>> welcome back, everyone. it's 9:13 on this glorious, sunday morning. this is a live look from our santa cruz camera. it is going to be in the 70s today. lots of clouds there. in fact, around the bay quite a difference today compared to yesterday. our meteorologist lisa argen will be along shortly with your accuweather forecast. this morning former south african president, former president nelson mandela remains in the hospital. people around him are sounding
9:14 am
increasingly concerned. his family at his bedside, people throughout the country are praying for mandela. we have the latest. >> we are waiting for the government to release the latest on he nelson mandela's condition. last word he was in serious but stable condition. when you read this more than's head lean, they describe the mood out on the street. it reads mandela fights for his life. and another headline that really is telling. this one reads "it is time to let him go." this was a statement given by mandela's long time friend who served in prison with mandela and he gave this statement this morning to the sunday times. he was brought here around 1:30 on saturday morning for a reoccurring lung infection. we are told his wife has been by his side the entire time. we are also told moments ago some of mandela's family members have left the hospital. this is the fourth time the former south african president and civil rights leader has been hospitalized in the last six
9:15 am
months and three visits were really focused on this lung infection. the 94-year-old has continued to battle back each and every time from this illness. but there is a senior government official who has described man della's condition this time around as bad, and the people of south africa are coming to grips with his inevitable death. there were church services this morning where many were praying for him. including one that was very significant during the anti-aparti movement. i have spoken to many people and it's difficult for them to talk about mandela's condition. they say when you look at engine he's meant to the nation, they don't want to talk about his death right now. but others say he's 94, with to turn 95 next month, and as his friend said, this time it's time to release him so god can have his own way. normally the mandela family will
9:16 am
come out and make a statement but this time they are making no statement. in fact, they are asking for privacy. abc news. >>. the discussion about privacy is in full tilt this morning now that americans know about the one government program tracking almost every phone call. senate dianne feinstein explained it. they said they are all within the law and only take content of any phone calls if there is suspicion of terrorist activity. >> if there is strong suspicion that a terrorist outside of the country is trying to reach someone on the inside of the country, those numbers then can be obtained. if you want to collect content on the american, then a court order is issued. not likely to stop the criticism. she adds the debate over privacy

is difficult because the public is unaware of the times it thwarted terrorist attacks because all but two instances have been classified. in a part of san francisco with apartments and condos springing up everywhere, neighbors say something is missing, parks. even though there is a nice new park on harrison street in racon hill. jonathan bloom explains why red tape is keeping neighbors from using it. >> in a park near san francisco's city hall the screams of delighted children fill the air as workers catch a few rays of air on their lunch break. but across town you will hear grinding and hammering as new high-rises spring up. it's a neighborhood known as rincon hill. the 6,000 families that already live here, you won't hear kids playing. there is a park but there is hardly anyone in it mostly because it's surrounded by an 8-foot fence. >> to make this a public park sooner rather than later. that's my goal.
9:18 am
>> a neighbor started a petition that in one day already reached more than 100 signatures. he knew it was supposed to be public when it was built along with the high-rise apartments, but the negotiations between the city and the developer have been slow. in the meantime it remains private for residents only and it's the only green space around. >> there are no parks because it used to be railroad tracks and warehouses. we need a park. >> unlike most land deals, the sticking point isn't the price. when they built it, the owners agreed to build the park and give it to the city for free. the trouble is the city says even at that price they can't afford to take it. >> understand the recreation and parks department is reluctant to take ownership at this point because they have not had identified funding for maintenance of the park. >> the parks department is already strapped and they would need about $24,000 a year to keep the park clean and safe. the city wants it to be public and they are exploring other
9:19 am
options like paying the owner to maintain it for letting the public in. there are other spaces in the city that are privately owned but have a public easement on them. >> there are questions like insurance, but a deal could happen in the next few months to bring the fence down. in san francisco, jonathan bloom, abc7 news. >> oakland officials will throw a car free party this morning to celebrate improvements to lake merit. love our lake day is a free event that encourages residents to get out of their cars and explore the neighborhoods around the lake. three miles of streets around lake merit will be closed. there will be live music, salsa dancing, free bike rentals and. boat rides and food trucks. mayor jean quan is scheduled to attend. it kicks off at 11:00 this morning and runs until 4:00 p.m. >> great weather for the event. >> yeah. a much different story than yesterday with the low clouds
