bay. it will pull back. but by 9:00 still fog over into the east bay. hayward and also up into the north bay around vallejo. but we will look for the clouds to hang out along the shoreline. it will be cool here with 60s in san francisco. still upper 60s across the pay in oakland. plenty of 70s on the peninsula. and we will look for even cooler conditions to head our way, just slightly cooler tomorrow. i will have a look at the warmer seven-day outlook coming up. kira. >> lisa, thank you. breaking news out of san leandro where about a dozen homes are without water because of a water main break. it happened just before 1:00 this morning on foothill boulevard and 166th avenue. water officials say a six inch main broke, sending water flowing down the foothills. you see there the crews were able to shut off the water just after 2:00 this morning. officials say the repair to the water main will be expensive. it could take until tomorrow to complete >> and break news out of florida where seven people are dead, including a gunman following a shooting at an apartment

complex. police say the gunman was shot dead by a s.w.a.t. team after a standoff that started last night outside of miami. at least four people were found dead inside the building. another victim found dead across the street. it's unknown if that person was purposely targeted or if he was hit by a stray pull let. neither the suspect nor the victims have been identified. happening today, an oakland community will hold a meeting about getting private police patrols in their neighborhood. this comes as residents plea with city leaders to help put an end to the city's violence. on wednesday a 66-year-old woman was shot and killed in car near her home and last week an 8-year-old girl was also shot and killed during a sleepover at a friend's house. oakland residents say they are fed up with the local attacks and they hope to hire private patrols to pick up the slack. >> one more set of eyes, what do you have to lose?

>> the residents say they would intermittently patrol the neighborhood at a cost of $15 per month per household. >> a family after 21-month-old missing oakland girl will go door to door, looking for her. her dad told police he left a convenience car and found she was missing from his car. witnesses say they found a woman matching with walking about a girl matching daphne's description that same day. a man ran into bicyclists last month and killed one of them. cody matthew hall turned himself in yesterday. he's accused of vehicular homicide and reckless driving. a 58-year-old woman died and her husband survived the crash. that was on june 9th. police also arrested his father during the investigation. his father, aaron hall, is a

convicted felon and is banned from owning guns and police say they found two assault weapons while searching the home. a jury has found the chief probation officer guilty of possessing child pornography. the 56-year-old man said the materials found on his hard drive were work-related. investigators said they found 470 images and videos of minors who were naked. forest faces up to three years, eight months in state prison. it's a rare honor bestowed on the bravest service members. president obama will award the medal of honor to staff sergeant ty carter who grew up in the bay area. his proud father spoke with our reporter. >> this isn't bragging rights. as a dad, yeah, you don't get that very often. >> mark carter has every right to brag. his son, army staff sergeant ty carter, is about to receive the medal of honor. sergeant carter was in afghanistan on october 3rd in

2009 when the army said his company was attacked by more than 300 taliban fighters. this video was taken by the insurgents. carter ran through enemy fire to retrieve supplies for his fellow soldiers under attack and dressed the wounds of a severely wounded comrade. then while under fire he carried the wounded soldier to cover. he also risked his life to recover a radio in order to call for help. all are actions that the army said went above and beyond the call of duty. >> i don't know anybody that could have done what he did. >> carter's father, mark, and stepmother, barbara, spoke to abc news in their home. even hours after hearing he will get the medal, his father is beaming and emotional. >> there's not a lot of fathers who can claim that they have been able to go through this. >> mark showed us the soldier of the year award ty received two years ago. was it from the uso. staff sergeant carter grew up in antioch and in washington. he has a multitude of military medals and honors including a purple heart for his deployments in iraq and afghanistan. on august 26th he's scheduled

he's the fifth living recipient to receive the medal for service in eye rack and afghanistan. abc7 news. >> new accusations this morning from the union workers representing bart workers, eight days before the deadline to reach a contract deal. the two groups filed a conflict of interest claim against the bart claiming a conflict of interest. the union accused the bart leader of the labor union profiting from the strike. he works for a bus company that provided shuttle buses during the work stoppage at a cost of more than $12,000 to the district. the union said it's not fair bart said it's a false attack and said the real amount paid was only $500. >> caltrans hopes to find out next month when the new span of the east bridge can open. it hinges on the findings of independent engineers. they will determine if it can open before seismic repairs are

