cheryl because we're here in oakland. lyanne melendez, "abc 7 news". >> larry: i will be out there live during the 6:00 newscast to bring you opening day for giants and dodgers. i'm see you out there. >> bring my suntan lotion. >> larry: we'll see you later. >> cheryl: switching gears, new details on a driver's rampage at a walmart in san jose zbloovl four people were hurt one of them seriously after this man drove his cutless in front of the store and assaulted some of the customers inside. customers at the store held him down. >> we're learning more how the suspect crashed his car inside the walmart. he did it by driving up on the sidewalk and going through that opening and making a sharp right turn crashing through the glass doors. he got 30 feet inside.

he got out of his car and started beating people with a club. police say it was a steering wheel locking device or metal bar and it was customers inside the store that brought him down. >> apparently at some point, one of the victims was struck, the customers in the store decided to go ahead and prevent the suspect from creating further harm to any of the on or about patrons. few of them stepped forward in a valiant effort, in my opinion and subdued the suspect. there was some mention that his legs were tied with belts they pulled off their waist. >> reporter: they said thank god to for those customers. they prevented other people from being injured. a store employee remains in the hospital but his condition is not life-threatening. mark matthews, "abc 7 news". >> larry: federal judge has made stockton the biggest u.s. city to ever file for bankruptcy.

they asked to default on $165 million they borrowed back in 2007 to pay the state pension obligations. creditors argued that the city did not cut spending or raise taxes. the bankruptcy case has been closely monitored for precedent setting implications. california law says debts to the state pension fund must be honored and it questions whether federal bankruptcy trumps that. >> cheryl: they arrested three serial carjacking suspects. these are two of the men. police are not naming the third suspect because he is a juvenile. investigators say the robber used a long barreled gun in multiple robberies on march 4 and 5. they arrested tillman last month. he was shot after back go into an officer with a stolen bmw. >> larry: chp says distracted driving was the cause and

alcohol may have been a factor in a fatal rollover crash in bodega bay. the driver was killed and officers say she was use can her cellphone system when she lost control. three passengers suffered minor injuries. coming up, we will ride along with the highway patrol as law enforcement agencies throughout state kick off a crackdown on drivers who talk or text on the phone while behind the wheel. i was coming across the bridge i saw the officers out there today. >> cheryl: a man whose body was found burning last week has been identified. 31-year-old adam lieber to be a stein. napa police are investigating the case but his death is believed to be a suicide. the sheriff's office said he did not appear to have suffered any injury other than burns. he was pronounced dead at the scene. dental records were used to identify him. >> larry: a victory in court for oakland police and two officers

that shot an unarmed man three years ago. >> cheryl: they sided with police. they filed a wrongful death suit against the officers. nick smith was in court following the verdict. >> two officers have this their lives on hold since the shooting of an unarmed man in 2010. they were cleared of any wrongdoing after a federal jury decided there wasn't enough evidence. oakland police officers left court without speaking. two were cleared of any wrongdoing in a federal lawsuit filed by the widow of 37-year-old derek jones. a barber who they shot and killed in november of 2010. a police investigation and court records show that an unarmed jones ran when the two tried to question him. they have said they thought jones was reaching for a gun. it turned out to be a small scale. the attorney for jones' widow that the jury didn't see all the

evidence. >> more than 75% of your evidence has been excluded not to mentioned the witnesses were excluded. the two officers feel vindicated, they did exactly as they were trained to do. this is the second time they have been cleared. the d.a. refused to file criminal charges and civil jury cleared the two. the widow's attorney says she will appeal the ruling. >> larry: this is new video from dozens of students have wrapped up a march in comprehensive immigration reform. showing about 40 protestors walking down international boulevard heading toward downtown oakland. they are not satisfied with this weekend's deal with a guest worker program. >> we're fighting over the details of it, historically the worker programs are workers are

>> larry: it is one of the most horrific injuries you'll see in sports. good news kevin ware was up on crutches and may be able to go to the atlanta with his teammates. we're not going to show you the injury. it's too graphic. this picture was posted on twitter and it shows him getting around on crutches less than 24 hours suffering the break in his leg. his visitors and the coach and coach's son. they held his jersey up to the trophy.

ware got his chance to hold the trophy as well and coach talked to reporters outside the hospital. >> he is in good spirits. surgery went well. obviously we want to make sure no infection sets in but the surgery went well. he is good spirits. he has the trophy next to his bed. >> louisville will face wichita state. i have to tell you, watching that injury, it was horrifying. good news is, you didn't she see shots on television how graphic. if you go on line you can see the bone sticking through. kevin ware told his teammates, he wasn't in pain because he was in shock. then he saw the reaction of the coaches and players around him who were just stunned. that is when he got scared. >> cheryl: i didn't get to see the game but i saw the reaction and players and coaches were tears. they were shocked. they couldn't believe what they

were looking at. i don't want to see those graphic images. >> larry: that is part of the reason we are not showing them. you have go back into sports, joe these man where you have a compound fracture. that took place on monday night football and still so vivid in everybody's memory. it's so graphic and so horrifying. it's one of those things you never forget. hopefully he'll heal up fine. he is in atlanta. it will be a homecoming fok for him obviously not what he had planned. >> cheryl: some of the speculation what may have caused this. some people are saying it was porous bone density or compound fracture he never even knew about. >> you never see that kind of horrific break, but hopefully he will be okay. >> cheryl: good stuff. we have more news for you.

