country -- county, rather, or city. gurero was on the way to las vegas. he was scheduled to fight in may. >> the westbound lanes of interstate 80 now open again tonight after being closed most of the day because of a deadly truck accident. around 10:30 near the area of old cavis road a collision set off a fiery scene. the driver told authorities he was distracted. >> he was driving, he was eating and he started choking. he then lost consciousness. while driving. the vehicle drifted off the right hand shoulder then veered hard left back across the rains. the tractor trailer collided with a bmw. >> the driver and passenger inside of the bmw died. the big rig driver is hospitalized with moderate injuries and could face charges of vehicular manslaughter and driving while distracted. driving under the influence of alcohol is clearly illegal but

test positive for even a trace of drugs. that would include most prescription medication, medical marijuana. drugged driving is on the rise. a study found that more drivers are now testing positive for drugs that may impair driving than those who test positive for alcohol. but prosecuting those cases is difficult. if drug tests turn out positive, prosecuters currently have to convince injuries -- jury there's is a correlation between erratic driving and drugs in bodies. supporters of sb 289 say that will change if the bill becomes law. >> it will be against throughout drive any detectable amount of controlled substance in system. >> it will result in drivers being falsely charged. >> it could stay in the system as long as seven days.

an elderly san jose woman and her son took on the public guardian today in court and won. the. >> county wanted them to take out a reverse mortgage on their home. >> dan, what happened? >> well, it was something. today, in court grace got a chance to set the records strai. she was confused by the questions and got emotional but in the end the judge heard her loud and clear. this 85-year-old owns this house in san jose but has been living in an assistive living facility paid for by medical. >> what lou like about it? >> because it's -- it's my friends. >> the public guardian filed a motion to take out a reverse
