>> abc7 news starts right now with breaking news. >> a stunning new charge this morning against already disgraced former santa clara supervisor george shirakawa jr. under a new arrest warrant for the biggest campaign scandals in recent years. >> good morning, the prosecution is tying shirakawa to a fraudulent campaign flyer that tanked one candidate for city council. matt keller is in san jose with the story. matt? >>guest: here is a copy of the

felony complaint filed against george shirakawa this morning. right now a press conference is being held by the district attorney. they announced they are now filing a felony charge of false impersonation against george shirakawa. the district attorney confirms the charge came after he gave a d.n.a. sample when arrested in march. the sample matched cells from a flyer with a communist flag sent out in a city council race appearing to be from another candidate. the d.a. is everyone whatting him because it said the flyer appeared to come from her campaign. a former aide to shirakawa won the election and shirakawa denied involvement back in 2010 and is scheduled to be sentenced friday for misusing campaign funds. the d.a. is asking for a year in jail on those damages. the arraignment on the new charge will be held at the same time as the innocencing hearing. we do have a crew at the press conference at the district

attorney's office, and we will bring you more details on abc7 news. >> santa clara county officials will plan a run off election now to decide would will fill the seat vacate by disgraced supervisor shirakawa. seven ran in a special election and the top three vote getters are former vice mayor chavez with 41 percent, and water district official alvarado with 31 percent and former alum rock trustee from the school district with 14 percent. no one received 50 percent it appears that chavez and alvarado will be in a run off. >> state senator calderon is firing back after search warrants were searched in his office at capitol. he represents a district in los angeles county. this morning the attorney says the f.b.i. has no case and is trying to hassle an innocent person. agents searched the office of

the latino legislative caucus which he is a member. officials are refusing to say what it is about but are related to allegations of criminal activity. "los angeles times" said it could be part of a corruption investigation. >> in oakland, arson investigators look into the cause of a second fire in the samebandoned fire at 7th and harrison week in the last couple of months. you can see it caused traffic problems during the morning commute. abc7 news reporter amy hollyfield joins us from the scene. >> for people coming out of alameda, look behind me, the tunnel was blocked at one point completely closed for a few minutes. it is still heavy right now. it is still jammed. the huge fire truck is taking up a couple of lanes. the fire had a wide impact and many say they are frustrated because they feel like it was preventible. fire was huge. in a visible spot, too, or harrison in oakland next to

interstate 880 and it was at 7:15 a.m. >> we got a lot of calls, hard against the freeway, a lot people coming through the tube right by it, so the public really stepped up and called us. >> this is the second time this year this old empty victorian has caught fire. the last time was in january. fire officials say homeless people keep breaking in and sleeping here. investigators suspect they keep starting the fires. >> it is an assumption on my part that it was probably homeless activity because utilities are shut off. no one is supposed to be in the structure. >> it is next to a home with two units and firefighterred had to help the residents escape and protect the home. the man two doors down said this is frustrating. >> they need to contact the owner of the house. the owners are also frustrated saying they would like to tear

it down but they dealing with several agencies and it just is not that easy. >> we cannot just demolish it because it is an historical building. the city will not let us demolish it. we feel terrible because the neighbor is a family and we have been down here twice a week trying to board it up and get people out. >> the four department is tired of coming here. >> i want to see something done with this building quickly. i will talk to public works about what we are doing and get a game plan on how to handle this. >> the property owners have big plans for the corner of oakland. they would like to build a high-rise, a condo, put retail here, and would like to see oakland thrive, not filled with buildings like this, abandoned and run down. turning the dream into reality has been difficult.

>> in vallejo the red cross is helping people find a place to stay after an early morning fire at a housing complex for lowe -- low income seen years. 100 were evacuated in the middle of the flight. the fire started on the 5th floor after someone left a pot on the stove. four units were damageed. it re-opened in january after a 2008 fire that killed three people. >> vallejo police are investigating a deadly shooting involving one of their own on a large boat docked at a marina last night after 8:00 p.m. authorities say an officer was responding to a call of a violent fight when a man pointed a gun at the officer. they say the officer shot in self-defense. the man, in his 40's, died at the hospital. he was living on the boat and his identity has not been released.