a san jose firefighter back on duty today after suffering a massive heart attack while fighting a fire last summer. >> he collapsed. went into cardiac arrest three times on the way to the hospital. keira has more on his return to work. >> hugging and laughing dominates the fire station number one as firefighter frank ryan returns to duty first time in seven months. >> last couple months i've been getting healthier and easier to start thinking about what happened. >> the veteran firefighter suffered a massive heart attack while battling a fire at st. patrick's cathedral. he was in the right place at the right time the care he received on the scene. he was in a melody induced coma and released in three weeks. over the last seven months he has been doing rehab and working out in the gym, whole time anxious to fighting fire. >> i've been doing it this long,

it's a little awkward. >> reporter: he has to change his diet a little but is modest about he has done since august. he said he can never thank them enough for saving his life. >> all i can do is go to work, i can do the same. these guys aren't going to take thank yous very well and i don't think anybody in this profession does. >> frank ryan's second shift back at the station is wednesday. i asked him if he thought about easing his way back to the demanding schedule of the firefighter but he wanted to get back full time immediately. >> cheryl: apple made some policy changes in the wake of criticism from chinese customers. >> john joins us live.

>> reporter: apple ceo tim cook is apologizing to customers in china and apology is tied to apple's customer service, something that is very well known here in the u.s., but that n china the second largest market. apple has faced poor service in warranty policies. they say they repaired broken iphones instead of replacing them. 90% of customers have been satisfied by the fixes, it said it would replace those and offer a new one year warranty. in other apple news, the company's application to trademark has been denied. the name mini is merely descriptive and not a distinctive name. orbit and parent company of american airlines has reached a settlement in a legal battle.

american sued orbit accusing it of hurting it's competition to make it harder to book airlines. the terms must be approved by a bankruptcy judge. >> check on trading, stocks falling on disappointing manufacturing data out. bloomberg index also lower in part on apple weakness as well as intel. yahoo ceo describes why she decided to take the yahoo job despite being 28 weeks pregnant. in her post, she writes how she had been planning a long maternity leave but all that changed when yahoo came going. it was started by sheryl sandberg to get women to achieve more in the workplace. cheryl, larry, i'll send it back to you.

and a little bit of fog developing in the overnight hours. there may be reduced visibility for those of you that are commuting. forecast animation, at 11:00 at this point we'll see low clouds and expand beyond the coast and pushing inhidden. that will be the pattern in the early morning hours. first fog and clouds go away and in the afternoon, mainly sunny skies. a pleasant day shaping up tomorrow. overnight tonight, low temperatures will be pretty much on the mild side. upper 40s to right around 50 generally around the bay area. then only afternoon, highs in the upper 60s to near 70. 68 in santa clara. upper 50s to low 60s on the coast. downtown san francisco, 62 degrees. north bay, santa rosa, high of 68 tomorrow. 69 in napa. on the east bay look for highs of 66 at oakland.

stars of castle have reasons to celebrate. first news. >> tony has the entertainment report. >> we start today with tv actor corey monte who has checked in rehab important substance addiction. a spokesman confirmed the news saying he did it voluntarily and requesting respect and privacy. in an interview two years ago monte admitted to a serious addiction in teenage years which led to treatment when he was 19. >> they are celebrating a milestone, a hundred episodes and we were on the set to talk about it. >> hundredth episode is pretty new to me. >> i'm happy that we are here. it's kind of like, wow, cool. it's a great book mack for the show. >> hundredth of castles right here on abc. now to the hit show, they played

cleanup crews hired by the city of san mateo were forced to clean up a home of debris and junk. they gave the homeowners 30 days to clean up their own mess. vic lee was there when they arrived. he is here now live with exactly

what happened. >> reporter: larry, first that court ordered deadline to clean up the yard, then last week they received an abatement letter saying the city would come by today and clean up their yard. >> here they come. >> city inspectors accompanied by police at the home to begin their walk through. waiting in the wings a cleanup crew to haul away debris. watching was his wife and their son. this is what their front yard looked like before they were ordered to clean up their property. it was littered with debris. the city called it an unsanitary hazardous dumping ground that needed to be cleaned up. >> they were given more than enough time beyond the 30 days the court ordered. >> this is what it looked like today. they spent the last month taking loads of junk to the dump hoping to satisfy the judge's order.

take another look, before and after pictures. >> they are going to have an independent contractor come in and take out whatever it is they want to take out. >> inspection begin and walk through included the backyard where supplies were covered with a large tarp. the inspection lasted about half an hour. for him and his family, every minute was filled with angst. >> after conferring with each other they reached a decision. they said they weren't totally happy with the cleanup but it was good enough. >> it appears that according to city staff that they are in substantial compliance with the court's order. >> reporter: their plight is not over. at 6:00 we'll tell you about bigger problem which they may be facing in the future. it has to do with the construction of their house.

