real-looking replica gun but they say they had to act quickly to protect the public. they're investigating why this happened in the first place. >> this is a person who pulled a gun on someone else. the motivation in pulling a replica firearm, any firearm at somebody else is in the mind of the person who pulls it. >> reporter: both officers who responded are on paid administrative leave per protocol for the next ten days. the group of victims, another group of witnesses are currently at the police station giving their statements as police continue to piece this together. they're still here diagramming the shooting and the gang task force is here looking into whether it was gang-related. they tell us their investigation should wrap up within the next few hours. reporting live, kira klapper, abc 7 news. concord police are investigating a shooting that occurred last night at an apartment complex off monument boulevard. so far investigators have not

released details, but dispatchers do confirm for abc 7 news that there is a shooting investigation under way. we're told more details will be released this morning. meanwhile a community website, claycord.com are reporting two people are shot. police are interviewing several potential witnesses at that apartment complex. ambulances and fire department medics were called to the scene. we'll update this story throughout the morning as concord police release new details. developing news in south san francisco where a caltrain fuel leak last night still has one track closed for repairs this morning. that leak happened on the tracks between the bayshore and south san francisco caltrain stations. in this video you can see diesel fuel leaking from the tank of a southbound locomotive after it struck some sort of debris on the tracks. it happened around 7:30 last night. about 800 gallons of fuel spilled. this morning caltrain service between the area between the

bayshore and south san francisco stations is limited to just one track. fire officials say the spill is not posing any danger to the public, but it's going to take a lot of twork clework to clean i >> the cleanup will involve removing the dirt that is involved with the diesel spill and it's inside the track, so they'll have to remove the track conceivably to get to the dirt and then put the track back together. >> caltrain is operating trains in both directions this morning, but the work is probably going to cause some delays. no trains will be stopping at the south san francisco station. new this morning, bay area landfill workers will meet today in livermore discussing whether to strike against their employer, waste management. their contract talks have stalled over wages and what the union calls dangerous working conditions. the talks broke down after the company rejected a union proposal to give workers a 50 cents an hour raise. we will be watching this story

as it develops and let you know whether a landfill strike is called. there are new details on two stories we first broke on the abc 7 saturday morning news. in san francisco police are confident they will catch whoever stabbed two tourists and badly beat another. it happened late friday night at the best western americana hotel on 7th street south of market. hotel employees tell us a group of people walked into the building, got into an alt altercation with three tourists from southern california who were checking in. the fight escalated outside with two of the tourists being stabbed and robbed. >> there was blood all over the street right in front of the elevator. we had seen him as he's getting on, he had wounds all over him. it was very upsetting. >> a female tourist was beaten. all are expected to recover. in the east bay, a former photographer for the oakland tribune was killed in a shooting in oakland.

54-year-old lionel ray fluker was shot while driving home from the gym. this happened just after 10:00 friday night outside a gas station at seminary avenue and mcarthur boulevard. investigators say it was another man who was the intended target. he was critically wounded. the family of a 2-year-old oakland boy is distraught and exhausted after he was injured due to a sideshow on the freeway. this morning the boy is recovering from major surgery to his head and neck. this sideshow collision happened last month along 880 in san leandro. abc 7 news reporter lisa has new details from the boy's family. >> reporter: 2-year-old corey williams is in kaiser oakland's intensive care unit right now. he underwent a six and a half hour long disk fusion surgery to r repair his broken neck. it's an injury he sustained on march 20th while his mother drove on 880 south in san

leandro. >> the sound was just -- i can't even describe it. it's undescribable. >> reporter: jasmine glenn was driving her black impala while her son and mother were in the back seat and suddenly a sideshow erupted right in front of her. >> the last thing i remember saying was look at the guy doing the doughnut. and i woke up in the hospital. >> reporter: jasmine glenn's chevy was rear-ended by a big rig. these are photos of her smashed car. she was the only one conscious after the crash. >> after the big rig hit us, he spi spined out of control. after she stopped we were facing oncoming traffic. >> reporter: cory was the most serious hurt but he was rushed to kaiser in hayward where doctors took head and neck scans but found nothing wrong with the boy but he couldn't straighten his head. glenn took him to kaiser oakland where doctors performed major surgery on wednesday. >> i hold responsible the person that was doing the sideshow.

