>> good morning, everything. i'm katie marzullo. it is 5:00 a.m.. we will start with a quick first look at the weather. it will be a foggy one today. meteorologist lisa argen is here. good morning. >> good are morning. here's a live look at doppler 7hd. a little cloud cover and rain activity to the north. plenty. low level moisture allowing for mild numbers and mist and drizzle out there. temperatures are in the 60s everywhere. san jose 65. mid-50s san francisco. 65 by the delta. and the actual area of low pressure still offshore. so it will allow for the rain to increase from about 8:00 this morning to about noontime. here we are around 9:00 and you can see more shower activity along the heart of the bay. it pushes through the bay.

we are looking at a pretty decent evening. then sunny and warm conditions as we fast forward to sunday. so that's a short look at the forecast. more detailed look coming up. katie. >> thank you, lisa. a different kind of storm blowing through 49ers headquarters to morning. a star player busted for dwi. the line bark was arrested yesterday morning after he crashed his car. we have more from where it happened. >> 4-9der teammate ray mcdonald lives about eight house ace way but didn't want to talk much. >> was he over last night? all right. any comments at all? no? >> several neighbors tell us there are often parties at mcdonald's home so they figure aldon smith was here at some point before he missed a turn and ended up on the driveway of this house. this is a pile of burned-out rubber. one neighbor said he could smell it so he came out to find a stuck truck with its tires

spinning out. kim lives here and said she also saw the tires burning. >> the car stopped. but he sleep. >> san jose police say smith was taken from the scene and eventually charged with suspicion of dui. according to the san jose mercury news, he had a blood alcohol level of .15. smith quickly bonded out of jail. we visited his house in san jose but did not get a response. he did show up for practice. coach jim harbaugh addressed it immediately after the team left the field. >> disappointed and felt like he needs to go to work, face his teammates, and, you know, soldier through it. >> harbaugh would not discuss how the nfl will handle this. in san jose, sergio quintana, abc7 news. the league will likelity a look at smith's history before making a decision about a suspension. it includes a january, 2012 dwi

arrest in miami. this is a mug shot from that arrest. the charge was later reduced to reckless driving. in june of 2012 smith threw a party at his san jose home. he was stabbed, but not seriously hurt. two men were shot. police say smith was not the shooter, though both men filed lawsuits against him this month. he could still face charges for being caught with three gun charges with guns that are illegal. linebacker nate st. bue tweeted make sure you check out uber to get places without driving. we don't know if they have signed up but it will be available in 20 nfl cities. dogs attacked and killed a chihuahua in brentwood. two pit bulls belonging to

quarterback jones more than night. it was being walked by its owners. jones agent said jones was with the dog when it happened and he tried to get in touch with the owner. the dogs may end up with warranty with two pit bulls that mauled a little boy this summer. now there's a push to get the dogs put down. >> the antioch animal control officer's report describes a ten-year owed bloody stairwelly this ten-year-old was afaked his neighbor's pit bulls on the august 11th. the son was also bitten on the arm while trying to stop the attack. both dogs had expired rabies vaccinations and the animal control investigators has deemed them to be vicious and recommends them to be euthanized. but the owners told the city

they would do anything they needed to do to fight for their dogs. >> these people are making a desperate attempt to save their dogs at the expense of the health and safety of the neighborhood and my client. >> now some neighbors are passing out flyers asking others to speak out at the hearing against the attempt to save the dogs and bring them home. >> my concern is if the dogs are not contained, they will get out and somebody else will get hurt. >> judddy hall said she'll be at the hearing to explain why she shot the video of the escaped dogs in front of the home. it happened several months before hunt wares attacked. >> i thought of what may have happened to me had i been running past at that time. and it's not the first incident the dogs have gotten out. >> the report says there were two sets of bite marks on hunter, but mr. and mrs. delacruz insists only one dog attacked the boy. the hearing will be on thursday

n antioch, abc7 news. concord police arafted mannoses expected of stealing personal information from an automated postal machine. a skimmer was attached to the machine at the concord main post office earlier this week and tuesday the investigators caught the suspect. he knew when they tried to retrieve his equipment. they then searched his hotel room where he was staying and they found stolen pin numbers and credit card numbers. our media partner the marin independent journal said nathan asked for a sentencing date in january. prosecutors argued it was too much time. there is is extension date in november. they argue he should get connection with the death penalty with the death of four women but the judge must consider an automatic appeal to reduce the sentence from death to life in prison. forecasters are calling the most powerful typhoon of the

