a crash so violent it broke into two pieces. his father could face criminal charges. good evening, everyone. i'm carolyn johnson. >> and i'm dan ashley. it happened along pay say yow parkway as the -- paseo parkway as they headed out for an afternoon of fun. lisa amin gulezian is live in san jose with the latest on this very sad developing news. lisa? >> very true. both of the boys' parents underwent surgery here today. the little boy's mother is in serious condition, and his father is in fair condition.

tonight fremont police interviewed the boy's father for hours. the four-door honda was split in two. it littered paseo parkway in fremont. >> the vehicle was traveling at a high rate of speed and lost control and hit a curb and a tree. >> abc7 news has learned the one behind the wheel was gilbert gill. he wasn't wearing a seatbelt and was thrown from the car. his wife, joey, was in the passenger seat with her seatbelt on. and their son, angelo, was in the backseat buckled into his carseat. the boy in the entire back half of the -- and the entire back half of the car landed in a backyard. witnesses immediately tried to help the family. >> i went inside the car and saw the wife. she was bleeding heavily. i kept seeing keep bleeding. after 30, 40 seconds the father said where is my son? >> i said i don't know where

your kid is at because the whole car is ripped apart. he proceeded to lay in the middle of the street. i checked his son to see if he was alive and he was no longer here. >> three-year-old angelo died immediately. he was just a few weeks away from his fourth birthday. >> i just saw him yesterday. run around, just wearing shorts. >> the famy's dishome is empty. they left after noon for fremont. they were taking angelo to aqua adventures water park. lisa amin gulezian, abc news. we have news about a violent crime spree and manhunt. oakland police released a photo of this man, jamar cleveland, suspected of two shootings three carjackings and two possible kidnappings in the span of one hour this morning. police say the whole thing ended when cleveland crashed a car into a light pole on 105th and san leandro before running off. oakland police told abc7 news the two shooting victims were the suspect's ex-girlfriend

and the father. both are said to be in stable condition tonight. >> breaking news in sacramento. an after hours fbi raid at the state capital. agents served search warranticer ron calderon who represents a district in los angeles county. agents searched the office of the latino legislative caucus of which calderon is a member. officials are refusing to say what this is all about. the l.a. times reports it could be part of a corruption investigation. calderon's attorney responded saying the fbi has no case and is trying to hassle an innocent person. the first lady came face-to-face with a heckler tonight. michelle obama was giving a speech this evening in washington, d.c. when a gay rights activist interrupted her demanding that president obama sign an anti-discrimination executive order. that's when the first lady left the podium and walked up to the protestor. she said "one of the things i don't do well is this" referring to dealing with hecklers. everyone clapped when she said that.

mrs. obama said the protestor could, quote, listen to me or you can take the mic, but i'm leaving. you all decide. you have one choice. the protestor was then escorted out of that event. the heckler is ellen sturtz and she is linked to the berkeley-based group, qet equal equal -- get equal. this is her outside george clooney's home last year. a well-known breast cancer fundraising organization is ending a tradition in san francisco. starting next year the susan g komen foundation will stop the three-day walk here and in other cities as well. john alston is live to explain why. john, these events raise millions. >> yes, dan. first off, the co man -- koman3-day walk still on for later this month. beginning next year it will no longer happen partly because of political dispute over planned parent hood and abortion. in past years the three-day walk through the bay area has tried to put an end to breast

cancer. the number of walkers has dwindled, but the koman founder stopped sending money to planned parenthood. she took part in three komen walks raising more than $8,000. last year she pulled out. >> i registered and then the news hit regarding planned parenthood and funding by komen to planned parenthood. >> a komen spokesperson admits the controversy was a factor, but points to a sour economy and competition from other charities. beginning next year the three-day walks are being canceled not only in san francisco, but phoenix, boston, chicago, cleveland, tampa bay and washington, d.c. they will continue in seven other cities. it is a disappointment for marjorie jenson in ukiah. >> my sister is fighting breast cancer. i think they should bring it

back and they will bring it back because it is the right thing to do. >> a number of former walkers are switching to other fundraisers like the avon walk for breast cancer. >> my hope is because they are pulling out and that people will still fund organizations for breast cancer research. >> the decision to end komen will not end the race for the cure which will continue. john alston, abc7 news. happening now in the south bay the votes have been counted in a closely watched race to replace a santa clara county supervisor with all 58 precincts reporting. the vice mayor has 41% of the vote followed by teresa alvarado. that was cindy chavez. teresa alvarado has 41%. the school district trusty with 14%. there will now be a runoff since no one received 50% of the vote. the seat represents downtown san jose and the city's eastside.

