an out-of-control driver smashes into a row of parked cars resulting in the death of passenger. this is the scene in san jose. now, the 18-year-old is under arrest, suspected of driving under the influence. i'm cheryl jennings. >> i'm kristen sze. >> matt is live at the scene. what was he doing right before the accident. >> yes, we do. behind me is one of the parked cars that was damaged in this accident this morning. on the ground you can see some police markings

showing how another car went out of control crashing into several parked cars. here is video when we first arrived on the scene. you can tee see the damage done by the toyota. the driver was speeding and drunk when he lost control and hit the parked cars. his 40-year-old passenger was strapped inside. firefighters ripped off the roof but he died at the scene. they were wearing from the uniforms and appeared to be coming home from work. they were shocked to see the damage. >> how one small car can do that. >> i was hoping nobody had gotten really hurt. it's really sad. >> investigators found beer cans inside the toyota. an 18-year-old was the driver and taken to the hospital with relatively minor injuries. he was arrested on suspicion of indictment

with grots negligence. they expect to release the identity of the 40-year-old victim later today. thank you. we have breaking news out of new jersey where f.b.i. agents are going to meet an incoming flight after a passenger claimed he had poisoned poisoned everyone aboard. i just touched down in newark. if not the f.b.i., law enforcement officials have boarded the plane. a passenger aboard the flight that originally came from hong kong said he poisoned everyone on the plane. he had to be restrained by the other passengers. there is no evidence that the passengers were poisoned, but officials believe the man may be emotionally disturbed. the victim of a gang rape testified today about what happened to her when she was 16 years old.

amy hollyfield joins us outside the contra costa courthouse in martinez. this is case where the girl was assaulted for nearly two and a half hours. >> she described her injuries in court saying when she woke up in the hospital she was in excruciating pain. she is known as jane doe, the court and abc7 decided not to identify her. she is 5'3" and 103 pounds and three years ago when she was attacked she was smaller. she was about five feet tall then. she doesn't much remembering about the attack. she remember being kicked in the stomach. she described her injuries, swollen face and stabbing pain in her private area. she testified, quote, i felt a burning feeling in my back and i was told that is where they put the cigarettes out. i still have scars to this

day. she remembers his face as introduced in the group after she left the homecoming dance. he she doesn't recognize the second man. each face life in prison if convicted. two men have been convicted in this attack, two other men are awaiting trial. as many 20 men participated in the rape and the attack. victim has finished her testimony. defense attorney asked her just a few questions and then she was dismissed. when she started to testify at 9:45 this morning right before she took a very deep breath and slowly let it out before answering questions about that night. amy hollyfield, "abc 7 news." thank you. happening now, opening statements are underway in marin county in the trial of an accused bay area serial killer.

joseph mesa was charged with killing four women between 1977 and 1994. their bodies were found along rural roads in different counties. mesa is representing himself and faces the death penalty if convicted. the trial could last until mid-november. happening right now, these are live pictures, morgan hill police have a suspect -- okay, i'm sorry. these pictures are out of newark. >> newark where the plane and passenger threatened he poisoned everybody and landed there. you see the f.b.i. there right now putting him inside that vehicle. it looks to be an emergency ambulance vehicle and authorities are still searching the plane. f.b.i. says there is no evidence that people have been poisoned and as economy check out this plane and this is flight 116 having touched down. the plane originating from on hong kong and they will

be talking to a lot of people. the passenger to made the threat may be emotionally unstable. back here at home. morgan hill police have a person in custody after discovering a naked body of a woman. he was charged with one count of murder and one count of domestic violence. he was in a romantic relationship with the victim. they lived together on monterey road. >> pacifica police need your help trying to abduct a 10-year-old girl. he tried to grab but punched him and got away. man was last seen running away on sanity rose avenue. here is a police sketch. white man, 30-40 years old. about fiex six feet with stocky build and wearing a

red checkered shirt and blue jeans. >> walnut police are investigating after a man was attacked inside his home overnight. it happened on jones road. the man was taken to the hospital. he is expected to be okay. the attack does not appear to be random. they are trying to find who attacked this man. happening now alameda team is searching in livermore. 30-year-old man disappeared while kayaking with his sister. he decided to swim to shoe shore and had difficulty and went under. fire department searched the water for more than three hours yesterday. >> happening now, at least 150 homes have been evacuated from a wildfire burning near yosemite. it broke out yesterday afternoon. it spread quickly fueled by steady winds and dry grass. thousand acres have already burned.

authorities have declared part of the burned out area as a crime scene. two people were killed and 500 homes were lost in the blaze. they try to put out all the hot spots. they are hoping to have it fully under control by thursday. >> f.b.i. agents are digging up another field of michigan to find the remains of jim you any hoffa. they executed a search warrant north of detroit. dig is based on information by former mobster. he told a new york tv station that he was buried here in a shallow grave. he was last scene seen in 1975 outside a detroit area restaurant. his disappearance has baffled authorities for decades. >> pretrial hearing for

novato. 77 in calistoga. 74 in sonoma. berkeley will be the high and 64 in oakland. we'll start to see the upper 60s turn to 70s. 77 degrees in walnut creek. 80 in brentwood. as we take a look right now at our forecast, giants taking on the padres at 7:15. first pitch, you will be needing a sweater, 62 degrees will be the starting temperature. 57 will follow. seven-day forecast. we are going to be seeing a little bit of rollercoaster in temperatures. things will cool down and start to jump up a little bit breezy. then we head into thursday and friday, then we'll see temperatures raising a couple of degrees but inland we'll see temperatures in the upper 80s. and look at friday and seriously, sunday, inland temperatures will reach up
