manslaughter. paul diaz was intoxicated and speeding when he rear ended a honda before hitting a retaining wall. all three passengers were killed. a family member says a victim, 23-year-old rosa was engaged to diaz. >> i loved her. i miss her. i don't know what i will do without her. diaz walked away but turned himself in hours later. he is held in san mateo county jail on $750,000 bail. >> prosecutors are considering criminal charges against a father who lost two daughters in a crash and investigators are recommending manslaughter charges against the father who was driving on highway 101 in palo alto and he fell asleep at wheel and crashed the s.u.v. the two daughters were thrown from the vehicle and killed. he also hit a c.h.p. officer who suffered minor injuries. investigators say he drove

oakland business shows the burglary near the intersection of market and 36th street. watch the top of the screen. you can see it happen, the thief hops in the back of an unmarked postal truck with mail, goes through the contents and runs off. postal inexpecters are offering $10,000 reward. >> the silicon valley education foundation and santa clara supervisor are headed to sacramento to push for more education funding. this week, lawmakers are trying to reach a budget deal including how to spend $3 billion revenue surplus. the governor brown wanted to spend cautiously and the proposal did not include the protect ever surplus but k through 12 would receive more money than in the 2011-2012 year giving addict grants to districts with nor disadvantaged -- more disadvantaged.

times". he was garden and a tall pine tree crashed into the yard on monday, trapping him in the branches. neighbors came running to help and he says he is feeling okay but look at the damage to the back of the home. he and his wife had just put it up for sale, the couple says they spoke to a tree specialist who said it was rotted. >> and thieves stole motors from rescue boats and caused thousands of dollars in damage. it is a story you will see only on abc7 news. the bay area association of disabled sailors used specially equipped sailboats to help sailors with disabilities navigate the waters. the stolen motors were on five inflightable boats used in rescues if they get into trouble. the thieves caused extensive damage when they put through the looks and cords and cables that secured the motors. if you would like to help them there is information on our website at abc7news.com under

yesterday. now the bay bridge moving over to at&t park, with first pitch at 70 and then drop down to 55 degrees. most of the wet weather will dry no matter where you going. right now, it extends from tracy and mendocino toward tahoe and yosemite and maybe a stray shower in the high country but mostly we see increasing sunshine and 53 in tahoe and mid-to-upper 80's around sacramento and fresno and 100 in palm springs. that heat is coming our way. how about leyla gulen and the traffic? >> right on time, as we take a look at the golden gate bridge and you can see the drive in the northbound direction the flashing lights and they pick up cones and the project is wrapping up. also, we will get the center divider that will be installed and the project should be finished by 2015 so that will make the drive along the golden gate bridge safer.

department of education when tightths call for eliminating nurses. law requires measures to add minute sister insulin or other medication. however, the department of education has allowed staffers to give shots since 2007. the president of the nurse's union says that jeopardizes safety. >> the medication can be fatal if given wrong. it is a hormone. too much insulin can cause fatality and quickly. >> the american diabetes association says insulin shots can be administered safely by nonmedical staff with proper training. >> more and more americans are getting eyelid lifts but who is picking up the tab? medicare. according to a report by the center for public integrity the number of eyelid lits paid for by medicare more than quadrupled recently. the cost to taxpayers for the simple surgery rose to $80 million in 2011, up from $20 million in 2001.