you are looking at mist and drizzle. about 65 degrees. it's only going to warm up maybe five degrees more. get out your sweaters today and look forward to a moisture day out there, most of the bay area. meanwhile an elementary school on the peninsula covered with graffiti and even more of a shame because the school was extensively remodeled over the summer. just two weeks into the school year students and teachers are wondering who could do such a thing. we have the story. fox elementary school in belmont was hit by vandals sometime between midnight wednesday and 6:30 thursday morning. taggers turn the school into their personal playground, leaving messages and drawings on the black top, tables, curbs and outbuildings. >> there was like a zombie face and there was another one that says, well, like drop it like it's hot. >> some kids were really upset by it. >> i thought they were like bad guys this came to our school

during the night and then like paint it had with graffiti. >> parents can't understand why anyone would want to deface the school. >> this whole school got remodeled over the summer and it looked really beautiful. i was just really disappointed somebody would do that. >> little kids play here. they don't need the graffiti all over. >> some has been painted over like on the shed but you see some of the red in between. this is just a temporary solution. a contractor will be coming to do a permanent fix. it's still unknown to find out how much it will cost to get rid of the graffiti, but the dollar amount does make a difference. >> in the cost and repairing and painting gets hay enough, this could potentially be charged as a felony. >> police hope someone will come forward with information about who is responsible so they can be held responsible. abc7 news. >> a new report finds smartphone robberies are on the rise in berkeley. smartphone robberies were a

major contributor to the increase in robberies the first part of the year. they are hoping to crack down by employing more officers on bikes downtown and telegraph avenue and sending officers to bluerry-broken neighborhoods. >> a step forward to add the childhood home of apple co-founder steve jobs to a list of protected historical sites. the media news reports on monday the local commission will discuss a property evaluation of the house. home is considered historically significant because it's where jobs and apple wozniak built the first apple computers in 1976. sticking with apple the company believes it will sell five to six million smartphones this weekend. for some it's been a struggle getting their hands on one. >> get out of the way. >> in pasadena fights broke out

yesterday morning. it started after a man promised to pay dozens of homeless people to stand in line, but many were never paid. two people were arrested. it was much more peaceful at the flagship apple store. the new gold i-phone sold out quickly. it's backordered until october. bummer for gold fans. consumer reports has teamed up exclusively with abc7 news to release the preliminary test results on the i-phone 5s. dollars to the included. it looks a lot like the 5 but there are key differences. one, a scanner registers your fingerprint so a touch unlocation the phone. it does work well according to consumer reports and it blocks everyone else. the camera delivers better results in low light conditions than i-phone 5s. and the new operating system is more user-friendly. >> overall while the 5s isn't a

revolutionary step forward, at first look it's an improvement over the previous i-phone with lots of cool features. >> they released the i-phone 5c yesterday which comes in several colors and starts at $99. both phones will be put through a range of tests. if you buy one be sure to watch the app we have that allows you to see our ramming live streaming. it's an app in the apple store. >> the dairy queen minnesota received a call from warren buffett for doing the right thing. he saw a mantei money from a site impaired customer and then put if of it in his pocket.

he refused to serve him until he gave the money back. there was a new queen in huntington beach. he's been living as a woman for three years. she plans to become more active in the lgbt community and fight for equality. firefighters at the massive rim mire around yosemite said the full containment probably won't come until october 1st. that's a week and a half later than the original estimate that was actually yesterday. the san francisco ran kill reports the delay is due to flames spreading in high elevation for efforts near hetch hetchy reservoir. it is now the third largest fire in state history. help is needed for coastal clean up day in california. volunteers are invited to come out to any one of the state's beaches to collect trash. last year more than 65,000 people turned out and collected more than 700,000 pounds of

garbage. the event kicks off at 9:00 and ends at noon at most beaches up and down the state. hopefully we will top the record. not that you want more garbage on the beach but if it's there, pick it up. maybe people should bring rain gear today. >> it will be moist and misty. but as we take a look at live doppler 7hd right any, a lot of low level moisture and we are out ahead of the system. that's why the temperatures are so mild. a few sprinkles offshore and the area of low pressure poised to move on in here the next four to five hours. here's a look at the first shot of the exploratorium camera. you see the clouds out there. 61 san francisco. 65 oakland, as well as san jose. 62 los gatos, 59 half moon bay. if you are headed on into the city you may need the wipers and the roadways are damp all the way through san francisco,

san mateo. roof camera pretty cloudy. 60 santa rosa. 64 concord, as well as livermore. the final stop in emeryville, a little wet with temperatures this morning all in the 60s. by the afternoon only five to seven degrees warmer. we won't warm up that much a lot of clouds holding down the temperatures. tomorrow will feel more like spring with a warm ask sunny afternoon for your sunday. the mild weather keeps coming right on through next week. look at the 24 hour temperature change. we are as much as 15 to 16 degrees warmer up in the north day. eight degrees warmer than yesterday at this time. seven degrees warmer in san jose. here's the area of low pressure. the cold front. plenty of dry air out ahead of it. the first system moistening up the atmosphere. we have some wet pavement out there. a slight chance of a thunderstorm in the north bay. otherwise we look for scattered showers, cooler temperatures today and here is the timeline. so as we go through the rest of

