day planner for the next 12 hours. 58 degrees, cool start to our day. we will see temperatures starting to warm up just a little bit around the bay. 56 to 64 degrees by noon. 74 will be your high at 4:00 p.m. with a cooldown, as the clouds come back again. so we are going to be seeing a little bit warmer temperatures, but cool again tomorrow. and then it starts to warm up as we start heading towards the end of the week. more on that with your accu weather seven-day forecast. but now let's take a look at our traffic, shall we? okay. we do have a report of a brush fire in the east bay, but we also have this, a stalled car southbound 101 along the golden gate bridge, just as you come around the curve. we are seeing plenty of fog rolling in over there, as well. so do proceed with caution, use your low beams, not your high beams. maybe slow down a little bit, because you never know when you can't see that far ahead of you. let's check out what's happening. this is your drive coming into central san rafael, 101, clear one there. as you make it down to 580,

certainly accident-free. as you continue down to the waldo tunnel. kristen, eric. >> leyla, thank you. 6:02 now. we begin with breaking news in south bay. one man dead, another taken to the hospital after a toyota crashed into a line of parked cars on foxworthy and hillsdale avenues. we're being told a 40-year-old passenger in the toyota died at the scene. the driver was taken to hospital with minor injuries. investigators say beer cans were found inside the vehicle. abc 7 news reporter matt keller will have a live update from the scene in the next half hour. developing news, walnut creek police canvassing a quiet residential neighborhood, looking for clues after a stunning attack inside a home overnight. somebody was viciously beaten. abc 7 news reporter amy hollyfield is live in walnut creek. amy? >> reporter: kristen, we're at the police station where we're getting updates. the latest we have heard is that the investigation is very busy right now. but no arrests have been made. police have r looking for the person who beat this man,

happened around midnight. he was taken to the hospital and police tell me he is expected to be okay. it happened in his home in a condominium on oak road. this is near the b.a.r.t. station in walnut creek. police are being careful about what they say, because their investigation is so active right now. so they wouldn't specify if this is a home invasion. but they did tell me, it doesn't appear to be a random attack. they want the general public to know that people do not need to be overly concerned or worried about their safety right now. police say, though, they are actively following up on leads, so they tell us to keep checking back for updates. reporting live in walnut creek, amy hollyfield, abc 7 news. amy, thank you very much. an 11-year-old buy boy is recovering after being shot by an apparent drive-by shooting in oakland. several shots were fired into the boy's home on 7th street 5:00 yesterday morning. authorities say there were seven people in the home at the time.

the sleeping boy was hit in the shoulder when a bullet came through a wall. he and his brothers were all in bed at the time. the family says it's not the first time their house has been shot at. >> years ago, they shot through where my room was and shot through our windows. and then a few months ago, they shot threw up there, which almost hit my dad. we have an oxygen tank up there, so that could have blown up. >> police say they're not sure who was the intended target. they're still looking for the gunman. this morning, two fremont police officers are on routine administrative leave following a fatal shooting. investigators say just before 7:00 yesterday morning, a woman called police to alony street. she said her 53-year-old son was throwing around furniture and attacking a door with a knife. when police got there, they entered the home and the man confronted them. >> two of our officers ended up shooting the suspect. they proceeded to give medical aid, cpr. fremont fire responded.

and subsequently declared the male deceased. >> two family members were injured by the man, but they are expected to live. happening today, state lawmakers will take up legislation to make limousines safer, intended to prevent deadly fires like this one on the san mateo bridge. five women were killed in the blaze after they became tripped. the law would require limos to have two rear exit doors in the passenger compartment. it would also require two windows that could be pushed out from the inside. a gas main break has been capped after a leak forced major evacuations in san francisco's south market neighborhood, including a crowded moscone center. the rupture happened near 4th and folsom streets around noon yesterday when a construction crew working nearby hit that six-inch gap line. several buildings and businesses in the area had to be evacuated, including the moscone center and the gardens. the leak was capped a few hours later.

