>> we are hinting at another cooling trend. stay with us. we will have a look at the seven day outlook in a few minutes. katie. >> union and bart management will be back at the bargaining table today with less than 48 hours until the streak deadline. they left talks last night giving no indication a breakthrough was imminent. we have the latest on negotiations from oakland. >> mark's lead negotiator, thomas hawk, pushed through a gauntlet of reporters and talked while he walked about ongoing negotiations. >> longs you continue to meet, there's progress. >> just before 8:00 p.m. the talks ended for the night with a sunday night deadline looming. >> at this time there is no discussion about extending the contract. >> chris finn is a union

negotiator and train operator. she said only about ten minutes of negotiations between the union and bart negotiators happened to, pinning the lack of negotiation on bart's lead negotiator. >> the people who are interested in keeping bart going, they would like to talk more, but when he's in the room they stated they are not free to express their opinion. >> the general manager spent plenty of time during an afternoon briefing defending hawk, saying attacks on him are par of the often i don't know's strategy. she said labor and pension costs have to be controlled because of needed improvements. >> our system is 40 years old. we are out of trains. we've had to order a new -- a complete new set of trains. >> a bart fare increase that kicks in early next year will fund the capital improvements, but she said any wage increase less have to come from somewhere else and right now federal and state funds are unavailable n oakland, serge, abc news.

>> the governor has the authority to call a 60-day off period, but he has not received a request electric either bart or the union. carpooling could be the key to reducing traffic congestion if there is a trike. officials expect 10% more traffic this time compared to the first strike last month. many commuters are expected to turn to ride sharing apps to find rides. during the last strike the sidecar uber and lift found a 50% increase in drivers and riders. the ride sharing app carma is offering cash back for those who sign up. another option is ferries, the sfa ferry will run extra ferries. there will be 13 vessels system-wide instead of the normal eight. golden gate transition will not have additional service but two of its boats will be used by bay ferry. other public transit agencies are gearing up for the

possibility of a bart strike. sam tran said it would provide a shuttle service from daly city and bart station to san francisco. cal trains may add additional service as it is permitted. ac transit plans to add transbay buses but it doesn't know how many just yet. also bart still hopes to round up 95 carter buses to shuttle passengers from the five locations you see here on this map in the east bay with the possible addition of concord and san leandro. a new poll from the bay area council said the public is largely opposed to a strike. they find 70% of those surveyed are against a walkout. 3% would support it. we have more from san francisco. >> we are losing money, we are losing time. people can be losing their jobs. >> anniseness saw almost lost her job when bart went on strike in july. she complies into san francisco from the east bay. she work at a tech company and

said her employer isn't very lenient when it comes to attendance and family. >> last bart strike it was a requirement to be here because of the deadlines we had to meet so it was a huge inconvenience, especially since my son's school is in hayward. i had a find a way to get him to school and try to get to work on time. >> after work when she couldn't pick up her son terrorist continue in time, she paid the price. >> it cost me almost 120 fee just for the late fees picking him up. >> the bills add up for the commuter and economy. they estimate the economy impact. >> a bart strike costs us about $73 million a day in lost productivity. that's people sitting in traffic, having to find other ways to get to work or to get to where they are going. >> that doesn't include the trickle-down effect. here at the bar and grill, bartender joann campbell said the business depends on people being able to get to work. >> a lot of our customers will come in for lunch.

we will show what you is happening with the commute. joining us for an early start at 4:00 a.m. on at. bc7 sun morning news. in oakland developers are trying to find clues into the 53rd homicide of the year. officers found one man dead last night. police have yet to say if anyone else was injured and have released few details about what happened. today a county-wide gun buyback event will be held in three east bay locations. several local police departments, along with the contra costa district attorney's office are taking part. officers will exchange working firearms in exchange for gift cards. no questions asked. redense can receive up to $200 for an assault weapon, up to 100 for handguns and up to $50 for shotguns or fires. officials say the firearms must be unloaded with the safety on. the gun buy back will be held at three locations. richmond city hall, the contra costa county fair grounds and

antioch and the parking lot of the concord pavilion from ten to three this afternoon. oakland will soon unavailable a second downtown plaza that the city hopes will draw people to the area and be a boom for local merchants. this is an artist's rend death. it's located on telegraph avenue between 16th street and broadway, just a block from frank cogala plaza. they report the plaza will host weekly entertainment some local property owners are worried, they fear it will attract homeless people and obstruct traffic. they will have a three week trial run on august 16th. city officials will receive a progress report before i am approving a long-term plan for the area. more shock details are revealed in the caves two lake county men charged with section whale assaulting anden shaving a runaway teenager. the two appeared in court yesterday. they pleaded not guilty to the charges, which include growing and trafficking marijuana.

