>> good morning, everything. so glad you could be with us this morning. let's tart with a quick look at the weather with meteorologist lisa argen. good morning, lisa. >> good morning, katie. it is cloudy done town and in oakland were but san jose is clear with 54 dreams later on today going for a high in the upper 70s underneath sunny conditions. should be a beautiful day in the south bay. elsewhere upper 60s to low 70s for oakland. more sunshine for you. ballgame this afternoon. and at our coast the clouds have been hanging tough, keeping the shoreline cool from the upper 50s to the low 60s for the most part. but you head out toward stinson beach and you should see high necessary the mid-650s. inland the warmest numbers not

only today, but for the weekend and much of the week ahead. so it looks like with the warmer day coming in today, we are talking about an even stronger cooling trend headed our way as these numbers come down in the days ahead. but as for today, that's your warm spot inland. we will pinpoint the numbers and talk about the cool down, show it to you with our seven-day outlook in a few minutes. katie. >> lisa, thank you. breaking news right now in san jose. police are investigating the city's 30th homicide of the year. police say a 19-year-old woman was shot while riding this a car just before 1:30 this morning at south third and east san salvador street. the 21-year-old driver of the car stopped at south second street and called 9111. the woman was taken to the hospital where she died of her injury just after two. motive is not known. no one else was not hurt. at least check police department have any suspects identified or anyone in custody.

>> unions and bart management will be back at the bargaining table today with less than 48 hours until the streak deadline. they left talks last night giving no indication a breakthrough was imminent. we have the latest on negotiations from oakland. >> no progress was made. >> bart's lead negotiator, thomas hawk, pushed through a gauntlet of reporters and talked while he walked about ongoing negotiations. >> i would tell you as long as you continue to meet, there's progress. >> just before 8:00 p.m. the talks ended for the night with a sunday night deadline looming. >> at this time there is no discussion about extending the contract. >> chris finn is a union negotiator and train operator. she said only about ten minutes of conversation between the union and bart negotiators happened to, pinning the lack of negotiations on bart's lead negotiator. >> the people who have interested in keeping bart going, they would like to talk more, but when he's in the room they stated they are not free to express their opinion. >> the general manager spent plenty of time during an

afternoon briefing defending hawk, saying attacks on him are part of the union's strategy. she said labor and pension costs have to be controlled because of needed improvements. >> our system is 40 years old. we are out of trains. we've had to order a new -- a complete new set of trains. >> a bart fare increase that kicks in early next year will fund the capital improvements, but she said any wage increase will have to come from somewhere else and right now federal and state funds are unavailable. in oakland, abc news. >> the governor has the authority to call a 60-day cooling-off period, but he has not received a request from either bart or the union. carpooling could be the key to reducing traffic congestion if there is a strike. officials expect 10% more traffic this time compared to the first strike last month. many commuters are expected to turn to ride sharing apps to find rides.

during the last strike the sidecar, uber and lift found a 50% increase in drivers and riders. the ride sharing app carma is offering cash back for those who sign up. another option is ferries, the sfa ferry will run extra ferries. there will be 13 vessels system-wide instead of the normal eight. golden gate transit will not have additional service but two of its boats will be used by bay ferry. other public transit agencies are gearing up for the possibility of a bart strike. sam tran said it would provide a shuttle service from daly city and como bart station to san francisco. cal trains may add additional service as it is permitted. ac transit plans to add transbay buses but it doesn't know how many just yet. also bart still hopes to round up 95 charter buses to shuttle passengers from the five locations you see here on this map in the east bay with the

possible addition of concord and san leandro. a new poll from the bay area council suggests the public is largely opposed to a strike. they find 70% of those surveyed are against a walkout. 30% would support it. we have more from san francisco. >> we are losing money, we are losing time. people can be losing their jobs. >> vanessa oliver almost lost her job when bart went on strike in july. she commutes into san francisco from the east bay. she works at a tech company and said her employer isn't very lenient when it comes to attendance and family. >> last bart strike it was a requirement to be here because of the deadlines we had to meet so it was a huge inconvenience, especially since my son's school is in hayward. i had a find a way to get him to school and try to get to work on time. >> after work when she couldn't pick up her son tristen in time, she paid the price. >> it cost me almost 120 in fees just for the late fees picking him up. >> the bills add up for the commuters and economy.

