>> good evening, and thank you for joining us, b.a.r.t. trains will be rolling tomorrow morning. both sides in the labor dispute are in contract talks right now in oakland. negotiations resumed shortly after the judge issued a 60-day cooling off period, pushing back any possibility of a strike. >> bay area commuters who make nearly half a million trip on b.a.r.t. each day are breathing a collective sigh now that a b.a.r.t. strike will not happen tonight. >> that's excellent news. i'm pretty sure the commuters well be happy. >> in a ware reekend a weekend hearing, the judge granted the request for a cooling off period so negotiations can continue while trains keep running. b.a.r.t. management and the unions remain at odds over wages, benefits and pensions. in statement. b.a.r.t. says, while we are glad

there will be no labor-related service disruptions we regret an agreement has not been reached. the first contract expired june 30th and workers win on strike for four and a half days. both sides agreed to stepped the contract for one month and the unions were set to go on strike on monday but governor jerry brown stepped in on sunday. the ruling centered on whether another strike would impact the welfare of the bay area. attorneys nor unions did not oppose the hearing. >> i'm afraid negotiations have stalled. and when the 60-day -- it's going to be stalled. >> b.a.r.t. board members deny the allegation. >> as a director, i and my colleagues will be placing pressure on the continuation of negotiations. i. >> the new deadline to reach a contract agreement is now october 10th at midnight. both sides say they're excited to getting a deal done before

then. >> san francisco mayor ed lee responded to cooling off order saying, i applaud governor brown for taking the steps necessary so that bay area residents will not endure another unbearable b.a.r.t. strike. after the first strike, lee suggested the governor get involved in the dispute. >> just a few hours after the judge approved the cooling-off period, both sides continued their negotiations. sergio quintana is in oakland. what's the latest? reporter: well, as you mentioned there is a court order and a 60-day cooling off period but the negotiations continue and return to the bargaining table this afternoon. they have been back at it for a few hours now, coming to the caltrans building at 1:00 p.m. prior to this morning's court-ordered calling off period all side were facing a midnight deadline for a deal. unions are not happy about the governor stepping in because

they were hoping the pressure of a deadline and strike would get b.a.r.t. management to move on the issues. this afternoon all sides said they do not want to extend the negotiations any longer. >> i would be much happier if we had an agreement. the whole idea is to get an agreement. >> i'm afraid negotiations have stalled. and when the 60-day -- it was going to be stalled. and b.a.r.t. just took the plan they got a 60-plus day play now. >> for now, riders can enjoy 60 days of uninterrupted b.a.r.t. service, but a strike in october is stale possibility -- is still a possibility if a deal is not hammered out before then, and all sides are hoping for a deal. the negotiations are continuing. however, it is dinnertime, and they only just started at 1:00 p.m. some of them are now taking a break and getting something to eat before they return again. reporting live, abc7 news.

>> ama: we're going to be monitoring the talks all evening with lie updates at 6:00 and 11:00, and because of the b.a.r.t. service uncertainty abc7 news will start an hour early tomorrow -- a half hour earlier than usual at 4:00 a.m. tomorrow for morning news. new details tonight as san jose police investigate a car accident that killed two teenagers. officers say a car with five teenagers inside crashed into a tree. happen just before midnight. the 19-year-old driver and a 16-year-old passenger died. one person was ejected from the car and he and two others are in the hospital. they are expected to survive. investigators say speed was likely a factor in the crash. they're also investigating if alcohol had anything to do with it. horseback ride north america idaho who spotted the suspected double murdererrer and his teenage captive are telling reporters the two did not want

to talk. james lee dimaggio was shot to death by fbi agents yesterday in the idaho wilderness. one of the riders noticed the two were not equipped to camp in the rugged terrain and tried to talk to the 16-year-old girl. >> i said to the girl, that was soaking her feet, what are you doing with your feet in water? there's fish in there. and trying to joke. and then as we turned to ride away, she didn't make any comment. so we started riding away and then says looks like we're all in trouble now. >> anna anderson was found safe and is in hospital under observation. dimaggio is suspected of having kale hannah's brother and her mam. >> now we can take our time to grieve my daughter and mr. grandson. -- and my grandson, but we have our granddaughter, and couldn't ask for anything more at this point. >> ama: hannah's dad is expected to land in idaho shortly.

