you. >> thank you. and to the chief for speaking with us this morning. new this morning, concord police are actively investigating a shooting that occurred last night at an apartment complex off monument boulevard. so far investigators haven't released any details but dispatchers confirm for abc 7 news that there is a shooting investigation under way. we're told more details will be released shortly. meanwhile a community website reports two people were shot and police are interviewing several potential witnesses at the apartment complex. two ambulances, the fire department, medics all called to the scene. we'll be updating this story as soon as we get additional details confirmed by police. developing news in south san francisco where a caltrain fuel leak last night still has one track closed for repairs this morning. the leak happened on the tracks between the bay shore and the south san francisco caltrain

stations. in this video you can see diesel fuel leaking from the tank of a southbound locomotive after it struck some depbris on the tracs last night. about 800 gallons of fuel spilled. this morning caltrain service through the area between the bayshore and south san francisco stations is limited to a single track. fire officials say the spill does not pose a danger to the public but it's going to take a lot of work, understandably, to the it cleaned up. >> the cleanup will involve removing the dirt that is involved with the diesel spill and it's beside the tracks so they'll have to remove the tracks conceivably to get to the dirt and put the track back together. >> caltrain is operating trains in both directions but the work may cause delays. no trains will be stopping at the south san francisco station. new this morning bay area landfill workers with meet today in livermore to discuss whether to strike against their

employer, waste management. their contract talks have stalled over wages and what the union calls dangerous working conditions. those talks broke down after the company rejected a union proposal to give workers a 50 cents an hour raise. we will be watching this story as it develops and let you know whether a landfill strike is called. there are new details on two stories we first broke on the abc 7 saturday morning news. in san francisco police are confident they'll catch whoever stabbed two tourists and badly beat another. it happened late friday night at the best western americana hotel on 7th street south of market. hotel employees tell us a group of people walked into the building, got into an altercation with three tourists from southern california who were checking in. the fight escalated outside with two tourists being stabbed and robbed. >> there was blood all over the street right in front of the elevator. we had seen him, you know, as

he's getting on, he had wounds all over him. it was very upsetting. >> a female tourist was beaten. all are expected to recover. and in the east bay a former photographer for the oakland tribune was killed in a shooting in oakland. 54-year-old lionel ray fluker was shot while driving home from the gym. the shooting happened just after 10:00 friday night outside a gas station at seminary avenue and mcarthur boulevard. investigators say another man who was the intended target was critically wounded. the family of a 2-year-old oakland boy is distraught and exhausted after he was injured due to a sideshow on the freeway. this morning that boy is recovering from major surgery to his head and neck. the sideshow collision happened back in january along 880 in san leandro. abc 7 news has new details from the boy's family. >> this is my baby now.

>> reporter: 2-year-old cory abrams is in kaiser oakland's intense care unit right now. he underwent a six and a half hour disk fusion surgery to repair his broken neck. it's an injury he sustained on march 20th while his mother drove on 880 south in san leandro. >> the sound was just -- i just can't even describe it. >> reporter: jasmine glenn was driving her black impaula while her son and mother were in the back seat and suddenly a sideshow erupted right in front of her. >> the last thing i remember saying was look at the guy doing the doughnut, and i woke up in the hospital. >> reporter: jasmine glenn's chevy was rear-ended by a big rig. he was the only one conscious after the crash. >> after the big rig hit us, we ended up hitting another car. after we stopped, we were facing the oncoming traffic. >> reporter: cory was the most seriously hurt, but he was

rushed to kaiser in hayward where glenn says doctors took head and neck scans but found nothing wrong with the boy, but he couldn't straighten his head. glenn took him to kaiser oakland where doctors performed major surgery on wednesday. >> i hold responsible the person that wassing to the sideshow. why would you do a sideshow on the freeway? do it somewhere else. >> reporter: this wasn't the first sideshow to take place on 880. in january, several cars were involved in a sideshow in the middle of 880 near the oakland coliseum. now this family is making a public plea. >> i encourage parents who have young children out there driving to let them know that this type of behavior is totally unacceptable. >> reporter: police have no leads on the driver involved in the sideshow. the big rig driver was not cited. in the newsroom, now back to you. more than 5,000 runners are expected in san francisco this

