>> abc7 news starts now with breaking news. >> the breaking news is if san francisco. it is 5:00 a.m. >> in the sunset district a house fire turned fatal claiming two lives, one a toddler. abc7 news reporter amy hollyfield is at 18th avenue. >> 2 1/2-year-old child and the child's father died in the fire. four people were here at the home on 18th when the fire broke ought at 1:30. the father-in-law is in very critical condition and firefighters say the mother escaped okay. they don't know how she managed to get out and they have not been able to talk to her. firefighters say it started in the basement and are trying to figure out why it turned so deadly. >> the house was constructed very well for weather but it

keeps all the ventilation -- in the old buildings the windows might pop. >> they got the call at 1:30 this morning and firefighters say they had a tough time getting into the home. there was a metal gate in front of the door so they had to saw a hole into the garage door to get in but once they were inside it took only a half hour to put the fire out. they do not know if the family had working smoke detectors or the cause of the fire. no firefighters were hurt. >> a fire near candelstick park tied up the crews. video captured by abc7 news shows debris burning in the bayview and it broke out at 1:30 this morning. firefighters spent several hours

there. southbound side is in good shape coming away from 580 into mill valley and as you head closer to sausalito over the golden gate bridge not going to be a problem. also, mass transit, if you decide to ditch the car, you are looking at good conditions so far so no delays and as we go outside, we will take a look at what is happening in san jose, the drive along 280 away from 17 , not too many headlights are making their way in the northbound direction. >> this morning, the father of the man accused of fatally stabbing a dodgers fan near at&t park claims his son was acting in self-defense. the 21-year-old mike montgomery is charged with killing 24-year-old jonathan denver during a fight after the game. it happened near 3rd and harrison a few blocks from the ballpark. the suspect's father said the victim hit his son over the head with a chair. state assembly speaker attended the game and says it is good to have rivalries but it is

appalling when it towns violent. >> blue are from los angeles or san francisco you know there is no room for violence and that action in sports. >> detectives are examining video from the cameras on the buildings and police are searching if several more suspects. >> some fans were hesitant about going to the finale between the dodgers and the giants and san francisco police added extra security for the game. >> we wanted to go, this is our last game. >> i heard about it, i thought twice about coming. made they think twice about what i wear. >> had were a hot of officers inside the stadium and on the streets before, during, and after the game. many were in uniform. some were undercover dressed in giants and dodgers gear. >> we spoke with a family member outside denver's grandparents' house in southern california and he said they are in shock.

thephakaysone will be formally charged with murder. he shot and killed a 20-year old justin valdez as he got off a streetcar on monday. detectives say they found sell guns including assault weapons, $20,000 in cash, and survivalist gear at the suspect's home. police say nikhom thephakaysone took out the weapon several times on muni and police say he confronted other people before getting on the train. >> he pulled the gun on at least one other person in the year but the person did not report it until after this took place and they got home. >> police still don't know the motive the both men attended san francisco state but miss say there appears to be no other connection. >> this morning, a man accused of opening fire as he was evicted from his home is scheduled to be in court for arraignment. the 43-year-old surrendered after a stand off last week. he and his wife defaulted on a home loan and were evicted when

rest of us are in the upper 70's to low 80's around castro valley and the east bay valleys it will be warm but not uncomfortable from 79 in brentwood to 83 in pleasanton and walnut creek and 84 for the warm spot. tonight, the temperatures are back in the 40's in our sheltered valleys and the coast because of the lack of clouds and low-to-mid 50's for the prosecute of us when you step outside tomorrow. it is jacket weather. high pressure is starting to take over more of our neighborhoods but the lows are close enough we still have a good pressure gradient above 1,000' so the wins are keeping us in the fire threat. on sunday, a chance of rain slides into the north bay and toward monday morning a few sprinkles by monday afternoon and the system is gone and we will have coolest weather then and on tuesday and wednesday sunshine is back and warm weather but notice over the weekend, the warmest and bright of the days will be tomorrow.

avenue in the sunset district. they got the call at 1:30 this morning. there were a total of four people inside this home. >> we found the father-in-law and the 2 1/2-year-old child on the top floor and they found the father in the basement, in the live unit on the ground floor. the mother was able to get out the back door. she was transported to the hospital. she is in good condition. >> the investigators on the scene are still trying to figure out what caused the fire. they have ruled out arson. that is the process they are going through now trying to rule out different possibilities. they have not uncovered the cause. they have determined that there were working smoke detectors inside the home. firefighters say it is very unusual to find smoke detectors and have such a tragic outcome.

any another breaking news story fire crews from at least five cities are on the scene of a hay fire along interstate 505. the four alarm fire is burning 20 miles from vacaville with crews from the area all coming out to help fight the fire. officials say they will let the fire burn itself out. it could burn for a day or more. no word on the cause. we will bring you updates throughout the morning here on abc7 morning news. >> we will see how the winds are, mike? >> there are critical fire conditions for the santa cruz mountains and diabolo range with winds from the north at continue to 20 but they dry and gusting to around 25 to 35 miles per

for that festival. >> the father of the map accused of stabbing a dodgers fan to death near at&t park is speaking out and telling a very different story. owe reporter is at at&t park with details. matt? >> the suspect's father said his son was defending himself when he stabbed a dodgers fan a few blocks an from at&t park. the police chief says this fight started over the giants and dodgers rivalry. there was an initial fight and no one was seriously injured. that fight stopped. for whatever reason, one or more of the party would not let it go and there was a second altercation and the stabbing occurred. >> police arrested 21-year-old michael montgomery for homicide accused of stabbing to death the 24-year-old after the game on wednesday night. the suspect's dad said his son and friends remain hit without warning by a chair in the head and defended himself by stabbing

>> covering walnut creek, burlingame, campbell and all the bay area, this is abc7 news. >> huge flames lit you the night sky in beverly hills. this fire broke out in a multimillion dollar mansion at 9:00. crews kept the flames from spreading to other homes nearby. no one was hurt. it appears the large home is a total loss. >> a new voter initiative to legalize marijuana has been cleared for signature-gathering by california secretary of state. supporters have until near the end of next february to collect a little more than 500,000 signatures to place the measure on the november 2014 ballot instrutting the state legislature to pass laws licensing and taxing commercial sales of marijuana. a president by the public policy institute of california shows that 60 percent of likely voters support legalizing pot. voters aprove using it for medal purposes in 1996. >> the 49ers have a few extra days off before the next game

overnight house fire. >> among them is a two-year old girl. abc7 news reporter amy hollyfield joins us from the sunset district. amy if. >> the fire chief just toured the home and says you can still hear the smoke detectors going off. she says it is hard to say why this fire turned so tragic. the 2 1/2-year-old was on the top floor and sheeping and killed with her father sleeping in the basement trying to stay away from the child because he wasn't feeling well and didn't want to pass it along to the child. the child's grandfather was on the top floor and is in critical condition. the mother got out okay. she just finished working a late shift and was up, eating something, but be else was asleep and could not get out in time. >> everyone is hurting. this is not what we are in the business of doing, we are in the business of saving lives but sometimes this is the outcome. we had a rescue squad on the
