we are trying to figure why this happens and if anyone was >> this morning, a 30-year-old man is in jail in martinez after assaulting another man on bart and being taken down by fellow passengers. zachary mccabe seen here from another arrest last month was lying across two seats as the train pulled into the pleasant hill bart station. investigators say he was fighting with a 62-year-old man who wanted to sit down. other passengers jumped in and police got there, three men were holding mccabe down after a woman on the train used her stun gun on him. >> i laud that woman. it sounds like that was

appropriate. >> police say the stun guns have less voltages than tasers and you do not need a permit to carry one. mccabe is facing assault charges. >> san francisco police chief is no longer asking some of his officers be allowed to carry tasers. the "san francisco chronicle" reports the chief has withdrawn the proposal that specially certified officers carry tasers and wanted the less lethal weapons so officers could use them on suspects they could not reason with like those who are drunk or mentally ill but after so many suggestions by the public the chief said the restrictions make the them user. >> someone shot a man walking down the street before 8:00 last night a few blocks from highway 101. police say the 29-year-old victim was walking down the street when he was shot in the head by someone in a passing

vehicle. the only description police have so far of the vehicle is it was dark in color. investigators say the victim is in stable condition this morning. >> contra costa county sheriff are looking for a gunman who shot a man would looked for help at a grocery store. he tubs up after 8:00 last night at the safeway. police believe he was shot in richmond and was driven to another area and dropped off. he is expected to drive. the safeway stayed open while crews tended to the victim. >> it is 4:35. police have found a key piece of evidence in the case of a paramedic who was shot to death in the oakland hills. police have recovered a car connected to the crime. the 34-year-old quinn boyer was gunned down in his car last week. police say someone in another vehicle fired at boyer driving down keller avenue. bullets hit quinn boyer twice and the car went off the road crashing into a ravine and quinn

boyer died two days later. police are not revealing much information burr the oakland tribune says a car related to the investigation was found near horace mann elementary school. a $10,000 reward is being offered in the case. >> on capitol hill the senate will vote today to start debating gun control legislation. a bipartisan agreement unveiled yesterday would expand background checks to gun shows and online sales. some conservatives have threatened to filibuster the vote to keep the bill from moving forward. president obama welcomed the agreement and says it represents significant progress but he wishes parts of it were stronger the national rifle association says it should be on the sources of violence and mental health. >> in the midwest a state of emergency is declared in missouri after a string of tornadoes overnight. tens of thousands of people are without power this morning. authorities say a tornado touched down last night in the

st. louis suburb ripping roofs off several homes with reports up to six tornadoes touched down in all. one is being blamed for damage in northern, where it left dozens of homes damaged. drivers were hit by the strong winds with cars and trucks overturned. >> calmer here but a tree came crashing down in the north bay damaging a home. it fell on the roof and into a house yesterday in sonoma county. you can see the damage. no one was in the house at the time. the tree also took out a power line. the power has since been restored. >> san francisco mayor and the super bowl bid committee will make a new announcement regarding the bay area bid to hope super bowl 50 or 51. san francisco and santa clara are hoping to jointly host the super bowl in 2016 or 2017 in the new 49ers stadium in santa clara which will open next year. the bay area is competing with miami to host super bowl 50 and the loser battled houston for

super bowl 51. next month san francisco and miami make presentations during the owner's meeting. >> governor brown spoke at a major university in china calling for unified action to combat climate change telling the students "we have one big problem and we have to work on it together." the governor is on a trade myths in china and signed agreements to boost trade between china and california and to help the most populated nation improve its air quality. brown also announced a $1.5 billion chinese investment in an oakland waterfront housing and retail construction project that would create up to 10,000 jobs, an ambitious project we will hear about in the weeks to come. >> now the weather. before we get do that, one note: we mentioned tornado tore through hazelwood, missouri, where mike went to high school.

are gone around the bay. dug the evening hours we will be back to the 60's but for the 50's at the coast. now an update on the commute. >> we are seeing high winds on the roads as we look at maze along 80 westbound, the tail lights are moving at the 580 junction with no problem to report. as we stick to the east bay we have construction out here along northbound 680 between south mission boulevard to north mission boulevard until 6:00 a.m. with a couple of lanes blocked. nimitz is clear. in san bruno we have more construction southbound 101 at 380 until 6:00 a.m. with the transition road shut down. >> next, a breakthrough in the treatment for a deadly insect borne illness that kills hundreds of thousands of children eve year, a dream come true for a bay area scientist.

>> covering cupertino, concord, wine country and all the bay area this is abc7 news. >> a pharmaceutical company has production of an antimalaria drug 12 years after a breakthrough discovery by a uc berkeley professor. it will start producing a partly synthetic version of a chemical critical to making the antimalaria drug that based on the discovery of a cal professor. he hopes it will save the lives of hundreds of thousands of people in developing countries. each year 650,000 people die from malaria, mostly children. >> now the man who appeared to be sleeping on top of a bart elevator when he was crushed to death last month.

the san francisco medical examiner has identified the man as 42-year-old david thomas. authorities are asking for your help in finding out where three was from to notify his family. police are still looking at surveillance video to figure out how thomas got into the elevator shaft at the bart station. bedding material was found on the elevator car. >> look at the surveilled of two men suspected in a string of armed robberies, walking into the grocery out let on east 14th street in san leandro in january. one robber pulled a gun on an employee and demanded money. they fired shots inside the store to get everyone's attention. witnesses say they were scareed. we saw them hit the floor, crying, emotional, they froze. customers ran out the door to the emergency exhibits.

