>> good morning, everyone. thanks for joining us on this sunday, may 12th, mother's day. i'm carolyn tyler. let's start with a quick first look at the weather with lisa argen. >> good morning. it's nice and sunny downtown. we have dense fog and cool temperatures in the north bay. we are looking at just 50s with quarter mile visibility in santa rosa, all the way up to

the mid-60s by the delta. already a 15-degree spread out there. we are looking for another warm day inland. in fact yesterday we saw low 90s. today in the mid-90s well into the east bay valleys. we will have the breeze pick up along the coast and across the bay this afternoon. it should be a little stronger today. that's indicating the changes that are to come as soon as late today into tomorrow. you will want to stay tuned for our seven-day outlook coming up in a few minutes. carolyn. >> thank you, lisa. >> developing news. the calaveras county sheriff said leia fowler's killer is not a stranger, not an intruder, but her twelve-year-old brother. john alston has details on this shocking development. >> this is the calaveras county can sleep a little better.

>> at 5:10 authorities arrested loa's 12-year-old brother and charged him with the homicide. >> the 12-year-old brother, now the accused killer, joined family members at a vigil. we are blurring his face because he is a minor. more than 1,000 people gathered at jenny lind elementary school where leila was a third grader. her mother spoke briefly to the crowd. >> i just want to thank the community for the overly amount of support you have given my family. it will never be forgotten. the 8-year-old girl was stabbed to death inside the home three weeks ago. her brother told investigators he encountered a tall man with long, gray hair who then ran off. authorities say they collected dna at the scene, collected household knives and searched a nearby pond for evidence.

it put the entire valley springs community in a state of fear as authorities conducted a door-to-door manhunt that gradually tapered off. a neighbor who claimed seeing a man run away from the fowler home later recanted the story. >> we have put in over 2,000 hours into this investigation to provide leila fowler's family with answers in her death. >> the sheriff did not address some obvious questions, such as a motive or whether the weapon has been found. he says the investigation is not over yet. john alston, abc7 news. the brother cannot be charged as an adult because he's under 14 years old. legal analyst jim hammer tells us the process will be private. >> the focus in juvenile court is going to be on figuring out who this kid is, what is his family situation like, is he appropriate to be in the family setting or taken out of the family setting, either foster care or some kind of custodial setting. but the focus is on how to rehabilitate this kid at

operations in the thick backwoods. haywood police are investigating what caused a crash that injured two people and damaged a house last night on mannon avenue. two people are seriously injured after an accident that closed the road between ranker place and schaefer road. two to three cars was smashed, a house was damaged in the incident. we will let you know just what happened as soon as retails are. -- details are released later this morning. disappointment in vallejo as little league players learned games were cancelled because of yet another shooting near one of their fields. it's the second time shots were fired near the ballpark. we have more on the little league's next steps. >> sebastian kern should be pitching against the giants. instead he's practicing with his eight-year-old brother. it's because north vallejo little league has cancelled all of their saturday games. for the second time in three

weeks, gunshots have been fired near one of the league's games. >> it's getting kind of frequent. this 12-year-old heard the gunshots that rang out thursday. police say someone in one car fired into another car at around 6:00 p.m. no one from the league was involved or hurt. >> to have someone just be as callous as that, and to not think about the lives that they are putting in danger is just incomprehensible. >> but this isn't the first time young players have been near gunfire. on april 17th shots were fired after a tee-ballgame at john williams field. no one was hurt then either but the league briefly suspended the season. games resumed a few days later. >> i'm assume one, i was a little more angry at the second one. >> both of her boys play in the league. >> mainly sad. started wondering if i was going to let them play. >> she's decided only to let them play in games she can attend.aing that to these boys

isn't easy. what do you want to do? >> i would rather play. i would rather be playing right now, i guess. >> starting monday games will be played at dan foley park. league officials are sure their players will be safer here. league officials are also calling on city leaders to make the neighborhood around williams and thurman fields a priority. they say more officers are needed now. in vallejo, abc7 news. >> we are learning more about the fatal officer-involved shooting by concord please friday night. 21-year-old charles burns was suspected of dealing drugs. police were doing surveillance of his home friday night. they tried to serve a search warrant. they say burns hopped into a vehicle driven by another man and it rammed an unmanned police car. burns got out and tried to run

away. two officers then opened fire. >> they blocked him in on the other side. one guy got arrested. he tried to run out of the car and they shot him. >> pow, pow, bang, bang, boom, boom, boom. it was nonstop. nonstop. we didn't get up until it stopped. >> the other man in the car was arrested. developing news, a lake county neighborhood is sinking into a hilltop. it's happening in a neighborhood in lake port. that's a city on the west side of clear lake. as abc news reporter clayton -- gee owe benitta reports, homes that have been standing for 30 years are now falling apart. >> i don't know what to think. in march everything was fine and everything is gone now. >> this morning authorities in one california town are mystified, trying to figure out what caused seven homes to be swallowed up by the earth. >> it has grown substantially from the time i saw it earlier

