it is 8:00 a.m. on saturday and we want to start you off with a quick first look at the weather. here is meteorologist lisa argen. good morning, lisa. >> good morning, katie. here is a look at the temperatures right now. mid60s for concord, but all the way into the upper 60s for san jose. members -- numbers in the north bay have been cool. a quick warm up on the way. very little wind and compressional heating and a clear start with the absence of fog. throughout the day we will allow for the quick warm up. look at the 90s and 100's. most of the bay will be in the it -- 80sand 90s confined to the immediate shoreline.

it looks like we will see a little patchy fog develop late tonight from the south. but overall it is going tobe a hot several days. high fire danger and kind of oppressive out there with poor air quality throughout much of the bay area today. take it easy and we'll let you know when the cooling trend heads our way in a few minutes. katie? >> thank you. new this morning san jose police are working to find out more about the death of a man on the eastside. several people reported hearing gunshots around 9:40. officers arrived and found a man dead. no arrests have been made yet, but detectives have interviewed someone they are calling a possible suspect. they have not said if the shooting is gang-related. it is san jose's 35th homicide of 2013. also new this morning, crews remained on scene for several hours after putting out a big fire in san jose. you can see flames rising in this video provided to us by abc7 viewer amanda savage.

the fire broke out in a warehouse near mayberry road around 11:00 last night. extra firecrews raced to the scene after the flames spread to two adjoining buildings. nobody was hurt and investigators are looking into what started this fire. police in vallejo are investigating this morning after an 18-year-old man was shot to death. it happened before 11:30 last night on louisiana street. officers found a white honda at the scene riddled with bullet holes. the driver was pronounced dead. two juveniles in the car were shot and were taken to hospital to be treated for their injuries. witnesses say they saw a brown honda drive by and open fire. the death marks vallejo's 15th homicide this year. we are learning more about the woman killed by a san francisco park and rec truck. she was enjoying a sunny thursday with her baby and dog at holly park when she was run over. now we are learning the man accused of killing her is out of jail. abc7 news anchor ama dates has

more on this development. >> the 35-year-old was run over and killed by a san francisco park maintenance truck at holly park. people who knew her are remembering her kind spirit. she was a wife and a mother to an 11-month-old daughter. she was a zen monk who worked at new ventures west in san francisco, a business that of oners professional coaching. her employer released a statement saying in part, kristi was full of brilliance, passion and kindness. her high energy and enthusiasm affected everyone she touched. she was also a dancer and per tomorrowed with a group out of ohio. we spoke with the dance director by phone. >> she was a real generous, loving, beautiful heart. anytime you see her she was always smiling and always had nothing but wonderful things to say. >> police believe 57-year-old tom bernosky is the park and rec employee who killed her. he drove off after running over her. police found him a few blocks

uh what i and arrested him. he posted bail. he has been placed on unpaid leave while police investigate what happened. he worked as a gardener for the park and rec department since 2006. he is also dealing with a loss. in april his 20-year-old daughter tiffany was killed in a car accident on the i-5 in fresno. >> she frequently shopped at three stone hearth. the store has been getting donations to provide meals for her young daughter and husband. if you would like to help with that we have a link on abc7news.com under see it on tv. the family of a man killed by police officers in sunnyvale is angry about what an investigation into the shooting has revealed. 34-year-old juan ruellas was killed on wednesday. police say it happened after an under cover drug sting. officers say they bought a pound of meth from him. he threatened them and made a move that looked like he was

reaching for a weapon. he was hit several times. officers did not find any weapons on him or in his truck. his family told us they are upset with how many times he was shot and that no weapon was found. the 6 veteran officers are on paid leave during the investigation. dive teams will be back out today to search for an oakland man who disappeared in lake shasta while swimming with friends. around 10:30 yesterday morning robinson sook began to struggle and went underwater. his friends tried to find him, but he never resurfaced. dive teams and aircrews joined the search and were not able to find him either. president obama will address the nation on tuesday in an effort to gain support for a military strike against syria. the president wants the strike in response to a chemical attack president obama says was against the syrian government. the president said winning support from allies in congress will be difficult. right now half of the house and a third of the senate

