>> abc7 news reporter joins us with that story. carry? >> we are at stanford hospital where police will come later this morning to question a paint to find out if he is the driver responsible for the crash and leaving the scene. we have video from the accident that happened last night before 11:00. there was only one vehicle involved accord to the c.h.p. and the driver of the party bus lost control, and drove off the road and into a tree 10' from the highway. the bus went down a 20' embankment and the right side of bus was sheared off and the bus mangled and the passenger was killed, a man in his late 30's from san francisco. when responders as lifed the driver was gone but they discovered a man with minor injuries near the scene of the

crash. we have one person we located in that area and that person was transported for minor injuries but at this time we don't know whether that person is involved in the collision. was he a passenger or driver? >> police will come to the hospital to question the man to figure out if he was the driver. because the area near the crash site is so wooded, if you are familiar with the area you know that, the man must have been involved because this was no way he would have been if that area. they want to confirm and come here and question him. but they did inspect him and tell me they do not believe alcohol was a factor in the crash. >> thank you, kira. >> we will see what is going on at the accident scene. leyla gulen? >> everything is moving on at

top speeds with all lanes open northbound 280, you can see 64 miles per hour is the top speed and everything is back to normal and the activity on 580 westbound over the pass, we have a report of a crash at flynn road involving a big rig. up ahead we have another report of an accident and we have a small vehicle at 1st street on westbound 580 so we are not sure if this is connected but it is causing plenty of slowing in the westbound direction. so bumper-to-bumper traffic is expect an hour in the car from tracy to dublin. i don't know if you using the air conditioning, but we will find out from mike if it is necessary. >> warmer weather in the afternoon and live doppler 7 hd is showing a dry commute but drizzle is possible. for the bay the next 12 hours show clouds and sunny by noon, and mid-to-upper 70's hanging out near 70 in the afternoon and

governor asked for the extension. so, now the two sides have two months to grow on a contract. is that enough time? leaders from both sides say they still far apart and accuse the other side of being unreasonable. riders say they hope they are not forgotten in the negotiations saying they paid the price dug last month's strike. for everyone else, it is a problem because we don't have cars and we cannot just go anywhere with the shuttle like going to sfo but at walnut creek area, we do not have a shuttle. he is referring to the shuttle bart provided riders from the east bay to the city during the four day strike in july. commuters are hoping that will not happen again and we are hearing a variety of predictions and some think there is a good chance to could an agreement because the public is demanding it and others feel hopeless