crews are in the area working on a station for the central subway, but it's unclear if that's who hit the gas line. happening today, the controversial topic of retail firearm sales in los gatos will be heard in tonight's town council meeting. a hearing in february was packed. opponents of a new gun store that opened in december say a public review of the permit process for temp lar sports was not conducted, even though city officials weren't required to. supporters of the store say it opened legally and shouldn't be punished. tonight's hearing will consider an amendment to the permitting process for the sale of firearms, ammunition and other explosive devices. we have new details about a candlelight vigil held by members of occupy the farm in san francisco. >> because i want to sweat as i labor over the fort. i want to take the salt as i sweat. activists read a poem about the virtues of farming. last night's vigil was for the trees being removed for a building project at the former site of the heys valley community farm. activists tried to occupy the

site earlier this week, but police moved them out and occupiers would like the area preserved as an open space. bicycling accidents are up in san francisco. the "chronicle" reports a new civil grand jury report released this month found bicycling accidents are up 20% between 2009 and 2011. the increase comes as cycling gets more popular in the city. the report makes several recommendations to bring down the number of accidents. among them, better traffic enforcement the, better safety classes and more teamwork between the mayor, the board of supervisors and muni. if you plan on crossing any streets in the north bay this morning, make sure you use the crosswalk. santa rosa police and other agencies are crocking down on jaywalking. the "press democrat" reports officers will be on duty looking for jaywalkers. the highway patrol also taking part. the new effort will last until june 28th. direct for george lucas will

make a pitch today for a new art museum. he will present his idea. the "star wars" idea has a large collection of pop and classic art. lucas wants to display at the proposed lucas cultural art museum. it would include his collection, along with cultural and performance exhibits. lucas is willing to pay the $300 million construction cost for the museum. he would also spend $800 million on two endowments to run it. uc-berkeley is having problems selling seat licenses to pay for nearly half a billion dollars in debt for the renovation of memorial stadium. cal's new football stadium opened last september after undergoing seismic retrofitting and a major remodeling. uc officials say part of the money could come from nearly 3,000 seats they would sell to alums to keep it for up to 50 years at 40,000 to $250,000 each. but the "san francisco chronicle" reports only 1,800 seats have been sold so far.

>> let's hope the cal bears will make a strong showing next season. in the meantime, leyla gulen. we're talking baseball today. >> that's right, i know. good morning, everyone. our radar and satellite, we are seeing plenty of low clouds rolling in over the bay area. and here's a look at it, just a gorgeous shot. this is from our mt. tan cam. and you can see how that black yet just sllg insettling into t hills over the trees, a beautiful sight there. current temperature in san francisco, 52 degrees. oakland, looking at 55. up to 56 in mountain view. 50 along the coast in santa cruz. here is another gorgeous shot from our tower cam. and it's those puffy clouds there, cooling things down for today. we are going to be seeing 76 degrees inland, as our high. 66 at the bay. 54 along the coast. it will still be a little bit cool tomorrow, but temperatures start ramping up, though, as we get closer to the end of the week. you'll have your full forecast in a bit. but for now, we've got some traffic to get to. lots happening, i have to say.

we are starting to look at busier conditions. in hayward, this is where we do have a report of a car fire, southbound 880. this is right at marina boulevard, and it is blocking one lane. we have a couple of reports of it there, so we could see chp making its way over to that area. as we take it into san jose, this is where we have this other stalled car, southbound 880 at old bay shore highway. and that is blocking a lane starting to see a slow down there as you come up on to highway 101. and outside we go. here's a quick look. this is a gorgeous drive, right through walnut creek. and our 680 starting to load up a little bit, but sunshine. so we are going to be seeing some sunshine today. clouds will come back over the evening. but we'll have more on that coming up in just a little bit. kristen and eric, over to you. >> leyla, thanks. 6:10 now. steve jobs' top-selling biography getting a makeover. we'll show the new cover featuring the late apple ceo. first, nelson mandela remains hospitalized in south africa this morning. the words of thanks now coming from his wife. and law enforcement agencies trying to get customer data from

low clouds we have out there this morning. leyla gulen, doing double duty with weather and traffic will have the latest on when we will see the sun fully today and cool temperatures ahead coming up. new this morning, san jose based orchard supply hardware is filing for chapter 11 bankruptcy and getting a new owner. several media reports say lowe's home improvement agreed to buy it for $205 million. orchard operates 91 stars up and down the west coast. lowe's plans on keeping the orchard name and operating the stores independently. however, the deal is still pending and another company with a higher bid could still come in and buy orchard. north korea is now saying they want to talk. after months of threatening to wage a nuclear war, north korea has done an about-face and says it's willing to talk with the u.s. if there are no preconditions. the u.s. says it's willing to have credible negotiations with the north, but that those talks must involve north korea's compliance with u.n. security

