>> live from the kgo-tv broadcast center this is abc7 news. >> action on this wednesday awaiting the supreme court decision on same-sex marriage cases. thank you for joining us. and now a look at weather forecast as the weather changes. good morning, we are in a changing pattern. here is a look while you are sleeping, the last six hours of live doppler 7 hd notice no real radar return and that doesn't mean it is completely dry but there is lingering moisture in the form of fog in the north bay valley and the coast and mist and drizzle around for the morning commute. this is how it looks from mount tamalpais at 2,600' up. the clouds are broken.

we will get sunshine in the afternoon even at the coast where it is 62 to 65 with 70 to 82 around bay and low-to-mid 80's inland. afternoon sunshine and muggy. it will be that way. leyla gulen? >> i was showing at the altamont pass there is a little bit of yellow. if you are headed through antioch to concord that is only 15 minutes. we have construction eastbound 580. we have this project that will last until 6:00 a.m. this morning. now at look at what is happening in walnut creek headed from highway four an eight-minute delay to the junction with 24. we are already seeing a few extra tail lights. it is a dry ride. >> we are just two hours away from a supreme court decision that began with a case in

california but will reverberate around the country. gay pride was represented last night ahead of this ruling. we have coverage starting with abc7 news reporter cornell bernard at city hall. cornell? >> good morning. the waiting is almost over. the countdown is on. soon we will know the fate of proposition 8. the supreme court rule expected to endown at 7:00 a.m. our time and many already are on the way to city hall to wait for the news. this is where the battle for marriage equality began nine years ago. emotions are high and same-sex couples are hopeful that the voter imposed ban will be struck down. a major player, former mayor and current lieutenant governor first issued marriage licenses to same-sex couples back in 2004

expecting an outcome which will allow marriages to resume in california. >> i think california will begin the process of marriage licenses in the worse case, 30 days and the best case, they can let the state immediately provision marriage applications. >> the supreme court has several options, uphold proposition 8 or strike it down or invalidate it. whatever happens, it will be pivotal and it will be historic. if it is struck down i am told by the city attorney weddings will likely happen in 25 days. right now, clerks in san francisco and all across state of california are devising plans to make that happen if the supreme court allows it. we are in san francisco this morning for abc7 news. >> proposition eight supporters say they are on pins and needles

of the supreme court decision and are expecting the unexpected. >> in the event proposition 8 is struck down which we certainly hope it will not be, our mission will turn to ensuring rights of con conscious for individuals who object gay marriage will be respected and gay rights will not dismiss free speech and free democrat of religion. >> the pacific justice institute has been defending traditional marriage if 15 years and say it should not be considered by the courtness a way that radically re-enters the constitution. >> the battle over same-sex marriage began in san francisco in february of 2004 when the mayor directed the city clerk to issue marriage licenses to same-sex couples in vie police of state law. seven months later the supreme court annulled the marriages ruling they conflicted with state law at the time. >> in november of 2008 proposition 8 went before the

voters. a yes vote uphold the state law defining marriage as between a man and a woman and a in vote would have cleared the way for same-sex marriage but it passed with 52 percent in favor and 47 percent against. lawsuit began immediately and it was overturned in federal court. the case made it to the supreme court in march when the justices heard two days of arguments, the first on proposition 8 and the second on the fell -- federal defense of marriage act. >> gay rights groups are planning rallies including one tonight at 6:30 in castro district in san francisco where people are expected to gather. they will wait with anticipation for the court's decision when it is happened down in two hours. then, of course, the rally tonight. abc7 news reporter katie marzullo will have more from the castro in the next half hour.

>> same-sex marriage supports will also gather at other locations including in oakland with a celebration planned for 5:30 at 19th and telegraph. in san jose at city hall at 6:00 and in concord, a champagne celebration is held at the rainbow community center at 6:30. other events are planned for mountain view, redwood city, santa cruz, vallejo, and fairfield. >> outside the united states supreme court in washington, dc, you can see people lined up in anticipation of the ruling that the justices will issue their decision on the challenge to the federal defense of marriage act which defines marriage as only between a man and a woman and denies federal benefits to same-sex marriage couples and president clinton signed that if law in 1996 and in 20112012 the obama administration abandoned the defense of that act in court. >> we will have coverage on the air and online as the supreme court rulings are announced with

extended coverage starting at 7:00 a.m. look for breaking news on twit we, facebook, and download our new app so you can get an instant alert. >> another job story on abc7 news bart riders are nervously waiting to find out if the union members have voted to authorize a strike. kira klapper has the latest. >> kristen, at 9:00 this morning the two unions representing bart workers will announce the results of the strike authorization vote. it happened yesterday. thousands of employees came out to voice their opinion on whether or not their union leaders should call a strike. this is after both sides failed to reach an agreement in negotiation over pay and benefit. their contract expires this sunday june 30. bart and the employees are far apart on wages, pentagon, and medical gives. bart employees want bart to

negotiate on safety and security issues. both sides agree that a strike would not be good for anyone. >> the vote today is to give authorization for an agreement. our members do not want to go on strike. >> we are looking at contingency land and looking at keeping the trains running with negotiation. we feel there is a deal to be had. >> if a strike is called it does not mean a strike is inevitable and the union leadership could call a strike if the district and the public is given notice but keep talking and avoid a strike if resolution is reached in time. the bart contract expires on sunday and workers could strike by monday but, again, we final out at 9:00 this morning whether workers even authorize a strike at all.

