smelled something burning. >> i don't know why the engine is still working. the car stopped, but the smoke come out but he sleep. >> san jose police say smith was taken from the scene and eventually charged with suspicion of dui. according to the san jose mercury news he had a blood alcohol level of .15. he quickly bonded out of jail. we visited his house in san jose but did not get a response. he did show up for practice. coach jim harbaugh addressed it immediately after they cleared the field. >> disappointed. felt like he needs to go to work, face his teammates, and, you know, soldier through it. >> harbaugh would not discuss how the nfl will handle this. in san jose, sergio quintana, abc7 news. the league, though, will likely take a look at his history before making a decision about the suspension, and that history includes a january,

2012dui arrest in miami. this is a mug shot from that arrest. the charge was later reduced to reckless driving. in june, 2012, smith threw a party at his san jose home. he was stabbed but not seriously hurt. two men there were shot. smith was not the shooter, though both men filed lawsuits against him this month. prosecutors say he could still face gun charges for being caught that night with three assault rivals that are illegal in california. it was just thursday night on twitter one of smith's teammates encouraged others to use the nfl's player partnership with the ride sharing uber. line knacker nate stupar tweeted make sure are you check out uber to get places without driving. across the bay, news about an oakland raider who is said to be devastated after his dogs attacked and killed a chihuahua in brentwood. two pit bull mixes be longing to

tyrone jones charged a dog monday night. the chihuahua was being walked by the owner, according to our media partner. jones' agent said his client was with the dogs when it happened and that he did try to get in touch with the owner. jones' dogs may end up with quarantine with two pit bulls that small a little bit this summer. now there's a push to get those dogs put down. abc7 news reporter allen wong has more from antioch on the latest report just released by animal control. >> the antioch animal control officer's report industries a bloody stairwell where a ten-year old was attacked by pit bulls on august 11th. his face was mauled and part of an ear chewed off. the owners son was also betten on the arm trying to stop the attack. both dogs had expired rabies vaccinations and the animal control investigator has now deemed them to be vicious and is recommending they be euthanized. but the owners, who would not

answer our attempt to contact them today, told the city they would do anything they needed to do to fight for the dogs. >> these people are making a desperate attempt to save their dogs at the expense of the health and safety of the neighborhood my client. >> now some neighbors are passing out these flyers, asking others to speak out at the hearing against the attempt to save the dogs and bring them home. >> my concern is if the dogs are not contained, they will get out and somebody else will get hurt. >> judy roberts said she would be at the hearing to explain why she shot the video of the escaped dogs in front of the dell cruz home. it happened several months before hunter was attacked >> i thought what may have happened to me had i been running past at that time and it's not the first time the dogs have gotten out. >> there were two sets of bite marks on hunter but mr. and mrs. dell cruz insist only one dog attacked the boy. fate of the dogs will be decided

at the hearing on thursday. in antioch, abc7 news. concord police have arrested a man suspected of stealing personal information from an automated postal machine. authorities found the device, called a skipper, attached to the machine at the concord main post office earlier this week. on tuesday post office inspectors caught the suspect. they said he was trying to retrieve his equipment. inspectors searched a hotel where he was staying. they found stolen credit card numbers and pin numbers. >> con teemed diller joseph naso said he's been wronged after a judge refused to delay his sentencing. he asked the judge for a sentencing date in january, and prosecutors argued it was too much time. judge booked a sentencing date in november. a jury unanimously ruled naso should get the death penalty in connection with the murders of four women but the judge must consider an automatic appeal to reduce the sentence from death to life in prison.

island communities in asia are being battered to by what foe casters are calling the most powerful typhoon of the year. super typhoon is lashing parts of taiwan and the philippines as it moves through a strait between the country. it's triggered landslides and power outages in the fell means where it made landfall this morning. forecasters say the storm is heading toward hong kong. we will certainly keep an eye on this for you. always a bad scene when you see that coming. >> certainly. we are looking at a very early season, a wet weather maker, call it a cold front. it's certainly not a storm. here's a look from the roof camera. temperatures just in the 60s this morning. but that will be the highs, as well, for some parts of the bay. already a couple hundreds we've been picking up since last night. we will detail the last of summer forecast and the first day of fall when we return. >> i will have to dig out some sweaters. thank you. and an elementary school hit by

clouds just above the bridge. but the entire sky is cloudy and it will be rainy today. stick with us and lisa argen will fill you in on the details coming up in just a little bit. an elementary school on the peninsula covered with graffiti and even more of a shame because the school was extensively remodeled over the summer. just two weeks into the school year students and teachers are wondering who could do such a thing. we have the story. fox elementary school in belmont was hit by vandals sometime between midnight wednesday and 6:30 thursday morning. the taggers turned the school into their personal playground, leaving messages and drawings on the blacktop, tables, curbs and outbuildings. >> there was like a zombie face and there was another one that says, well, like drop it like it's hot. >> some kids were really upset by it. >> i thought they were like bad