council resolutions. that ultimately result in the north giving up its nuclear program. new this morning, the wife of nelson mandela is thanking the public for their thoughts and good wishes as her husband remains hospitalized. mandela is now spending his tenth day in the hospital for a recurring lung infection. he remains in serious condition, but doctors said over the weekend they're seeing some improvement. in a new statement issued this morning, mandela's wife said in part, quote, so much love and generosity have come our way to lighten the burden of anxiety, bringing us love, comfort and hope. new this morning, apple revealing the number of security requests law enforcement agencies are making for its customer data. the cupertino company announced this morning, it's received between 4,000 and 5,000 requests for customer data in the last six months. microsoft and facebook both made similar announcements last week. in a statement released on its website, apple said the security requests included both federal, state and local law enforcement

agencies. the most common forms of requests came from police investigating robberies and missing persons. the paper back version of the best-selling biography of late apple founder steve jobs will come out this fall, and it will have a new cover. take a look. on the left, the original cover. which was released in 2011. on the right, the new cover obtained by all things digital. it's a photo of a much younger steve jobs, dating back to 1984. publisher simon and schuster haven't released sales figures but amazon.com says it was its best-selling book in 2011. tweet is now a real word when it comes to your activity online. the oxford english dictionary announced over the weekend, it's expanding the definition of the word "tweet" to include the posting of a message on twitter. tweet, of course, was already in the dictionary for its relation to bird calls. the expanded definition comes despite the oxford english dictionary stating a word needs

brady will travel the world, raising awareness for breast and ovarian cancers. russian president vladimir putin has responded to a super bowl ring controversy during an awards speech last week. new england patriots' owner robert kraft said in 2005 when he showed putin the ring, the russian leader said, quote, i can kill someone with this ring. and then walked off with it. putin is denying that he stole the ring. he says it was a gift. a spokesman for kraft released a statement saying the storing is just an anecdote and not to be taken too seriously. a wild video of a florida teenager hitching a ride on the back of a 30-foot whale shark is sparking controversy. this risky stunt has become an online sensation. 19-year-old chris kras says he spotted the whale shark off the gulf of mexico. whale sharks are considered to be the genital giants of the sea. he jumped into the water, grabbed on to the fin and held on for about nine seconds. biologists say the incident could have a potentially negative health impact on the

60s along the peninsula. 80 degrees in morgan hill. as we push inland to the central valley, 79 degrees in antioch, 79 in livermore and north bay. 76 in santa rosa. our accuweather seven-day forecast, a bit of a roller coaster between today and friday. and that's when that will be our first full day of summer and certainly hot over the weekend. more coming up in a little bit. as we look at our traffic, we have a couple things going on. right now as we take you into fremont, this is where we do have a report of a crash. southbound along the nimitz at fremont boulevard blocking one lane. so far, doesn't appear to be affecting traffic at this hour. hopefully chp can get that cleared out. take a look at this, southbound along 101 at washington street, a crash out there. and blocking the lane. and that is now causing bumper to bumper traffic to highway 116. so watch out for that. you might want to give yourself a flew extra minutes before you head out. let's go outside and take a live look. that is your berkeley drive

westbound along 80. 36-minute drive coming from highway 4. so very busy conditions as you make it towards the maze. kristen, eric? >> leyla, thanks. breaking news, san jose investigators on the scene of an early-morning car crash that resulted in the death of a man and sent the driver to the hospital. matt keller is live at the scene. matt? >> reporter: yeah, we still have an active police investigation here on foxworthy avenue. the road closed at hillsdale avenue where i'm standing now. behind me, you can see the cars involved in this accident. now i was just told by police, the 18-year-old driver of the toyota avalon will be arrested on suspicion of driving under the influence and vehicular manslaughter with gross negligence. he was taken to the hospital with relatively minor injuries. his passenger in the car was killed. here's video from when we first arrived on the scene at about 3:30 this morning. police believe the driver was speeding on pearl avenue and lost control of his car where the road changes to foxweather avenue and crashed into parked

cars. firefighters will had to tear off the roof of the car. he died at the scene. neighbors say they see a lot of cars speeding from capital expressway. >> they speed around the corners through the road, red lights. >> reporter: seeing something like this, is it surprising? >> not really. >> reporter: police say they found beer cans in the vehicle. officers also say the men were wearing uniforms and believe they were coming home from work. back out here live, foxworthy avenue will remain closed until the investigation is complete. we're also waiting for the coroner to arrive on the scene to remove the body. reporting live here in san jose, matt keller, abc 7 news. >> matt, thank you. 6:33 now. pacifica police looking for a man who tried to abduct a 10-year-old girl in broad daylight. police say the man approached the girl near beach boulevard and santa rosa avenue yesterday afternoon. he tried to grab her, but she punched him and got away. the man was last scene on santa rosa avenue. here's a sketch of what he looks

