will last until 6:00 a.m. let's go outside and see what is happening in walnut creek. clear drive to 24. reforms enacted to improve bart police procedures and passenger security will go under the microscope. bart's police chief is making a big announcement this morning. amy hollyfield is live at the bay fair station in san leandro. >> the chief wants a report card. he wants to know how bart police are doing. he wants to know if bart police are engaging with passengers and how they are doing on issues like the use of force, biased policing and training. they commissioned and audit back in 2009 after an officer shot and killed passenger oscar grant who was not armed. findings showed 300 pages. bart police had bad relations with passengers. had outdated policies and a

lack of discipline. we asked passengers this morning if things have changed in the past four years. >> it's a lot better safety wise. they are watching out for a lot of things. we get along better. >> the last audit was done by noble and bart chief is bringing back the lead auditor named patrick oliver and they will hold a press conference to announce that police will be putting it under the microscope. amy hollyfield, "abc 7 news." >> eric: two teens are under arrest this morning after police say they carjacked a man and his daughter at gun pointed in san leandro. our media partner reports that it happened at castro street and san leandro boulevard when the duo ordered the man and his young daughter out of their

parked car. teen sped away and led officers on a chase that ended with a crash on the gulf links road only ramp where the teens were taken into custody. >> kristen: in contra costa county they have filed new charges against the richmond high school football coach after third sexual assault victim came forward. they report 51-year-old baron edwards now faces 39 felony charges after amended charges were filed. they say he molested a third girl in the early 2000. he had already been charged with molesting two other girls in the 80s and 90s. he did not enter a plea in court yesterday. the judge raised his bail and is due back in court on july 2nd. >> new details about the nsa surveillance program from president obama. speaking in germany he says the program has saved lives

in the u.s. and overseas. katie marzullo is live. >> reporter: president obama just wrapped up the news conference in which he was asked about the national security agency's data collection program. he reiterated what we just learned that a rare open hearing in the house that the programs have derailed some 50 terror plots worldwide. public support for the program appears to be up. new poll out this morning, it finds 58% of americans are okay with the government looking at phone and internet meta data. yesterday that number was 48%. president obama has consistently defended the program. >> this is not a situation where we simply go into the internet and start searching anywhere we want. this is a narrow system directed at us being able to protect our people.

>> reporter: things are happening in the bay area that could change the debate. google based in mountain view wants to tell it's users more about the data. it has turned over to the nsa. company has filed a motion asking the foreign intelligence surveillance court to lift a gag order. they claim the secrecy is hurting its business. in last few days, yahoo and apple made public the number of requests for information they get from law enforcement. but those numbers include from requests from local police about local crimes. google wants to get specific about their requests. >> kristen: san jose is suing major league baseball accusing the league of a conspiracy to keep the a's from moving. they hope the lawsuit just filed against major league baseball and commissioner bud selig will speed up the

process to bring the a's to the south bay. at issue the territorial restrictions that giants have. matt keller will have a live report in the next half-hour with much more. >> eric: the san francisco da is expected to now a plea agreement with two landlords charged with multiple felonies after they tried to evict a tenant several years ago. they why nicknamed if the landlords from hell. they had ordered workers to cut the floor supports where the tenant successfully fought eviction. in another suit they poured ammonia on a couple's belongings. they fought extradition and they returned to san francisco and entered guilty pleas. >> firefighters are still battling a grass fire. this happened at suisan

valley road. the flames quickly spread to the roof of a motel 6 and row of palm trees outside a motel. firefighters say everyone was evacuated before all the rooms were damaged. it got close to a gas station with 30,000 gallons underneath. >> another stubborn grass fire is out in the north bay. it devoured trees and dry brush in remote part of benicia. the fire burned 124 acres before firefighters contained it. no structures were ever threatened and no evacuations were ever ordered. the cause is still under investigation. >> eric: dry conditions continue to fuel the fire at mariposa county at yosemite but extra manpower has helped it. there are 2500 firefighters containing it. it started in sunday in an

unattended campfire. it's 40% contained and less than 1900 acres. 800 homes have been evacuated. >> kristen:, you have a forecast, we have a several cool days. >> and winds are calming down as well. we do have a low lying clouds and some coastal fog. that is going to last through this early afternoon. we take a look at live doppler picking up a little bit of that. get you out the door, by 7:00 a.m., patchy clouds and 56 around the bay and 48 along the coast. by noon it will be warm up, 70 degrees inland and about 10 degrees warmer around the bay and 58 degrees around the coast. as clouds burn off we are going to be seeing gusts up 10-15 miles an hour. right now pretty windy at sfo, 21 miles an hour.

7:00 p.m. temperatures will be dimming down to 17 degrees. it will warm up tomorrow. here is a look towards the city. this is from mount tam. you can see the sloe sun is is slowly waking up and cooler temperatures giving way to sunshine. that will be the story for the rest of the week thursday into saturday. now let's look at traffic. on the roads it is busy this morning. we do have a couple things going on. novato right now along northbound 101, a sig alert. this is all due to power lines that fell over onto roadway. construction crews are trying to get things back out of the roadway so people can get on their way. northbound 880, hyde street, a stalled car, one lane blocked. we'll see slower traffic out there. and san jose, a little dark picture, 280 coming from

self-driving cars like the one google is directing. they have been telling the dmv what rules of road they would like to see. a hearing got underway in sacramento today. tech companies are worried about overregulation while consumer groups worry about safety. by law dmv have to have the regulations in place by the end of 2014. >> san francisco board of spergs has approved legislation to make better guidelines for food trucks. the measure says food trucks must be 75 feet away from existing restaurants. new guidelines allow trucks park closer to school and operated on college campuses. he says the legislation is the result of two years of negotiations between the food truck industry, restaurants and others. >> eric: feathered friends have made their way back to a bay area hotel. this is a picture of the barn owl family, they are staying at the san

league baseball to let them move to silicon valley. matt keller is live in san jose with the potential of a new ballpark. >> reporter: i'm standing where the proposed ballpark would be built. to give you an idea where it would be built, this is the caltrain station here in san jose, one of the main stations here in the south bay. then just a few blocks away is the shark tank. we heard from politicians on this. what do the oakland a's players think about a possible move. a.j. griffin told the san francisco chronicle, i like the coliseum and atmosphere there but in terms of function, i'm sure everyone would agree it is not worked well. oakland coliseum is most aesthetic place to play but the fans are the best. they have been supporting the team since 1968. baseball fans in oakland and san jose both think their city is best for the team.

this morning and hills borrow and burlingame this afternoon. they have started pedestrian safety seminars alerting people to watch out for drivers that don't yield the right of way. >> eric: they are searching for a missing man considered at risk. he was last seen near san francisco city college yesterday morning. he has a mental capacity of a ten-year-old and had unable to read or write. he is also diabetic and doesn't have his medication with him. he is 5'10" and weighs 165 pounds, he is missing a front tooth. if you see him, police urge you to call 911. >> the reward now stands at $30,000 to help find a killer of an emeryville man shot to death after a traffic accident. 22-year-old man was gunned downed after a fender-bender on a north oakland street last wednesday night. he would have turned 23 the next day. family and friends increased the reward in an effort to find the killer.