remain undecided. >> there is no question what is coming is overwhelmingly negative. >> it is conceivable at the end of the day i don't persuade a majority of the american people that it is the right thing to do. >> yesterday all nonessential personnel were ordered to leave lebenon because of security concerns ahead of the possible strike. in the bay area several groups are planning demonstrations to show their opinion about our possible intervention. >> we need to know what we are doing before we do it. >> it is a no win in the long-term. >> while lawmakers debate whether to support president obama's call for a limited military strike in syria, others here in the bay area have already made up their minds. >> we are very much against u.s. intervention in syria. >> rick sterling is with the mount diablo center a group that will demonstrate against

about what is going to happen if we do this. here you have the middle east which is already in bad shape. >> while many have made up their minds about potential u.s. action, others want to see the details of the president's proposal. that before making a final decision. laura anthony, ab abc7 news. the rim fire in yosemite national park is now the third largest fire in history. the fire burned 385 square miles. it is 80% contained. this morning state route 120 which has been closed since the rim fire began is back open. fire damage to the san francisco water and power system could reach nearly $30 million. repairs are underway to the roof and transmission lines at hech-hechi reservoir. the city has spent about $900,000 for other power sources during the shutdown. the water service for the bay area residents was not

affected. a man suspected of killing a popular schoolyard supervisor in san jose is being held without bail. she was found dead in her mini-van tuesday outside san antonio elementary school. the suspect has been charged with her murder. he did not enter a plea yesterdayment police have said the two knew each other and have not said how. details of the case have been sealed during the investigation. she is expected back in court next friday. a married couple dubbed the landlords from hell have been sentenced in san francisco. here they are. kip and nicole masey. one of their tenants went to court and says the sentence does president go far enough. lilian kim has more. >> kip and nicole masey knew their fate when they walked into the courtroom. their four-year, 4-month sentence was a plea deal made in june. nevertheless neck coal masey's

attorney said it was draw cone yun and the argument went no where. >> we had some arguments and i do believe this is not a draw cone yen sentence. i believe it is a reasonable sentence. >> they have been convicted of residential burglary, grand theft and stalking in connection with a two-year effort to get five of the tenants to move out of the building. prosecutors say the masey's doused their beds and cut out sections of support beams and sawed holes through the floors. they cut telephone lines and cutoff gas and power and repeatedly changed the locks. he was a live in building manager at the time and fears for his safety. >> they have a criminal mind and i can't expect anything from them. so either they can be free or pay somebody. that's why i feel a nervous insecurity. >> i will give you credit for having served -- >> they have already served almost three years of their

san jose has been clear all nightlong and this morning we are looking at a beautiful start to the day although it it will be warmer than yesterday. santa rosa had the radiational cooling. numbers dropped off to near 50 degrees this morning. at 58 right now. novato is still in the 50s. 75 in antioch. a quick warm up on tap with a high fire danger and concord is at 64. hazy view from mount tam. it will be very warm here. you had a taste of this yesterday, but with more heat on the way we are just really right in the middle of what will be a mini heat wave for us. a cooler pattern begins with a more general sea breeze by tuesday. but it will kick up a bit tomorrow. from our sutro tower we have poor air quality out there. you can definitely see it from the cameras. with santa clara, the poorest of the air quality, but the inland east bay taking a hit as well. by 2:00 in the afternoon they hillary assess whether or not

we will see another spare the air day tomorrow. as high pressure build had in from the north we will get the offshore flow and very little help from the marine layer. in fact, it will stay absent and that will allow for another warm evening tonight. we are looking for the heat to continue throughout the next several days in oakland. we will give uh glimpse of the next week or so and you notice with sunday and monday well into the 80s to near 90 it is not until tuesday and wednesday that the bay really gets a dose of that marine air. but we still should be a couple degrees shy of what we will experience today. our inland east bay, not so lucky with numbers near 100. you are going to stay sizzling hot right through the early part of the week and then finally dropping down into monday and tuesday. the rest of the south bay today, 92 mill pea disand how about 97 in morgan hill. low 90s in redwood city and mountain view and at the coast we will touch 80 in the sunset and 86 san francisco with 95