finished beneath the span. original plans called for the bridge to open labor day weekend. traffic is running smoothly once again on the bay bridge after being shut down for a short time yesterday because of a suspicious device. sky 7hd was overhead on this unusual sight of the empty bay bridge. the suspicious device was found at the exit but it turn out to be a small gray canister that ended up being harmless. bridge was closed about 2:45 yesterday afternoon and lasted about 30 minutes. you can see there we caught drivers going in the wrong direction in the toll plaza to turn back around. others got out of their cars and walked around while they were stuck and waited. the bridge shut down came during an already hectic commute over the bay area thanks to two major league baseball games and a concert. there was the a's game against the angels and across the street streets in san francisco were jammed as fans walked to

candlestick park for the jay-z and justin timberlake concert. many lost their patience in the sea of cars. >> what do you think about the traffic? >> it's a nightmare. you should ask the driver, though. she's in a rage. >> other events included the giants game against the cubs, a postal service concert in berkeley and a john mayer concert in mountain view. for the latest traffic news, done load our exclusive waze app on your smartphone. go to abc7news.com/waze. a santa rosa family is fighting the county over seizure of their property. sonoma county is expanding the runways and that means moving a 73-year-old woman off the property she's owned 30 years. the family said the county is paying her a fraction of what the land is worth. reporter mark matthews has the story you will only see on abc7. >> reporter: the house is what the real estate agents call a tear-down. the land around it is beautiful.

>> there's a bunch of vernan pools in there. >> this woman shows us the property her has been brought many years ago for just under 90 grand. the woman wanted us to talk to her daughter. she wanted us to talk to her daughter. >> she's better at this and the county is eating us bad and i don't want to mess things up. >> what napoli is talking about is the county seizing the property under the power of eminent domain to expand the airport runways. the county is offering her $135,000 for the 6.5 acres. but tax records show the property is assessed at $406,000. >> it's been an emotional roller coaster. our government should be protecting us, and they aren't. they are just trying to take our property, steal it, essentially. >> the family's attorney says the constitution guarantees to -- the right to let a jury decide the land's value. but in eminent domain case, tax records are inadmissible and cannot be shown to the jury. >> they probably will never hear what, in my opinion, is the biggest injustice in the case so far.

>> the county attorney's office said the airport manager would be speaking for the manager. all the manager could tell us about the expansion, but he was barred from talking about the case. >> so we can't talk about price? >> no. >> we can't talk about what the property is appraised for? >> no. >> what he finally did say was penny was given two offers, one for her land and one for moving expenses. the family's attorney said the expense allowance was $279,000, but the issue here is the value of the land. the real estate agent who internalizes in santa rosa acreage told us $354,000 would be the low end just for the dirt. >> how about $135,000? >> i don't believe so. i don't think you can get anything for that. >> napoli is afraid. >> this is the last part of my life and instead of getting ready and just enjoying life, for the last few years i think every minute of the day, every hour that's in my mind.

inauguration. today marks the 60th anniversary to the end of the korean war. here in san francisco veterans of the war will dedicate the site for the new korean war memorial. it is being built in the presidio and will be completed in 2015. speakers will include a former congressman pete mckoski. he was awarded the navy cross and silver star and two purple hearts for wounds he received during the war. sixty years later he still is troubled that korea remains divided. >> they are one people. and they were divided by mistake. probably the dumbest mistake of made. the invite for the russians to come to the north half and the u.s. occupied the south half, but they are one people. they aren't two people. korean and american war veterans will gather at the presidio at 10:00 this morning to mark the signing of the armicist. the the veterans, though, are

still looking for help and donations to build the memorial. if you can help there is a link on our website, a local hero from the korean war is finally coming home next week. specialist first class joseph david steinberg was captured and killed in korea in february, 1951. his remains were discovered in may of this year. they will be flown home to san jose monday. he will be buried with full military honors on wednesday at san bruno cemetery. one veteran got long-awaited one of the bison living at golden gate park for three decades has died. she was put down by the zoo staff yesterday morning after it was noticed she was no longer able to move. she lived to be more than 30 years old. she was one of the only descendents after 1984 birthday present to former san francisco mayor dianne feinstein from her husband, richard blum. an effort is underway to save an endangered species to the south and bringing it to the north bay.

wayne freedman is in bodega bay with the story of hope for the white abalone. >> scientific achievements are miracles and can come in small sizes. the abalone are still young and some day will grow to be like this. big, healthy, and hopefully no longer an endangered delicacy. >> let's see if i can get this here. >> they are delicious. i have never tasted one. >> but tasting success will be another matter for this scientist at uc davis. she and colleagues showed off after how after ten years of trying they successfully bread white abalone. no small task. >> the challenge is getting them to reproduce in captivity, to create babies in captivity. >> what's so hard about that? >> they didn't want to. >> the question is what causes these abalone to reproduce? they know the trigger is a combination of food and light and temperature. but in what amount?

