video shows the 15-year-old mom and her mother pushing a baby carriage toward the cashier. this happened on monday as the

baby's mom goes through. she slipped her pass back to her mother who was going to use it at another station to avoid suspicion. but in the hand off, the two of them apparently forgot about the baby. you see it's still there. the cashier noticed the stroller and called 911. an officer says the pair were frantic about leaving the baby behind and because of that police are not going to charge them with fare evasion. new this morning the new 2014 jeep cherokee debuts today at the new york international auto show. but long-time fans of the suv might not recognize it. chrysler has given it a radical redesign ditching the cherokee's boxy shape and opting instead for a more aero dynamic style. the change is reportedly upsetting some long-time jeep fans. one jeep owners tells the associated press the new cherokee is, quote, ugly and more suited for a trip to the mall than the rubicon trail. however, jeep is under pressure to meet new fuel economy requirements which explains the new, more aero dynamic design. a california restaurant is

taking to twitter to shame customers who don't show up for their reservations. red medicine is based in l.a. and sells vietnamese fusion food and is now tweeting the names of customers who don't show up and posting the time of their reservations. there were seven no shows this past saturday. the managing partner says he decided to take action because no show customers have forced them to either overbook or have empty tables. kind of a rage on twitter this morning. a lot of buzz about it. >> might just want to show up. >> or call. 6:26 now. happening now the supreme court is getting ready for another historic hearing of same sex marriage. we'll take you back live to washington, d.c. to show you the rally and protests bringing together opponents and supporters. new this morning a sheriff's patrol car flips over the east bay. deputies reveal what led to the sudden crash. san francisco firefighters are trying to figure out what

we'll check in to find out who's winning. >> it looks like from this vantage point that the moon might be winning. what do you think? >> i think you're right. absolutely. the sun comes up at 7:02. parts of the bay area looking at mostly cloudy skies. herwise we are looking at a few peeks of clearing and that is allowing for the light of the full moon. it is pretty out there. along the shoreline today the clouds will be with us and we're talking about the seabreeze once again so it is mild now in the 50s. throughout the afternoon mid 50s. by 4:00, still about 56 degrees. with a mostly cloudy sky. chance of a sprinkle throughout the day today. mainly over some of the higher elevations around the bay this morning very mild. low 50s upper 50s by noon time. partly cloudy to mostly cloudy skies. and the lingering chance of a shower throughout the evening and throughout the afternoon. but in our inland valleys if you're in the higher elevations that is where you could see the best chance, mount diablo but otherwise starting in the

livermore valley upper 40s. mid 50s to 60 with a mostly cloudy sky. peeks of sunshine and outside chance of a shower. shower chances increase throughout the rest of the work week especially into the weekend. i'll explain a little bit later. >> thanks. we go back now to livermore where we had an earlier accident westbound 580 at first just getting reports from chp that has been cleared out but unfortunately i'm sorry to say the damage is done. 39 miles an hour through livermore. 30 off the altamont pass. 22 miles an hour you're averaging coming up toward the altamont and wind mill so that is jammed and to san jose we're just getting reports now. this is a stall 280 right at the 87 interchange. possibly blocking a lane. right now not seeing any slow traffic past the scene but we'll be watching so they get that stall out of there quickly. we're continuing to follow breaking news we first brought to you at 4:30. right now san francisco firefighters are still at the scene of a major four-alarm fire

in the bayview district. building inspectors also there. we'll go live for a look at the massive flames and the damage. >> reporter: about 20 people are now trying to figure out what to do next. they're working with the red cross. their homes are ruined. take a look at this huge fire that did so much damage overnight. firefighters say it spread quickly. they got the call just before 1:00 that one building was on fire. when they got here it had spread to two others. the final count ended up being three buildings with massive fire damage. two with water damage. one with some exterior damage. it started in a home on mckinnon street in the bayview district and spread to homes on 3rd street. all of the people got out okay. some tell us it was very scary and they were also in a bit of shock. >> oh, wow. it was like, you know what? i was in a maze. even though i seen it, i never got scared. i never got nervous.

i think i -- i thank you for your smile. i was like, oh, wow. look at that. you know? because it just freaked me out. >> reporter: everyone did get out okay. the fire damage is incredible but check out the water damage. a couple of homes have some flooding on their bottom floors from all the water that firefighters used to get this fire out. now they're trying to pump it all out of the home. one building is a home and the other is a bar the new club long island at the corner of 3rd and mckinnon. two firefighters were hurt. minor injuries. one fell off a ladder and suffered bumps and bruises. the other had minor smoke inhalation. about 20 people though don't have homes now. they're work wg the red cross to figure out what to do next. and firefighters are still trying to figure out what started this fire. live in san francisco, abc 7 news. >> thank you. also new this moorng contra costa county sheriff's deputy is

recovering after his patrol car crashed while responding to a call. look at this. ended up on its side. the crash happened just before midnight on richmond parkway in unincorporated san pablo. officials say the deputy hit the center divide other than san pablo avenue after passing another vehicle. they say he suffered minor injuries but is expected to be fine. happening now day two in the historic battle for gay rights before the nation's highest court. this is a live look from outside the supreme court. the justices will take up the federal defense of marriage act also known as doma which defines marriage as between a man and a woman. the 1996 law prevents same sex couples even though legally married in states that allow it from collecting federal benefits. today's case involves an 83-year-old woman from new york who was denied the benefits of marriage following a 42-year partnership. now today's landmark marriage case comes one day after the justices considered a california case on whether gays and

lesbians have a fundamental right to marry. a huge crowd rallied outside the high court yesterday while inside the justices had hard-hitting questions for critics and supporters of prop 8, california's same sex marriage ban. in addition to the merits of the case the justices must decide if prop 8 backers have the right to be in court since the state is not defending the voter-approved ban. the supreme court is expected to issue a ruling in both cases by june. here in the bay area many same sex couples are feeling cautiously optimistic about the supreme court taking on the same sex marriage. this couple is getting ready to adopt their first child despite the fact that they can't legally marry in california right now. >> the ceremony that i want is probably not going to happen any time soon necessarily. but i do want it. just like anyone else. >> it's important for a child to be able to say that my parents are married and that the state recognizes their marriage.

