steps of city hall waiting for that ruling. this is where the battle for marriage equality began nine years ago. the same-sex couples are hopeful the proposition 8, the voter imposed ban will be struck down. the high court could uphold it or invalidate it by referring to a lower court rule ruling that declared it unconstitutional. the city attorney has been involved from the start. >> the argument was clear there were not five votes in the chamber to uphold proposition 8. i feel confident we will see age equality returned to california. >> city hall was decked out in rainbow colors last night anticipating a court victory. it could be struck down, and

weddings could begin possibly in 25 days, partly giving county clerks across the state time to get ready to start suggesting marriage listens to same-sex couples. 7:00 a.m. is the time the ruling is expected and many are gathering at city hall waiting for the ruling. regardless of how the court decides groups are planning rallies and will hold one in san francisco's castro district tonight at 6:30. this is rainbow flag flying in castro and people will be waiting with anticipate if the court decision when happened down in less than an hour from now and the rally, tonight, at abc7 news reports in the next half hour. >> in addition to the rally, supporters will gather at other locations tonight. in oakland a celebration is

>> bart riders are waiting to find out if bart union members have voted to authorize a strike. kira klapper is here with more. >> bart employees voted yesterday whether to authorize a strike and we find out at 9:00 a.m. if they did. it doesn't mean they are newsily going do have one. that is something important to know. this comes after both sides, bart and the employees, failed to reach an agreement in pay and benefits. their contract expires this sunday june 30th. the workers have not had a pay increase if four years and they want 23 percent over the next four years. bart is offering 4 percent. they have until sunday midnight to reach an agreement on that and other hot topics of medical and pension benefits. the last bart strike was 1997 when riders i spoke with remember the commuting

nightmare. >> last time i took the ferry. maybe i will have a chance to work from home. that means more people on the road, more people on ferry and the ferry does not start as early as i do. >> more people on the road and more people on the ferry with 400,000 daily passengers would would have to fine another means of transportation. if a strike is authorized it does not mean there will be a strike. union leadership could call a strike and give the district and the public notice but keep talking and avoid a strike if a resolution is made in time. they have until midnight on sunday. a union representing transit workers is reminding commuters that the east bay bus drivers have authorized a potential strike and is concerned of reports that a.c. transit could

>> breaking news in massachusetts, new england patriots hernandez has been arrested. the star player was led from his home if handcuffs and put in a police cruisers in the last 30 minutes and an arrest war ran was issued for the 23-year-old in connection with a shooting death of a friend. sources tell abc7 news that a warrant for obstruction of justice charm was drawn after police discovered the security system at his home and cell phone were both destroyed. the district attorney has not released what charges hernandez is facing. >> a stat bill in texas that would have resulted in ovary abortion -- every abortion clinic being shut down but not before there was chaos and confusion in the special session of congress. >> order. we need order. >> the vote beat a midnight deadline but it had to be signed soon after but it wasn't.

and you will have the warmest temperatures at night. we are looking at the cloud cover this morning and notice by noon we are seeing a lot of this evaporate. afternoon, the coast will see sunshine developing in your neighborhood and it will be in the 60's to 80's inland. low-to-mid 80's in the south bay and cupertino at 82. a lot of upper 70's to near 80 on the peninsula and to the north milbrae is 72. at the coast, there a light breeze and low to my 70's downtown and south san francisco and sausalito and low-to-mid 80's through the north bay valley and you jump ten degrees to the north. at the beaches, with the sunshine and breeze it is 20 degrees cooler. berkeley is the cool spot at 75 and the warm spot is america close at 83 and richmond will join you at around 80. the warmest weather is in the mid-80's in the east bay valley.

today we have a day game raising money for juvenile diabetes with very high u.v. index so dress for the warmth. the heat wave starts tomorrow and lasts through tuesday. temperatures could spike in triple digits monday inland and low 90's around the bay on sunday and monday and we will hit near 70 at the coast saturday and sunday but mostly 60's is where the free air conditioning is. >> busy with our commute with a brand new crash with a stall on the eastbound side of 24 to the tunnel and possibly there are two accidents but possibly it is one involving tour vehicles so we will have more details on that in just a little bit. we are starting to see a delay in the eastbound direction.