>> once we have enough of these young that we can experiment with, we will put them in and manipulate each one of those individually and see which one has an effect on reproduction. >> as of now the lab has 125 specimens from these. one is as large as a tip of a pen and one that is a fully grown. grown adult. sport diving has left abalone so few and far between in the waters of california that reproduction has become next to impossible. to survive the white abalone needs numbers, and once they get the process down to a more efficient science this, lab can produce them. >> i think the vision is within the next, say, five years, to be able to start producing tens of thousands of these young animals to repopulate the ocean of southern california. >> imagine that, saving an endangered ocean species by breeding them in tanks. from the bodega marine lab, wayne freedman, abc7 news. a training exercise turned

into the real thing for a marine mammal rescue team in the bay area. this youtube video was posted by the marine mammal center. its crews were training in monterey when they came across an adult sea lion at the wharf with a rubberband around its neck. during a 90-minute rescue, they captured him and pulled him on to a boat. they nicknamed him h.c. back in sausalito veterinarians cut the bands off and after a few days of recovery, look at that, they released the sea lion back into the ocean wednesday. very happy. meteorologist lisa argen joins us now with the preview of a cooler accuweather forecast and then a heat-up? >> that's right. we have have the low clouds and fog behind us but not in oakland and san francisco. they have moved to the east. in fact the inland east bay in livermore reporting cloudy skies. you can see the sweep on top of mount st. helena. we have been picking up the

subtropical moises alou cross parts of california and that does continue today. so if you are headed to the mountains, it will be pleasantly warm, but perhaps some thunderstorms in the southern sierra. take a look at mt. tam with all of that sunshine above the marine layer. it will work to evaporate the low fog and clouds throughout the morning hours. we are looking at sunshine after the 9:00 hour in the north bay. here we are with temperatures from half moon bay to santa cruz, mid-and upper 50s. oakland at 59. mountain view lost a degree at 61. and not to be outdone, the beautiful east bay. this is vollmer peak. wow, this is mt. diablo here. the marine layer up to 2,000 feet deep. it will take a little bit of time to scour out toward san francisco, but you will be getting to the sunshine throughout the early to midmorning hours in the east bay. fairfield a healthy wind there with the delta breeze, allowing for the winds to gust up to 40 miles an hour this morning. that will be transporting that cooler air all the way into the east bay throughout the afternoon. 54 napa, 60 los gatos with the

57 in livermore. take a look at the low clouds here at the surface. of the golden gate bridge, it is bleak here with the wipers needed at times. so with the drizzle this morning, it will be cool, just in the 50s here. but by this afternoon we will lack for sunny skies. but it is going to be a couple degrees cooler than yesterday. thatcology trend got underway yesterday and continues through the weekend. so here's a look at what you can expect throughout the rest of the morning hours. he we have the fog toward hayward and lever more begins to pull back 9:00, 10:00. but notice still along the san mateo county coast and by the afternoon we have fog from stinson beach, half moon bay and pacifica but elsewhere it clears. by 10:00, 11:00 we will get into mostly sunny conditions. last to clear and marin and the coast. a mild afternoon today and it's all due to the area of low pressure that is spinning off the coast. that has brought the remnant subtropical moisture into the sierra nevada.

southern california bringing the chance of thunderstorms once again today. the highest terrain, but overall for us it means just some -- a couple degrees shaved off the afternoon high temperatures. so cooler than yesterday and in fact the trend will take us through sunday and monday. 80 degrees in san jose today. look for 78 in menlo park. 72 in san mateo. san francisco waiting on the sunshine until about noontime. then 64 degrees so cooler than average up in the north bay. you should see highs in the low 80s, but look for highs of mid-70s santa rosa. the kite festival in berkeley, lack for high temperatures in the upper 60s but plenty of wind to help out with flying the kites. 75 union city. out over the hills we have lower 80s. it could be much hotter. we will get much hotter by the next seven days. we are talking back to normal readings. in fact, even above normal then. but today very comfortable at 85.

