district where the ruling is being hailed as historic. happening now, supporters are celebrating the high court's ruling. the streets have now been blocked off to accommodate a rally there scheduled to get underway in just half an hour. we'll take you there live in just a moment. first let's go to oakland. a celebration is happening there as well. >> the party started around 5:00. you can see that the music and celebration continues. supporters are celebrating the street party in response to a decision handed down on prop 8 and doma. not only acknowledging this as a victory but say there is more work owe to do until there is marriage equality.

this is part of a national movement and organizers say they're not sure what will happen in the state senate bans may marriage but wants everyone to recognize the victory, come out, celebrate your brothers and sister who's fought for equality n oakland abc 7 news. >> now, abc 7 news reporter david louie in san jose just getting underway there. david? >> that is right. san jose zrnt a large visible community such as castro district but tonight does have the plaza. you can see a growing crowd gathered to celebrate the decision, they're estimating about 300 to 400 people here. the president of the -- board of supervisors is here and as well as some city council members. this is being sponsored by a political action group called

bay mac as well as other, smaller organizations. santa clara county announced it's ready to resume once getting the go go head straight attorney general. >> back to sky 7 in san francisco. this is the big celebration getting underway in about half an hour at 6:30. sell braigs being planned tonight for concord, mountain view, vallejo and a number of other cities but looking live now on market and castro, in san francisco, this is in many respex the center of activity in the gay community and led the fight for marriage equality. they've closed off streets in anticipation of thousands of people to celebrate the ruling. >> same-sex marriage started

county clerk to issue marriage licenses to gays and lesbian autos reaction in 2004, 2006 was difficult. and politicians ran away. from the issues and then, all of a sudden, things started to shift and in 2008, 2009. politicians came back on to the floor. it's been an extraordinary process. >> newsom predicts clouds for the initiative process since u.s. supreme court justices decided prop 8 backers had no legal right to fight for the voter approved ban after state officials refused to. >> you had a governor and attorney general that didn't support it and refused to defend litigation. >> but this family of four is celebrating. >> what does it mean to your children? >> pretty cool, right? >> now, the wedding chapel

a follow up to a story with you brought you yesterday. san francisco district attorney's office has slapped a landlord accused of repeatedly terrorizing tenant was five criminal charges. he was arrested on monday, after police say he broke into one of the units this, is video of the incident cap fwird a neighbor. police say he was combattive during arests, injuring an officer. he faces three felonies and two misdemeanors after entering with out permission of the tenant. >> bart and owe two unions back today after union members voted overwhelmingly to authorize a strike. the contract expires sunday night and bart workers could strike monday morning. that would impact 400,000 bart riders but there is no

massachusetts charged former new england patriots tight end aaron hernandez with first degree murder, he was taken into custody at his home 40 miles southeast of boston. in court prosecutors told the judge he shot and killed otin lloyd. police say hernandez was upset with lloyd after the two had a dispute at a nightclub days before. hernandez was denied bail. >> president obama is now in senegal. air force one touched down in the capitol about two hours ago. the president was accompanied by first lady michelle obama and daughters malia and sasha. the trip is highly anticipated given his personal ties to the continent. many of his relatives still live tlchl the president spent one day in africa since taking office a quick stop in ghana

following breaking news there has been a terrible backyard pool tragedy. a family was checking out their new home. >> just awful. we're live tonight with the story. laura? >> hi, dan. we don't know the condition of the little boy who fell in the swimming pool in the back krard here. we're at a home on bush avenue. now we understand from the sheriff's department that this happened a couple hours ago. this is a family new to the neighborhood, they were planning to move into the home, i'm told, tomorrow. and they were here today to check out the house, you can see inside they're doing painting. and the like and according to

the sheriff's department this little boy fell into the backyard pool or was found in the pool. it's an inground pool apparently he was not in good condition. they called both sheriff and the fire department. and that boy was treated here and transported to kaiser vallejo for additional treatment. again, at this point we do not know his condition. but clearly a very serious and tragic situation. again, the family here just today to check out the house and anticipation of moving in tomorrow morning. just talked to a neighbor who knows the family. and he told us this buyboy is three years old. >> so devastating. thank you, laura we'll move on now. >> a's making noise and rest of the league starting to pay attention hosting the reds today in a matinee.