>> questions from several justices yesterday focused on the children of same sex couples. according to a santa clara university constitutional law professor, this may be why californians no longer support prop 8. the professor said marriage is not simply about procreating anymore. abc 7 news reporter carolyn tyler is in washington, d.c. covering the supreme court and is just about to go in to watch today's doma hearing. we'll have live reports this afternoon starting at 4:00. carolyn is also tweeting updates from her twitter account at c tyler abc 7. 6:36 now. a new problem on the new eastern span of the bay bridge. caltrans and bay area transportation officials will meet today to figure out what to do with at least 30 of the giant bolts holding the span that have snapped. the san francisco chronicle reports caltrans is considering replacing all 288 bolts or rods on the new eastern span. the rods are about 2 1/2 inches in diameter and about 9 to 17

feet long. it's unclear how much it would cost or how long the work would take. caltrans insists the bridge will be safe and will open on time labor day weekend. this morning an 8-year-old girl is recovering after a frightening incident. she was hit in the leg by a 20-inch arrow while on a class field trip. this happened at uc-berkeley's hall of science. nadine hairston was playing on a life sized whale on a trip with about 60 third graders. police are trying to determine if it was an accident or potential felony. detectives spoke with neighbors asking if they had seen anybody with a bow and arrow. nadine's family gave us photos of her in the hospital. her mother says the arrow only went through the fatty tissue in her thigh luckily missing vital blood vessels. >> she cried a little bit and calmed down right away. everyone said she was pretty calm for what had happened. >> can you imagine? the girl's mom tells abc 7 news nadine should be able to go back to school in a few days.

good morning fairfield with south wind. 51 there. we are much warmer this morning from san carlos, 5 degrees warmer. 4 degrees warmer at the airport. certainly in the north bay. despite that breeze by the delta you're warmer too. your forecast a chance of a shower throughout the day today. mid 60s for afternoon highs around the east bay. inland east of caldecott tunnel upper 50s, 60s at the coast. shower chance today and tomorrow as well. dry on friday though. we go to fremont. good morning. you've got a problem here. this is on 880 near stevenson. what happened was apparently a speeding vehicle spun out, hit the center divide, and crossed all lanes. in the process clipped a couple other cars. now we've got one lane blocked. traffic here one of those cars southbound 880 at stevenson. you can see slow traffic there beginning from about highway 84 and also in the south bay stalled northbound 280. this one right at 87. it is now in the center divide. i'm seeing really typically slow

traffic northbound 87 here but that is not due to the stall on 280. let's take a look at the san mateo bridge. the brake lights are beginning to get heavier in the westbound direction. a lot of companies you make your way westbound up toward the high rise. you're looking at about a 17-minute delay as you make your way from hayward over toward foster city and a little bit less in the opposite direction. at 6:42 now, this morning's report suggests hewlett-packard is trying to remove its name from san jose's hp pavilion. the current agreement expires in 2016. however, tech website all things d reports ceo meg whitman has said she would like to get out of the deal earlier. it costs hp $3.1 million a year for the name. any change would have to be approved by the san jose city council. 6:42. admit it. do you think you're cool, part of a unique club when you order from the secret menu not on the official menu at neighbor fast food restaurants? >> hum. >> sometimes right? the secret meals may come with a secret of their own. and a live look at the big

6:45. happening now the morning commute on the golden gate bridge is different. for the first time in the span's 76-year history there are no toll collectors in those booths. we'll go live to the bridge. how is the first morning of the all electronic era going? >> reporter: so far so good. things are going smoothly.

maybe too smoothly. by that i mean too quickly. i have a new warning for you from the chp. right now they say people are going too fast through the toll plaza. the speed limit has been raised to 25 miles an hour but that doesn't mean speed. remember, there is very little room for error out here on these narrow lane. looking at the video from last night when things were much slower and much quieter and more sentimental. the last car went through the toll plaza paying cash and it was a vintage packard. actually the same car that made the crossing on the day the bridge opened in 1937. also you see workers revealing signs that read "do not stop." the last toll taker, marilyn alvarado talked with us after she took the last cash toll. she says after 29 1/2 years she is retiring and it is a bitter sweet moment. >> feeling like this was it. this is the last day. this is the last day we accept toll. and i mean there are feelings of euphoria but also some sadness.

jane? >> good morning. if you're a wells fargo customer you may have had problems with the website yesterday. the site experienced an unusually high volume of traffic. now they believe it came from a so-called denial of service cyber attack. however, a spokeswoman tells reuters the vast majority of customers weren't impacted and information remains safe. this is the most recent incident in a series of bank hack attacks which started last fall. let's see how market is doing this morning. hit another record high yesterday. but pulling back today, in fact we're losing about everything we gained in the dow yesterday. and the bloomberg silicon valley index also trading lower. now apple is the stock to watch today citing unidentified industry sources. manufacturers are expected to be producing the itv at nearly full capacity by the end of this year. they describe it as an ultra hd tv with voice and motion control features and internet connectivity. and you know how air travel and going through airport security is so stressful? a new survey says as bad as all
