matt? >> the investigation is continuing on checkers drive. the crime scene van is still here and as my photographer pushes in you can see below the van are some evidence markers on the street this. we also have seen a police photographer taking pictures across the street from where the victim was found, about 50 yards from where we are standing. the officers arrived on the scene at 12:45 to find a man with multiple stab wounds. the man is 40, he was taken to the hospital and died after 1:30 this morning. two men who lived here on checkers driver were surprised to come home to the crime scene. >> we went to jack-in-the-box. came back. >> what were your thoughts when you see police tape? >> whoa, what is happening? whoa. >> the police said the drive would be blocked off for four or five hours, the 24 the homicide

of the year and police are not identifying the victim until the family is notified and they are not saying whether this is gang-related homicide. >> breaking news in san francisco where police are investigating a shooting that killed two men. it happens shortly before 1:00 o'clock this morning in visitation valley neighborhood. the victims were found near santos street near the park. three suspects drove away in a white truck. in word on a motive in shooting. >> more breaking news in san francisco right now where police are moving to evict a group of activists occupying the former hayes valley farm site. this is fell and the scene is active. there is a cherry picker. the head lamps can be seen. three people have been taken

>> it is slowing down but before we get there we want to check out our milpitas drive where we have plenty construction on 880 and 680 and the project on 680, southbound, from the south bay freeway, 237, a couple of lanes are blocked until 6:00 a.m. and on 880, twine brokaw and great mall parkway there will be construction crews and transition from eastbound 237 to northbound 880. lots of stuff and very busy. on the altamont pass, out of tracy, you are look at 31 miles per hour and it continues to ranch up so it will improve but as we hook at san jose 280 away from 17 we have only one lonely car making the drive away from 17. kristen and eric? >> it is 5:30 4. happening today in san francisco the d.a. is 3,000 miles from home looking for ways to stop smartphone theft as summit in new york bringing together law

enforcement and executives from the cell phone industry. katie marzullo has more from the newsroom. >> you have one of these, and your eye phone or, yes, a samsung phone and that makes you a prime target for thieves. what of all robberies in san francisco involve a cell phone according to the district attorney. today he is in new york to do something about it holding with the new york attorney general meeting with representatives from apple, samsung, google and microsoft to have a way to make them less appealing to thieves. the d.a. is recommending all come with a "kill" switch. some of the thefts have been caught on tape and they grab them, they erase memory and re-sell them. in san francisco, that man has led to victims getting hurt, beaten and cut.

in addition to the summit, in a few hours they will announce a nation-wide initiative and coalition of police, prosecution and others, in an attempt to stop the surge in smartphone theft. apple announced the new smartphone software which comes out in the fall will have activation lock technology. he says he appreciates the gesture but will reserve judgment until he can see how it works. >> there was an overnight accident that injured six people shortly after 9:00 p.m. which involved three vehicles, and the six people injured included one person who was trapped in a car. >> the driver that ran away from a crash that killed three in colma will be in court. the 25-year-old paul diaz will

be arraigned. he was intoxicated intoxicated g weapon the mustang rear ended a honda before hitting a retaining wall. all three passengers were killed. investigators say he walk away but turned himself in hours later and is smelled in san mateo county jail on $1 million jail. >> berkeley police are looking for the man who sexually assault add ten-year-old boy inside a park restroom. the attack took place at the berkeley marina on tuesday afternoon and triggered a large surge. officers made themselves visible at the marina after the attack, and parents are teaching an extra close eye on children playing in the park, and the boy describes the attacker as african-american male, blond hair, with green streets. berkeley police want to hear from you if you have seen someone matching that description. >> the family of a missing man. after the bay to breakers race

is planning a memorial race after he went for a swim after the race on may 19 but was never seen again. his phone, credit card, and passport were discovered near the restaurant and the family is holding a memorial on june 29 in portland, oregon. >> 140 technicians what put on last month's napa bottle walk festival are getting stiffed from the wages, just one difficulty facing the organizers. they are in a dispute with the catering company promising to donate $1 million to charities is not fulfilled. the stage hands are owed more than $600,000 in wages and benefits. organizers say they will make sure everyone is paid. >> we will check with our meteorologist, mike nicco, and it will warm soon. >> soon is the key, and now it is chilly. we have to wait until the afternoon hours to get the full

seven things to know of the breaking news, police are investigating a fatal overnight stabbing in san jose. the hand was found in front of a home after 112:30 this morning. we will have a report from matt keller at top the hour. >> san francisco police are investigating a double homicide in the visitation valley neighborhood. two men were found shot to death on santos street around 1:00 o'clock a.m. and police are looking if three suspects would took off in a white truck. >> right now, san francisco police are moving to evict all the activists occupying the former hayes familiar farm site. police is got were one guy out of the trees and they were on the cherry picker and protesters are saying three people have been taken into custody. >> number four, san francisco district attorney is in new york to talk about the grow problem

cars and they are now fully engulfed. as we go to the waze app, you can see our wayser took the picture of the plume of black smoke rising in the sky were afternoon and we had a grass fire that has been sparked. if we can go back to the map, i will slow you the slow downs. it is a sig-alert and we funneled down to one lane and this is causing major backups, with the top speed at eight miles per hour causing tremendous pressure from walnut creek and 680. westbound direction, of course, the commute direction, if you are headed to, would, avoid 24, and mount diabolo boulevard is an alternate and you can take highway 4 or highway 80 which will add more time to the commute. the boulevard is the best way to get around this, and, again, this is going to be blocking lanes until further notice and we will show you pictures from the seen in a moment.