recent shooting in south los angeles. there is a stand off with a gunman who opened fire on officers doing a parole probation search. one officer was shot in the mechanic and face and admitted for surgery in critical condition. a parole officer was hit in the leg. it is not believed related to a shooting yesterday morning when a gunman opened on two officers after an undercover operation. >> a landlord in san francisco and facing charges for terrorizing his renters. a tenant recorded the incident that led to the man's arrest on monday. he is accused of breaking into a unit. police arrested him after a struggle which left an officer with an injured knee. there is video of what appears to be him attacking a renter.

california and maybe across the country. good morning, thanks for joining us. >> things will get heated in washington, dc, but, also, it will be heated, literally, in the bay area. >> it will be like...human. >> yes, it will be humid. it is muggy. the last six hours live doppler 7 hd was working and not picking up organized areas of wet weather but the wind hasn't change direction we still have a moist southern flow and that is why it is so misty and foggy and cloudy and mild. look at temperatures, the day planner will start at 7:00, and 66 degrees, and dry by noon and notice the clouds are opening at 71 and 76 at 4:00 and mild and sunny 69 at 7:00. the day planner the next 12 hours inland, clouds and fog and bright are by noon and mid-70's and low 80's but a touch muggy so we may have heat index today.

unconstitutional. many couples are optimistic that things will go their way. >> we are anxious. optimistic. we have been together six years and now we have a chance of when we want to get married and where we want to get married and not having to rush. it is an incredible opportunity. the city attorney believes if prop 8 is struck down weddings could begin in 25 days. anticipation, of course, is building, and, in fact, the doors have opened early at city hall and we were told at 7:00 a.m. but they have opened at 6:30 so many people can gather to wait for word. there is intense media attention on the story, that would be an understatement. there is international media here from all over the world and your best coverage will be right here on abc7 news.

when the ruling comes down you will be the first to know. >> we have coverage from city hall to the castro district. >> i am the corner of castro and market. today is decision day and the rally is tonight at 6:30 and i ran into an organizer, headed over to city hall. if the supreme court rules in favor of same-sex marriage, there will be a big rally and celebration in castro. if the court does not rule in favor of same-sex marriage, they will march to city hall and protester. i talked to a gay couple that says they can feel the excitement building in the was tremendous -- in the castro. >> it feels exciting. the energy is building.

the court based on oral arguments. >> if prop 8 opponents win either on the constitutionality matter or the standing issue, no doubt the support of the prop 8 will come back. what are the options at that point? >> guest: that is why the rationale matters. if the court says this is a a technicality the people who still want to support the bans can keep trying, keep passing the bans and defending them in court. if instead the court rules these kind of bans are themselves institutional, this is really no other recourse like there was not with interracial marriage. >> on the big cases you have the four conservative and four liberal members and justice kennedy in the middle? >> guest: what will justice kennedy do is the question of the morning.

everyone expects him to be the swing vote. he has been author of the two most important gay rights victories from the united states supreme court but he often is conservative on family law matters. will he go with the gay rights streak or the conservative family law streak? we will know soon. >> many same sex couples in california could wonder if this is a way the court could rule if their favor but only affecting the two couples wore the plaintiffs in this suit? >> it is possible. the court could say only those two particular couples are affected but the way the cases lay out is in the court makes a ruling with a rationale that goes to the merits of the case, that would by implication apply to other couples, as well, and you are right, we could have something as narrow as a ruling only applying to two couples or as broad as applying to the whole nation. >> it is rare we get these

culturally significant rulings from the court. what are you going to do for class? >> guest: this is a wonderful teaching moment for society of how the constitution works. the constitution obviously is designed to keep the government in check. the supreme court this week in the affirmative action and voting rights and now same-sex marriage, the court has been tough on the government, really requiring the government to justify what they do to groups of people. we will see if the court does the same thing in same-sex marriage as it did in affirmative action where the court said to the government, you have do show us why you are doing this and show us how what you are doing is going to achieve your goals. >> the supreme court is not supposed to be swayed by public opinion but since prop 8 passed public opinion has changed so much and most americans now movie same-sex marriage is inevitable. >> guest: that gives comfort to couples in coal who believe they
