bail. and california patrol statistics are out. chp there are 15 traffic deaths on the roads. six of those killed were not wearing seat belts a cross the state 1100 people were arrested for driving under the influence. and there have been 165 dui arrests and two fatal crashes. a police officer was injured chasing three men wanted for a drive by shooting. police say several people were outs side when someone signed of a car opened fire during an attempted robbery. three people were hurt. police spotted a car matching the suspect vehicle in the bay view district. the car backed into the patrol car slightly injuring an officer.

a 9-year-old horse recovering after nearly dying yesterday. we brought you this story at 11:00 bud yeet horse fell down this well in rural san rafael yesterday afternoon. it took a team of people to keep buddy afloat. buddy has just cuts and scrapes and his owner expects a full recovery. >> good to see everybody just jumped in. >> the nurses union is fighting an effort. they don't want nonnurse as loued to give insulin shots to diabetic kids to school. state supreme court hears the case tomorrow. the story from sacramento tonight every time she eats she takes her blood sugar. >> when megan's third grade daughter was diagnosed her child's school does do d.not have a full time nurse so she quit her job to give the shots four to seven months we zrnt a

nurse. my family and i made the decision i would stay home to take care of here california supreme court will be deciding a case that could change the lives of families living with diabetic children. should a trained z.but unlicensed worker be able to give insulin shots to public school students? state law says now noe, but not all schools could afford a nurse, at some districts the ratio is 6,000 students to one nurse. in 2007 the department of education allowed other school employees to give the shots. the president of the national association of school nurses says that move jeopardizes student safety. >> insulin as a medication can be fatal if given wrong. it's a hormone. too much can cause fatality and fairly quickly. >> critics of the nurse's union say they're just trying

to boost jobs and that insulin shots can be administer bid other people. in one move the obama administration chimed in. urging the california justices to allow other school employees to give the shots when nurses are unavailable. >> it's easy to give a shot but not easy to give an assessment on whether or not the child has been treated successfully. >> while megan is leaning towards requiring school nurses she worries about other parents. >> i can only imagine nairnts couldn't quit their jobs. what do they do? >> trader joes is the target of a new ad by a consumer group targeting the meet calling on trader joes to stop selling meat and poultry from animals given antibiotics.

in a statement trader joes says it offers a wide selection of meat free of antibiotics. other supermarkets sell only antibiotic-free meat autos and walmart pleaded guilty to criminal charges. >> it's interesting. walmart will pay $81 million in fines after it pled guilty to misdemeanor charges of dumping hazardous waste across california. insy zents dents happened between 2003 and 2005. prosecuters say employees were seen dumping materials into drains and trash bans. including bleach, fertilizer and hair spray. the company acknowledged it did not properly train employees. walmart says it fixed the problem, those riding in a must mercedes-benz will be safer thanks to an old

california. the blaze triggered a big response because it broke out near a populated neighborhood. crews sent into a subdivision. all of this didn't disrupt the run at magic mountain. they stayed open all day long. it's a tougher task for firefighters down south. so called white fire broke out yesterday. so far, it's burned almost three square miles of wooded terrain. crews took advantage of calmer conditions to make progress on the fire. now at about 10:00% contained so more work to do. >> our showers moved out. a little bit of warm up coming. >> sandhya. >> nice, sunny afternoon. as a result temperatures did

one of the most photographed fountains in san francisco may be push add side. it was created by ruth asawa. plans would replace that building with a square apple store but renderings do not show the steps between two buildings or the fountain. abc 7 news has contacted apple but we have not yet received a response. >> in san mateo planning commission will get a chance to review a proposal to revamp hills daels shopping center. sears and development company are talking but have not reached an agreement. a spokesperson says the company looks forward to continuing to serve it's customers. tonight's meeting taking place at city hall. >> another great honor for a