guys that came to our school during the night and then like paint it had with graffiti. >> parents can't understand why anyone would want to deface the school. >> this whole school got remodeled over the summer and it looked really beautiful. i was just really disappointed somebody would do that. >> little kids play here. they don't need the graffiti all over. >> some has been painted over like on the shed, but you see some of the red in between. this is just a temporary solution. a contractor will be coming to do a permanent fix. it's still unknown to find out how much it will cost to get rid of the graffiti, but the dollar amount does make a difference. >> if the cost and repairing and painting gets high enough, this could potentially be charged as a felony. >> police hope someone will come forward with information about who is responsible so they can be held accountable. abc7 news. >> a new report finds smartphone robberies are on the rise in berkeley. according to the san francisco chronicle. smartphone robberies were a major contributor to the

increase in robberies the first part of the year. police are hoping to crack down by employing more officers on bikes downtown and telegraph avenue and sending officers to burglary-prone neighborhoods. new this morning, a step forward to add the childhood home of apple co-founder steve jobs to a list of protected historical sites. our media partner reports on monday the local commission will discuss a property evaluation of the house. home is considered historically significant because it's where jobs and apple wozniak built the first 50 apple computers in 1976. sticking with apple the company believes it will sell five to six million smartphones this weekend. for some it's been a struggle getting their hands on one. >> get out of the way. >> no. >> get out of the way!

>> in pasadena fights broke out yesterday morning at an apple store. it started after a man promised to pay dozens of homeless people to stand in line, but many were never paid. two people were arrested. it was much more peaceful at the flagship apple store. the new gold i-phone sold out quickly. it's backordered until october. consumer reports has teamed up exclusively with abc7 news to release the preliminary test results on the i-phone 5s. it looks a lot like the 5 but there are key differences. one, a scanner registers your fingerprint so a touch unlocks the phone. it does work well according to consumer reports and it blocks everyone else. the camera delivers better results in low light conditions than i-phone 5s. and the new operating system is more user-friendly. >> overall while the 5s isn't a revolutionary step forward, at first look it's an improvement over the previous i-phone with

>> a transgender person has been selected homecoming between in campbell at marina high school in huntington beach. he was born lance campbell and has been living as a woman for three years. she said she plans to become more active in the lbgt community and fight for equality. firefighters at the massive rim fire around yosemite said the full containment probably won't come until october 1st. that's a week and a half later than the original estimate that was actually yesterday. the san francisco chronicle reports the delay is due to flames spreading in high elevation for efforts near hetch hetchy reservoir. it is now the third largest fire in state history. help is needed for coastal clean up day in california. it's the largest one-day event. volunteers are invited to come out to any one of the state's beaches to collect trash. last year more than 65,000 people turned out and collected more than 700,000 pounds of garbage.

moon bay with quarter mile visibility. we are looking at plenty of clouds, allowing for all of the heat from yesterday to really stay with us. so we are nice and mild out there from this vantage point. 59 novato, 54 concord and finally from emeryville you can see we do have -- still it's dark conditions out there with the sunrise just before 7:00. so showers today. chance of a thunderstorm up in the north bay. fall arrives 1:44 tomorrow. we are looking at a railroad nice mild weather pattern next week." almost getting to the last week of september where we typically have the try, off short winds but the on-shore winds in a system offshore today will allow for the moisture and the sticky feel to the air. the slight possibility of a thunderstorm just in the north bay, but more likely the scattered shower activity for the first half of your day. so here we are at 9:00 from sonoma county through napa,

marin. and then as it sweeps through the east bay, berkeley, contra costa county and already we are look at the shower activity in the santa cruz mountains and watsonville. we will be left still with the possibility of showers through the afternoon. but as we clear on out tonight it's going to be quite chilly. in fact, we are going to look at temperatures in the upper 40s to the low 50s. but before that, the totals anywhere from .01 to about .01 in the suggest bay, maybe .2 in the east bay with more along the coast and up in the north bay. so with yesterday's mist and drizzle, they have already had really kind of a wet start to the weekend up in sonoma county. 68 today in oakland. look for 64 in half moon bay. so notice the temperature spread is really pretty narrow from the mid-60s coast to the low 70s inland. 68 this santa rosa. 71 in morgan hill. and the accuweather seven-day forecast featuring temperatures that will bump up considerably

these days. >> i will hang on every word then because i can even guess. thanks. >> see ya. >> more bears for you this morning. authorities on the central coast are on the lookout for a bear this morning. police and wildlife officials have been tracking 3900-pound bear for three days now. officers received numerous reports of the black bear roaming freely in and out of parking lots and in the backyards of homes. authorities were able to shoot a tranquilizer into his shoulder but the animal still managed to get away. a controversy is brewing over tomorrow's primetime emmy awards. the award ceremony will include five special tributes, including one to actor corey montee. the "glee" star died at the age of 31 of a heroin and drug overdose. that had some people questioning the move, including fans of actor larry hagman who died last year but who is not among those getting a special tribute. the producers are standing by their decision, saying he was admired by a younger generation. >> he doesn't have the body of

