making news in america this morning -- a welcome proposal. as the president prepares to address the nation on syria, a diplomatic solution now appears to be on the table. we're live in washington with the very latest. domestic dispute. george zimmerman is taken into custody after his estranged wife called 911. >> he continually has his hand on his gun. and he keeps saying, step closer. >> what kicked off the argument? and will any charges be filed? strange sighting. something unusual makes a flyover a baseball game. and cameras were rolling. and tough talk. new this morning, things get heated between anthony weiner and a reporter. >> you don't like things that you know about me. you want to make fun of me on television. join the club.

and good tuesday morning. we begin with new details that a deal which could avert a u.s. air strike on syria could be in the works. >> but as a possible diplomatic solution continues to unfold, the fighting in syria's civil war rages on. that is dramatic video, just into abc news, showing an aerial bombardment in and around damascus this morning. clearly, the fighting between rebels and syrian forces is not letting up. >> let's get the very latest on a possible deal. abc's tahman bradley is joining us from washington with more. good morning, tahman. >> reporter: diana and john, good morning to you. as president obama works to rally support for a strike against syria, a stunning turn of events. the president is now leaving open the possibility of a diplomatic solution.

tonight, syria takes center stage. president obama addresses the nation, calling for action against bashar al assad's regime. but as mr. obama gears up for the big speech, a possible diplomatic breakthrough. the president told abc's diane sawyer that the assad regime can avoid a military strike if it turns over its chemical weapons. >> i want to make sure that that norm against use of chemical weapons is maintained. if we can do that without a military strike, that is overwhelmingly my preference. >> reporter: the syrian government embraced the suggestion made by secretary of state john kerry, that it could avert a u.s. attack by handing over the weapons. president obama calls it a potential breakthrough. but added, he still wants congress to authorize military action. >> if, in fact, the choice is between a world in which dictators and other countries start believing it's acceptable to use chemical weapons on civilians and children, that will make it more dangerous for us.

>> reporter: the possible diplomatic out could not come at a better time for the president. on capitol hill, opposition to a military strike is hardening. >> i see too much risk that a military strike could do more harm than good. >> reporter: polls show a majority of americans agree. that anti-strike sentiment spilling into the streets. meanwhile, president assad, in an interview with pbs' charlie rose, issued a new warning to the u.s. >> if you strike somewhere, you have to expect the repercussions somewhere else in different forms, in ways that you don't expect. >> reporter: the senate has delayed a vote on a military strike against syria. this will allow more time for those diplomatic developments to play out. john and diana? >> tahman bradley, live in washington. thank you. former secretary of state hillary clinton is weighing in on the possible deal. speaking at the white house, clinton repeated her support for the president's plan and said if syria surrendered its chemical weapons, it would be an important step. >> this is not be another excuse

for delay or obstruction. >> we are likely to hear more from clinton on the issue tonight during a speech at the national constitution center in philadelphia. she will be given the organization's annual liberty medal. stay with abc news, for continuing coverage on the situation in syria. we will, of course, carry the president's address to the nation tonight at 9:00 eastern. new charges being filed against george zimmerman, following a domestic dispute involving his estranged wife. this took place yesterday at the house they used to share in florida and resulted in george zimmerman being briefly detained. shellie zimmerman called 911 to report george was threatening her with a gun and had punched her father. and she also said she was scared because she didn't know what he was capable of. >> he punched my dad in the nose. my dad has a mark on his face. and then, took my ipad out of my hands and smashed it and cut it with a pocket knife. >> now, hours after reporting the incident, shellie zimmerman admitted she never saw a gun and police never found a gun.

george zimmerman's attorney denies that zimmerman ever punched his father-in-law. the drunk driver who made an online video admitting to a fatal crash is heading to court today. 22-year-old matthew cordle spent tonight in a columbus jail cell after turning himself in to police yesterday. so far, the confession video he posted online has more than 1 million views. >> my name is matthew cordle. on june 22nd, 2013, i hit and killed vincent canzani. this video will act as my confession. when i get charged, i'll plead guilty and take full responsibility for everything i've done to vince and his family. >> cordle's blood alcohol was more than twice the legal limit. he could face 8 1/2 years in prison. his attorneys say cordle did not make the video to get leniency. but they are hoping that it works. hawaii could soon become the latest state to legalize gay

marriage. the governor has called for a special legislative session next month to move forward on a bill that allows gays to marry. support for the bill appears evenly divided among lawmakers in the house. the governor says he's not sure it will pass. now, to those destructive wildfires burning in california. in shasta county, two fires are burning in the happy valley area. at least 20 structures have been damaged or destroyed. nearly 6,700 acres have been scorched. more than doubling in size in just a few hours. the fire is only 5% contained. and the wildfire burning in the san francisco bay area wilderness park continues to grow, as well. the mt. diablo fire is forcing more people to leave their homes and leading to a fire advisory for area residents. crews will face temperatures in the high 90s later today, with windy conditions. flooding fears persist today in the southwest. and with good reason. they got a dose of it yesterday in phoenix. and it was not good news for several drivers. 2 1/2 inches of rain fell in a few hours during that afternoon, flooding stretches of highway and submerging several cars there. it is likely they will get more of that today.