later. police do not have any suspects. it is the 24 the homicide of the year. our reporter is on the scene gathering new information with a report in 30 minutes from the scene. >> from san francisco, police are on the scene of a shooting that killed two men. it happened in the visitation valley neighborhood before 1:00 o'clock a.m. when police founded victims near a park. three suspects drove away in a white truck. there is no word on a motive. >> breaking news a tense showdown in san francisco between police in riot gear and occupy protests. the protesters had refused to leave trees but now arrests have been made and abc7 news reporter is on the scene. amy? >> there have been big developments. look at this video, police are pulling a man out of a tree. it was quite dramatic.

they used a cherry picker to lift the officers up to him and he still refused to come out so the officers pulled him out with crash pads below in case he fell. he did make it out okay and the physical let protesters were yelling from across the street at him in support, yelling they loved him and supported him. police pulled a total of three protesters out of trees. two of them suffered minor injuries according to the police. one of the protests fell out of a tree. right now, police say they have made a total of seven arrests at fell and that gun -- laguna. his got here at 1:30 this morning and when they got here, 30 people left on their own. five decided to stay and be arrested. two of those were arrested on

look at surveillance video to identify two teen girl whose assaulted and problem add woman on a streetcar. it happened on tuesday at third street in the bayview. investigators say a 67-year-old woman was punched in the face by the two girls who she believes are around 13 or 14. awe-struck her in the face with a clenched fist. she let them have her purses and did not resist the. >> the victim had a produced cheek without her purses which contained cash and a cell phone. >> san francisco police will look at video from surveillance video to figure the cause of the massive muni crash. 15 people went to the hospital after a historic streetcar rear ended a bus on market street. the injured including summer camp kids on a field trip to the cable car now seem.

expert thinks. that schedule was put in jeopardy when engineers discovered three dozen anchor rods designed to steady the bridge in an earthquake snapped. caltran is working on a fix but the safety experts say the problems with the new span are minuscule compared to the overall safety. >> now breaking news westbound 24, leyla gulen, only one lane open? >> one lane open. this is a major sig-alert involving a big rig carrying cars, at least nine, all of which are fully engulfed in flames. westbound 24 at central lafayette, here is the waze app, the picture shows a black plume of smoke and you can only imagine a big rig and nine vehicles con completely engulfed. this sparked a gas fire and causing major slowing as they have all but one lane closed. no word as to when this will get cleaned up. you can imagine it will be a very major clean up process so

now as we take our drive from walnut creek, look at that down to seven miles per hour from 680 is crawling as you head to work this morning. you request not always use mount diabolo road, and if you are coming from concord, you can see four is clear at 65 miles per hour and concord is looking clear. if you are headed out of pleasanton or coming down through san ramon rather than taking 24, take 580, this is moving along at top speed and we do not see problems. the sig-alert will be around if quite some time and clean up hasn't begun yet but all but one lane is blocked. more updates in a little bit but the forecast shows more please an news with mike nicco. >> duratio is moving from washington, dc, philadelphia, new york, flight delays because

>> covering san ramon, san mateo and all bay area, this is abc7 news. >> back now to the breaking news story of the morning we have pictures of this fire in the east bay. this is highway 24, you can see the car carrier, a big-rig truck caught fire and the cars on board caught fire and there is a grass fire on the side of the road with only a couple of lanes getting through on 24 in the eastbound direction, correct, leyla gulen? no, westbound direction. that is the commute direction. you can see the backup.

my goodness, stretching all the way back probably lafayette and maybe to walnut creek, but leyla gulen is were watching this very carefully with the latest information on this coming up. >> due to only one lane being open we will get back to that. we have developing news from colorado. >> a wildfire burning out of control destroyed 92 homes. officials in el paso county people that number to grow. and other homes were seen burning as they released the count. the fire has charred 8,500 acres and forced 7,000 people to evacuate since breaking out two days ago. >> antioch is facing a critical shortage of police officers. it is looking at the police chief's plan to have workers on the street help keep a watchful eye until more officers can be hired. the police department is thinking out of the box training

lanes open. we had one lane open for a time but two are now open so that is slowly starting to relieve traffic. it is quite a sight to see so there will be spectator slowing the it does not appear to be affecting anything eastbound but avoid 24 headed to work, you can take bart, we have mount diabolo road if you need to drive. highway 4 is wide open and top speeds on 580 that is also looking clear and accident-frees but, again, westbound 24 at central lafayette, this is at a standstill. we will keep our eye on this as further details become available but avoid it coming from walnut creek, looking at a heavy backup and a lot of time on your hands. >> now a look at the weather. mike nicco?

big-rig fire, and the big rig was carrying nine to 12 cars. outside right now we can show you the pictures, the fire crews are getting this fire under control. as you can imagine, it was a major fire that was causing great big black plumes of smoke to rise into the air and it also sparked grass fires. you can see the uncontrollable flames pouring out of the big rig. emergency crews put the fire out and it looks like traffic now is starting to move a little bit better than it was. we opened up an extra lane so two lanes are open but the backups remain and we are looking at heavy delays away from walnut creek and this is in central lafayette on westbound 24. on the maps i can show you our speeds moving at aid miles per hour, so that is the top speed, but how will this affect the drive into walnut creek?
