witness. on friday, a man grabbed a 2-year-old girl from her yard and made it about 50 feet. he dropped the girl and took off. the girl was not hurt. >> the body of a missing san francisco sheriff deputy was found this afternoon. the coast guard had been searching for the 56-year-old since they found his boat adrift near the marina this morning. the keys were in the ignition and investigators found the cell phone and id in the boat. three men found the body and say he was wearing a life vest that was not inflated. investigators say there were no visible signs of injury and the death appears to be an accident. >> this was a deadly weekend for divers trying to harvest abaloen. three men died in separate accidents. one lost his life and two died

heat up around the middle of the week let's take a look at live doppler 7. sunny skies prevail now. from coast to inland. and whenever you are today you probably felt warmth on the coast. let's take a look at highs 92 in antioch and fairfield. 90 in napa and 89 in san rafael. ties the record high for this date in san rafael set back in 1957. we had numerous locations hilting oor exceeding 90 degrees today. here is a live view looking at western skies. it's mainly clear, temperatures right now 72 degrees in san francisco. 71 across the bay in oakland. san jose 80 degrees a cool 59 in half moon bay. another live view looking southeastward here in downtown san francisco. also looking at blue skies, further readings and warmer ones at that. 85 in santa rosa. 85 in livermore and 84 in los gatos, flying down to san jess yeah skyline. we'll see record warmth this week. not just today, but more

records likely. later in the week windy conditions developing tomorrow night with a red flag warning in affect for high fire change danger for the hills into wednesday. pulling back now satellite image over the last 12 hours shows movement of a dry cold front not bringing rainfall but will bring gusty winds and increasing our fire concerns. we have a wind advisory for the east bay, well, east bay hills, south bay and diablo range all of the hills in the bay area. this is in effect from 5:00 in the afternoon to 11:00 wednesday morning. winds out of the north about 20-35 miles per hour. gusts as high as 50 to 60 miles per hour. low humidity can strong skbindz heat. we now have a red flag warning for high fire dangers also for higher elevation as above 1,000 feet for the bay area in effect from 6:00 tomorrow evening to 6:00 wednesday evening. record dry vegetation exists

every year in this country 5,000 pedestrians are killed in accidents involve being cars but when the driver at fault fewer than half charged with a crime and those who are

serve little time in jail. that is what our media partner found out when they started digging through data from the patrol. >> in september, 20116-year-old torres was on the way to school. she was struck dmoun a crosswalk by a teacher driving to another school. police determined the driver was at fault for failing to yield the right of way. guadalupe is waiting for police to bring her daughter's killer to justice. >> they should do when they need to do because it's not right the driver is running around free. as if nothing happened. >> east palo alto residents were outraged when officers released the teacher. the district attorney steve wagstaff says his team decided not to prosecute. he says jrz often sympathize with the driver. >> i've seen that time and time again. the jury may say. >> but are to the grace of god that is me. i don't want to call the person a criminal.

>> pouring over records collected by the state and found that 30% of people killed by drivers were hit while walking in a legal crosswalk. that is three times the national after richblgt since 19 30s prosecuters have had difficulty convincing juries to convict drivers. in response, california lawmakers in 1945 created a vehicular manslaughter statute with lighter sentences and the option of charging the crime as a misdemeanor. not a felony. our review of the five years of pedestrians deaths found prosecution rates were still low. 60% of the drivers found at fault for killing pedestrians or suspected of a crime did not face criminal charges. and when they did file, punishment was often light. >> 40% of drivers charged with killing a pedestrian did not have their licenses revoked. four of 10 sentence owed to

sports. collins the 34-year-old center wrote i didn't set out to be the first openly gay athlete playing in a major american team sport but since i am, i'm happen yes to start the conversation. he was all american at stanford first round draft nick 2001. he's bounced around among six teams over 12 years but known for his aggressive physical style play. he played for wash this year but contract expire sod big question now going forward is, will another team offer him a job? and will today's announcement help or hurt? he's getting a lot of support. kobe bryant wrote proved jason collins. and bay area native jason kidd tweeted jason's sexuality doesn't change the fact he's a great friend and a great teammate. golden state warriors president knows about the courage it took for jason
