northbound 280 the transition is closed for construction project that re-opened at 7:00 a.m. now a look at the toll plaza, clear commute with clear skies, as wealth, and month accidents reported from oakland and into san francisco. >> happening today, south bay prosecution will reveal details of the biggest ban crackdown in santa clara county history, a massive indictment of gang members on charges including murder. abc7 news reporter matt keller has the details. >> case like this has never been done before in santa clara county. a supervising district attorney says the criminal gang case includes 77 indictments against 39 male and nine female defendants. they involve alleged murder, robbery, drug sales and weapons charges. from 2010 to may 30 of this year

all 48 took part in the criminal gang organization in santa clara county and conspired to sell methamphetamine. the police officer is announce the arrest of cruz for the murder of a 38-year-old. the indictment charges that cruz, a 30-year-old angel martin meze and a 24-year-old joseph oaks murdered him while members of the gang. other allegations in the inindictment include participating in the armed robberies banks, possession of prohibits weapons, and a felon in possession of a firearm. district attorney will go into more detail at a news conference today scheduled for 10:30 this morning. it is expected to last at least an hour. >> matt, san jose is looking to restore cuts to public safety when the council votes on the $2.6 billion budget. the city is ready to adopt the budget without service reductions or layoffs for the

second straight year. the mayor reed wants to allocate more cash to repain police officers and $4 million to pay for police overtime until enough new officers hired and trained. >> there are new safety questions about a limousine that burst into flames over the weekend. the 2008 lincoln town car was licensed to carry eight passengers but this were ten inside when it caught fire on sunday morning. all the passengers, many elderly women, got out safely. they say the driver gave them the go ahead to have more passengers than allowed. >> only eight people are allowed to fit inside the limo but we did a head count he said, ten is okay. so fine of us in the back and the birthday girl sat in the front. >> this is the limo driver would said this? >> yes. the owner of the limo has been in legal trouble recently. documents show he was convicted of making nets and passing a bad check in a dispute with the

bit. >> they always get broken up by the police and someone always gets in trouble. it never ends up good. >> officers arrested 18-year-old from live oak as he tried to leave. he had a rifle, a shotgun, and jewelry stole were from the house. no one has been arrested for vandalism. >> the father after 16-year-old accused in the deadly carjacking of a san jose paramedic claims his son is being frameed. he pled not guilty to the murder of a 34-year-old quinn boyer who was shot and killed april 2 as he drove in the oakland hills. five other juveniles face charges including a 13-year-old but the prosecution believes burton was the gunman. the father said he believes his son was in school at the time of the the shooting. burton is tried as an adult and could face the death penalty. >> move than half of california voters believe same-sex marriage should be legal. according to the "los angeles times" poll, 58 percent of

voters support legalizing same-sex marriage and 36 percent are against it. the poll finds the support is strong of the right here in the bay area with 9 percent of voters in favor of same-sex marriage. the supreme court is going to make a decision on the same-sex marriage ban any time this month. >> it is 4:35, east bay water officials are expected to vote today on a plan to raise water rates 10 percent a year for the next two years. east bay says the increase is necessary to maintain damns and pipelines that deliver to $1.3 million customers. the hike costs the average family $5 month a month starting in july and $5 more next year. the board will hold a public hearing at 1:00 o'clock at the headquarters in oakland before that expected vote. >> and the latest bay area city could ban plastic bags, the city council will consider whether to been single use plastic bags and foam take out container.

area this is abc7 news. >> welcome back on this tuesday morning. san francisco muni officials are concerned about a growing problem, passengers trying to on the doors of moving buses and jumping out between stops there have been 15 of these incidents since the end of may over a week and a half period. it is mostly on the 14-mission limited but it is happening on other runs. according to the "san francisco examiner", police thought they were just trying to get out quickly after boarding the wrong bus but now they review surveillance video to determine if it is a malicious mischief by a grouch passengers. phones say it is a matter time before someone is hurt. >> six months ago we profiled 20 something winemakers trying to make it big in traditional industry by being untraditional. now, they are getting close with a marketing campaign so out there so shocking, that it is too edgy for tv. but not for the internet.

albany, berkeley, make a few sprinkles, too, even toward richmond parkway. this is just the low finally giving us a last parting shot before calmer weather. great start to the day and high clouds as we talked about a slow warming trend through thursday and friday, saturday, and sunday we have temperatures that will drop a little bit below average but today we try to get back to average with 75 in san jose, and four degrees cooler than average, and 79 in los gatos, that should be the normal high in san jose, and 80 in gilroy, and milpitas at 72. headed up the peninsula, 74 in los altos and low-to-mid 70's and cooler at 66 in millbrae and along the coast it will be breezy in the low 60's to mid-60's on the bay side, downtown, and south san francisco, and toward sausalito, low-to-mid 70's through the north bay valley and upper 50's to near 60 long the coast.

we have new video from turkey a sand off between police and protesters. the police are trying to keep protesters away from water cannons. they fired tear gas and rubber bullets at the crowd but the protests kept coming back. demonstrators have occupied the square since may 31 where poverties staged a sit in over the replacing of a park with bear rans ending in a violent crackdown and three people have died in the characters. turkey's prime minister will meet with protesters tomorrow. >> significant flight delays are expected across europe because of a strike by air traffic controllers. the strike began in france this morning and it is expected to spread to other young nations. the aircraft controllers are protesting plans to centralize criminal of europe's airspace. the move would reduce the power of the unions representing the controllers. >> a chinese space shift of the thatted off today from the gobi desert with three astronauts on what is expected to be the 5th

>> we have breaking news from san francisco where firefighters are on the scene of a two-alarm fire in the bayview district that started at 2:30 on hudson avenue. we are told it may have started in a vacation around building and spread to cars. the fire is out but firefighters are still on scene keeping an eye out for any hotspots. four adults and two children have been displaced and we are told one firefighter was injured and they have been taken to the hospital. abc7 news reporter amy hollyfield is arriving shortly on the scene. >> we are waking up to a different morning. mike nicco? >> no lightning strikes to track but a few