morning at 7:00 for a brand new half marathon event. the inaugural transamerica rock 'n' roll san francisco run begins and ends near aquatic park where they have been setting things up. the course goes through the marina, crissy field, the presidio, across the golden gate bridge and back. the event has sold out with 5500 runners from 15 countries expected to compete. rock bands will perform in aquatic park after the race. that concert is free and open to the public. the rock 'n' roll half marathon is expected to cause delays getting to the marina green, that area, the whole area, until about 11:30 this morning. there are also street closures, muni detours in the race area that you see highlighted there. also expect heavy traffic around civic center plaza during the greek independence day celebration between noon and 6:00 p.m. and delays are likely around at&t park before and after the giants afternoon game. we've a full list of the detours

problems for oakland police as they try to launch a new radio network of public safety channels. the city recently had to rebuild its public safety radio system due to interference problems. well, now the group that oversees the east bay's mutual aid system is refusing to give oakland agencies access because the city has not paid its membership dues. today's "oakland tribune" reports the east bay regional communications agency refuses to program oakland public safety radios into its system of talk groups. they allow agencies throughout contra costa and alameda counties to talk directly to one another during emergencies. the $72 million network was built primarily with federal funding after the 9/11 attacks. people in san francisco's ocean view district are coming together to deal with the urban blight that's built up in their neighborhood. city officials joined residents and local business owners in a community walk to examine the challenges in the district. you can see graffiti there.

there's illegal dumping, buildings neglected for years have made that neighborhood an eyesore. people are frustrated and are now partnering with the city to deal with the problems. >> we have a new program out of the mayor's office so we have a confluence of things happening where residents are involved. we have support from the city to actually uproot a lot of the blight we have here in the neighborhood. >> and he's talking about the new program the mayor's office has established. it's called invest in neighborhoods initiative to help economic development in 25 san francisco neighborhoods, including oceanview. there's a new court program in san francisco that helps military veterans who get into trouble with the law. it's called the veterans justice court. it's a program that's had tremendous success in other cities that have adopted it. abc 7 news reporter vic lee was in the courtroom on opening day. >> reporter: judge braden woods will run the pilot court program. the crimes range from

misdemeanors to nonviolent felonies. the defendants have one thing in common, they're all veterans. presiding judge cynthia lee was the driving force behind veterans court. >> it's an opportunity really to give them and to give the court a different way to reintegrate them into the community. >> reporter: it's a collaborative effort between the court and the veterans administration. elizabeth brett will be the va's liaison. >> the focus in a court like this is on treatment and connecting veterans to treatment. >> reporter: and that's the key. it works like a medical triage. not only are there va counselors, there are prosecutors, public defenders and probation officers, all trying to create a supportive environment, not the contentious one which often exists in regular courts. defendants like richard davis are applauded when they do well with their treatment program. davis is an army infantry

veteran who was arrested on drug charges. he believes this court will help others like him go straight. >> they just have demons that they have to work through themselves, and this -- this court gives you that opportunity. >> reporter: make no mistake, judge woods will be tough when defendants stray. >> the court will issue a bench warrant. will stay that warrant. there will be no bail. >> reporter: but there's a lot of encouragement too. >> all right, sir, keep up the good work. >> reporter: and a lot of straight talk. >> you have a lot to do over the next week. >> reporter: deputy public defender brian pearlman says that this collaborative approach seems to work well with veterans. >> i think with veterans they have a multitude of issues dealing with a lot of posttraumatic stress, dealing with drug issues. >> reporter: the addition of a veterans court comes at a time when courts in general are struggling financially. their budgets have been slashed. but judge lee says she's been able to find the resources necessary to find this program

