have to use it. there has been an arrest in another grass fire in san jose two days ago. that fire burned tuesday evening spitting out large flames. there you can see a fixed wing. about eight to 10 homes were just 100 yards from the fire lines. first investigators thought the fire might have been sparked by a lawn mower, now, they tell us they've arrested a juvenile. >> a reversal the local boy scouts voted to allow gay scouts to participate. >> this is what we're working towards. it's a small step but huge in another way. >> 1400 voted for that change, 60% supported the proposal.

school district owe initials have cleared a special ed teacher of allegations of student abuse. the teacher is back. she and a principal were placed on leave after a parent accused the teacher of pushing her special needs child down the slide. it was physical abuse. the district found no merit to the accusation. the principal is still on administrative leave. officials finish investigating whether she responded properly. >> if you think about the weekend already, you might want to head to computer before to the beach because the group heal the bay posted its beach water quality report card. there is some good news. 93% of the beaches received an a grade this year.