like. he's described as a white man, 30 to 40 years old, about 6 feet tall, with a stocky build and brown hair. dive teams will resume their search this morning for a man who jumped off a kayak. it happened yesterday afternoon. authorities say the 30-year-old man was kayaking with his sister when he decided to swim to shore and jumped into the water. authorities say he began having difficulty swimming and went under. dive times from the alameda county sheriff's department and alameda county fire department searched the water for three hours until it got dark. happening now, at least 500 homes have been evacuated from a wildfire burning near yosemite. it broke out yesterday afternoon in mare posa county and spread quickly, fueled by steady winds and dry grass. cal fire says 1,000 acres have already burned. evacuations are under way for the jersey dale and clarks valley areas. opening statements set in the trial of an accused bay area serial killer.

79-year-old joseph naso is charged with killing four women between 1977 and 1994. their bodies were found along rural roads in yuba, marin and contra costa counties. naso is representing himself. the trial could last until mid november. he faces the death penalty if convicted of the murders. the u.s. supreme court could decide on two major cases involving gay rights this morning. one is california's same-sex marriage ban, prop 8, that was struck down by a federal judge. if the supreme court upholds that decision, same-sex marriage could begin again in california. the other decision is on a challenge to the federal defense of marriage act. it's a federal law that defines marriage as being only between a man and a woman. it's 6:35 now. oakland police headquarters will open to the public again at 8:00 this morning, about an hour and a half from now to repair damage caused by a plumbing problem. it started with a leaking toilet on the third floor on june 4th.

water dripped down on to the other two floors, and the building was closed for clean-up. it reopened, but it had to be closed again friday to finish the repairs. new this morning, president obama in northern ireland for a meeting of world leaders at the annual g-8 summit. this is new video of mr. obama arriving in belfast this morning. just about an hour ago, he made a speech on the sustained peace in the region between catholics and protestants. he's headed to a resort for a working dinner with other leaders. he is expected to push for consensus in syria. the trip will include a meeting with russian president, vladimir putin. a just-released poll shows president obama's approval rating has fallen eight points in one month. the new cnn and orc international survey shows only 45% of americans now approve of the president's job performance, down from 53% one month ago. 54% of americans now disapprove of the president's performance, and for the first time in his

then what's happening this morning. we'll get to the numbers in a second but a recall from general motors, kind of an expanded recall, actually. on a bunch of suvs, including the chevy trail blazer, gmc envoy, 2006 and 2007 model years. and potential fires associated with the driver's door module and the fact that the fire can happen when the car isn't running. initially, the recall was just for vehicles in 20 so-called snow belt states and the district of columbia. but now a gm and ntsa, california owners, those in nonsnow belt states as well warning owners not to park the suvs inside until they're fixed. bank of america facing new accusations. homeowners are suing, claiming the bank gave employees bonuses that would prevent the homeowners were getting government-backed modifications, refinancing, by switching their home into for closure, instead. the bank denies this. they say they have held more loans under the h.a.m.p.

san francisco. 56 in palo alto. a5 in concord. as we head into the north bay, 53 degrees in napa. and right now as we take a look at your accuweather seven-day forecast, the roller coaster of temperatures, 80 degrees for today is your high inland. as we take a look at that temperature starting to dip down again tomorrow, but back up again, you're going to be in the low to mid 70s through the end of the week. first day of summer is on friday. so that is definitely something to look forward to. but 90 to 92 degrees over saturday and sunday. and this is going to be inland, of course, lower 60's along the coast. as we take a look at your traffic, stuff going on out here. we do have this car fire, a crash at petaluma boulevard blocking one lane, bumper to bumper traffic. we hear there is at least more than 90-minute delay as you come up to highway 116. you want to give yourself plenty of extra time. get out the door. as we head over to your drive

having problems selling seats to pay for its memorial stadium renovation. the school is nearly half a billion dollars in debt. uc officials countsed on selling the premium seats, 3,000, at a price of 40 to $250,000 each. but only about 18,000 seats have been sold so far. number five, a few minutes from now, the supreme court could decide on two major cases involving gay rights this morning. one is california's same-sex marriage ban, prop 8, struck down by a federal judge. the other is a challenge to the federal defense of marriage act, which prevents married gay couples from receiving federal benefits. and number 6, our day planner for the next 12 hours, a cool start to this morning. we are going to be seeing temperatures warming up just a little bit into the mid 70s inland, 60s bethe bay, and mid 50s along the coast. mostly sunny by the afternoon, and then those clouds will start rolling in, once again. and let's take a look now at our traffic, number seven. that's the bay bridge toll