64 degrees in fremont. the forecast for the south bay and the rest of the bay area featuring more clouds today than sunshine with scattered showers, even the possibility of a thunderstorm up in the north bay. temperatures will be mainly in the 60s around the bay. low 60s coastside. we are talking about the first day of autumn tomorrow. feeling and looking a lot like summer. details in a few minutes. katie. >> lisa, thank you. this morning president obama is warning of another recession if house republicans don't back down on their position on the debt limit. yesterday the house passed a temporary funding measure to keep the government running, but the bill is attached to a measure that strips funding for the president's healthcare law. in his weekly media address the president said the house vote threatens to inflict economic pain on millions of americans. >> our message to the united states senate is simple. the american people don't want the government shut down and they don't want obamacare. >> some are actually willing to plunge america into default if they can't defund the affordable care act.

think about that. they would actually plunge this country back into recession all to deny the basic security of healthcare to millions of americans. that's not happening. and they know it's not happening. >> the provision to defund the affordable health care act is expected to die in the democratic-controlled senate. happening today, bay area communities are joining a nationwide protest over the proposed keystone pipeline. people in san francisco, berkeley will hold demonstrations. advocates say the pipeline project will have an adverse impact on the environment. today's demonstrations begin the 1:00 at the hub and noon at biofuel oasis in berkeley and at noon in san francisco. at harrington park. also happening today, san francisco will celebrate the u.n.'s international day of peace. the peace day rally and celebration kicksoff at noon at the unseld plaza.

it will feature musicians, artists and speakers. they will hold a general assembly to commemorate the second anniversary of the occupy movement. police have arrested members of a notorious street gang who they say ran a dogfighting ring in san francisco. investigators confiscated the video. vic lee has it. >> the video is too violent and disturbing to show in its entirety. two pit bulls are fighting as their owners and bystanders provoke them to fight harder. the inspector dan silver is with the gang task force. slapped and punched and yelled at and they fight pretty viciously for about five minutes. the video cuts off. >> police believe this dogfight happened in march at the hunters view housing development. they arrested three men who police say are documented members of the west mob gang. >> robberies, murders, they have been burglaries, drug dealing.

>> police say ed perkins owns one of the dogs. they say a.c. lee matthews, junior is owner of the other one. another was a bystander. but being a spectator at a dogfight is also a crime. when police searched jackson's home they found a pit bull mom and her three puppies and a bulletproof vest and ammunition. they also recognized 19-year-old jaquan rice from the video. he was shot to death three months after the dogfight at the bus stop in the bay view. it was sad irony that rice himself was the victim of an almost fatal mauling by two pit bulls when he was only 11 years old. police found other videos of pit bulls in perkins' cell phone. this one showed two of them apparently being trained to bite by attacking hanging tires. silver suspects pit bull street fighting goes on more than we know. >> it's not an uncommon practice at all.

leeann melendez visited there to find out what is being done. >> sometimes it's what of a challenge to find wireless. >> i have to move around campus. all right, does this work? ndoes this work? >> students are candid about the university's wireless internet system. >> unreliable. >> it has its good moments and its bad moments. terrible. >> despite being located in the silicon valley, san jose state admits it doesn't have enough wireless access points around campus. >> this school is in silicon valley. we are supposed to be the number one place in the whole country for technology. >> the library is especially challenging. it's used by both college students and the general public, and there are plenty of laptops and smartphones in constant use. i tried to do my online class pause i have an online class and it wouldn't even load the page. >> when i need it the most, it doesn't work. >> the university says there are 2,000 more students this year compared to last year. the number of wireless devices

the day. isn't this beautiful as the sun hits the clouds here from our exploratorium camera. with all the low level moisture and the cloud cover, we have stayed pretty mild. 57 with a quarter mile visibility on the coast. very foggy conditions from the golden gate bridge all wait down to half moon bay. from our roof cam. take a look at the low level clouds and the mid-level clouds making for a pretty nice start to your saturday, despite the cooler afternoon. 63 with the southwest winds up to 20 miles an hour and antioch. 60 santa rosa. 64 livermore and concord. finally from our sutro camera you can see the beautiful start to the day. although we are still looking at a slight chance of a thunderstorm in the north bay throughout the day today. fall arrives tomorrow. it will feel like summer and today feels like fall. the last official day of summer. mild weather pattern for next week. we are looking at the first fallish system. we did see rain in august and september. it's not the first rain we've seen. we are looking at the atmosphere

moistening up since yesterday and with that moisture in place and the triggering mechanism to the north and west of us, we are look at scattered showers at least for the first half of the afternoon. so as we put it together for you and time it all out, you will notice that by about 9:00, 10:00, we have the moisture from marin, sonoma, over to berkeley, couldn't draw costa county and it's already in place in the south bay. it pushes on through throughout the first half of the day. by the afternoon some sunshine, but the possibility still exists for a thunderstorm. so rainfall amounts, the highest amounts maybe up to a half-inch in the north bay. .2 in the east bay. about .01 to a tenth in the south bay and then the mist and drizzle should stay put along the coast all afternoon long. it will be pretty misty out there for the coastal cleanup but we will see temperatures pretty mild. mid-60s half moon bay. look for 71 today over by the delta. 72 in livermore. santa cruz coming in at 70.