meantime, out in the atlantic tropical storm gabrielle has reformed and there's another one in bermuda. >> the tropical storm is moving west right now. the national weather service says it could be declared a hurricane today. its maximum sustained winds reached 60 miles per hour last night. and checking our maps, now, closer to home, where we're going to see rain that could cause more flooding. that's going to happen in phoenix and elsewhere around the southwest and the rockies. and some rain today, also around the great lakes and new england. in florida and texas, as well as parts of the southeast. >> it will be 88 degrees in atlanta and baltimore. 80s also in the northwest. 90s will dominate the middle of the nation. readings of 70s for the rockies. it's almost here. we'll likely get a new glimpse of the new iphone later today. but we know a little something about what to expect. and under speculation. some swimmers are skeptical of diana nyad's swim from cuba to key west. and they say they have proof that she got some help. plus, now you see it. now you don't.

fitch. a judge ruled that the retailer wrongly fired a muslim worker for refusing to take off her head scarf. the company claimed it violated its looks policy. airlines fees are soaring to new heights at the expense of travelers around the globe. last year, airlines across the globe raked in more than $27 billion from passengers for baggage fees. seat upgrades and other extra charges. that's up 20% from 2011. and there's another massive recall from toyota to tell you about this morning, involving nearly 900,000 cars and suvs in the u.s. and canada. the recall affects rav4s and lexus sedans. a repair from last year may not have been fixed. nine crashes and three injuries have been linked to that problem. raise a glass to the creator of sam adams beer. the founder jim coke is a

>> no surprises here. if you're flying, airport delays possible in phoenix and denver. endurance swimmer diana nyad defending her record swim last week from cuba to key west. >> nyad plans to meet this week with members of the endurance swimming community, who are skeptical about her swim. with more on this controversy, here's abc's dan harris. >> reporter: when she staggered ashore on key west last week, diana nyad, age 64, became an instant icon of perseverance. >> you're never too old to chase your dreams. >> reporter: but pretty soon, the questions began. fellow long distance swimmers crunched the numbers, based on gps data posted by nyad's team. for the first 24 hours, she was going 1.6 miles an hour. then, according to her critics, she appears to have rocketed up to speeds of three miles an hour. four, then briefly six, which is faster than a u.s. olympic speed swimmer. >> the community is wondering how her team accounts for that incredible speed. >> reporter: did she hold on to the boat during this time? or even get in? nyad's team says she just got

lucky, a strong current helped her to paddle into key west one full day ahead of schedule. there's a question that according to her blog, for a period of seven hours, nyad apparently didn't stop to eat or sleep. >> in my own experience of marathon swimming, i find it hard to go longer than an hour without feeding. it's hard to imagine, even if my life depended on it. >> reporter: nyad told "the new york times," she's never cheated on anything in her whole life. if she cheated, she had a lot of help. she was accompanied by roughly 40 people on 4 boats. in and era when so many sports heroes have been brought low, those inspired by diana nyad are hoping she will not become yet another one. dan harris, abc news, new york. a new bride in montana has been charged with killing her husband by pushing him off a cliff just eight days after their wedding. friends of 22-year-old jordyn graham said she was having second thoughts about getting married. she told the fbi that she and her husband, cody johnson, were arguing at glacier national pork

park in july. she says she shoved him in the back and he fell off the cliff. one person is missing after a house explosion in indiana. the home was completely leveled. debris scattered 75 yards away. the flames spread to a nearby house. officials say the missing person was a neighbor who was watching that home. and another terrifying blast to show you. this one captured on camera in england. take a look. that food truck exploded into a fireball, completely blown to pieces. parked cars and nearby businesses were damaged. but luckily, there were no reports of any injuries. the driver said he was just moments away from hitching it up to a trailer when it blew up. officials at oklahoma state university say they are already investigating some bombshell allegations being published today by "sports illustrated." among the allegations, that certain players were paid for their performance. that some players were given better grades than they deserved. and that the school's drug use policy was inconsistently applied. "sports illustrated" says it's basing its report on interviews

with 64 former osu players, most of whom were at that school from 2001 to 2007. let's get to the pros now. "monday night football" is back. and it started with the new high-octane philadelphia eagles offense. the frenetic pace was way too much last night for the washington redskins. >> michael vick threw two touchdown passes. he ran for another one late in the third quarter. it was 33-7, eagles. washington scored three-straight touchdowns. they made the score more respectable. but in the end philly wins it, 33-27. tuesday morning on the east coast by the time the texans and chargers were done. san diego went out to a big lead at this one. at one point, the chargers lead 28-7. that's thanks to philip rivers and his four touchdown passes. >> they just couldn't hold on. the texans mounted a furious comeback, scoring the game's final 24 points, including a field goal to win it, as time expired. texans take this one, 31-28. rafael nadal, now to tennis, is now a two-time winner of the u.s. open. nadal battled novak djokovic,