we are coming up on 8:30 and we are starting this half hour with a quick look at the weather. here is lisa argen. >> good morning from our sutro tower camera. it looks steel and hazy out there -- still and hazy out there. we have no wind at all and the marine layer is absent and it will stay that way for the next several days. before today, not only a spare the air today, but the poor air quality with the ozone gathering in the santa clara valley. elsewhere things will get pretty interesting throughout the next several days because the temperatures are not expected to cool off. we will look for this little mini heat wave to take us through the weekend and monday temperatures near 90 in the inland east bay. that's near oakland. at the coast talking about 80 half moon bay and plenty of sunshine and warm conditions there. inland, here is where you will have to wait several days for anything to change. we are talking upper 90s for

the san ramon valley and toward concord and live more and no delta breeze out there. we are talking about temperatures well above afnlg. this is hotter -- well above average. this is hotter than average. pg&e is facing more fines and penalties for another error in its records and for the way it let the state public utility's commission know about that error. this comes just days before the three-year anniversary of the deadly san bruno pipeline explosion. heather ishimaru has the story from san bruno. >> on september 9th, 2010 an underground high pressure pg&e natural gasoline ruptured and exploded into flames. eight people were killed and 38 homes destroyed in san bruno's glen view neighborhood. after that pg&e reduced the pressure on its gas system on the peninsula when it asked for permission to bring the pressure back up it was required to show that it was safe to do so. now it turns out the regulator granted the permission based on some faulty information.

pg&e did let the commission know about the error, but only months after discovering it. they are also concerned about the way pg&e submitted before a long holiday weekend in a process used for less serious constructions. they are not sure a fine will change pg&e, but it might have other benefits. >> it is certainly a3penalty fine or as stiff as possible sanction as a result of the proceeding. it appears to be appropriate. if only to draw attention to the fact that deficiencies continue to exist. >> the faulty records showed a pipe in san carlos near the intersection of britain and rogers was seem less. pg&e discovered it actually had a seem weld when it went in to fix a leak. it didn't try to submit the correction until july just before the long holiday weekend which san bruno lawyers believed was time to go unnoticed by interested

parties. pg&e's lead attorney on all san bruno matters testified that there is no safety issue and there never was. and that "we filed as quickly as we could without any thought on my part that this was the day before july 4th." 16 of the 38 destroyed homes are rebuilt. five more are under construction. but the three-year anniversary weighs heavily on residents who say it feels like yesterday. >> it is a tough time for us. it is made more difficult by the realization that safety deficiencies continue to exist. >> the cpuc will decide on the fines against pg&e sometime after october. heather ishimaru, abc7 news. >> the legislature has approved a bill to put limits on the paparazzi. celebrities say mob scenes like this caused by photographers trying to snap pictures are a common occurrence and last month actresses general neither garner and halle berry spoke out against paparazzi. the bill would fine or even jail photographers who hassle

the children of celebrities. >> everyone has a right to take a picture, no be pro. when you intentionally harass, verbally and physically, a child to secure a photograph to profit from, i think there is a problem. >> the bill would allow paparazzi to take pictures of adult celebrities as long as they don't harass the chirp. it is awaiting the -- harass the children and it is awaiting signature. if you have a sick relative it may change the way you care for them. the governor has a bill on his desk that rad clear alters the family leave act. capital correspondent nannette miranda has the story. >> lisa batista found herself in a situation where she couldn't care for her grandmother as much as she wanted in her final days. the nurse asked her boss to take time off, but couldn't. workers can get 55% of their pay for up to six weeks when caring for 6 pairns,

children -- sick parents, chirp, partners or spouses. no one else. >> the grandmothers are not included, and i couldn't believe that. she is my grandmother. >> the state legislature sent governor brown a bill that would expand the list of relatives the california family leave act would apply to, grandparents, siblings and in laws. supporters say that reflects the responsibilities of today's families. employees pay for it through their paycheck deductions under short-term disability insurance. >> these are funds that are paid by the employee and not the employer. they are monies put into a fund by each of us at our workplace. >> reporter: opponents sympathize with families, but they say there comes a point when somebody has to do the work. imagine a small business that doesn't have a lot of employees. >> at the end of the day, somebody has to do some work or else the company can't stay in business. we want to support those families and that's why we