the morning hours, you will notice plenty of cloud cover. by about 8:00 take a look at the rain line from sonoma through napa, san francisco, san mateo, and it kind of limps along through the rest of the bay area. this morning we report the sprinkles from napa to watsonville. even down through monterey you see shower activity. finally it pushes eastward into the central valley and into the syria nevada where we are looking at showers and windy conditions. rainfall amounts not too impressive but still we will look for anywhere from the coast. you may not see anything in the south bay. high temperatures today ranking from the mid-60s, but it is mild from half moon bay to richmond. upper 60s in vallejo and low 70s in the east bay. 72 livermore. a slight chance of thunderstorm up by santa rosa, cloverdale. 67 clear lake.

>> welcome back. it's 5:23. authorities are on the lookout for a bear this morning. police and wildlife officials have been tracking 3900-pound bear for three days now. officers received numerous reports of the black bear roaming freel in and out of parking lots and in the backyards of homes. authorities were able to shoot a tranquil laser into his shoulder but the animal still managed to

get away. a controversy is brewing over tomorrow's prime time emmy awards. the award ceremony will include five special tributes, including one to actor corey montee. that had some people questioning the move, including fans of actor larry hagman who died last year but who is not among those getting a special tribute. the producers are standing their decision saying he was admired by a younger generation. >> he doesn't have the body of work, and there are people like larry hagman and john klugman who had more resonance over the years. >> if younger viewers are watching, that's where the money is. it isn't a charity, it's a business. >> the others will honor the soprano star and jean stapleton, johnathan winters and gary david goldberg. golden state warrior tickets are sure to be a hot item this

fall but several san francisco students may be treated to court well seats for doing good in school. warriors guard made the incredible offer while visiting students at martin luther king middle school yesterday. he told the kids if they do all their schoolwork for the next month he will treat them for court side seats to the warriors opener on october 30th. >> just trying to make a difference and hope to see all the kids on opening night. it will be so heartwarming for me and so grad tying at the same time because i can kind of feel like i had a hand in on their success >> the season openers is against the l.a. lakers. he enjoys being a role modler and being a person who inspires others. do your homework, kids this may not be the smallest apartment in san francisco but it's the smallest currently available. it's just 264 square feet, most of which is taken up by the kitchen and bathroom. the monthly rent, here's more

>> welcome back, everyone. we are so glad you are with us on this saturday morning. coming up on 5:30. we are starting out this half-hour with a quick look at the weather. here's meteorologist lisa argen. >> good morning, katie. we are looking not only at mist and drizzle but a cold front offshore that will provide much cooler weather and damp pavement and perhaps a washout in the north bay. we have a little fog u may need your wipers. temperatures very mild this morning. we are looking at plenty of 60s but by this afternoon with the cloud cover the chance of scattered showers, notice we aren't going to climb much. low to mid-60s along the coast. mid-60s to the upper 60s with a chance of showers for not only the east bay but san jose and the inland communities, as

well. not much, just a tenth to a quarter inch of rain but we will look for a big change the second half of the weekend, the first day of autumn tomorrow. i'll have the details in a minute. katie. >> thank you. this morning president obama is warning of another recession in house republicans don't back down on their position on the debt limit. yesterday the house pass add temporary funding measure to keep the government running, but the bill is attached to a measure that strips fund fourth president's healthcare law. in his weekly address, he said the house vote threatens to inflict economic pain on millions of americans. >> our message to the united states senate is simple. the american people don't want the government shut down and they don't want obamacare. >> some are actually willing to plunge america into default if they can't defund the affordable care act. think about that. they would actually plunge this country back into recession all to deny the basic security of healthcare to millions of

americans. that's not happening. and they know it's not happening. >> the provision to defund the affordable care act is expected to die in the democratic-controlled senate. happening today, bay area communities are joining a nationwide protest over the proposed keystone pipeline. people in san francisco, berkeley will hold demonstrations. advocates say the pipeline project will have an adverse impact on the environment. today's demonstrations begin the 1:00 at the hub and noon at biofuel oasis in berkeley and at noon in san francisco. also happening today, san francisco will celebrate the u.n.'s enter -- international day of peace. it kicks off at noon at the u.n. plaza. it will feature art tests and speakers and music. they will hold a general assembly to commemorate the second anniversary of the occupy movement. police have arrested members

of a notorious street gang who they say ran a dogfighting ring in san francisco. investigators confiscated the video. vic lee has it. >> the video is too violent and disturbing to show in its entirety. two pit bulls are fighting as their owners and bystanders provoke them to fight harder. the inspector syl verse is with the gang task force. slapped and punched and yelled at and they fight pretty viciously for about five minutes. the video cuts off. >> police believe this dogfight happened in march at the hunters view housing development. they arrested three men who police say are documented members of the west mob gang. >> robberies, murders, they have been burglaries, drug dealing. >> police say ed perkins owns one of the dogs. they say ac matthews, junior is owner of the other one.