new jersey where a 37 hour hostage ordeal is finally over. a s.w.a.t. team moved in early this morning to rescue three children. police shot the man who held them prisoner [gunshot] >> with grenades the s.w.a.t. team moved in around 1:00 this morning our time. police ended a standoff that began friday after they went to check the welfare of the victim. they were met at the door by the gun men and could see the bodies of a woman and a 13-year-old boy inside so they backed away. this morning ambulances raced from the scene, carrying the three surviving children. the gunman gerald murphy, died later at a hospital. neighbors are relieved. >> i couldn't describe it. it was just like a movie. you know what i mean? never seen nothing like this in my life. >> at a news conference the police said they decided to storm the house when the suspect began to threaten the kids. this morning a message from the three women rescued in

cleveland. after being held captive for a decade. >> alex shows us the cell phone video of when they broke through the door. we are having problems bringing that video to you. we will try to bring that back. it is quite dramatic video there. let's move on. a meeting is scheduled for this tuesday with the four teams of the america's cup to discuss thursday's tragedy on san francisco bay. teams from the u.s., italy, sweden and new zealand will be in san francisco this week. they will decide what steps, if any, to take in the wake of that catamaran accident that killed a british medalist andrew simpson. the skipper's father tells a australian newspaper his son heard a sharp crack moments before the boat tumble forward. the "newcastle harold" reports the racing yacht folded like a taco shell,

one enthusiast believes the cup will go on. >> i don't think anything will deter us from hosting, let alone attending, any of the events. of course, there's more public awareness now that an accident has occurred. sailor andrew bart simpson died after being trapped beneath the wreckage for ten minutes. >> knew this morning, a tour in california kicks off today with this year's course starting in southern california and heading north. the eight-day, 750-mile race ends in santa rosa, bringing the climax of the race to our region. cycling fans say the bay area stages should determine this year's winner from among the world's elite cyclists. individual time trials come to san jose friday with a grueling climb to the top of 3800-foot mount diablo next saturday.

those trials are expected to draw tens of thousands of fans to san jose and have the cycling world's attention for a full day. the final scenic stage runs from san francisco to santa rosa. concession workers at at&t park have authorized a strike. the workers voted at the ballpark yesterday. they want their first raise in three years. now the vote doesn't mean a walkout is imminent. there are negotiations between the union and management scheduled for wednesday and thursday. management calls yesterday's vote unfortunate. >> check out the winning numbers from last night's 27 to million dollars power ball draw. 6, 13, 19, 23, 43. the power number 16. no one correctly picked all six numbers. but there is a bay area person who is a bit richer this morning. three tickets in california matched five numbers. one of those tickets was purchased in petaluma.

each of those tickets worth $573,000. wednesday's jackpot is estimated at $350 million. the odds of winning power ball are about 1 in 175 million, but lisa, that does not keep lots and lots of people from playing. >> yeah, i know. definitely it's fun. good morning, everyone. we are looking at some fog still out there. it is shallow but where we have it it is dense. santa rosa and also along the coast. that shallow deck burning back, but as it really gets a little closer to the ground, that's why it is pretty dense. but a southwest wind will influence much of the bay and coast today already in the delta winds gusting to 22 miles an hour. but we are pretty mild in some parts around the bay, as well. so a lot going on. as we look from mt. tam you can see some holes in the deck of clouds there. 57 san francisco but look at the mid-60s for mountain view and san jose. already about a 15-degree spread. we are looking at upper 50s

santa cruz. he were in the 80s yesterday. looking for a warm day again today but the sea breeze is coming back and it will come back a little stronger this afternoon. that will set the stage for a cooler week. the work week beginning tomorrow. 56 iann sta rosa. you have had fog all morning long. and now beginning to break up and evaporate. fairfield, mid-60s despite the southwest winds. 6 in livermore. that's the high for san francisco today and los gatos in the upper 60s. we are all still look at a nice day. temperatures around the bay will be wide ranging once again. starting out with mostly sunny skies, still warm inland with numbers in the low to mid-90s yesterday. livermore airport was at 94, concord 91. low 90s from morgan hill to las got toes. that won't change but breeze today and cooler conditions for everyone tomorrow. that will be the story for much of the week ahead. 24 hours ago we were cooler. we are six degrees warmer at the

parent and livermore. you notice up in the north bay it's been a little cool and gray. as high pressure continues to block this week weather system to the north of us, it's building and and that is allowing for the warm weather in our inland east bay. elsewhere, as the sea breeze kick up throughout the afternoon we will feel some of that cooling. as this weak weather system passes to the north tomorrow, we are going to break out into sunshine later and also with the stronger sea breeze it's going to aid in our cool down tomorrow. mid-60s today, monterey. look at the rest of the state. very warm. we had records in tahoe yesterday, also in reno. 89 degrees. 101 in fresno. high fire danger in southwestern california. our little corner of the state really enjoying the best weather. 90 in morgan hill. about if you like it a little cooler, 82 sunnyvale. upper 60s in the coast.