>> 5:08. a man and a 14-year-old boy are in custody this morning in connection with a murder at a san francisco bus stop. the 19-year-old and a 17-year-old girl were shot in a muni stop on monday. the boy died and the gill lived. two were arrested including a juvenile. they are trying to figure out if anyone else was involved. >> city officials are demanding the release of key documents and e-mails of the public utility commission on the decisionmaking process to propose penalties against pg&e for the 2010 pipeline explosion disaster. top attorneys refused to endorse a recommendation by the head of the commission's safety division they pay more than $2 billion in repairs and improvements to the natural gas system and not pay a fine for the explosion. officials say if they do not get the documents by friday the city

>> covering santa rosa, berkeley, san jose and all the bay area. >> on wednesday morning, a landlord in san francisco is facing charges involving claims he has been terrorizing the renters, a story only on abc7 news. a tenant recorded the incident that led to the arrest of the landlord on monday. he is accused of breaking into a unit. police arrested the landlord after a struggle that left an officer with an injured knee and a video of what appears to be him attacking a renter. >> get out of my face. >> you struck me.

that is a felony. >> he made life so miserable if people that are struggling to work and pay their rent on time with no peace, no tranquility in their home. >> what is going on? >> three former tenants are suing. miss have received a number of complaints about landlord. he has been accused of failing to provide tenants with heat and water and refused our request for an interview. >> the next it is legislature special session inned in -- ended in chaos and confusion over the vote on a tough abortion restriction bill this morning. >> if i can have order. order. order. >> they beat the midnight deadline but the signing did not as hundreds of cheering protesters stopped the passage of the toughest abortion measure in the country. the chaos prevented him from formally signing the measure before a midnight deadline

warm to hot days around the bay and inland on thursday through at least tuesday, one of our longest stretches of hot weather this year. it will be mild at the coast. the cloud cover is thickest in the north bay and along the coast. by noon we are seeing the cloud cover removed and the coast will be stuck in the 60's, 70's, and 80's with warmer temperatures today than yesterday. region by region, we have low-to-mid 80's through the south bay and 81 in santa clara and cooler in milpitas and around 81 in los altos and dropping to 79 in menlo park and palo alto. the coast shows sunshine and lack of a real stiff breeze and low-to-mid 60's with low 70's around downtown south san francisco and sausalito and ten degree jump if sausalito to san rafael and 72 to 82 and we stay in the low 80's throughout the

north bay valley. along the east bay shore, a spread from 75 in berkeley to 81 in castro valley and fremont and the mid-80's in the east bay valley. headed to the game the sun will be strong from sunny to mostly sunny and 73 at 12:35 to 77 at the end of the game. the temperatures jump tomorrow and they hover in the 90's inland to near 100 by monday and 80's around the bay to 90's on sunday and monday. the coast is still stuck and the heat wave will pass you by. >> the talk of skin looking younger i thought you were making another compliment to yourself! >> what? >> where did that come from? >> just a little playful. good morning, everyone, you look fabulous, all right, just deal with it. good morning, everyone, we have

the bay is 70 to 82 and let to mid-60's at the coast. leyla gulen? >> good morning, mike, we have a couple of rock slides in marin county. along highway one we have a report of rocks that fell on the roadway that is embedding traffic. we will keep our eye on this. be careful if you on highway 101 coming from sausalito and toward the golden gate bridge. speaking of bridges, the toll plaza shows how it is out there, and traffic is building especially for the cash-paying lanes and you can see the clouds in the distance and the traffic is moving smoothly as you make it from oakland to san francisco. >> today is decision day in 1 1/2 hours california will know if same-sex couples can marry in this state with possible ramifications across the country. the supreme court will issue the

ruling on prop 8 and the federal defense of marriage act. abc7 news reporter cornell bernard is at city hall where it began nine years ago. >> it has been a long wait but the wait is almost over. the countdown is on. we will know the fate of proposition 8. that supreme court ruling expected to be handed down 7:00 a.m. our time. many will gather here at city hall where the battle for marriage equality me began nine years ago. emotions are running high and lots of same-sex couples of hopeful that the ban on gay marriage will be struck down. a major player is former mayor and current lieutenant governor. he first issued marriage licenses to same-sex couples in 2004 and is expecting an outcome that allows marriages to resume in california. >> it is an exciting moment in time if those that matter the motor: the people this have not been afforded the ability to say