another was a bystander. but being a spectator at a dogfight is also a crime. when police searched jackson's home they found a pit bull mom and her three puppies and a bulletproof vest and ammunition. they also recognized 19-year-old rice from the video. he was shot to death three months after the dogfight at the bus stop in the bay view. it was sad irony that rice himself was the victim of an almost fatal mauling by two pit bulls when he was only 11 years old. police found other videos of pit bulls in perkins cell phone. this one showed two of them apparently being trained to bite by attacking hanging tires. silver suspects pit bull street fighting goes on more than we know. >> it's not an uncommon practice at all. it is vastly underreported, i believe. >> silver told us street gangs use dogfighting as a means of controlling their turf. >> it creates increasing

violence and intimidation in the neighborhood. >> police believe one of the dogs may have died, but they would like your help in finding him. if you recognized anyone else in that video, they would also like to know who they are. vic lee, abc7 news. police have arrested members of -- excuse me. if you are flying you can expect cancellations. they are inspecting the slides on the planes. they grounded as many. 30 of its planes, about half of its entire fleet and it will affect flights out of oakland. if you are delayed less than four hours, you get a $100 voucher. and $200 for section hours or more. if your flight is cancelled you get a fuel refund and a $200

bridge? if you can make it out through the mist and drizzle this morning. there is wet pavement in san francisco already. be warned if you are out early driving. you know the view at the golden gate bridge is going to change maybe about this time next year. the bridge board just voted yesterday unanimously to install the movable median barrier that prevents head-on collisions on the bridge. so when conditions are bad like this, that would come this handy. that will cause a 52 hour bridge closer, first time of for the golden gate bridge, but again, we are looking at that next year. san jose state may be in the silicon valley but all that tech is not helping the college's wooer less internet keep up with demand. leeann visited there to find out what is being done. >> sometimes it's what of a challenge to find wireless. >> i have to move around campus. all right, does this work? is it this work? >> students are candid about the

university's wireless internet system. >> unreliable. >> it has its good moments and its bad moments. terrible. >> despite being located in the silicon valley, san jose state admits it doesn't have enough wireless access points around campus. >> this school is in silicon valley. we are supposed to be the number one place in the whole country for technology. >> the library is especially challenging. it's used by both college students and the general public, and there are len of laptops and smartphones in constant use. i try to do my online class pause i have an online class and it wouldn't even load the page. >> when i need it the most, it doesn't work. >> the university says there are 2,000 more students this year compared to last year. the number of wireless devices more than doubled in one year. >> we have found each person is carrying two or more wireless devices and often using both or all of those devices to attach

quarter mile visibility half moon bay at 67 degrees. san jose at 64. good morning san carlos, 63 for you. from our roof camera it is cloudy, and with all that subtropical moisture in the atmosphere, we possibly could see a thunderstorm north of san francisco today. mainly in the north bay. napa is at 63 and reporting some light rain. 59 in santa rosa with 64 livermore. so your temperature in santa rosa has just dropped, whereas most of the bay area is pretty mild. so this last full day of summer featuring the cooler and cloudier weather with a chance of shower, possibility of a thunderstorm in the first day of fall tomorrow. back to more sunshine and mild weather arrives at 1:44. boy, by next week it's going to be pretty nice out here. but we will look for some breezy conditions to result result for the early part of the week and that always concerns us with high fire danger. dry air in place. first wave the moisture has moved through and that is sort of moistening up the atmosphere.

low is still yet to come later this morning and mixing with the subtropical moisture, the possibility, slight chance, of a thunderstorm. timing it out, you will notice most of the activity up in the north bay. but by 9:00 from sonoma to marin to contra costa county to the santa clara valley we are look at the possibility of light showers. it sweeps on through really by the early afternoon. so the second half of the day looking at partly cloudy skies and still that chance of a thunderstorm. rainfall amounts, you will notice that, of course, the focus in the north bay anywhere from a tenth to about a half-inch. that's well north. you can see along the coast we will have the mist and drizzle, maybe .2 in the east bay and maybe .01 in the south bay. the santa cruz mountains picking up in the higher elevations. you will notice over into the east bay just in the low 70s. the cloud cover, the possibility