the bay area council representing business owners estimates the economy being impact. >> a bart strike costs us about $73 million a day in lost economic productivity. that's people sitting in traffic, having to find other ways to get to work or to get to where they are going. >> that doesn't include the trickle-down effect. here at the bar and grill, bartender joann campbell said the business depends on people being able to get to work. >> a lot of our customers will come in for lunch. we have a busy lunch time. and if they aren't making it to work because they are telecommuting from home, we don't have a lunch business really. >> fewer customers, fewer dollars. >> besides the business doing well, we all work for a living and need the customers. it may affect everybody where it hurts. >> campbell, like so many others, hopes bart and its unions can come to an agreement without striking. in san francisco, abc7 news.

today a county-wide gun buyback event will be held in three east bay locations. several local police departments, along with the contra costa district attorney's office are taking part. officers will exchange working firearms in exchange for gift cards. no questions asked. residents can receive up to $200 for an assault weapon, up to 100 for handguns and up to $50 for shotguns or rifles. officials say the firearms must be unloaded with the safety on. the gun buy back will be held at three locations. richmond city hall, the contra costa county fair grounds and antioch and the parking lot of the concord pavilion from ten to three this afternoon. oakland will soon unveil a second downtown plaza that the city hopes will draw people to the area and be a boom for local merchants. this is an artist's rendering. it's located on telegraph avenue between 16th street and broadway, just a block fromwillt

weekly entertainment. some local property owners are worried, they fear it will attract homeless people and obstruct traffic. they will have a three week trial run on august 16th. city officials will receive a progress report before approving a long-term plan for the area. more shocking details are revealed in the case of two lake county men charged with sexually assaulting and enslaving a runaway teenager. ryan and patrick appeared in court yesterday. they pleaded not guilty to the charges, which include growing and trafficking marijuana. in court records the 15-year-old girl claims the men kept her inside this metal box that had air holes punched into it. she said they also sometimes shocked her with a cattle prod. one faces additional charges having to do with weapons for the arsenal he kept on the property. >> the former alameda county superior judge that milked his

97-year-old neighbor out of millions of dollars gets probation. through a plea deal with prosecutors, the 58-year-old paul seeman of berkeley avoided what might have ban long prison term. he was accused of stealing money from his elderly neighbor over a period of 13 years. he will be banned from holding judicial office and is disbarred from practicing law in california. >> lisa argen has a look at the forecast ahead. >> today is the warmest day of the week. we are talking about temperatures climbing right here in the north bay. the few from mt. tam, the fog was generous. it is up to 2,000 feet deep. it's gray in the north bay and partly cloudy in the east bay. the fog will fade-away and we will look for numbers today with a nice range. 25 degrees or so. i'll come back and let you know when that cool-down hits and how cool when we return. >> lisa, thank you.

>> this morning environmental activists are planning to protest in richmond outside of the chevron refinery. the groups plan to protest until 1:00 in the afternoon. the demonstrations are held three days before the first anniversary of last year's chevron refinery fire.

the activists are opposed to the refining of tar sands crude oil. they say it's the dirtiest of all fossil fuels and is a climate change threat. they are also demanding improved plant safety and an investment in clean energy jobs for local residents. u.s. embassies around the world are on high alert this morning and americans traveling abroad are being warned about a credible terrorist threats w we have reaction from people on their way out of the country at the international terminal at sfo. >> it's a global travel alert, but the u.s. is concentrating much of its attention on the muslim world. abc news spoke exclusively with the chairman of the joint chiefs. >> the intent is to attack western, not just u.s., interests. >> the alert expires at the end of the month, but one of them , the travel agents, say they around taking it into a concern.

the comments reflect the attitudes of most international travelers we spoke to at sfo. >> it's an everyday thing now. terrorists and whatever. >> i'm from london. we are used to travel problems all the time. if you listened to them all, you wouldn't go anywhere. >> but bob baer, a former cia case officer the mideast, says the threat in that region appears to be very real. >> i would say if you don't have urgent business in that part of the world, you shouldn't go. >> the closing of 20 embassies and 20 consulates in the mideast is the sign the u.s. has picked up on what they believe to be a credible threat. >> it has to be fairly specific, the sources, the phone calls are probably pretty well-known. my only question is will the attack occur in the middle east? >> baer said al-qaeda has created diversions before and they can do it again. hence the global travel alert. abc7 news.

