. i love oakland. come on. i have been here long enough to vote. >> frustration and fatigue at the bargaining table from both sides of the bart contract dispute. negotiations have been going on all day and there is still no deal. we are live in oakland tonight with the latest. >> reporter: i will tell you what. on most nights the negotiating team leave this building at 8:00 in the evening and sometimes they stay until about 10:00 or after. right now they are still inside. officially making this one of the longest negotiating days and we just saw food delivered. there is a chance they will be in there for a while longer.

another full day of negotiations and even with a chance of a court-ordered cooling off period, the pressure to hammer out a deal is still on. >> all along the process is more delayed than it should have been. at this point with a little bit of pressure we are hearing that the legislators are weighing in and urging the resolution. >> in a move to keep the trains running, even if a deal is not reached, governor brown called for a 60-day cooling off period. a superior court judge will hold a hearing to decide if that's necessary. that prompted both sides to say they agree on at least one thing. >> we need a deal by sunday. we don't need the writers wondering what the heck is going to happen on october 11th. >> we are not nuts. you want to come back here in 55 or 50 days? >> there plenty of points of view. >> i get paid pretty good.

eric thomas and kristin we have will ob a half hour earlier than usual on the abc 7 morning news. >> the man accused of killing a woman and her son is dead. police shot and killed 40-year-old james dimaggio in idaho late this afternoon. the young girl was found, live and will soon be reunited with her father. we have the details. >> a six-day manhunt from san diego to idaho for a 40-year-old double murder subject and the girl he allegedly abducted, hannah anderson, is over. >> during an arrest attempt at the north end of moorhead lake in idaho, the suspect james lee dimaggio was shot and killed by an fbi tactical agent. hannah was successfully rescue and appears in pretty good shape.

>> a homicide suspect in a very rugged area and we have a 16-year-old girl we wanted to bring home safely. we wanted it to end safely and wanted her home. that's what happened. >> 200 specially trained officers penetrated the terrain called the river of no return wilderness to find dimaggio and the teen after hikers spotted them there on wednesday, three days after dimaggio allegedly killed her 8-year-old brother ethan and mother and burned the home to the ground. police believe he had an unusual infatuation with hannah. her father brett desperately wanted to have his daughter back. >> he is elated we found his daughter alive and plans are being made to reunite him with his daughter. >> a reunion that will happen days after a family tragedy. abc news, new york. >> new detail about the plane crash in connecticut where four were killed.

the pilot, microsoft executive and his teenage son. a 13-year-old boy and a 1-year-old child also died in one of the homes hit by the plane yesterday. the federal investigators say there no obvious signs anything was wrong with the plane. new details on a fire that engulfed a double-decker tour bus. the engine compartment exploded and the flame happened around 6:00. it happened near the waterfront. the dozen or so tourists got off safely along with the bus driver. many had no idea the bus was on fire. the bus driver knew something was wrong and ordered everyone off. >> there was an explosion and then a fire. it was on the back of the bus. this is the only thing we saw. we didn't feel like it was on top of the bus. >> the fire department arrived quickly to douse the flame. no word on what caused the fire.

>> a little girl is recovering at home tonight after a very strange accident. the horse that was pulling the buggy she was riding in got spooked and took off down a city street. lisa joins us live from the newsroom with what happened. lisa? >> it's not every da a see a horse and buggy going down a busy street, but that's what happened in petaluma. at point there was no driver and no easy way to stop the scared horse. the 10-year-old had the fright of her life today. she was sitting in the back of this buggy where it was pulled by the horse. the owner was steering the buggy. >> just like that she took off. >> lady raced down east washington going 25 miles an hour towards on coming traffic. at one point a metal sign was in her way and she barrelled through it, knocking her owner out of the buggy.

>> it catapulted over the top of the board and landed on my arm and side. still had her line in my hand. >> the buggy ran him over. >> this leg has got road rash over that side and looks like the buck board wheel ran over my leg. >> this meant cecilia was all alone. late was running down the middle of the street. a total stranger stepped in to help and blocked the road with his truck. lady went around it, but the buggy smashed into it. it left injuries to cecilia's face. >> the out come of this collision could have been worse. >> that good samaritan stayed with her until her mother arrived. >> he sees a child in distress and he is like any father, he will do what he can do. >> lady's owner doesn't plan to take his horse and buggy out on city streets again.

in petaluma, abc 7 news. >> authorities are not expected to release the identity of a found for a few days. the search for a criminal investigator is over. the 50-year-old woman was last seen sunday with the sex offender and felon, randy alana who was arrested on a parole violation. they are calling him a person of interest. they dated about 20 years ago. >> the search if are a missing marin county woman has been suspended after a body was found in sequoia national park. johnny gene daniel was last seen sunday. she is an experienced hiker who frequently goes hiking alone. daniel was hiking along the saw tooth trail and they found a body today just below the trail and are wading for positive id. >> firefighters in southern california are starring to get the upper hand on a fire burning in riverside county.

the silver fire is 70% contained, but the fire is growing. it burned 19,000 acres and burned homes and buildings. or evacuation orders have been lifted, but some are still told to stay away. it has been a rough fire season in california and the peak is still to come. fire officials said they battled 4300 wildfires already this year. the average is around 3,000 for the year. more than 110 square miles has burned this year. that's closing in on 170 square miles. the total burned over the last five years combined. >> let's go to abc's meteorologist for the check on weather. >> we managed to warm up a few degrees today. even mid- to upper 80s inland, but still picking up that low cloudiness and fog. starting to move back inland. it will not be as widespread. not as dense as the past several mornings.

as dramatic scene in san leandro, but it was just an exercise. screaming student volunteers marked the beginning of the exercise and police, fire crews and paramedics respond as a person with a gun was shooting on school grounds. the importance of such training exercises can't be emphasized enough. even a few minutes of delay could mean the lives of several students. oaklan responded s responded toa call to end gun violence and turned in dozens of weapons. it was the second anonymous gun buy back. residents who turned in weapons were given $200 for a hand gun. it's not about the money. >> it's not a secret and nothing we expect to solve. we don't expect it to stop tomorrow, about you we want to

belmont little leaguers ended with the western regional championships in southern california. there plenty of fans waiting to welcome the team home as heroes. those who couldn't go to san bernardino gathered in belmont to watch the game on our sister network, espn. they saw the team dominate to advance to kill yams port. we will have highlights in sports. a great job for the little leaguers. back to school time is a little more than a week away. to make sure the kids have what they need, the mo magic program handed out humans of backpacks. each was stuffed with school supplies courtesy of groups and businesses. the public defender's office started this in 2006 to help disadvantaged students. >> new at 11:00, a fund-raiser was held to ensure this yellow

and in the north bay. fog forecast at 11:00 showing you all of this will move further inland towards the delta, but it will start to back off quickly tomorrow. this is 2:00 tomorrow afternoon. most locations are seeing sunshine. lower pressure off the north coast responsible for bringing us a cooler than average four to five days where it moves away from the bay area. high pressure builds from the southwest and this is going to warm us up. back to temperatures which are normal for this time of year. for livermore, 89 degrees. for sunday up to 84. you will notice the trend by wednesday back up into the 90s and even san jose will start to get warmer as well. 83 this time of year and 77 and you will be back up into the low 80s by wednesday. outside lands tomorrow, if you are going there, bundle up.
