>> announcer: from new york city, this is "nightline" with cynthia mcfadden. >> good evening. you can't talk your way out of this one. that's what a federal judge in chicago told the silvertoned former infomercial king kevin trudeau before ordering him off to jail. it's not trudeau's first time behind bars. this ruling follows a long game of cat-and-mouse between him and the u.s. government after determining he misled customers the courts ordered him to pay back $37 million in restitution. but trudeau claims he doesn't have any assets and cannot pay. so last month a federal judge appointed a receiver to

>> reporter: how would you characterize your wife's involvement in the companies? >> that's her business. that's really not part of this interview. >> does she run day-to-day. >> we are private companies. that has nothing to do with the interview. >> why don't you talk about your wife? >> please leave the family out. >> reporter: are you using g.i.n. as a personal piggy bank to live a lavish lifestyle and avoid paying the judgment. >> that is a legitimate question. even if i was, what's the point. i'm screwed. i can't own anything for the rest of my life. so i am not going to start a company and put it in my own name. it would be dumb. i can go to friend. relatives, neighbors whatever. you start a company. i will help you out. and there is nothing wrong with that. there is nothing illegal about it. guess what it ain't my asset. >> reporter: that argument might put you in jail? >> we'll see. i have an insane, ridiculous $37 million judgment against me.

schools closed, the senate in lockdown, and at the u.s. navy yard, a san cene of carnag. monday morning's massacre brought washington to a stand still leaving 13 dead and shooter aaron alexis. awe learn more about the gunman. new question as rose -- were there indications that the 34-year-old might go on such a rampage. now for the first time his family speaks. abc's pierre thomas has the story. >> reporter: three days after the horrific shooting at the washington navy yard, it is a muddy picture emerging of the latest face of terror. aaron alexis. his mother who asked not to be shown had no answers. >> i don't know why he did what he did. i will never be able to ask him why. aaron is now in a placer who he can no longer do harm to any one and for that i am glad. to the families of the victim thousands, i am so, so very sorry that this has happened. my heart is broken.

hurting himself or any one else he said no. a dozen blocks away on capitol hill, the relatives of victim from previous mass shootings were once again pleading for new gun legislation. >> i don't want another family to go flew whthrough what i am through right now. you know, i don't want another 15-year-old to be having to pick out his sister's casket. i don't want that to happen. >> we will not give up. we will not go away. we are here forever. >> reporter: tomorrow, four days after the shootings, the naval yard will reopen. back to business. but the pain of the families of the dead and wounded remain fresh and once again, question as but how another killer schlepped through t slipped through the cracks for.