this afternoon gay rights advocates are planning to gather in san francisco at the russian consulate to protest anti-gay laws in russia. two days ago they poured vodka on the streets in west hollywood because of fines on people who hold gay pride rallies. today's protests includes flying a huge rainbow flag and there will also be a active picket lines. >> you probably remember the embarcadero freeway. officially it was interstate 480, a double decker highway that cut through san francisco south of market neighborhood and i long the waterfront. it's been 22 years sense it was torn down and the rubble is long gone, replaced with businesses, condos and skyscrapers, and the building boom isn't over. carolyn tyler looks at how the city skyline is still changing. >> drive through san francisco south of market neighborhood and you will see a whirlwind of

construction. >> this is going to be the biggest change to the san francisco skyline since i think the mid-80s. >> gabrielle metcalf is with spur, a nonprofit that advocates for smart urban renewal. he said san francisco is about to burst with new development. most of that new construction centers around this site. it looks like just a big hole in the ground right now. the transbay terminal will be the grand central station of the west. linking high-speed rail, caltrain, and eight bus lines from all over the bay area, all under one roof. a four-block long public park will top it off. this animation provided by the terminal planners shows what the center will look like when it's completed in 2017. >> the idea for the transbay transit center was to create a national model for transit-oriented development to make transit more accessible and available and to surround that transit access with high density development. >> in the 1980s, san francisco

saw a backlash against high density projects. critics worried the new high rises would threaten views and shade parks and lead to the man manhattenization of the city. but since the 1980s the demographics have shifted in the city and so has public opinion. >> next to the terminal the builders will build the centerpiece of the new development. the transbay tower will rise more than 1,000 feet, making it the tallest, most visible building in the city. >> development around the site is beginning to move forward. just in the one-block radius surrounding the center, we have four buildings that are either under construction or about to be under construction. >> nearly two dozen projects have been approved between second street and the bay. these architectural rendering show some of the projects currently under construction or about to break ground. it includes the lumina, 655 luxury condominiums at maine and

fulsom streets. construction started last month. they will go on sale next june. >> putting housing and jobs together in a dense, urban environment where people can interact and have that kind of spontaneous interaction is what people crave. >> carolyn tyler, abc7 news. family and friends of the belmont little league team came out to watch the kids in play off action. a viewing party was held at a high school yesterday. the team played arizona in the first game of the western regional in san bernardino. shawn lee was the starting pitcher for the belmont-redwood shores all stars, and he is tough to hit. >> he has a fastball, a change ball, curveball, splitter, knuckle, he pretty much has everything. >> sounds like it. sports director larry beil will be along later in sports to tell you how the boys did. lisa argen is here now to tell

us how the weather is. so summary this morning. >> totally! nothing like summertime in the bay area with a blanket of low clouds and fog and mist and drizzle at the coast. as we head outside in a minute, you will see a pretty sunrise. right now live doppler 7hd showing you the sweep from the national weather service. and ours up around mount st. helena. official sunrise 6:15. setting at 8:16 and delays at sfo about 56 minutes due to the low ceiling. we are looking at the mash reason layer once again up to 2,000 feet deep. the look from our golden gate bridge, you see all the gray sky. you may need your wipers from time to time. numbers in the mid-50s with the clouds moving on into san jose. we talked about the airport delays at san francisco, partly cloudy in oakland. here's a nice shot from mt. tam. you see the sun is just trying to on now. we are looking at partly cloudy skies in concord and livermore this morning. mid-and upper 50s. out by the delta, the southwest

winds, up to 28 miles an hour. so it will be breezy today. the higher elevations by the delta, also by the coast. napa right now, a little warmer at 55 degrees. finally, from our exploratorium camera, you notice it is pretty gray-looking out there. the low fog, clouds, even a little mist this morning. a mild to warm day today and the warm side of the forecast really just for the first half of your weekend because things cool down not only tomorrow, but into next week. so summertime not really coming back into play. in fact, right on through the middle of the week looks pretty cool. so it's been gray at our coast, and that doesn't change today. the onshore flow remains steady. so with that southwesterly component we are looking at the low clouds, the fog pretty generous throughout the afternoon. and then this trough comes into play. as it does, that enhances the onshore flow. no sign of any 90s around here, the typical summertime

heat we would expect. today as much as 5 degrees below average in the south bay. 78 for your high today in san jose but a nice sunny afternoon. 81 los gatos and 71 in santa cruz on the peninsula. you are starting out gray, 74 later on san mateo with 78 in mountain view. so average temperatures here, the clouds remain from pacifica to half moon bay. the sunset district pretty gray for most of the day. 61. but afternoon sun san francisco, 65. and in the north bay here's where we have the range. numbers will be in the low 60s with mostly cloudy skies for stinson beach. but head north through clear lake and ukiah, no 950s. 7 in castro valley. out over the hills, numbers here pleasant. 84 in concord with lots of blue sky. 9 in brentwood today. we are looking at another nice afternoon for a ballgame with low 70s. hopefully they can turn it around today, the a's.