in court records the 15-year-old claims the men kept her inside this metal box that had air holes punched into it. she said they also sometimes shocked her with a cattle prod. one faces additional charges having to do with weapons for the arsenal he kept on the property. >> the former alameda county superior drug that milk his 97-year-old neighbor out of millions of dollars gets probation. he avoid what might have been a lengthy prison term. judge see man was accused of stealing money from his elderly neighbor over the course of 13 years. under the plea he will be band from holding judicial officer and is disbarred from practicing law in california. >> hikers in the east bay are warned to watch out for rattle snakes after one was spotted a week ago. there are signs now posted and warnings on dilden park trail

>> this morning environmental activists are planning to protest in richmond outside of the chevron refinery. the groups plan to protest until 1:00 in the afternoon. the demonstrationing is held three days before the first anniversary of last year's chevron refinery fire. the activists are opposed to the refining of tar sands crude oil. they say it's the dirtiest of all fossil fuels and is a climate change threat. they are also demanding improved plant safety and an investment in clean energy jobs for local residents. u.s. embassies around the world are on high alert this

it will include flying a huge rainbow flag and they will stage a picket lines. . the embarcadero freeing? officially it was interstate 480, a double decker highway that cut through san francisco south of market neighborhood and i long the waterfront. it's been 22 years sense it was torn down and the rubble is long gone, replaced with businesses, condos and skyscrapers, and the building boom isn't over. they look at how the city's skyline is still changing. >> drive through san francisco south of market neighborhood and you will see a whirlwind of construction. >> this is going to be the biggest change to the san francisco skyline since i think the mid-80s. >> gabrielle is with spur, a nonprofit that advocates for smart urban renewal. he said san francisco is about to burst with new development. most of that new construction centers around this site. it looks like just a big hole in the ground right now. the transbay terminal will be

the grand central station of the west of. linking high-speed rail, caltrain, and eight bus lines from all over the bay area, all under one roof. a four-block long public park will top it off. this animation provided by the terminal planners shows what the center will look like when it's completed in 2017. >> the idea for the transbay transit center was to create a national model for transit-oriented development to make transit more accessible and available and to surround that transit access with high density development. >> in the 1980s, san francisco saw a backlash against high density projects. critics worried the new high rises would threaten views and shade parks and lead to the man at anization of the city. but since the 1980s the demographics have shifted in the city and so has public opinion.

changes as the marine layer strengthents. it should be milder and warmer on the bay. this is from our sweep on top of mount st. helena. and further to the south, san jose looking pretty good. here's the roof camera. cloudy with coastal drizzle. oakland, good morning, 57 for you. 58 in mountain view and san jose coming in with the clear sky at 54. los gatos 52 and on the coast we have had the clouds, and that is going to remain the same deal this afternoon. but our exploratorium camera you see some of the low cloudiness there and the bay bridge with 50 in santa rosaa. warmer in napa due to a southwest wind. 56, as well as concord. clear conditions there. livermore clear skies, 57. and the golden gate bridge, here's where you might run into a little bit of mist and need your wipers from the low clouds and the fog this morning. take your time out there. it is chilly. but this afternoon mild to warmer around the bay and the cooling trend starts tomorrow into the middle of the week.

there's a trough of low pressure to the north and west of us. due to that, that will allow for a steady onshore flow. keeping the numbers from getting too warm around here. in fact, not only will we be cooler tomorrow, but we are looking at this trough to set on up, bringing us temperatures below average for the upcoming work week. no signs of summer heat. we aren't talking about 90ths, but it should be a pretty nice day today. in the south bay look for highs in the upper 7 tos in san jose. 75 milpitas and 71 santa cruz. peninsula numbers mid-and upper 70s. 77 in palo alto, but with the clouds it will be cool here. half moon bay. san francisco, 65 degrees with that afternoon sun. 59 in daly city and up in the north bay we have that rain. she has to get pretty far north, though, to get into the low 90s from ukiah to clear lake. 75 in san rafael. near east bay, a nice afternoon for the ballgame. 72 at about 4:00. 74 union city, and you head on

inland, plenty of 80s here. some low 80s from pleasanton, but you head out toward the delta and antioch and brentwood, you are in the upper 80s. it should be a beautiful afternoon there. the look ahead showing the numbers at least four to five degrees cooler tomorrow as that trough gets closer, the sea breeze kicks up. the coolest day of the week should be around tuesday, wednesday, and then a slow moderating trend. we are going in the wrong direction but today should be nice. >> thanks, lisa. congress is heading out for summer vacation and some say the time off