support parents taking time of on -- off, but adding grand parents and siblings goes too far. >> she believes she will have other sick relatives to care for. >> i can't live without my pay, especially in this economy. i have two children and i am the main bread winner. >> governor brown has until mid-october to take action on the proposed expansion of the california family leave act. in sacramento nannette miranda, abc7 news. a bay area musician is doing more than just playing the blues this morning after someone stole his car and all of his musical equipment. ron thompson has played with many of the blues greats, but now he is playing with barrowed instruments. monday night he parked his car at his hayward home and didn't unload his equipment and everything was gone. that includes his 1950s gibson guitar, a guitar he had since he was 19. >> i am trying not to think

about it and try to think positive -- positively. hopefully it will return somehow. >> thursday night ron played his first gig since the theft. he barrowed instruments from the blues society. the society is also helping search for his stolen equipment. the contra costa county fire protection district has launched a new pilot program to keep more firefighters available for emergencies. a two-person medical squad well now handle lower priority medical calls. they will be based out of station one in downtown walnut creek. this will free up fire engines to handle higher priority calls like fires and rescues. the 90-day pilot program is designed to help maintain staffing in the wake of county wide budget cuts. >> we have areas around walnut creek and lafayette that don't have fire protection coverage like they used to have. they are still an engine that will show up. the fire department will still show up to those calls, but they are coming from farther

away now. >> fire station one was chosen because it is centrally located. five fire stations have been forced to close due to budget cuts in the fire district over the past two years. the bay area has some of the highest minimum wages in the country which has some people asking if tipping, especially in restaurants, is really necessary. lisa amin gulezian has more from san jose. >> the service at original joe's in san jose is known to be impeccable. diners expect it when they are paying $30 a plate. but what if tipping was eliminated? >> people would feel awkward if it disappeared entirely. >> but it has in san someplaces. they pay a flat service charge to the staff. jay they put in something like a 10% service charnel or graw few -- service charge or gratuity. most people tip more than 10%. >> steven silver is a professor of consumer behavior

at san jose state. he does president think the no -- he doesn't think the no tipping idea is something americans would go for even though in europe tipping is minimal. in parts of asia no one does it. restaurant tours in cyst that tipping is part of our culture. >> it wouldn't happen here because one we would have to raise our prices. it might affect my wait staff not getting the right service. >> what would you do if you didn't have tips? >> i wouldn't be a server. joy consumers -- >> consumers had mixed reactions to the thought of a set service charge. >> i think it is confusing. sometimes you have different server and you don't know where the money is going. one flat rate is great. >> i will tip either way. >> most americans who took an on-line survey agreed. 63% said they tip even when service is bad. in san jose, lisa amin gulezian, abc news. a bay area designer working for the royal family. wait until you see the one of

inland and that will really stay for the next couple days. i think the sea breeze will kick up a little tomorrow and into monday for folks at the coast and around the bay. but nonetheless it is going to be very warm until the early part of the workweek. and here is why. it started out this morning much warmer. so you add that into the equation with 9 degrees warmer compared to this time yesterday in hayward. you know it will be a warm afternoon out there. the culprit is this area of high pressure which has built in and with that we get that compressional heating. the air warms as it descends and it flows from the land out to the sea and that pushes the fog away. the marine layer is not having a chance for the next couple days although small craft advisory outside the bay and also inside the bay later on. 98 in sacramento and feeling like the valley here and looking like it this afternoon. still pretty smoky in the northern sierra. 80 degrees for tahoe, but better air quality, but hot in yosemite at 95 degrees.

look at all of the thients today and the -- look at all of the 90s today and the 80s. you will be lucky if you are at the coast, a popular spot. looking at temperatures warmer than yesterday. 86 san francisco, 90 in oakland and 92 palo alto and 94 in san jose. you were in the upper 80s yesterday. 94 in vallejo. can't escape the heat for most of us. if you are headed to mop 10 view for the art and wine festival, in the low 90s and plenty of sunshine. elsewhere around the bay we are looking at a very warm game today for oakland with the game time after 1:00 in the mid80s. it is climbing to about 90 degrees and foilly tonight if you are lucky enough to get giants tickets, it should be a gorgeous night. the temperatures are starting in the mid70s and then we will see 60s by 10:00. a mild night. the accu-weather seven-day forecast, very little change on sunday and monday. a little bit of a sea breeze close to the coast, but it is really tuesday when everyone gets to feel the cool air. back to normal on wednesday and thursday.