>> cheryl: friends and relatives of the aurora, colorado shooting victims went to court to see if he would face the death penalty. more on the district attorney's division. >> prosecutors brought the accused gunman and wanted him to be accused if convict. justice is death he told the judge as several victims relatives cried in court. >> thumbs up for the death penalty. >> brian's friend was one of 12 people killed last july during a midnight movie premiere. dozens of others were wounded. prosecutors say they spoke to 800 victims and families leading up to this decision and rejected the defense's offer for him to plead guilty to avoid the death penalty. >> i don't know how much pain my friend went through.

>> he looked at both his parents on monday as the case heads into a lengthy death penalty. a new judge has been assigned and the trial has been pushed back to february of next year, 18 months after the deadly shooting spree. >> it's frustrating as a victim. you are talking another calendar year before he even gets to a trial that we already know what the outcome is going to be. >> reporter: this will a long and emotional trial. it could last nine months, the judge said it should take four. >> larry: the head of oklahoma's dental board wants criminal charges against the dentist to who may have infected 7,000 of his own patients with hiv or hepatitis. thousands lined up for health screenings after getting warning letters. they found unsanitary conditions at two of his dental clinics. he was previously sued for medical malpractice and

negligence. the district attorney is now considering criminal charges against him, as well. >> protecting courted houses across texas following the brutal murders of a top prosecutor and his wife. he and his wife were shot multiple times in their home east of dallas. the assistant district attorney was squtd in january right near the courthouse. >> this whole thing is shocking to all of us. we've got to move forward and hope and pray that the people that are investigating this will -- i know they are doing everything they can. >> cheryl: they are looking into a possible connection to the murder of a colorado chief of corrections shot two weeks ago. a suspect in that case was later killed and shootout with police in texas. >> new jersey man who won the $338 million powerball jackpot have settled a child support

fda new guidelines okayed for longer periods as long as patients are talking to their doctors. more than 45 million americans smoke and half of them try to quit every year. >> a new report revealing a dramatic rise children diagnosed with adhd. one in five high school boys in the u.s. is diagnosed with adhd. diagnosis of the disorder jumped 53% in the last five years. it could be a sign of overdiagnosis and overmedication. >> reg regulators are investigating complaints about the hyundai senata saying that it can rust and cause failures. it affects 400,000 cases from 2006 to 2008 years. they say it's received six complaints of suspension failures with three happening at

automatically pick up those costs. you will pay the taxes because you owe them but interest and penalties they will pick up. >> larry: i know the case of one preparer went to jail because shady stuff. >> they will tell you what you want to hear and so they fill it out to get your money. they want to know if bart fares are distance based why are fares about four dollars less than sfo? >> you are sharp, you checked it out. yes, it is the distance you go except for those that go to sfo because there is a special fee to get bart to the airport. so anybody that goes there pays the extra money. everywhere else but sfo is by distance. >> cheryl: they emailed is it legal for a retail store to write down a driver's license for a purchase or return? >> there is a loophole in the

storm is moving in coming up. >> dan: this is the man san jose police say drove his car into walmart and started attacking customers. he is hamid zaid. >> big question this evening is why? for answers we have team coverage with mark matthews at san jose walmart. david louie is family home in sea sied. mark, let's begin with you. >> reporter: you never know it from looking at the store right now, except for those wooden doors that are now up over where the glass doors were. yesterday, there was pandemonium scene, this guy racing around the parking lot in his oldsmobile cutlass he hit cars and driving right through the front of this walmart store. >> witnesses describe a wild scene inside the store.

>> there was panicking. you could see the fear on their faces. everybody was running toward the exits. >> he climbed out of the cutlass armed with a metal rod and hit the first man that came up to him. >> he believe the mexican guy an older man. >> the victim was a store employee that suffered a serious wound to the head. what happened next is remarkable. >> when one of the victims was struck customers in store decided to go ahead and prevent the suspect from creating further harm to any of the other patrons. >> in this cellphone video, customers took down the suspect. he is there in white t-shirt and jeans and holding him for police. >> there was mention his legs were tied with belts. >> police officer says thank god for those customers. outside the store today, shoppers commented on the bravery of those that stepped in. >> makes me very happy there are people out there willing to risk

somebody to help somebody out. >> reporter: coming up at 6:00 we'll be hearing from more customers and daughter of the man who was hit inside the store 61-year-old. she has told abc7 news her father is out of intensive care and they are very grateful that customers stepped in and brought the suspect down. mark matthews, "abc 7 news." >> dan: new details this evening on the man arrested for that wal-mart rampage. san jose police tell us while he was in his car he hit a couple of cars in the parking lot and jumped the curb and then rolled along the sidewalk before making a hard right turn into the store. he was able to miss the security barricades. police say all of this came to an end when they were able to rest erase 33-year-old hamid zaid until shoppers held him down. david louie