>> an s.u.v. has been recovered from a berkeley estuary. a map drove into it when he was being chased by police and c.h.p. but was able to free himself from the sinking car. the chase started in san francisco's mission district and crossed the bay bridge on to interstate 80 and the suspect is wanted in a hit-and-run accident. he was taken into custody. >> from san jose, police are investigating suspicious death this morning. a man's body was discovered about 9:00 this morning near a shopping carton north 4th street. investigators tried to determine whether the man was a transient. the cause of death is not none at this time and homicide detectives are on the case. >> developing news, it could be the largest performance enhancing drug scandal in american sports history. major league baseball is looking at suspending up to 30 players would might be connected to a miami laboratory that sold drugs abc7 news reporter katie marzullo is in the newsroom.

are on seen of a building clap where to people are still trapped under tons of rubble. the four story building was being demolished and it came down on a drift store this morning. 12 people have been taken to the story with minor injuries. officials say another woman walked away unharmed after being trapped for more than two hours. no word exactly what caused the collapse. >> developing news in southern california, paris rack john the daughter of michael jackson has been rushed to the hospital. the celebrity site tmz is reporting it could be a possible suicide attempt. she was taken out of her family home by ambulance at 2:00 a.m. and this morning it is reported that paris is doing okay. >> happening now a major shakeup in president obama's national security team, national security advisor tom donilon is resigning after being part of the circle for four years. a recent magazine are file painted him as a domineering

figure who had stranged relationships with colleagues and staff. he'll be replaced by u.n. ambassador susan rice. the president is expected to officially announce the changes shortly. >> if you think you are spending more time stuck in traffic, you are right. a study says that bay area roads have not been this congested since the "dot.com" boom of the 1990's, including highway 4 between bay point and antioch, interstate 80 from 101 to treasure island, i-80 in berkeley, sunol grade, and part of 101 in san jose. according to the traffic research company congestion increased 25 percent in the san jose area from april of 2012 to april this year. that is the 6th biggest jump across the country. in fran, the traffic is up 22 percent, and researchers say the good news is it is a sign of an increasing economy. >> new economic forecast shows

>> covering walnut creek, burlingame, campbell, and all bay area, this is abc7 news,. >> san francisco district attorney is headed up a new effort to help stop cell phone theft. he will travel to new york next week to join that state attorney general and representatives from apple, motorola, and samsung hoping to use technology that would permanently disable stolen phones. new york's attorney general says cell phone theft is a national epidemic and the fastest growing street crime. >> if you don't like going to the grocery store you may be able to kiss that weekly trip good by, amazon is getting into the grocery business with the launch of amazon fresh on-line ordering service that delivered grocery and fresh produce right to your home. the program has been tested in seattle for the last six months and is expanding to los angeles this week. the company hopes to roll it out to the bay area by the end of the year and to 20 more cities next year.

drop to 66 in millbrae with a nice breeze, a few holes in the cloud cover along the coast and temperatures around sick, and mid-60's downtown and south san francisco and sausalito, and 67 in petaluma, but low-to-mid 70's for the north bay and we will have mid-60's to upper 60's in the east bay shoreline with mid-70's to around 80 in the east bay valley and the forecast shows sunscreen because we are seeing the sun come out quickly and we are going to start at 62 degrees and warm to 64 by the time the game ends. your seven-day forecast shows temperatures dropping two to eight degrees tomorrow but we are still focused on friday and saturday for the dangerous heat inland and warm around the bay mid-to-upper 80's. temperatures will taper by monday and into tuesday, back to you. >> thanks. still ahead, the first lady takes on a heckler. still ahead, hear the first lady if her own words after a protester interrupted her