>> the men are suspected in seven robberies. >> sponsors of burning manifest value have won a round in the battle over who should regulate the event the a committee of nevada legislature approved a bill to prevent the county from trying to hit it with new regulations. the burning man is held on land owned by the federal government but officials slapped organizers with a $1.50 fee to fay for law enforcement and is suing to overturn the fee which would cost $600,000. burningman is a festival that draws 50,000 people a year to the nevada deputy either. >> great excitement in the south bay by a colony of beavers in downtown san jose. it has been 150 years since beavers have been seen there. over the past two weeks, video cameras with night vision lenses have captured a mother and two yearlings feeding in the dark. a willow tree there, the trunk, was a sign they had settled. the board habitat is along the

runs although slow clouds are returning to the coast and some will spill into the bay over the next couple of hours. it looks clear from our east bay hills camera with high definition look back to the west across emeryville and oakland and san francisco. here is a look at what is going to happen today. san francisco is ten degrees cooler and down to 64 and fremont at 69 and san jose 71 and santa rosa 73 and 11 degrees cooler than yesterday and concord tops out at 72 and mild for this time of year but 13 degrees cooler than yesterday in oakland at 69 is 14 degrees cooler than yesterday. here is a look at the macarthur maze it is clear in oakland where the temperature is 54. same in san jose. we are at 50 in san francisco, and 56 in walnut creek and mill valley and palo alto is the cool spot at 49 degrees. upstairs while we were sleeping, cold front rushed through our neighborhood and that is a dry cold front, no rain unfortunately and that is the theme through the seven-day outlook with cold fronts coming

through and they will be dry. however, they will bring us a seesaw nature to our temperatures called the spring seesaw. up one day, down one day, up a couple of days, down a couple of days. today is a "down day." on the peninsula, it is breezy further to the north around millbrae at 54 and everyone else in the mid-to-upper 60's and at the coat it is brick mid-to-upper 50's. and mid-60's in downtown and south san francisco and sausalito and low do mid-70's through the north bay valley and upper 50's at your beaches and mainly upper 60's long the east bay shore with hayward a cool spot at 66 and san ramon is the cool spot at 69 and everyone else in the low do mid-70's. tonight, in the mid-40's to near 50 at the bay the seven-day outlook shows temperatures warmer tomorrow as it will not be so breezy. saturday will be about the same and sunday, another cold front,

and a drop in temperatures with wind on sunday into monday. have a great day. >> we are taking a check of the drive to san jose at 280 northbound coming away from 17, the headlights are moving along with no crabs and no crabs, really, anywhere. as we look at the san mateo bridge it is hazy picture there, but we have a high wind advisory for that bridge and traffic is moving well out here. now, speaking of witch, we also have some construction that is set to take place starting tomorrow for the next two weeks at the toll plaza along the san mateo bridge. that is going to involve the installation of the new automatic tolls so when you get there you may run into a bit of traffic so give yourself extra time when you head out. that is a quick look at the drive from the central valley down to 63 miles per hour. but, still, doing well headed through the altamont pass into livermore and to

>> new this morning, more than three million vehicles are being recalled over defect with the airbags made bit same maker. it affects the big japanese automakers, toyota, honda, nissan and mazda. the detroit recall includes some lexus vehicles between 2000 and 2004 and honda recalls involve civics and crv's and nissan is recalling 5, 2013 models. mazda says the recall affects various years and models.

the search is on for two carjacking suspects who crashed a stolen vehicle into the side of this apartment building at union and van ness. they then took off running. they took out a fire hydrant. look at this video shot moments after the crash. water gushing 20' in the air. police say the nissan was carjacked in modesto three days ago. c.h.p. spotted the car south of market this morning. there was a short chase. the suspect hit a muni bus, hit the hydrant and slammed in the side of the apartment building and ran away. neighbors say police around here have been asking a lot of questions. >> i was sitting on the bench. next thing, i saw the hydrant flowing. i saw five sheriff and c.h.p. and i thought, well, that is

weird, and then next thing they are asking me questions and i am like, they are asking if i saw anyone runaway. >> here is the damage to the side of the suspect car, the nissan, just a lost extensive damage. airbags deployed. it is hard if believe anyone could walk away left alone runaway from the scene but police are looking for two male suspects. this is no description available the muni bus had no passengers on it. the driver was shaken up but that person will be fine. the bus now has left the seen and the car was just towed away in the last 45 seconds. all that is left is a lost bricks from the side of the building, the apartment building here in union and van ness. the search continues here in the neighborhood for the two car jacking suspects
