>> good saturday morning, everyone. i'm katie marzullo. let's start with a quick first look at the weather. it's looking to be hot. >> that's right. the winds are providing a little bit of a brisk start in the higher elevations where numbers are still warm but at our reaches, half moon bay and santa cruz, low to mid-50s right now. 67 in san jose with 60 downtown so already a pretty mild start out there around the bay. we are looking at excessive heat warning right on through tuesday night. that means temperatures anywhere from 100 to 110 degrees in our inland east bay. notice upper the 0s to 106

in marin county starting at nine. under the u.s. supreme court rule the losing side in a dispute has 25 days to ask the high court to rehear the case. the ninth court waited just two days, as we know now. camilla harris spoke about the quick issue. >> people waited a long time. they shouldn't have to wait longer. any kay justice is delayed, justice denied and i think the nine circuit made that statement when they lifted the stay as quickly as they did, and good for them. >> they say they know of know instance in which the supreme court grant add rehearing after issuing a full-blown ruling. prop 8 supporters have slammed the decision to lift the stay on same-sex marriage. late yesterday we spoke to the lawyer who helped get the initiative an the marriage to ban gay marriage. he said he thought it was an abuse of power.

with the mayor. one idea to keep traffic moving is to have extra officers at key intersections directing traffic. if there is a strike and hundreds of thousands of bart riders pile on to the already crowded bridges and freeways, it will create big problems for area businesses and their workers. we have more on that. >> andre is the owner of the flower shop in san francisco. he's concerned that a bart strike will cause so much traffic on the roads and bridges that his flower deliveries could be delayed. he's trying to come up with a plan. >> maybe do deliveries when there's nobody on the road, which is early morning or in the middle of the day or at night perhaps. >> bart's 400,000 daily riders are going to have to find ways to get around the bay area that. means many will be cloggings the roadways. while he's concerned about the problems the strike might cause, this business owner thinks it's an opportunity. >> we will be bringing in money.

>> in san jose police are investigating the deaths of a four-year-old boy who drown in a community swimming tool last night. shortly before six officers found the child unconscious at the county fair mobile home park. cpr efforts were unsuccessful. no foul play is expected. a concord teach he were is under arrest this morning for allegedly abusing kids at
