lives. >> he told san jose police that he lived here on seaside in monterey county. but it turns out he doesn't live here at all. zaid's mother came out of the house and did share insight into her son. she said she didn't know her son was even in town. i asked if zaid had any dispute with walmart but she didn't think so. he worked as independent auto repairman. in our own background check, he lived in concord, vallejo, sacramento and even out of state. his mother said he has never been in trouble. house belongs to elderly grandparents and she is trying to shield them about the incident. now, the investigation continues into what was behind the incident at walmart's story road store. she was charged with assault with a deadly weapon and being

under the influence of drugs. he is being held at santa clara county jail. the incident was out of character according to his mother. she and other family members are still trying to digest what happened. 33-year-old hamid zaid may not have had any previous brushes were law but under the influence of drug charges and facing hit-and-run and resisting arrest. >> cheryl: thank you. >> sky7hd takes us to breaking news a deadly accident near the altamont pass. one person has died. another suffered very serious injuries when a car went off the road apparently off the overpass of the railroad tracks along interstate 580. it happened around 3:00 p.m. and crash is not blocking lanes but traffic is slow along westbound 580 because drivers are slowing down. it has been a wild weather

an officer with a stolen bmw. both he and tillman remain in police custody. police have arrested a man suspected of breaking into san francisco city hall and defacing the building. they believe shawn watson scrolled on the marble walls. this is video of the cleanup effort. he is being charged of burglary as well as vandalism and being held on $48,000 bail. >> dan: two oakland police officers on trial for killing an unarmed man are free to return to duties. they shot a 37-year-old man back in 2010. they thought he was releasing for a gun. the officers left federal court without speaking on camera. they told us they feel vindicated. federal grand jury ruled there was not enough evidence to proceed with the trial. the suit was brought by the widow of derek jones and the

ruling was not a surprise given earlier rulings brought by the judge. >> it's difficult to put a trial when more than 75% of your evidence have been excluded. the judge felt the evidence she is talking about was unsustainable claims made against the officers. family's attorney is says they will appeal. >> napa county sheriffs say the man whose body was found burning last week was district attorney's son. police believe that 31-year-old adam urbanek committed suicide. intelligence crews were called to an overpass south of francis street early tuesday morning. sheriff's office says the body did not appear to have suffered any injuries other than the burns. dental records were used to identify him. >> cheryl: a san jose firefighter is back to work after suffering a massive heart

attack. frank ryan went cardiac arrest while fighting a fire. he returned to active duty today at station number one. he felt great since he left the hospital and he is thankful he was with the right people when he suffered that heart attack. >> we do this every day. i was lucky enough it happened at the fire. everybody did their job and a recipient and survivor. >> cheryl: he says he has to change his diet a little but is modest about the strides he has made since last august. >> dan: state lawmakers are considering a bill that would keep convicted drug dealers out of county jails. >> the alternative approach to sentencing serious drug pushers. supporters say it will ultimately make our streets

state prison to county jails. but sheriffs are finding drug traffickers are taking way too much room at jail with sentences up to two decades long. he wants drug traffickers back in state prison. he believes local facilities aren't the place for them anyway. under realignment they give money annually to run rehabilitation and other programs to stop criminals from rio fending. something that can't help hard criminals like drugging traffickers. >> it's a problem that doesn't fit the direction of what these county jails have become. >> one of many reasons behind the realignment plan is relieve prison overcrowding, not put more people back in. feds have overtaken the prison medical system because it

shifting things to the county is able to reduce a court order and improve health care and get out of federal receivership. >> doubling down on this failed policy will guarantee receivership long into the future. >> she says she had a case where a drug trafficker was convicted of possessing 15 pounds of meth, street value, nearly $700,000. >> as a parent i don't want hard drug traffickers staying in my community and have the benefit of services here, let them go to the state where they belong. >> going back to a broken system doesn't make a lot of sense. >> reporter: it's not just drug traffickers taking up so much room. california sheriffs association found that locals are helping more than 1100 inmates that are serving more than five years in jail, jail was generally designed for stays of one year