northern california. some light rain in eureka and also some light rain you reported in ukiah. here's a live look right now at the embarcadero. you can see a little bit of a westerly breeze there. the flags blowing and some low clouds and skies with temperatures on the cool side right now. san francisco 54, san jose 53, santa cruz only at 49. we also have another shot for you, the bay bridge at this time. union city 55, los gatos 49 degrees. here's what you can expect for today. chance of showers, couple chances. i'll show you exactly when. it's going to be cloudy and cooler, so temperatures coming down a bit, but then we have a much warmer workweek in store for us. if you're headed to the game again today, 1:05, temperatures right near 60, 59 degrees. mostly cloudy. so it looks like the chance of

rain won't hit you during the afternoon hours. but as we take a look at the satellite/radar image, we have this area of low pressure. this is going to bring some spotty showers mainly to the north bay and northern california. then we have high pressure building over the pacific. that's going to bring our temperatures well above normal through the workweek. so here's how the timing plays out. a couple of the storms headed to our north but we're going to get the tail end of it again. so a chance of light showers. 8:00 this morning you'll notice possible areas of drizzle, maybe some sprinkles along the north bay and parts of the coast, on the peninsula. then lunchtime cloudy conditions, but not much rain expected. and then this evening is when another system starts to drop in and we'll see some rain in the north bay, the areas of light green, possibly again in the santa cruz mountains and parts of san jose. most of the rain that we're expecting will be falling overnight in the midnight hours into monday and then you will

wake up to clear skies and very cool conditions monday morning. less cloud cover, then the high pressure builds and then we'll see temperatures really come up. highs for today, you'll notice a bit cooler compared to yesterday. 62 in san francisco, 68 in san jose and some mid-60s in parts of the interior valleys. 66 in concord and livermore. lows tonight definitely on the cool side with clearer skies, so in the 40s, getting up to 49 in san francisco. and here is the roller coaster accu-weather seven-day forecast. we've got the chance of showers today and then it kind of feels like fall. this is what i mean by the three seasons in the accu-weather seven-day forecast. then it's going to feel like summer midweek with temperatures climbing into the mid and upper 80s inland. tuesday, wednesday, very warm, sunny conditions. then it will drop down to moe spring-like temperatures by next weekend. so we've got it all.

apple is planning a major expansion in the south bay but their new building is reportedly way overbudget, about $2 billion over budget which would make it cost more than is being spent to build the new world trade center in new york. take a look at this artist's sketch of the new cupertino building that could now cost nearly $5 billion. abc 7 news reporter tomas roman has the story. >> reporter: it's a lot of money and apple's valuation is dropping pretty sharply. he says this proposed campus for apple is a tribute to the

company's late founder, steve jobs. when jobs unveiled the plans for this building in 2006 the cost was slated at $3 billion. now a recent article says the cost may balloon to $5 billion. the site has spread to incoencos the old hp buildings and land. some tech watchers now wonder if the new chief at apple, tim cook, will build it. >> you might call cook the exact opposite of steve jobs, so i have my doubts whether we'll ever see this building built. but this was steve jobs' droem and probably his physical legacy. >> reporter: others want to see this gleaming four-story structure go up as soon as possible. michael miller with the santa clara builders exchange says the jobs created would be a boon to the construction industry. >> the city would benefit not only with tax revenue but keeping jobs close to home. >> reporter: the campus has delayed a year from its fwich20

opening. that might be because of subcontractors being busy elsewhere. miller says there are more than 23,000 unemployed construction workers ready to get to work. the question remains, is $5 billion an exorbitant price for a building, no matter whose dro dream it is? >> apple has lost about a third of its value so they're probably less excited about this building. >> reporter: we tried contacting apple for comment but no one returned our calls or e-mails. cities around the world celebrated community spirit with a twist. they came out for international pillow fight day. mass pillow fights broke out in boston, atlanta, chicago, and this melee on the national mall in washington, d.c. feathers were also floying in hong kong, london and warsaw. san francisco had their back on valentine's day. still ahead in the next half