with them. espn reported the brothers have a backup deal to sell just a 20% deal to seattle investors. the nba finance committee meets by phone tomorrow discussing all of that with a final decision expected wednesday when the nba board of directors meets in dallas. o.j. simpson will be back in a las vegas courtroom tomorrow, seek to go reverse his conviction in the 2008 armed robbery of sports memorabilia dealers. simpson is claiming his lawyers were incompetent and that he should get a new trial. legal experts call it a hail mary as he tries to avoid what amounts to a life sentence. he was extended to 33 years in prison and must serve at least nine years. he is not eligible for parole until he serves 70. the group occupy the farm has once again taken over a piece of property in albany owned by u.c. berkeley. the occupiers said they tried

back workers hours to avoid having to offer them health insurance next year when federal health reform kicks in. abc7 capital correspondent nannette miranda reports on the benefits and the potential risks of closing the ball mart loophole. >> my hours are being cut. >> with her schedule being reduced, full time retail associate barbara couldn't afford to buy her own healthcare anymore so she enrolled her son in a government program. >> he's on med-i-cal and i will have to enroll myself. >> critics say that's a growing trend. beginning next year the federal affordable care act requires employers to provide coverage to anyone work more than 30 hours or more a week. to avoid the mandate, hours are reduced. it's forcing many low wage workers to go on taxpayer paid state programs like med-i-cal. >> i don't think that's right. >> jimmy gomez has a measure, a

proposal to penalize anyone who is trying to take advantage of the so-called wal-mart loophole. the money will go to med-i-cal. if the problem isn't fixed, he estimates the taxpayers will have to pick up the tab of over 400,000 californians. >> the nonfederal-state portion of medical will continue to squeeze out all other programs. education, public safety, you name the program, it will be squeezed out. >> company deny hours are being reduced to circumvent the law. opponents, including wal-mart, are teaming up to fight the proposed penalty. they say there's already a federal penalty in place and the state fine could be up to six times that or up to $15,000 per employee. they insist any added cost will hurt the economy. >> it's like a gun to the employer's head. it promises to increase our unemployment rate. guarantees it. and that's what we are telling people. >> she just wants her full time hours back and health coverage.

>> some of the parts are off the shelf. but they had to build a lot of things themselves like the solar panel that they built from scraps to save tens of thousands of dollars. >> we had to pick the best ones. >> he pieced together the little leftover solar cell triangles that cost a mere $1.50 each and when the satellite a deployed the panels unfold to charge the batteries and reveal the cameras. then comes the tricky part. >> the physics come later when it's tumbling through space and we have to predict the tumble but we can't do that until it is up there. >> the team will have to write the code that picks the perfect moment to take every picture, and then they have to get the pictures back. >> cost about $40. pretty cheap. >> he showed us what they build to listen to the satellite. thanks to a deal with the navy, it they can also post all their transmissions to the internet. but all good things must come to an end, including this one. >> this is the grand tie. -- finale. >> after the six month term in

degree to about six degrees warmer this morning. already that sunshine and that warmer air aloft work down to the surface, allowing for our quicker warmup and it's all thanks to high pressure as it continuesouild in. a weak weather system will head into the traffic northwest tomorrow. that will bring up the fog tonight, though. so that's going to allow for the sea breeze to kick up in the afternoon hours for those folks along the coast and bay you will feel it. so we are looking at the warmest weather far east today. down here not too bad with low 90s once again for gilroy and morgan hill. more mid-60s. average high should just be in the mid-70s so you are well above normal in the south bay, 80 degrees santa cruz. 82 sunnyvale. peninsula numbers pleasant with mid-and upper 70s from menlo park. low 80s for redwood city and near 610 with a little sunshine at you are coast. 20 mile-an-hour west winds later ernoon. upper 60s early, then falling temperatures in san francisco.

84 today forsen only ma. low 80s for vallejo. notice the reds moving farther westward and that brings the warmth to some of our north bay valleys. here very pleasant, 82 in fremont. we have more warm weather for fairfield and pittsburgh today. low 90s. pleasanton, how about 92. if you are going to the giants game, nice and sunny. you will need the sweatshirt with cooler sea breeze this afternoon. upper 60s to the lower 60s. the look ahead today, we have 80s and 90s, but not tomorrow. we will see the sea breeze and less sun. it will take a little time for the fog to burn back. that's the trend for the neck several days. i said before in the mid-70s but you wonder what is normal around here. north and south end of the bay should see mid-70s. >> so the midweek temperatures are what is normal? >> exactly. >> all right. thank you, lisa. let's check out sports.