>> breaking news. a 19-year-old woman was shot in a car at south third and east san salvador street. the 21-year-old driver she was with stopped at south second street and called 9-1-1. woman was taken to the hospital, where she died just after 2:00 a.m.. the motive behind the shooting is not known. there were no other injuries. also no suspects have been identified or taken into custody. despite the budget battle being at an impasse in washington, lawmakers are taking their summer break. that's five weeks of vacation. some are calling this a do-nothing congress. by this time last year lawmakers sent 54 bills to the president, although half of those were only minor issues. this year it's even worse. as of this week the house and senate have passed 26 bills for

president obama to sign into law. more any from abc news reporter david curley. >> talk about a mad dash. members of congress leaving the capitol, grabbing their bags and heading home for a five-week vacation. gone with time running out to pass some big pieces of the country's business, including a budget. >> when you are at work, you are working until you get it all done. then you go on vacation. >> citizens vacationing in the nation's capital. >> you were your vacation. >> most of us get two weeks vacation. and look at the calendar. once they return, the house will have just nine working days before the end of the budget year. the senate just a few more. >> oh, my goodness. i mean the amount of stuff, the list of important things that need to be done and this congress, it's as long as my arm. >> so far this year the senate met for only 96 working days. they were out of session for 53

half-hour with a quick look at the weather. here's lisa argen. >> good morning. we are starting out with a good deal of low clouds and fog. not everywhere, though. it's clear in san jose. also in the east bay valleys. but this morning the fog's footprint is with us over into our near east bay, but it pulls on back and it fades away as sunshine increases. but notice those 80-degree temperatures pretty far out to the east and north of us. overall once again 60s and 70s. and the warm weather will be found out toward the delta. today, though, should be a pretty nice day around the bay with plenty of sunshine. the clouds banked up along the shoreline. enjoy it today. it will be the warm are day of the weekend and the warmest day out of the next seven. i'll explain come up. katie. >> lisa, thank you. the u.s. supreme court has ordered california to release thousands of state inmates because the prisons are overcrowded. the governor, of course, has been fighting the feds in court to stop it. but he's now run out of options.

abc7 capitol correspondent nannette miranda reports. >> governor brown said california's prison population cannot be reduced any further without letting out dangerous felons. the u.s. supreme court refused to stop an early release order to ease overcrowding. the ruling in the decades-old case is a victory for inmates. and healthcare behind bars they say fails to meet constitutional stand cards, causing needless suffering and death. the overcrowding comes in the way for effective remedy for the medical and health cobs that plague california. >> california has already reduced it's prison population by 46,000 since 2006 but the courts have continually said that's not enough. the state needs to shave another 10,000 in less than five months. governor brown is really out of legal options at this contempt t charges if he doesn't comply by the end of the year. >> the corrections department

confirms preparations have gun to meet the reduction. 30 from the women's prison have been identified as eligible for medical parole. as long as more than 800 men throughout the system. contracts with out-of-state prisons have been extended and sentences are being recalculated for those with good time fred and completion of rehab program. >> this is absolutely insane. >> groups are worried. while in meats are still at historic lows, the numbers were slightly up for 2012. >> unfortunately the state has already shifted those who they consider low-risk inmates to the countyings, and now all that's left are your most serious and vie level criminals in the state prison. >> the legislature has until mid-september to pass laws or a approve funding that enables the state to further cut prison population. abc7 news. this afternoon family members and supporters of nearly

400 california inmates who are on a week-long hunger strikes are hoping to rally outside can quentin. they want officials to immediate the demands of the hunger strikers who want changes to solitary confinement. they claim the conditions amount to torture. correctional officials say the conditions are not inhumane. they say some want daily contact with staff and cable tv. humble county is often called america's marijuana frontier. and we are learning of the serious danger the area poses to bears and mammals. authorities found are more than 16,000 marijuana plants and enough poison to kill more than 750 black bears and armies of road ents. this week's raise targeted areas near willow crick, hupa valley and orleans. the pesticides are killing mammals like these fissures.

