it is happening tonight in castro valley. alameda county sheriff deputies confirm three people were shot during an attempted robbery at boulevard burger on castro valley. >> this happened about 20 minutes ago. we don't have word yet on their conditions. we have a crew on the way to the scene and we will bring you more information as soon as it develops this breaking news we are following. and we are updating the story on twitter at abc7 news bay area. good evening. i'm dan ashley. >> i'm carolyn johnson. our other top story, an -- anger and vandalism as protesters clash over a small piece of land. the protest is happening between fall and oak streets. sergio joins us live.

>> right now you can see several police cars that are here. that's because the san francisco police are going to stay here. they are going to make sure that demonstrators do not get into the vai can't -- into the vacant lot. a sizable police presence remains here and will remain here through the weekend to make sure they can respond in case the group returns. 50 demonstrators stayed in this area, but they did dispurse an hour ago after the eggs were tossed and the arrest was made. as rush hour was wrapping up, the group of occupiers clashed with the driver smashing his windshield and they smarled traffic -- snarled traffic. one person is charged with assaulting an officer because he threw rocks and hit one of the policemen. no serious injuries there. the other is under arrest

fortress passing. both people tried getting in the fenced o area. >> they found a spot and they figured they could scale the fence, but we were prepared for that and we were able to thwart that. >> it is a continuation of efforts to take over this vacant lot. a group established a week long encampment, but we were evicted early -- but were evicted. nests were discovered belonging to federally protected birds. trees are being cleared because a developer is planning a large housing complex here but demonstrators would like this lot to be a community garden. the san francisco police say they are actually going to remain here as i mentioned throughout the weekend. they have officers positioned throughout this entire block to make sure that demonstrators do not get in. they are also in contact with the developer to see if

private security will be sent. reporting live, abc7 news. >> sergio, thank you very much. we are following that story closely as well. vice president joe biden was less than five miles away from the occupation attending a private fundraiser. we have new video of the vice president. his motorcade left about 6:30 tonight. the vice president is in one of the three dark suvs. the fundraiser at the home of a local beverage didn'ter benefited the national committee. the vice president spoke for about 10 minutes to a gathering of a hundred people or so who shelled out between 500 and $10,000 for the privilege. burglars are on a crime spree in livermore. the technique is all too familiar. they knock on the door and when there is no answer they break in. residents reported eight such attacks in days in livermore and now police are warning neighbors to beware of this tactic. here is ama dates. >> this livermore neighborhood off patterson path road is one

of the areas targeted by burglars. eight homes have been broken into in the last week, b nt at night. it is happening during the day. >> it was a surprise. it was all eight houses at once. >> blake mason's house was burglarized on wednesday. >> sometimes i ride my bike home for lunch. i opened the door and i saw it was a little uh jar and i saw pieces of the door on the floor. >> this is what the thieves did to his door before making off with his laptop and case. they may be posing as solicitors and goods. but instead of selling things they are checking for empty driveways. >> i have seen guys walking up and down the street with clip boards going door-to-door and i don't know if they are sales men or taking notes of who is home and who isn't. >> alicia green says this is an area where they could sell things door-to-door. >> i feel bad that everybody is worried and show me your credentials, but everybody is being careful. >> green is scared so she is being pro active.

they applied for a permit to sell beer and wine. it would be priced from 99 cents to $4.99. one shopper is concerned the type of people the cheap booze would bring in. >> it is not a good idea especially at a dollar store. people are coming in here at night that aren't the greatest. it may be a dangerous situation for some of the employees. >> there will be a public hearing about the liquor application next month. and facebook reached a deal with national security authorities. it allows the social media company to released some of the details about the government requests it receives about information on its users. requests from the last half of 2012 was between 9 and 10,000 and 18,000 and 19,000 accounts were affected. facebook has come under fear for turning over data to the surveillance program.

a lot of dads are hoping for sunny weather this father's day weekend. i am in that group. sandhya patel is here. >> i wouldn't want to have it any other way. we are starting to see change already and near the coastline you will notice gray showing up and as you look at the coit to tower you can see the low clouds surrounding that area. the temperatures right now are 53 in san francisco and 58 in oakland and san jose 59 degrees. we are expecting low clouds, but will we see clearing for the afternoon plans and for father's day? i will be back with the entire forecast coming up. carolyn? >> thank you. the mark's cup racing team that lost a sailor in a deadly accident on the bay expects to have its replacement boat on the water next month. artimus racing team spoke only to abc7 news and it is the first time the america's cup contender has answered

questions since the catamaran capsized and killed andrew simpson. >> knocked down, but not knocked out. there are a lot of successful people on this team and they didn't win gold medals and get to where they got by rolling over when the hill gets steep. >> they will miss the first round of racing that starts on july 7th. the crew plans to compete in early ug a. it is the winner of that series that will go for the america's cup. >> the san francisco marathon will wind its way through the city this sunday, father's day. organizers expect about 24,000 runners. the embarcadero will be closed to traffic starting midnight saturday into sunday afternoon during the race. bags will be inspected near the start. san francisco police say they will have extra officers on patrol of course -- patrol. of course, security heightened after what happened at the

you still have a chance. just click the like button on the facebook page and fill out the entry form. you will still need to fill out the form 1k3* we will have a new winner on the abc7 morning news. in developing news out of colorado tonight, firefighters now have that huge fire that is burning in the black forest area 30% contained so some progress. the winds died down and the rain fell allowing firefighters to make some major advances. some mandatory evacuation notices have been lifted. firefighters also gave us a glimpse of their strategy too. to use water efficiently, they surround a house and wait for the flames to burn the fuel properly and turn on their hoses. despite their efforts, 400 homes have been destroyed. there are questions about the deck that collapsed in miami. we first brought you this story last night at 11:00.

listen to the 9-1-1 call. >> the dock fell in the water. >> the whole deck and the whole bar fell and everybody is in the water and i don't know if they are okay. >> this happened at a popular sports bar packed with basketball fans cheering on the heat. dozens of people plunged into biscayne bay without warning. 24 people went to the hospital, but only one seriously hurt. >> we were drinking our beers and then woosh and we were in the water. people were screaming help us, help us. everybody was frantic at that point. >> police ruled out over crowding or criminal activity as a cause. they are looking into a structural problem with the bridge. or with the deck rather, pardon me. it is not only the future farmers of america, but the future builders and programmers showing off their works at the san mateo county fair. as jonathon bloom found out the fair takes on a new meaning when you put it on the edge of silicon valley.

an update on our breaking news in castro valley. three people were shot during a robbery and it appears one of those wounded is the suspect. >> this robbery happened at 10:40. so about 45 minutes ago or so, 50 minutes at boulevard burger which is on castro valley boulevard. alameda sheriff officials have not released the condition of the victims yet, but three people shot. we will keep you updated overnight and on our morning news tomorrow morning beginning at 5:00 a.m. of course our reporting continues 24/7 at twitter at