one, why would you do a sideshow on the freeway? if you want to put your life in danger, do it somewhere else. >> reporter: but this wasn't the first sideshow to take place on 880. in january, several cars were involved in a sideshow in the middle of 880 near the oakland coliseum. now this family is making a public plea. >> i encourage parents who have young children out there driving to let them know that this type of behavior is totally unacceptable. >> reporter: police have no leads on the driver involved in the sideshow. the big rig driver was not cited. in the newsroom, lisa amin gulezian, abc 7 news. more than 5,000 runners are expected in san francisco this morning at 7:00 for a brand new half marathon event. the inaugural transamerica rock 'n' roll san francisco run begins and ends near aquatic park where they have been setting thingsds up. that course winds through the marina, the presidio, across the golden gate bridge and back.

the event has sold out with 5500 runners from 15 countries expected to compete and rock bands will perform in aquatic park after the race. the concert is free. it is open to the public. now, that marathon is expected to cause delays getting to the marina green area until 11:30 this morning. there are street closures and muni detours in the race area that you see highlighted there. you can also expect heavy traffic around civic center plaza during the greek independence day celebration between noon and 6:00. and delays are likely around at&t park before and after the giants afternoon game. we have a full list of all the detours and road closures on our website, abc7 news.com. just click on see it on tv. frances, i am heading to that giants game. i want to know about the weather there and people want to know in their neighborhood. >> yeah. it's going to be pretty cloudy today. we do have a couple chances of rain. i'll tell you all the details about that.

morning. thanks for getting up and joining us for the abc 7 sunday morning news. this is a beautiful shot from our east bay cam showing you parts of emeryville where it is cloudy this morning. the temperature right now about 56 degrees. what will it be later on today and in your neck of the woods? frances dinglasan will be along shortly with a full accu-weather forecast. new this morning, more radio problems for oakland police as they try to launch a new radio network of public safety channels. the city recently had to rebuild its public safety radio system due to interference problems. well, now the group that oversees the east bay's mutual aid system is refusing to give oakland agencies access because the city has not paid its membership dues. today's "oakland tribune" reports the east bay regional communications agency refuses to program oakland public safety radios into its system of talk groups. they allow agencies throughout contra costa and alameda

counties to talk directly to one another during emergencies. the $72 million network was built primarily with federal funding after the 9/11 attacks. people in san francisco's ocean view neighborhood are coming together to deal with the urban blight that's built up in the neighborhood. city officials joined residents and local business owners in a community walk to examine the challenges in the district. graffiti, illegal dumps and builds neglected for years have made parts of that neighborhood an eyesore. people are frustrated and are now partnering with the city to deal with the problems. >> we have a new program out of the mayor's office so we have a confluence of things happening where residents are involved. we have support from the city to actually uproot a lot of the blight we have here in the neighborhood. >> the mayor's office has established the invest in neighborhoods initiative to help economic development in 25 san francisco neighborhoods,

including oceanview. there's a new court program in san francisco that helps military veterans who get into trouble with the law. it's called the veterans justice court. it's a program that has seen tremendous success in other cities that have adopted it. abc 7 news reporter vic lee was in the courtroom on opening day. >> reporter: judge braden woods will run the pilot court program. the crimes range from misdemeanors to nonviolent felonies. the defendants have one thing in common, they're all veterans. presiding judge cynthia lee was the driving force behind veterans court. >> it's an opportunity really to give them and to give the court a different way to reintegrate them into the community. >> reporter: it's a collaborative effort between the court and the veterans administration. elizabeth brett will be the va's liaison. >> the focus in a court like this is on treatment and connecting veterans to treatment. >> reporter: and that's the key. it works like a medical triage. not only are there va counselors, there are

prosecutors, public defenders and probation officers, all trying to create a supportive environment, not the contentious one which often exists in regular courts. defendants like richard davis are applauded when they do well with their treatment program. davis is an army infantry veteran who was arrested on drug charges. he believes this court will help others like him go straight. >> they just have demons that they have to work through themselves, and this -- this court gives you that opportunity. >> reporter: make no mistake, judge woods will be tough when defendants stray. >> the court will issue a bench warrant. will stay that warrant. there will be no bail. >> reporter: but there's a lot of encouragement too. >> all right, sir, keep up the good work. >> reporter: and a lot of straight talk. >> you have a lot to do over the next week.