looking at a couple of ball games around the bay today, 63 in oakland at about 12:00. upper 60s by 4:00 and all right on today the giants will be playing and we will be looking at plenty of this late in the day. but starting out with temperatures in the up 50s and the sun setting 8:23 so the low clouds and fog will be with them later on in the evening. notice the warmup. not until tuesday and it's a modest one. wednesday, thursday and friday back into the 90s inland and sunshine and 60s at the coast. it will take some time to warm up, but in the meantime very pleasant out there. you can find the mild temperatures. >> yeah, we have everything. >> yeah. >> thank you, lisa. coming up, we will tell you how the moguls from the worlds of music and social media came face-to-face yesterday in the bay area. and the discovery behind a basement wall in san francisco leads to something that will

and gilroy, it will be a beautiful afternoon. 10:00, 61 degrees and sunny skies. we will look for the 1:00 temperature to be in the mid-70s, sunny and mild. by the afternoon just in the upper 70s. it could be much warmer for this time of year. a really nice afternoon. by the evening that breeze kicks up with numbers in the upper 60s, cooling off. so fantastic weather are from gilroy and the garlic festival this weekend. we will talk about the rest of the bay area and the cool down when we continue in a few minutes. >> lisa, thank you. new this morning, crews have contained a brush fire that burned three acres in pittsburgh. the fire broke out just before 9:00 last night near john henry johnson parkway near fire station 87. it's the same station that was closed last month because of budget cuts. crews were able to get the fire under control in about half an hour. a former police officer who pepper sprayed students at a u.c. davis protest is now seeking payment from the state. he was fired for his actions, but now he's filed a worker's

compensation claim. abc7 news capitol correspondent nannette miranda has the story. >> john pike drew worldwide criticism in 2011 for dousing peacefully-sitting demonstrators with pepper stray and now wants worker compensation for psychiatric injury. the former marine sergeant received death threats aft video went viral. pike was fired a year ago after an investigation found his action was unwarranted. >> i think it's wrong what he's trying to do. >> he and lee were one of the protesters pepper sprayed. he and others shared in a million dollars settlement from the university last year. he hopes his claim is denied. >> when you reward him with benefits, you tell people it's okay to hurt students and that's a message we absolutely cannot send. >> calls to peek's attorney were not returned. but melissa brown specializes in

workers's comp cases and is not connected with this case. she said they must have thought the case through very carefully because more public scrutiny lies ahead. >> filing a psychiatric claim not easy. they give up their rights to privacy, your whole life is an open book. >> the department of industrial relations will look at the claim august 13th. if no settlement is reached, his case will move forward to trial or move on for further hearing. organizers are already planning a demonstration outside the state building in the hopes of swaying the panel to reject the former cop's claim. >> this is outrageous. while he might be entitled to receive worker's compensation, the idea that his own actions of brutality would entitle him to a payout is absolutely unjust. it's crazy. >> pike made nearly $122,000 a year. brown, the worker's comp attorney, says because of recent cutbacks made by the legislature, a 50% permanent disability, for instance, would entitle pike to $62,000 in life time cash benefits, but medical treatment for life.

in sacramento, nannette miranda, abc7 news. new this morning, president obama says choices that are made now will govern the future economy, but that washington has lost sight of what needs to be done due to political posturing. in his weekly internet and radio address, obama said washington's top priority must be to reverse trends like economic inequality, weak middle class secured and global competition. >> if we don't make the investments necessary to make america a magnet for good jobs , if we don't invest in education, manufacturing and research, and the transportation networks, we might as well hit the pause button while the rest of the world forges ahead in a global economy. that's certainly not going to fix what ails the middle class. >> the president is pressing economic ideas he's been promoting in an ongoing series of speeches, including better access to education, home ownership, healthcare and secure retirement.

>> an unexpected discovery behind a church wall is being transformed into resting place for pets in san francisco. crews found this big space behind a wall at this church in north beach. church leaders decided to refurbish it and build a pet columnbureum. by spring people can place the ashes of their loved pets there. it will even have high-tech features. >> families will be able to incorporate snapshots or videos of themselves and the pets and there will be a directory that they will be able to look through the lives of these pets. >> there also will be a wall to honor service animals like police and seeing eye dogs. the 850 square foot columnbureum will have some renders and one of the patron saint of animals.