welcome back, everyone. we are starting this half hour with a quick look at the weather with our meteorologist frances dinglasan in for lisa. >> good morning, everyone. here's a live look at the radar. we could get a chance of showers two times today. the first chance during the morning hours. temperatures will be in the upper 40s to low 50s and then this afternoon we'll see cloudy conditions, also temperatures a bit cooler than yesterday, only

getting up into the mid-60s. and then tonight another chance of showers later on. i'll show you how the timing plays out and how much rainfall you can expect to get. temperatures will be in the 50s. breaking news in san francisco in the morning. two people have been injured in an officer-involved shooting in the mission district. it happened early this morning and police remain on the scene investigating. abc 7 is there live. >> reporter: good morning to you, carolyn. as you said, police are still here, san francisco police and the gang task force to investigate so many details. it is still so early as the shooting only happened three and a half hours ago, but the police chief did tell me that a man waving a replica handgun caused the shooting. take a look at the video we have from just after 2:00 this morning. it happened here on 17th and valencia in the mission district when a group of men approached another group of men leaving a bar. one man pulled a gun.

they did think it was real. witnesses ran to the adjacent mission police station. they told police what was going on. two police just ran out their front door and shot the man with the gun. another person involved also was somehow shot. both adult men were transported to the hospital with serious injuries. as i said, it turns out the gun the suspect had was very real-looking but it was indeed a replica. the officer who shot him is uninjured and will be questioned about the unfolding events. take a listen. >> any time an officer is involved in this, obviously it's unbelievably shaky -- leaves you in a shaken condition, but he's in there and he's being -- he'll be interviewed later on today. >> reporter: only one officer fired on the suspect, but two officers who responded are on paid administrative leave for ten days per protocol. the group of men accosted are

currently at the police station giving their witness statements. san francisco police are here, the gang task force is here, they are diagramming the shooting and expecting to wrap things up in the next few hours. the reason the gang task force is here is they're trying to figure out whether the shooting is indeed gang-related. >> all right, thank you. this is the amazing tsa takedown that's gone viral. an off-duty pinole police officer coming to the rescue of a tsa agent in hawaii. the officer just walking through the airport getting ready to fly home. well, now he is talking about what happened. abc 7 news reporter sergio cantana has his story. >> reporter: just as the woman began confronting a tsa agent at honolulu international airport, justin rogers was just about to go through security to catch his flight home. >> at an airport they have security -- officers for that. so i turned back around and then i heard what i thought was, you

know, skin to skin contact like somebody getting punched. >> reporter: in the surveillance video, you can see the woman punching the tsa agent, then put her in a headlock. that's when rogers literally jumped into action. >> i knew what i was going to have to do to pull her off of her because of the way they were situated. i just decided to use a simple takedown to move her to the ground. >> reporter: once on the ground, several other agents came to help. 43-year-old wylona hiola was arrested and taken to the mental unit at a local hospital. after rogers provided a statement to honolulu authorities, he was able to make his flight back home. sips then the video of his airport takedown has gone viral. this is the first shift for corporal rogers since he wrapped up his vacation in hawaii and he said he's surprised at the attention he's getting just for stepping in to help. before returning to patrol rogers was at a wedding in sacramento and that's when he started noticing the attention. >> at one point i was standing

in a line waiting for food or cake and the people in front of me were talking to each other about have you seen this video on the internet? >> reporter: he says he was happy to help the tsa agent and happy that other people appreciate that. >> i don't really know what to say when people are being so nice, especially since in this job you're kind of used to just doing stuff and going on about your day. a solemn memorial was held for the victims killed in a shooting at oakland's oikos university. members of the san francisco master choral offered a performance of mozart for dozens of family and friends at st. paul's episcopal church last night. six students and a staff member were killed at the university on april 2nd of last year.