you have a lot of appointments. >> reporter: deputy public defender brian pearlman says that this collaborative approach seems to work well with veterans. >> i think with veterans they have a multitude of issues dealing with a lot of posttraumatic stress, dealing with drug issues. >> reporter: the addition of a veterans court comes at a time when courts in general are struggling financially. their budgets have been slashed. but judge lee says she's been able to find the resources necessary to make this program work because it's a priority. vic lee, abc 7 news. this morning new concern over how north korea might respond has caused the u.s. to delay the launch of an intercontinental ballistic missile. the long-planned test from van denburg air force base is being delayed over concerns the launch could be misinterpreted and make the current korean crisis worse. abc news is also reporting the u.s. can't locate two north korean missiles that were spotted four days ago moving to the coast. coming up at 8:00 on abc's this week, one of the

showers and sprinkles during the morning hours in parts of the north bay and along the peninsula coast so we could see some drizzle for the half marathon and then by 11:00 just mainly cloudy conditions. cooler temperatures this afternoon if you're headed to the giants game. then this evening more light showers possible in the north bay, even in parts of the santa cruz mountains. it moves overnight, slides south. that's when we start to see more moderate rainfall midnight, but you'll probably be asleep by then. waking up to clear and cool monday morning and definitely dry, and that's the pattern for the workweek. and overall we're not talking huge rainfall amounts even around the bay, maybe up to 0.01 of an inch, maybe 0.1 or a quarter of an inch. today look for temperatures to be a little cooler. temperatures only getting into the upper 60s. 69 in antioch and 62 in san francisco, 68 in san jose. overnight temperatures very

overbudget, about $2 billion over budget, which would make it cost more than is being spent to build the new world trade center in new york. take a look at this artist's rendition of the new cupertino building that could now cost nearly $5 billion. abc 7 news reporter tomas roman has the story. >> it's a lot of money and apple's valuation is dropping pretty sharply at the moment. >> reporter: he says this proposed wheel champ us for apple is actually a tribute to the company's late founder, steve jobs. when jobs unveiled the plans for this building in 2006 the cost was slated at $3 billion. now a recent article says the cost may balloon to $5 billion. the site was originally 50 acres but now has spread to encompass the old hp campus buildings and land, taking up 75 acres. some tech watchers now wonder if the new chief at apple, tim cook, will build it. >> you might call cook the exact opposite of steve jobs, so i have my doubts whether we'll ever see this building built.

but this was steve jobs' dream and will probably be his physical legacy. >> reporter: others want to see this gleaming four-story structure go up as soon as possible. michael miller with the santa clara builders exchange says the jobs created would be a boon to silicon valley's construction industry. >> the city of cupertino will benefit as well too not only with tax revenue but people being there an keeping jobs close to home. >> reporter: the campus has delayed a year from its 2015 opening. that might be because of subcontractors being busy elsewhere. like finishing the 49ers stadium in santa clara. miller says there are more than 23,000 unemployed construction workers ready to get to work. the question remains, is $5 billion an exorbitant price for a building, no matter whose dream it is? >> apple has lost about a third of its value so they're probably less excited about this building. >> reporter: we tried contacting apple for comment but no one returned our calls or e-mails. still ahead in our next half