they are truckloads of plastic pipe being removed from the ground. new this morning president obama is call on congress to act on his plan that he says is a better bargain for the middle class. in his weekly address the president says the country has fought it's way back from the recession and started to lay a foundation for stronger economic growth but he says more work needs to be done. he said middle class family needs help finding jobs, owning homes and getting healthcare and securing retirement. >> there are no gimmicks when it comes to jobs. there are no tricks. ' versing the middle class security in this country, the erosion, won't be easy but if we work together and take a few bold steps and if washington is able to set aside politics and focus on what really matters wishes can grow our economy and give the middle class a better bargain. >> senator susan collins of may delivered the gop address. she said obamacare discourages

them from creating jobs and hiring new employees. bay bridge are putting new pieces of the span under the microscope after dozens of rods snapped earlier this year. they started testing a series of steel anchor rods. in may an older set broke when they were tight end, potentially strengthening the earthquake features and delaying the opening date. they are now make custom steel saddles to fix that problem. the new rods are undergoing tests and corrosion tests to find out what will happen to them decades from now. >> we want to make sure people understand we take very seriously, we take safety seriously and we want to make sure the bridge is safe not only whether it opens to the public but years down the road. >> so far they haven't found audition natural problems and they don't expect further delays. they have not set a date for the opening of the new certain span. the students are about to spend their time in graduate school learning about learning.

now they are faced with a master thesis like none other, to build a product designed to change education. abc7 news reporter johnathan bloom has a look at what they came up with at the stanford education technology expo. >> in a room milling with people, one man is playing guitar. nobody can hear him, but his computer can. it says he needs more practice. >> they are actually playing it correctly and returns feedback. it's kind of like guitar hero but with a real guitar and on your computer for free. >> danny is a stanford student and this app called struify is his. >> start and then end the program. >> megan built a toy called dr. wagon where you write computer code by averaging blocks. >> this way kids can get exposed to the basics of programming but using tangible objects. >> it has the faculty impressed.

>> they are awesome. the students have put together some amazing things that all have something to do with learning but in vastly different ways. >> all the teams have got past the discerning eyes of their professors. now it's their first chance to present to the general public. an audience over 150 people, including some silicon valley investors and lot of real life students. when we sea it in the hands of real users and they give us feedback it is awesome or it's working or not working, that's the most exciting part. >> that was key for this design duo to spend time building things with their daughters. >> they wanted to spend time with there'll daughters, but didn't know how to. >> it teaches engineering is creative. >> and they wanted to design it where the daughter teaches the dad and creating art together. >> you are never too old to learn. >> they spend time on their iphones, ipad. >> her app comes with a real life tea set to bring them back

>> a small mom and pop market are struggling to keep their store open after a small car slammed into the store almost two years ago. it happened in russian hill and the legal fight that's followed has almost driven them out of business. mark mathews covered the crash and has this update. >> surveillance video caught it as it ran a stop sign, clipped a sedan that spun through the intersection and ran into the front of the new russian hill imagine that was in 2011. a few days later the owners were throwing out food and thinking this accident might cost them months of business.

>> could be a month, two months, could be six months. >> they never guessed it would be ten months before the store could reopen. building owner's insurance paid to repair the entrance and the store's insurance company paid $121,000 loss of business. the store's owners say it's not nearly enough. >> we had bills. you have to pay the pg&e bill, you have to pay your insurance, whatever bills that come through the door. >> if customers were coming through the door, the two brothers who run the store say they would survive but in the ten months they were closed, a lot of the regulars found somewhere else to shop. >> they would go to one of the other markets and then they get used to going there. >> you close for ten months, people get on other buses to go to other stores. >> now the shelves are sparsely stocked and they say they have run out of capital to restock and they blame yellow cab for dragging out the leg fight. why they don't want to sit down and talk about settling the case. >> the lawyer for yellow cab told us there is a dispute as to

see the low clouds, the gray sky. we will look for the mist and drizzle along the coast and then a mild to warm day today with the cooling trend getting underway as soon as tomorrow. it's going to take us through the middle of the week. so we are talking about below average numbers as the trough of low pressure sets up to the north and west of us. that allows for the steady on shore flow. kind of breezy in the afternoon as the winds pick on up and we will look for the breeze anywhere from 15 to 20 americans. the trough isn't even really set up yet. so it's going to get even cooler in the days ahead. we are on the upper 80s in our warmest inland east bay, but as the trough continues to settle to the south, it will allow for the cooler-than-average numbers and really no sign of summer heat. so mainly in the 60s and 70s. with some few low 80s for the week ahead. and high temperatures state-wide pretty pleasant, though. low 90s sacramento with 95