oakland mayor jean quan introduced the special performance in their memory. >> it's only been a year since that incident, one that we still all remember, and we want to make sure that in our community, whatever we can do that we will reach out and help you. >> a second memorial concert in honor of the victims is next saturday in sacramento. new this morning, secretary of state john kerry is mourning the first death of a u.s. diplomat killed on the job since last year's attack in benghazi. 25-year-old ann smetingoff was one of six americans killed in an attack yesterday morning in afghanistan. she was from illinois on her second tour in afghanistan. kerry offered his condolences during a visit to istanbul. three other u.s. service members and two civilians were killed when a bomb went off near a military convoy. a heartfelt tribute was given to another u.s. diplomat

killed while on the job. a memorial to u.s. ambassador christopher stevens is now on display at a northern california art gallery. the piedmont native and uc berkeley graduate was killed in that benghazi terrorist attack on september 11th of last year. the christopher stevens memorial exhibition opened this weekend at the john solis gallery in davis. family and friends created the tribute featuring international artists. organizers say it's a fitting honor for the man who dedicated his life to peace and cooperation. >> we have ten different countries represented and people from all around the world are coming together because chris brought everybody together. that was always his philosophy. >> that christopher stevens memorial exhibition runs through april 20th. still ahead, new questions over vacation benefits given to some staffers in the santa clara county district attorney's office. and survival thanks to a

new this morning, some lucrative perks offered to deputy d.a.s in cash-strapped santa clara county. district attorney jeffrey rosen quietly gave his top deputies vacation benefits they can later convert to cash. the paper says the county's top administrator is investigating whether the same perks must now

be offered to tens of thousands of other union employees in the county. if so, that could wipe out potentially any savings the county achieves by renegotiating wages and benefits in the first place. an incredible series of circumstances allowed a family of five to survive a car crash into the american river. their suv went off highway 50, flipping over into the middle of the river. by chance a kayaker with emergency medical experience was nearby. he pulled three children to safety. he went back for the driver, who was trapped upside down, his head being held up by his wife. >> i was afraid if i cut the seat belt he would have died in front of me, in front of me, his wife and three kids. >> and again by chance a fire truck with men trained in swift water rescue was nearby. they put a life jacket under the driver's head while cutting off the roof of the car. only the husband, the driver,

the faa is delaying the closure of nearly a dozen airport control towers in california. the closures were set to begin this weekend because of government-wide spending cuts, but the faa is postponing the

closures of 149 towers nationwide due to legal challenges. in california 11 towers were given a reprieve. the faa now says the towers will be shut down or turned over to local authorities on june 15th. well, they're colorful and alluring and a potential safety hazard. consumer reports has partnered exclusively with 7 on your side for a report on some dangerous toy balls that are very popular with kids. here's 7 on your side's michael finney. >> thousands of them. >> reporter: this ad for a toy shows how the tiny, highly absorbent beads expand in water. these are also larger and were recalled late last year. this after an 8-year-old swallowed one. she was rushed to the hospital where doctors couldn't see anything on the x-ray, but in surgery, they removed a ball

nearly one and a half inches in diameter from her small intestine. >> if nothing had been done, the intestines would have perforated. the child would have had significant infection, sepsis and could have possibly died from it. >> reporter: consumer reports examined the recalled dune craft water balls. >> this ball is fresh out of its package and this is an identical ball soaked in water two days. >> reporter: they also looked at tiny polymer beads still on the market. while their full size is much smaller than the banned water balls, consumer reports say they also pose a safety hazard for small children. >> these products look a lot like candy or gum. they can expand enough in a few hours to block the intestine or airway of a small child. >> reporter: the beads do carry warnings. on the front the package says choking hazard, not for children under 3 years. on the back it says not suitable for children under the age of five. >> while additional injuries

have not yet been documented in the u.s., several have been reported in other countries. >> reporter: all types of super absorbent polymer balls have been banned in italy and malaysia. >> these are also sold widely as decorations. we are urging strongly that parents and caregivers keep these out of the reach of small children. >> reporter: the consumer product safety commission says it is currently investigating polymer balls and beads. meanwhile orbies says its tests show the toy is safe for children 5 and older. they say the ball should pass through their digestive track. however, consumer reports points out the company did not address the choking hazard or potential of a blocked airway, which is a risk for all children. i'm michael finney, 7 on your side. francis dies dinglasan is h. >> we've had fall today, summer