hours. still pretty quiet at this point so we haven't found any rainfall yet, but there's a chance of showers a couple times today. the first during the morning hours, temperatures in the upper 40s to low 50s. it will be cloudy and cool this afternoon. mid-50s to mid-60s. and then another chance of showers moves in tonight around 9:00. i'm show you the timing in my next full forecast. it will be cooler with temperatures in the low to mid-50s. carolyn. >> frances, thank you. we continue to follow breaking news in san francisco's mission district. that's where two men were shot by police after one of them pulled a gun on a busy street corner. abc 7 news reporter kira klapper is there live with the latest. good morning, kira. >> reporter: good morning to you, carolyn. san francisco police and the d.a.'s office are all still here investigating and they're looking at the gun. they are analyzing it because it turns out it was a replica handgun that a man pulled. he was shot and another person was shot. we have video from when those two men were sent to the

hospital with what we're told are serious injuries. it happened at 2:00 this morning. a group of men approached another group of men leaving a bar at 17th and valencia. as we said, one man pulled a gun. coincidentally it all happened right across the street from the mission police station so worried witnesses who didn't know it was a fake gun ran across the street. two officers responded. one officer shot the suspect and another man. as this investigation continues, we are about four hours in, police learned the gun was a very real-looking replica gun, but they say they had to shoot. they had to act quickly to protect the public. >> we never want to have to use deadly force if we don't have to. but then again, the officers are out here to protect life. that's our number one job. >> reporter: police are investigating whether those two groups of people are in gangs, rival gangs perhaps. the group of victims and another group of witnesses. also the responding officers,

all are currently at the police station behind us giving their statements. police continue to piece this together, but we do know that the two officers who were involved will be placed on paid administrative leave, that is protocol, for ten days. reporting live in the mission district, kira klapper, abc 7 news. >> thank you for the latest there. this is the amazing tsa takedown that's gone viral. an off-duty pinole police officer coming to the rescue of a tsa agent in hawaii. the officer was just walking through the airport getting ready to fly home and now he is talking about what happened. abc 7 news reporter sergio cantana has his story. >> reporter: just as the woman began confronting a tsa agent at honolulu international airport, pinole police corporal justin rogers was just about to go through security to catch his flight home. >> they have security -- officers for that and so i turned back around. then i heard what i thought was skin to skin contact, like

somebody getting punched. >> reporter: in the surveillance video, you can see the woman punching the tsa agent, then put her in a headlock. that's when rogers literally jumped into action. >> i knew what i was going to have to do to pull her off of her because of the way they were situated. i just decided, you know, to use a simple takedown to move her to the ground. >> reporter: once on the ground, several other agents came to help. 43-year-old wilona hiola was arrested and taken to the mental unit of a hospital. after corporal rogers gave a statement, he was able to make his flight back home. since then the video of his airport takedown has gone viral. this is the first shift back on the beat for corporal rogers since he wrapped up his vacation in hawaii and he says he's surprised at the attention he's getting just for stepping in to help. before returning to patrol, rogers was at a wedding in sacramento and that's when he started noticing the attention. >> at one point i was standing

convoy. a heartfelt tribute was given to another u.s. diplomat killed while on the job. a memorial to u.s. ambassador christopher stevens is now on display at a northern california art gallery. the piedmont native and ucht c berkeley graduate was the one killed in the benghazi terrorist attack on september 11th of last year. christopher stevens memorial exhibition opened at the john solis gallery in davis. family an friends created this tribute featuring international artists. organizers saying it's a fitting honor for the man who dedicated his life to peace and cooperation. >> we have ten different countries represented and people from all around the world are coming together because chris brought everybody together. that was always his philosophy. >> the christopher stevens memorial exhibit runs through april 20th. still ahead, new questions over vacation benefits given to some staffers in the santa clara

new this morning, some lucrative perks offered to deputy d.a.s in cash-strapped santa clara county. our media partner, the san jose mercury news, reports district attorney jeff rosen quietly gave his top deputies vacation benefits they can later convert to cash. the paper says the county's top administrator is investigating whether the same perks must now be offered to tens of thousands of other union employees in the