and where demonstrations will be held after the ruling. abc7 news reporter katie marzullo continues our coverage in the castro. katie? >> i am the the corner of market and castro and the san francisco police department have the barricades stacked up on the sidewalk in place in anticipation and preparation of the rally which is scheduled if 6:30. if the court upholds proposition 8, the rally could turn into a rally pride. right now, they are still hoping it will be a victory celebration. >> it puts our relationship on an equal place to any other relationship. >> having the vote in the california of the people in the referendum is sacred. that is going to have a problem if our proposition process in california. >> that was catholics for the

common good, the other side of the argument that the ban on same-sex marriage was the will of the voters. now we are just a few hours away from a division and sell hours away from a rally. you can see poster, hanging in the windows of businesses here in the castro district. the rally is planned for 6:30 but they did not necessity which day until yesterday and now we know the decision is. coming down today. the rally is at 6:30 so the police department is closing down castro street at 5:30. >> the justices will issue their decision on the federal defense of marriage act which bars gays and lesbians and married couples from receiving same federal benefits as opposite sex couples. a group of republicans took over defense of the law in court after the obama administration refused to do so. the supporters plan several several rallies in addition to the one in the castro.

last night and the union contracts with bart will expire on sunday and union leaders say they will give the public 72 hours to prepare if they decide to call a strike. the transit information website has a page lifting the options in case of a bart strike and we will let you me if and when a strike is called. follow us on twitter and kira klapper will have more on the strike threat coming up in half an hour. >> adding to bay area commuter worries, a contract with unions expires on sunday, the bus drivers have authorized a potential strike so they may not be able to absorb the riders stranded by bart. a spokesman is hopeful a new contract be negotiated in time to prevent a strike. the two sides are working with the state mediator. >> developing news the los angeles police department is heightening security at the stations after two separate

ambushes of officers. police are still searching for the two shooters. this is pictures of the scene of the most recent shooting in south los angeles with officers still there on the scene and there is an armored vehicle with forks on the front. police are in a stand off with the gunman who opened fire on officers doing a parole probation search. one officer was shot in the neck and safe and admitted for surgery and in critical condition. a parole officer was also hit in the leg. we don't know if they are planning on going into the house with the armored vehicle. we will let you know. police do not believe the shooting is related to a shoot yesterday afternoon when a gunman oned fire on two officers returning to the station after an undercoverration. both suffered minor injuries. in the south bay, officials are adding four more park rangers to patrol creeks hoping to curb homeless encampments.

the santa clara valley water district approved giving the city of san jose $175,000 last night to pay for two park rangers following the newty budget that will provide funding for two additional park rangers and a total of four. officials hope the presence will discourage homeless people if returning to encampment sites after being cleared. a bay area family is suing the maker of monster energy drink claiming their son died after drinking two cans a day if three years. 19-year-old suffered a fatal cardiac arrest in july of 2012 and the lawsuit accusing monster of negligence saying the company should warn customers the drinks are dangerous to young people. there is in response from monster. >> the thermometer is rising and the humidity, too. >> here is why the humidity is there: record rain from

at the coast. low-to-mid 70's if the bay. mid-70's to low 80's at 4:00. enjoy the evening hours. we will be back in the 70's. leyla gulen will tell you about the commute. >> good morning, everyone, we have traffic backing up headed over the altamont pass. 21 miles per hour is the top speed leaving tracy to livermore with speeds picking up and 42-minute ride headed away from tracy to dublin. to highway 4 this is your drive through antioch to pittsburg and concord and 11 miles per hour is the top speed. the 22-minute commute between antioch and headed into concord. we will check out what is happening with the san rafael commute in the southbound direction, your headlights are looking at lucas valley and traffic is running smoothly and we do not see fog.

>> covering fremont, palo alto, north bay, and all the bay area, this is abc7 news. >> the antioch city council has voted to hold a special election in november after declaring a fiscal emergency. our media partner reports that voters will be asked to consider half cent sales tax that could bring in an extra $4.7 million. a survey found 68 percent support the hike that will cost antioch $204,000 to put the measure on ballot. >> three new private streets in palo alto are named in the memory of city police officers killed in the line of duty. the new streets are add a new

development at the site of coal -- cole court, and jean court is after an officer killed in a shooting. there is a clifton court which is his last name so they using his first name. and another after a reserve officer shot and killed in 1994. >> warning signs are posted this morning in a popular pacifica beach after a kayaker had a close encounter. he was firsting yesterday when the shark bit his kayak. the police and the kayaker believe it was a juvenile great white and the kayaker was not hurt but he had to hold on to the boat for ten terrifying seconds. it was like the discovery channel with the eyes in the back of the head and the teeth