happening today advocates hold a rally in an effort to keep a historic post office from closing in berkely. the postal service has approved the sale of the downtown berkeley building as part after -- of a series of cutbacks to reduce costs and generate revenue. nearly 4500 offices across the u.s. have been slated for closure or sale. >> this is a special year for the gilroy garlic festival that kicked off yesterday. this weekend its celebrating its 35th anniversary. david lilly spoke with the volunteers who have been on board from the beginning. >> reporter: thirty-five years ago maybe 300 people turned out for the first garlic festival. now 100,000 show up from all over the u.s. and beyond. forever establishing gilroy as the garlic capital of the world. rich perez has been here all 35 years. >> will rogers said it's the only town in the world you can hang your stick on a clothesline

and it will be marijuana aided the next day. >> these people are called pyrochefs. his father was one of the founders of the festival. 1979 seems like only yesterday. >> that very first year was just my father and i. we did all the cooking and then the second year and the third year we created to a crew of about maybe six. and one stove, went to two stoves, now up to four double stoves and we have eight pyrochefs going at a time. >> this is a major food' other vent will every food reeks of garlic. the proceeds go toward a wide variety of community groups. over 35 years the festival has given back over 9 .$7 million to sports teams, scout troops, hospitals and even food banks. it takes 4,000 volunteers to make it happen. >> it just happens over and over every year and the volunteer congregation has grown so much it's made it successful. no, it's just a lot of fun. it's a real family atmosphere. >> this is a serious food show.

>> it's really frustrating because sometimes it's hard to find out what the error is. >> but that frustration is where learning happens. >> they just hit all these roadblocks and they, one by one, they knock them down and then they just hit this moment where everything works. >> all right! yes! yes! >> solving problems together is key, and it's a little easier without boys around >> i think boys naturally think that they are better on computers than girls, so they think that they know how to do it right so they try to teach the girls, of command the girls. >> instead the only ones taking orders are the robots. >> you are telling it what to do and it looks at you. and you get to learn how to put different robots together and you can make them like do anything. >> the robots they are using are called link box, designed here at u.c. davis to teach the same problem solving kids need in their science and math classes. >> they engage them and personalize the learning.

>> yeah. it looks pretty guy out there right now, but that will change. in fact, we are looking at low clouds and fog all the way into parts of our east bay valleys and some breezy winds, to boot, offering a little drizzle, as well, closer to the coast. mount st. helena where the doppler is, not showing returns. but low clouds and fog as hutch as 2,000 feet deep. 61 mountain view. we dropped a degree. good morning, san jose, 58. it's 54 half moon bay. you will be lucky to reach 60 at the coast. here's the east bay hills camera where we will get into some sunshine pretty soon. in fact, right now in concord it looks pretty good out there. 53 santa rosa, 54 by the delta. some breezy wined to transporting the cooler air. take a look at the golden gate bridge. it will stay gray here for most of the day. we will get into some sunshine in san francisco later on. still cooler than average for the city. and we will look for the cooling trend to continue into tomorrow and even monday with changes coming our way by early next week. so the steady sea breeze will be

with us throughout the afternoon, and that's going to allow for the cooler than normal air mass to be with us just by a couple of degrees. really not that noticeable. here's a look at the low. and it's the culprit that is allowing for not only the monsoonal moisture, but in fact it is allowing for the temperatures to be even cooler than yesterday. so all in all we are looking at things really trending down toward. so the weak low moves onshore and we will be looking at temperatures today, a nice spread, 25-degree spread. we have that going for us. but the week ahead, notice not only in san jose, monday we have 70s. we are looking at the warming trend beginning by tuesday, wednesday and thursday. still cool as we start the work week. some of that moises alou how long for the showers and thunderstorms from the southern sierra around yosemite. 84 in tahoe. we will call it partly cloudy and a cooler air mass visits sacramento at 91. 64 for a high today in monterey.

so mid-60s should do it for san francisco with 69 across the bay in oakland. look for 70s in fremont. in san jose about 80. that should to it for gilroy, as well. so temperatures very comfortable for the garlic festival. and looking ahead you will notice that the numbers come down amounts bit sunday. very little change on monday. it's tuesday we begin to warm up around the bay and inland. just modestly, though. you will really feel it come wednesday, highs reaching around 90 inland. 10 around the bay. look at the 60s returning to the coast and that means more sunshine. so it's been awfully gray along the coast. no changes there today. but certainly a pleasant afternoon if you are away from the coast. so, you know, we do have a little bit of something for everyone, but it is gray for most this morning. >> right. but it was so warm last week, at least in the east bay. we needed to cool down. >> yeah, we sure did. in fact, no real changes this store for tomorrow. >> thank you, lisa. well, the watch abc live stream