coming up and spring. i'll give you a look at what i mean. a chance of showers moving in towards the bay area during the morning hours and again during the evening hours. it's all coming from a few systems to our north bringing light rain right now to eureka and parts of northern california. so the farther north during the morning hours you are, the more likely you're going to see these showers. here's a live look right now from emeryville towards gray skies over the bay and the bay bridge there. and also temperatures are in the 50s for the most part. 58 in oakland, more moderate there. but only 49 in santa cruz. we'll show you another shot of the golden gate bridge. i just wanted to show you how clear it is here, so not as much fog this morning. that's a little bit why the temperatures are cooler. in napa it's 55, fairfield 52 and only 50 in los gatos. so for today, we're still seeing a chance of showers. we have some unsettled weather, and i'll show you why with the

satellite image. it's going to be cloudy, cooler today and a much warmer workweek in store for us. that's when we'll see the summertime weather. okay, so if you're headed to the game today, looking pretty cloudy for the most part, but rain showers should not happen during game time. it starts at 1:05. temperatures right near 59 degrees, about 60 degrees when it ends as the giants take on the cardinals. there's a couple of areas of low pressure. so these storms to our north will give us cloudy, cool and spotty showers today. i'll show you the timing as well. but then we have high pressure building over the pacific. that's going to give us some much warmer weather, temperatures climbing into the 80s inland through tuesday and wednesday. so the forecast model shows the areas of light green. this morning if you're headed to the marathon we could see some light showers, drizzle, some sprinkles in san francisco and parts of the north bay and all

along the peninsula coast. and then by about 11:00, lunchtime, just cloudy conditions, mainly dry through the afternoon with a lot of cloud cover. but then another system brings us some rain. 9:00 this evening we'll start to see some of it in the north bay and the santa cruz mountains. we'll see the more moderate rainfall but still pretty light at this point in parts of the hills east of san jose midnight. so it will fall overnight. you wake up to clear skies and a very chilly monday morning. but dry for you. highs today also a bit cooler, in the 60s. 62 in san francisco, 66 in concord and fremont, 68 in san jose, and look for cool temperatures overnight into tomorrow morning, just in the 40s. 49 in san francisco and here's the three seasons in one week. so we've got fall today with a chance of showers. it feels like fall, that's what i'm saying. then it's going to feel like summer with kwlainland temperat

i'm carolyn tyler. let's start with a quick first look at our weather with our meteorologist, frances dinglasan, who's in for lisa. >> good morning, everyone. live doppler 7 hd looking for some sprinkles. drizzle this morning could be possible. right now it's pretty quiet, some light rain falling in ukiah but we have a couple of chances of showers throughout the day. chance of showers during the morning hours, temperatures in the upper 40s to low 50s. it will be cloudy and cool this afternoon, a few degrees cooler compared to yesterday, so we'll only make it into the mid-60s in some areas by this afternoon and then another chance of showers moves into the bay area later on this evening as we dip into the low to mid-50s. i'll have the complete accu-weather seven-day forecast coming up. >> thank you, frances. we have breaking news out of san francisco's mission district where a man who pulled a replica handgun on people was shot and wounded by san francisco police. abc 7 news reporter kira klapper

is live on valencia street to explain the unfolding events. >> reporter: good morning to you. when this shooting happened four hours ago when the man pulled the gun, nobody here in the mission out on their saturday night knew that it was a fake gun, so they ran across the street to what happened to be the police department. police responded shooting that suspect and another man. we have video from right after that shooting. those two victims. originally the suspect, turned victim, being taken to the hospital for serious injuries. they are being treated as we beak. the police chief tells me it started when a group of men approached another group of men leaving a bar at 17th and valencia. again, one man pulled a gun. it just so happened it was right across the street from mission police station. witnesses ran across the street. two officers responded but only one shot the suspect and another man was hit by bullets. as the investigation continues, police l