the winner will replace him who resigned in march and is set to be sentenced on friday for charges involving the misuse of campaign funds and taxpayer funds to support his gambling addiction. early voting shows a tax measure shows it is passing. measure a would temporarily increase the utility tax from 6 to 8% over five years. it needs a simple majority to pass. new details about the hepititis a outbreak linked to contaminated frozen berries from costco. a 22-year-old woman from santa clara county has been treated for the infection. she is the third in the bay area. target also announced a pharmacy employee at two stores now has hepititis a. the employee works in the hayward store and also in san leandro on east 14th. anyone who purchased prescriptions there between may 5th and the 26th of may should stop using them immediately and return the medication for a refund.

new at 11, a woman who wept to prison for claiming she found a severed finger in her chil sigh going back to jail. she was sentenced to four years for planting the finger in her chili in 2005. now she cut a deal to serve two years for falsely telling police that two men shot her son in the ankle. investigators say the son accidentally shot himself. he was on parole and wasn't supposed to have a gun. he will also serve two years in prison. animal welfare advocates are offering an $18,000 reward in a disturbing case of dog abuse in oakland. the following images may be difficult for some of you to watch. want to give you the heads up, but it is part of the story. marla was so severely burned and abused that vets had no choice but to put down the german shepherd. someone dropped her off last week at the oakland animal shelter. now the search is on for her abuser. police say calls are coming in from across the nation with offers of help. for the first time since

the death of a team member, the artimus team was back on the bay. the swedish team took to the bay to practice for the america's cup sailing competition. team member andrew simpson died when his boat capsized trapping him underwater. artimus racing has not decided whether to compete in the america's cup. the team will only race if the sailors feel it is safe. president obama is scheduled to visit for two fundraisers. he is expected to speak about obamacare saying it is proof it is working. it is not clear where he will make that address or if it will be open to the public. on friday he will fly to southern california where he will meet with the chinese president. cash for gold. you can see the stores popping up everywhere, so why is one bay area city thinking about putting a stop to it? you will hear from a man who says the plan is misguided. >> and photo bombed. the actor slash wedding crasher who ended up in this group picture.

just crossed the bay bridge into oakland. it is moving slowly at the moment. that's because the car has a flat tire. the car just took the ashby avenue off eastbound 80. it started in the mission district in san francisco with a report of an attempted assault. our reporting continues on twipter on abc7 news bay ar in richmond they are dealing with a series of burglaries and one is to restrict the number of cash for gold businesses. abc7 news alan wang explains the connection. >> at the 18 and it shows it is 14carats and it is gold. >> reporter: this woman walked into the only cash for gold store in richmond and got $70 for her gold ring. >> actually we are one of the most honest in the area. >> some -- >> reporter: some city leaders believe they help criminals exchange gold items for cash, and they want to stop them from multiplying here.

>> they are like liquor stores on every corner in the economically suppressed community. you don't see these things in the alamo or on the creek. >> we are doing everything by the law. >> reporter: state law requires the stores to fingerprint and id the person exchanging the gold. >> once it is melted what evidence do you have? you have a driver's license and the fingerprints. >> reporter: but the dolled has to be held for 30 days and reported to police before being melted. in some cases criminals have been prevented from exchanging stolen items. >> i need your id. they said, can we do it without it? i said no you have to give your id. they said it is okay and ended up walking away. >> reporter: the only supporter for gold stores, a former parole officer said that the point is moot because most criminals don't exchange their stolen items in the cities where they steal them. still the council passed a 45-day moratorium and they can

city. this is our rooftop camera. you look out toward the bay bridge and you can see low clouds out toward oakland. morning fog and low clouds and cold to mild for tomorrow afternoon and we are looking at warm to hot weather on friday and saturday. we may be seeing temperatures getting close to record levels as we head into friday. check out our fog forecast. tonight 11:00 we have the fog around. by tomorrow morning you will start to see the fog and the low clouds. well into some of the valleys. it will start out gray and your temperatures will be on the cool side. you might want to grab a light jacket or sweater when you head out the door and make sure the kids are bundled up. numbers are in the 50s and once again pockets of poor visibility due to the low clouds and fog. the other thing to watch out for, we are expecting a long period of southly swell from the southern hem -- hemisphere. there is an increased risk of rip currents. wednesday night and into the weekend the south facing beaches will be facing that increased risk. just be careful with the

upcoming hot weather. you might want to go to the coast and get a little bit of relief, but it does come with the danger. tomorrow afternoon 76 degrees in the south bay in san jose and 79 in morgan hill. sunshine and mid70s and a few passing clouds. 66 in santa cruz and the peninsula is looking at numbers in the low 70s around redwood city and menlo park. the fog will hang around to the afternoon and keeping the temperature at 59 degrees. you are used to the june gloom. fog and around 60 in the sunset district. in the north bay you will see the temperatures vary. 58 in bodega bay, but up to 90 in ukiah. you are well above the layer of fog and low cloudiness. 70 in santa rosa and 72 vallejo. head out toward the east bay and 68 in san leandro and 67 oakland and 72 in fremont. the inland community ropes to 79 in livermore, fairfield and 76 in concord and 77 degrees in walnut creek.