>> welcome back. a farm in mexico is the source of a illness that broke out across many states. they trace it that taylor farms of mexico. they provide salad mix to restaurants in iowa and nebraska. the fda is not saying whether the salad is responsible for sickening hundreds of people in 14 other states. but taylor farms sells half of its salads to olive garden and red lobster. company said it's cooperating with the fda and none of the salad mix is in the food supply any longer. the fda is stepping up their surveillance of greens to the russell from mexico. a russian drive is back in jail this morning after taking a place man for a dangerous ride. take a look in this dashcam

footage. you see the driver take off just as the policeman approaches the car. he drives through traffic with the officer frantically holding on. the officer slips off about a half-mile into the ride. turns out he's going to be okay. the driver, who has a record of theft and drug possession, said he took off because he was afraid of going to prison. good morning. still ahead, a rare summertime decision by the u.s. supreme court. the vote that could set thousands of california inmates free. and a progress report on the new bay bridge. testing is underway to see how well it will hold up decades from now.

here's meteorologist lisa argen. >> good morning, katie. clouds and fog from the north bay with a mile and three quarters visibility. four miles half moon bay. elsewhere the fog has moved across the bay, but we are partly cloudy in concord right now. so your afternoon forecast looks pretty good with lots of sunshine, climbing into the low 70s for oakland. the coast will stay cloudy. it will be breezy right around the bay, and the higher elevations as that southwesterly wind reaches the delta. as it does, it will keep the numbers into the upper 80s, not making it into the 90s. in fact today the warmest day of the weekend, we are starting our cool-down tomorrow. i'll tell you how cool and what the first full week of august looks like coming up. >> thank you, lisa. the u.s. supreme court has ordered california to release thousands of state inmates because the prisons are overcrowded. the governor, of course, has been fighting the feds in court to stop it. but he's now run out of options.

abc7 capitol news correspondent nannette miranda reports. >> governor brown said california's prison population cannot be reduced any further without letting out dangerous felons. the u.s. supreme court refused to stop an early release order to ease overcrowding. the ruling in the decades-old case is a victory for inmates. they claim healthcare behind bars they say fails to meet constitutional stand cards, causing needless suffering and death. the overcrowding still stands in the way for an effective remedy for the medical and healthcare problems that plagues california. >> california has already reduced it's prison population by 46,000 since 2006, but the courts have continually said that's not enough. the state needs to shave another 10,000 in less than five months. governor brown is really out of legal options at this point. he risks contempt of court charges if he doesn't comply by the end of the year. >> the corrections department confirms preparations have begun

to meet the reduction. 30 from the women's prison have been identified as eligible for medical parole. along with more than 800 men throughout the system. contracts with out-of-state prisons have been extended and sentences are being recalculated for those with good time credit and completion of rehab program. >> this is absolutely insane. >> groups are worried. while crime rates are still at historic lows, the numbers were slightly up for 2012. >> unfortunately the state has already shifted those who they consider low-risk inmates to the counties, and now all that's left are your most serious and violent criminals in the state prison system. >> the legislature has until mid-september to pass laws or a approve funding that enables the state to further cut prison population. abc7 news. >> knew this morning, president obama is calling on congress to act on his plan that he says is a better bargain for the middle class. in his weekly address the president says the country has

fought its way back from recession and started to lay a foundation for stronger economic growth. but he says more work needs to be done. he says middle class families need help getting good jobs, owning homes, getting affordable healthcare and securing retirement. >> there are no gimmicks when it comes to creating jobs. there are no tricks to growing the economy. reversing the long erosion of middle class security in this country won't be easy, but if we work together and take a few bold steps, and if washington is willing to set aside politics and focus on what really matters, we can grow our economy and give the middle class a better bargain. >> senator susan collins of maine delivered the gop address. she says obamacare discourages small businesses from creating jobs and hiring new employees. bay bridge are putting new pieces of the span under the microscope after dozens of rods snapped earlier this year. they started testing a series of steel anchor rods.

