i'm dan ashley. >> we're live at san francisco city hall where the wedding is about to take place. sergio? >> yes, they were waiting outside of the front doors of the county clerk's office. this announcement just issued a few minutes ago. you may remember, wednesday, the supreme court decided that the plaintiffs in proposition 8, the people defending proposition 8 did not have stand asking so, what they do is they threw out the 9thth circuit court of appeals decision, it was anticipated to take several days to lift their stay except that it took only two days. that, as mentioned is just released on about 3:00 or so. and what that means is that it reverts back to the decision judge vaughn walker made at the end of the trial. he called proposition 8

unconstitutional. and that now lift as built for county clerks to start issuing marriage licenses to same-sex couples. now, as far as the couple that's filed this lawsuit one couple is inside city hall right now, they were waiting outside of the front doors as mentioned to get their marriage license. they're going to go in, get that license, they already have a judge lined up to perform that first wedding. we talked with them yesterday after the decision on wednesday. as soon as they returned to the bay area. they said they wanted to be the first couple to be able to marry and based on what's happening now, inside city hall, that looks like it's going to be the case. i talked with them quickly. they said they wanted to have their ceremony inside city

hall, now. because of how historic the building is tying this to harvey milk being the first openly gay supervisor. there are a couple other things surrounding this decision. there is a possibility of some county clerks deciding not to issue licenses. i did ask that of attorney general harris who is also inside with sandy steer and kristin perry. she says legality the wedding bells ring and says as far as she's concerned same-sex marriage is now legal again in california. first conversation was them, we'll bring you more on that coming up throughout the rest of the day. reporting live at city hall, abc 7 news. >> thank you. and we plan to bringing you that wegd live as it happens. >> is to so stay here. >> a constitutional law expert

is on the telephone with us for insight on this ruling. quite a surprise this happened so quickly. >> i do think it's appropriate. the supreme court ruled wednesday there is no standing for appeals. and so, thus, the stay, i believe was promptly lifted. they could have taken their time and waited for normal, slow court process. but i think it's appropriate that they went ahead and said the constitutional violation should end, clearing the way for marriages of same-sex couples to resume. >> we understood there was gg to be a 25 day wait. is it unusual they lifted it?. >> i don't think so. if you look at details each court rules this is a constitutional violation. you don't normally stay the order. i think the order were stayed

chris perry and sandy steer declared spouses for life. the first same-sex couple to be allowed to marry anywhere in california on this day that the ninth circuit suddenly lifts the stay order and allows same-sex marriages to resume. that is one of their sons. this, like all weddings months and years to plan in this case fight for legally and over, very quickly. right? the clerk's office will be staying open until 8:00 so these two will be among many to get married tonight but they're the first. i'm joined now by cheryl jennings as we begin abc 7 news at 5:00. >> we learned that the other couple in los angeles other plaintiffs in this case are getting married today. so exciting news. >> just a historic day and a day we can we did not expect.
