players stand on the track while a train is coming up and those jumping off first are called chicken. >> do you know high school kids know better and do things because they're kids. and this is unfortunate to lose austin in this way. >> price was hit by a train. his companions escaped injuries. his friends held a prayer vigil today. >> a 38-year-old mother of three is dead after she was you mauled by a dog this, happened last night in a quiet residential neighborhood of the san joaquin county community, stockton. she worked as a house cleaner, authorities say a female pit bull named russia attacked her after jumping over a fence and into a front yard where the bull was. a sacramento area tv station reports gallardo was looking for work. the owner was not home when this attack happened and says his animal was defending it's surf.

>> this is property, whoever the girl was, i don't know, i feel bad for the family. but they should not have jumped over the fence. >> animal control officers managed to capture the dog. it's been placed under quarantine. >> a spill spent sent an um employee to the hospital this morning. the employee had to be hospitalized after he passed out cleaning up a liquid that spilled. the team evacuated a business for several hours. >> tonight chevron submitted a report on the refinery fire and listed what changes it will make. the fire began when a pipe failed and leaking hydrocarbons exploded into flames. one official believes chevron must make changes. >> issue is how chevron makes

>> governor brown says he will not comply with the demand the state keep reducing it's prison population. they threatened brown and other officials with context of court if reforms were not made. >> we were ordered to reduce population to provide a constitutional level of health care to inmates we're now already doing that so there is no need to keep reducing population. >> the department says california would need to build three more prisons in eight months and impossible task given the financial situation. >> contra costa college has been hit by a financial fraud ring prosecutors say two dozen people are facing charges for receiving money to go to school but never attending class.

>> not just contla costa college this, is a nationwide problem. this scandal affected them. >> contra costa college is almost ancient history. a scam aloud nonstudents to steal 83,000s ndz grant money just bont go away. >> i don't think it's right. it's unfair to kids that do come to school. >> the pell grants award as much as $5500 a year, at contra costa, seven out of 10 apply. but in 2011, 22 recipients took money, never attended classes and ran. >> we had one case, a 78-year-old signed up for fundamentals of basketball. >> since fall, the deputy district attorney has been track those so called students and prosecuting them. seven more go to court next

>> it also gives data by race, gender and age. to help schools close gaps. >> we have just received word that there was an attempted kidnapping today at an oakland elementary skpool a staff member may have prevented a tragedy. police say a 5-year-old boy was standing in front of the school after 3:30. a stranger approached and tried to pick up the boy but a staff neb member stepped in, that stranger took off. the man described mid-30s, five 10, 170 pounds with a dark complexion and a short buzz cut hair style. police hope surveillance video can help them lokit a man suspected of molesting a 10-year-old girl this, is video of the man entering a ross store after this happened. police say the man pushed a girl into the bathroom in the office and abused her. witnesses say you walked with a limp wearing an army green

from the border with north cok a korea, aimed his message directly to the young leader to the north that it's time to stop the rhetoric and end this tense standoff. the message was clear. >> that the united states will, if needed, defend our allies and defend ourselves. >> reporter: a warning tonight to the north to stand down and hold off on test firing its missiles. this coming as the world absorbed a u.s. intelligence report which concluded with moderate confidence the north is capable of delivering a nuclear weapon on a ballistic missile. a startling assessment, but today, kerry was quick to point out the north's limitations. >> it is inaccurate to suggest that the dprk has fully tested, developed or demonstrated capabilities that are articulated in that report. >> reporter: and while there is no evidence that missiles currently in position to launch