county. that could potentially wipe out any savings the county achieved by renegotiating wages and benefits in the first place. an incredible series of circumstances allowed a family of five to survive a car crash into the american river. their suv went off highway 50, flipping over into the middle of the river. by chance a kayaker with emergency medical experience was nearby. he pulled three children to safety. he went back for the driver, who was trapped upside down, his head being held up by his wife. >> i was afraid if i cut the seat belt he would have died in front of me, in front of me, his wife and three kids. >> and believe it or not again by chance a fire truck with men trained in swift water rescue was nearby. they put a life jacket under the driver's head while cutting off the roof of the car. the family was hospitalized. only the driver suffered major injuries. cities all over the world

the faa is delaying the closure of nearly a dozen airport control towers in california. the closures were set to begin this weekend because of government-wide spending cuts, but the faa is postponing the closures of 149 towers nationwide due to legal challenges. in california 11 towers were given a reprieve. the faa now says the towers will be shut down or turned over to local authorities on june 15th. well, they're colorful and alluring and a potential safety hazard. consumer reports has partnered exclusively with 7 on your side for a report on some dangerous toy balls that are very popular with kids. here's michael finney.

>> thousands of them. >> reporter: this ad for a toy shows how the tiny, highly absorbent beads expand in water. these water balls also made of super absorbent polymer are larger and were recalled late last year. this after an 8-year-old swallowed one. she was rushed to the hospital where doctors couldn't see anything on the x-ray, but in surgery, they removed a ball nearly one and a half inches in diameter from her small intestine. >> if nothing had been done, the intestines would have perforated. the child would have had significant infection, sepsis and could have possibly died from it. >> reporter: consumer reports examined the recalled dune craft water balls. >> this ball is fresh out of its package and this is an identical ball soaked in water two days. >> reporter: consumer reports also looked at tiny polymer beads that are still on the market, including orbies. while their full size is much

smaller than the banned water balls, consumer reports say they also pose a safety hazard for small children. >> these products look a lot like candy or gum. they can expand enough in a few hours to block the intestine or airway of a small child. >> reporter: the beads do carry warnings. on the front the package says choking hazard, not for children under 3 years. on the back it says not suitable for children under the age of 5. >> while additional injuries have not yet been documented in the u.s., several have been reported in other countries. including one fatality. >> reporter: all types of super absorbent polymer balls have been banned in italy and malaysia. >> these are found not only as toys but sold widely as decorations. we are urging strongly that parents and caregivers keep these out of the reach of small children. >> reporter: the consumer product safety commission says it is currently investigating polymer balls and beads. meanwhile orbies says its tests show the toy is safe for children 5 and older.

going to be right around 59 degrees. mostly cloudy. so you don't need the rain gear. i'll show you why with the forecast model. so the satellite/radar image shows this area of low pressure. this is going slide south towards nevada bringing us cloudy and cool and spotty showers during the morning hours and also some during the evening hours. then high pressure builds over the pacific. sunny and warmer conditions, really warm, later on. now, 8:00 this morning we could see some light drizzle and some sprinkles in parts of the north bay and also along the peninsula coast. and then by lunchtime just cloudy conditions. cooler as well, so we're not going to see as many sun breaks. and then this evening we'll see a chance of showers once again. you see the areas of green, the darker green shows a little bit more rainfall. the heaviest of it moving overnight, midnight for us, but it's not going to amount to much. we're talking just about a tenth of an inch in most locations all around the bay area.

scandinavian airlines or sas will launch service between sfo and copenhagen. the 11 1/2 hour flight will depart san francisco six times a week at 5:35 p.m. arriving flights pr denmark land at sfo around 2:45 in the afternoon. the airline planned to fly to san francisco back in 2008 but the economy and rising jet fuel prices cancelled those plans. sfo becomes the fourth u.s. destination for sas. one of the most coveted baseball cards in the world has been sold for a record amount. we're talking about the 1909 honus wagner card selling for $2.1 million this weekend. the highest price ever for a card in a public sale. less than 200 of the cards were originally printed, handed out in packs of cigarettes. wagner said he stopped printing the card because he did not want to promote smoking for kids, but some baseball historians say
