tonight the daughter of a woman killed in a domestic dispute wants women in abusive relationships to speak up and get help before it's too late. good evening. i'm dan ashley. >> i'm carolyn johnson. domestic violence plagued the family for years. tonight the eldest child of martha casias is warning other women to report abuse. casias was stabbed to death over the weekend and her estranged husband in jail. ama dates is at police headquarters in san jose. ama? >> carolyn, she is 22 years old and she is quite strong. we spoke to her tonight and she didn't want us to show her face on tv, but she wanted to talk about the kind of woman her mother was and she wants to keep what happened to her from happening to anyone else.

>> my mom was everything to me. she was a hero to us. she was the best mom ever. >> chavez hopes to gain custody of her two younger brothers after her mom was stabbed on saturday night. it happened on dakota drive. the killer was mario chavez, casia's husband of 20 years. >> i feel disappointed and i hate him so much. >> chavez is in jail and they say he murdered her while out on bailment they threatened the couple's 6-year-old son with a knife. the deputy district attorney says casias did everything she could to protect her family from that point forward. >> she took her children and moved out of the home. there was a protective order in place. she was really trying to get away from him, and unfortunately he wouldn't stop and came after her, and this is what happened. >> the detective investigating

the case says domestic violence victims need to seek out help immediately. >> many of these situations go unreported. it is a constant history of unreported domestic violence which leads to something brutal like this. >> she thinks her mom would be alive still if she spoke up sooner. she urges others to not make the same mistake. >> if you are suffering from domestic violence just talk because she didn't and you see what happened to her. >> she is trying to handle her mother's funeral. they set up a fund to help the family. if you would like to donate go to our website, abc7news.com and look for the link. ama dates, abc7 news. new at 11:00, the city of san jose agreed to pay nearly $feef million to settle -- $5 million to settle a lawsuit of a man shot by police after they thought his fake gun was the real thing. he was shot more than 20 times in 2011.

he was passed out in a hotel stirwell after attending a costumes party. he was dressed as a surgeon and had a toy gun tucked into his belt. police fired because they thought he was moving his hand toward the gun. oakland police hope a new sketch will help police catch the man who shot and killed an 8-year-old girl. here is that sketch. the shooting happened during a sleepover in east oakland in july. she was hit when somebody fired through the front door of the apartment. two other children and a grandmother were wounded. they survived. investigators still have not revealed a motive for the shooting, but through witness descriptions they have put together the sketch of a man they believe is responsible for the shootings. >> one year ago today the u.s. ambassador to libya was killed in a terrorist attack on the consulate in benghazi. three others died as well. stevens was a 1978 piedmont high school graduate in the bay area and tonight the district named the library in his honor. abc7 news reporter heather

think it was in poor taste. we will show you that later. >> meantime a compromised plan has been used by the state legislature. today's vote asks federal judges to extend the deadline for releasing thousands of inmates. the proposal includes governor brown's plan for cells in county jails if they stick to the deadline. they were to reduce the prison population by 10,000 inmates by january. a manager at mcdonalds is accused of robbing his own restaurant and another one. he has pleaded not guilty to kidnapping and robbery after being arrested last week. on august 28th, police say he robbed the mcdonalds in pleasanton where he was manager. he was arrested after a robbery at a san mateo mcdonalds on september 2nd. in both instances they forced the employees into the freezer before grabbing cash from the safe. the man who created an uproar when he threw a ban

her belly was unusually cold and hard. well it was actually a false belly taped to her body and loaded with two kilograms of cocaine. whole foods is facing a legal battle over pesticides. they filed a lawsuit for ignoring state codes. the company is accused of selling products containing pesticides that aren't registered for sale. it is pet products and repellents. state res laters -- state regulators say they must be approved before they are sold in the state. the company is now reviewing the lawsuit. let's move on to the weather forecast. it is nice and cool. >> sandhya patel is here with a live look at doppler hd. >> we are looking at cooler than average con dieciouses -- conditions. as we head toward the weekend, live doppler 7hd is showing the expanding marine layer, and it is already clouded up in concord. we talk about a deepening marine layer yesterday, today, i want to show you exactly we