>> today state department officials re-opened several embassies and consulates. 1860 the 19 diplomatic posts closed last week and are back open. however the embassy yemen will remain closed. they were shut down after after intercepted met yack indicated a terror attack. >> an 80 people died in attacks that occurred within an hour of each other yesterday. suggesting a level of coordination in the assault. no group immediately claimed responsibility. those security forces and civilians are frequently targeted by al qaeda's iraq branch. the u.s. is condemning the attacks, saying those responsible are enemies of islam. >> one person remains unaccounted for in the colorado town hit by flashfloods and a mudslide. rescue crews say two people who were missing have been found safe.

>> ama: you may not hear much about it but race organizers say dragon boat racing is the fastest growing sport in the world. 20 different teams took part in the competition. these year's festival irthe regional jamship to determine who represents the u.s. team in the world championships in italy next year. it's a sport that has been around for 2,000 years and oakland has a special place in its history. >> in china, picked up in the united states about 20 years ago. oakland has a piece of that history. the oakland fire department had the first team in the bay area. >> ama: a wide range of teams take part with divisions including a group that is under

outside lands concert this evening, golden gate park, you can see this is the great highway. although low clouds and fog, mist and drizzle, moving in that direction, so obviously they'll have a great time but the low clouds and fog will be there as well. gusty winds, napa, southwest, gusts to 18. 14 in fairfield, mountain view, out of the southwest. live shots from san jose and you can see blue sky there. current readings, 73. san francisco, 67 and from the mt. tam cam you can see the arm of fog moving through the golden gate. most of the north bay was under mostly sunny conditions today. santa rosa right now, 76. novato, 77. temperatures did warm slightly. concord, 82. livermore, 84. definitely going to see a little bit more of the coastal low clouds and fog, mist and drizzle

overnight. a warmer day for the bay area for monday and then the warming trend will stay right on in through mid-week time span next week. here's a look at the lows for tonight. generally in the mid-to-upper 50s. the problem will be the mist and drizzle near the cost -- coast and if you have earl -- early flights, the fog will move inland and then back off by 3:00 tomorrow afternoon. here's the area of low pressure bringing the cool air to the north. that's why we saw a little bit more warming inland, and high pressure is bringing in a bubble of warm air, migrating from east to west. so looks like inland locations, central valley, will get into the warm range the next several days, and all of this will begin tomorrow. the coast, you'll still remain in the mid-to-low 60s throughout much of the work week, livermore, tomorrow,le 7.

the average high is 89. by wednesday you hit 90, and even san jose warms up nicely by mid-week, with highs starting to move into the mid-to-low 80 range. here's a look at our temperatures for your monday. 78 for san jose. 73 for milpitas. the peninsula, once again only in the mid-70s. palo alto, 74. san francisco, 64. mist and drizzle tomorrow morning. santa rosa, 82. 78 for sonoma. oakland, 70. 73, union city, and brentwood 90, 85, con card. the seven-day forecast, nice warming tuesday and wednesday. wednesday will be the warmest day. mid-to-low 90s, mid-60s at the coast and then start to trend down a little bit. thursday and friday. today was great, sign and temperatures coming up. >> ama: shu is here. first the president was golfing, maybe not championship level.

furyk led by one to start the day. two strays birdies gave dufner the lead. furyk ties for the lead with this birdie. however, dufner's iron play was on fire. his approach on eight. he would retaining the lead. dufner was calm. on 16 he does it again. a short birdie putt. makes that. dufner now up 3. but furyk made his birdie at 16, too. lead down to two, two to play so he has a chance. both bogey 17, and dufner on 18 for par. same putt on friday. comes up short but taps in, finishes bogey bogey with a 68. a two-stroke victory over furyk. jason dufner wins his first major, earning the wanamaker trophy. >> hasn't hit me yet.