in may an older set broke when they were tightened, potentially strengthening the earthquake features and delaying the opening date. they are now make custom steel saddles to fix that problem. the new rods are undergoing tests and corrosion tests to find out what will happen to them decades from now. >> we want to make sure people understand we take this very seriously, we take safety seriously and we want to make sure the bridge is safe not only whether it opens to the public but years down the road. >> so far they haven't found additional problems and they don't expect further delays. they have not set a date for the opening of the new certain span. the students are about to meet spent their time in graduate school learning about learning. now they are faced with a master thesis like none other, to build a product designed to change education. abc7 news reporter johnathan bloom has a look at what they came up with at the stanford education technology expo.

>> reporter: in a room milling with people, one man is playing guitar. nobody can hear him, but his computer can. it says needs more practice. >> it returns feedback. it's kind of like guitar hero burks with a real guitar and on your computer for free. >> danny is a stanford student and his app called sturify is a final project in a masters in learning design and technology. he's hosting this expo with a host of other bright minds. >> start and then end the program. >> megan built a toy called dr. wagon where you write computer code by averaging blocks. >> this way kids can get exposed to the basics of programming but using tangible objects. the sheer variety of projects has the faculty impressed. >> they are awesome. the students have put together some amazing things that all have something to do with learning but in vastly different ways. >> all the teams have got past the discerning eyes of their professors. now it's their first chance to present to the general public. an audience over 150 people,

including some silicon valley investors and lot of real life students. when we see it in the hands of real users and they give us feedback it is awesome or it's working or not working, that's the most exciting part. >> that was key for this design duo, a kit for dads to build things with their daughters. >> we found they wanted to spend time with their daughter but they had though idea how to. >> not just for bonding but it teaches girls engineering and creative and social. >> we wanted to design an experience they can create art together. >> you are never too old to learn. that's the point of "make tea." they spend time on their ipads or iphones. >> her app comes with a real life tea set to bring them back together with thought-provoking questions. technology sort of facilitating connection instead of decreasing it. >> and this expo is facilitating for the students as they go on to change the face of cool.

>> welcome back, everyone. we are coming up on 6:41 this saturday morning. you are looking at some gray skies over the san mateo bridge. hayward, cloudy right now. but you will get into the low to mid-70s this afternoon. some things to look forward to. downright toasty for the bay area summer. >> a small mom and pop market are struggling to keep their store open after a small car slammed into the store almost two years ago. it happened on san francisco's russian hill, and the legal fight that's followed has almost driven them out of business. mark mathews covered the crash and has this update. >> surveillance video caught it , the yellow cab, as it ran a stop sign, clipped a sedan that spun through the intersection and ran into the front of the new russian hill that was in 2011. a few days later the owners were throwing out food and thinking

this a them months of business. >> could be a month, two months, could be six months. >> they never guessed it would be ten months before the store could reopen. building owner's insurance paid to repair the entrance and the store's insurance company paid $121,000 for loss of business. the store's owners say it's not nearly enough. >> we had bills. you have to pay the pg&e bill, you have to pay your insurance, you have to pay whatever bills that come through the door. >> if customers were coming through the door, the two brothers who run the store say they would survive, but in the ten months they were closed, a lot of the regulars found somewhere else to shop. >> they would go to one of the other markets and then they get used to going there. >> you close for ten months, people get on other buses to go to other stores. >> now the shelves are sparsely stocked and they say they have run out of capital to restock and they blame yellow cab for dragging out the legal fight. >> we're not sure why they don't want to sit down and talk about settling the case. >> the lawyer for yellow cab told us there is a dispute as to

above the insurance proceeds. the insurance company has recently filed its own action. the two cases will be consolidated. yellow cab is prepared to attend a meditation to resolve all issues. but, in fact, it could be many more months. the brothers want damages amounting to a little over $1 million. and because their insurance company only recently filed its own action, the december trial date will likely be pushed to the middle of next year. >> there is no way. there is no way we could holdout until next year. >> the brothers say their families had the business for close to 20 years. this market crash could close them. mark mathews, abc7 news. >> lisa argen keeping an eye on the forecast and hopefully has some good news about when and where this will clear up. >> in san jose we were clear and now we are looking at the golden gate bridge, where it has been cloudy all morning long. mist and drizzle. so the clouds entering the picture for most numbers in the
