>> good morning, everyone. it's 6:00 a.m. on saturday. thanks for being with us. i'm katie marzullo. let's start with a quick first look at the weather with meteorologist lisa argen. good morning, lisa. >> good morning. we are starting out with temperatures on the cool side. over twelve hours of darkness we have dropped into the 40s from novato to napa. 43 half moon bay. it's clear so we aren't looking at anything in the way of fog. wall to wall sunshine. we finished a red flag warning for portions of the viewing area. now with better relative humidity, we are still talking about a warm take with numbers

from the mid-and upper 70s. fog increases along the coast later on today. starting off sunny. mid-and upper 60s for a highs. mid-80s. we have changes tomorrow. increasing clouds. looks like we won't be able to escape the rest of the month without talking about a little bit of rain coming your way. that is included in the accuweather even day forecast in a few minutes. katie. >> thank you. we start with developing news. suspect in the fatal stabbing after dodgers fan is out of jail this morning. 21-year-old michael montgomery had been in jail since thursday, the day after police say he stabbed and killed 24-year-old dodgers fan johnathan denver after a game outside of at&t park. denver and his friends got into a rivalry feud and his friends outside of the bar. montgomery's parents claim his friend acted with self-defense after being hit with a chair. a man who shared a jail cell, a cellmate with the suspect, said

montgomery told him he was outnumbered. >> he said basically it was a typical kind of riot situation that might happen at a sporting event and he was severely outnumbered and had to defend himself. yesterday district attorney george gascon said they didn't have enough evidence to prove murder beyond a reasonable doubt. he said it is vital for our office to have independent corroboration of the incident to in order to you our ethical obligation to charge in this case. stay with abc7 news for continuing coverage of the developing story. we will have the latest online at abc7news.com. you can also get breaking news anytime by following us on twitter at abc7 news bay area. this morning a kron4 crews crew is okay after an attempted robbery led to a shooting last night. it happened at third street in -- and la salle avenue in the bayview district in san francisco. here's a look at the news van as police looked for evidence

inside. police tell us two armed men demanded the reporters equipment. the reporter gave it to the men and then took cover. a security guard working with the reporter fired shots at the would-be robbers. one of them was hit. they took off in a car. now a short time later police say a man walked into san francisco general hospital with a gunshot wound. in the parking lot here you see police taped off his vehicle as evidence but officers will not confirm the incidents are related. a horrific car crash in san francisco has claimed the life of a high school student. the 16-year-old kevin sand was on his way to lincoln school with his mom and sister when a speeding driver slammed into his van, killing him yesterday morning. we have the more on how fellow students are trying to cope. >> this was a morning crash that left a scene of crumpled cars and killed 16-year-old kevin sand. he was the passenger in a minivan hit by a speeding

silver mercedes. word quickly spread that one of their students was in that crash. >> a junior or senior that passed away. i didn't know who he was. there was a guy that was in my class that was missing. it was kevin sandoval. -- seven sand. >> we sat next to each other in home last the last few years. we would talk a lot, help each other with homework and play games today. >> fellow students described kevin as an avid bicyclist and active member of the junior rotc drum corps. three other victims were also sent to the hospital. silver mercedes-benz came careening down causing the crash. >> i saw the car going fast. it was sitting near the van. >> it was sitting there. >> it got hit and flip over. >> the driver was not seriously injured in the mercedes. mercedes may have been speeding about 80 miles an hour. officers spotted the speeding s.u.v., but had no time to react. >> the car was going so fast they didn't have time to activate their lights or siren to get even within a block of it

before the crash occurred. police say the driver will likely be charged. abc7 news. >> a giant hay fire caused air quality problems in some parts of the bay area. a fire broke out just before midnight yesterday at a business named hay kingdom about 20 miles from vacaville. there is still heavy smoke this morning and officials say the fire could take another day or so to burn itself out. nick smith has the latest. this was the scene of a hay fire as it burned at its peak. firefighters from winters and at least five other surrounding agencies work to go get ahead of a blaze that continued to spread to barns, expensive agriculture equipment and light up the night sky as more than 200 tons of hay were consumed in the fast-burning inferno, assisted by the wind. >> certainly you smoke impacted the freeway last night. we had to slow traffic and at times close portions of the highway. >> smoke also had an affect on air quality in winters and beyond.

with the help of the winds the smoke was pushed down to pleasanton, livermore, and at one point could be smelled in parts of santa clara county but shifted before health officials felt the need to issue an alert. now the slow, long process as firefighters wait for the fire to burn itself out. >> we think we lost tons of hay and hay sales were going for $200 could $250 a ton. >> they are switching up their strategy, choose to go protect the buildings that are not burns and prevent the spread of the fire. between the structures, the product and the equipment, the losses at this time are believed to be well above $6 million. in yellow county, nick smith abc7 news. that's expensive fuel. the man accused of killing a college student in san francisco may have also been out hunting for a victim. the man is facing several charges, including murder, in the death of 20-year-old justin valdez. valdez was shot in the back monday while getting off a muni light rail train. district attorney says he also faces other charges for earlier

never any physical evidence. a family friend started an online petite to get the police to reopen the case. police chief said he will talk to the fbi on tuesday to see why it was closed and then he will reopen it if he is not convince it had should have been closed. it's been 20 years since another high profiling kidnapping case. 12-year-old poly klaas was be a -- abducted from her home during a slumber party in 1993. her kidnapper and murder is now on death row. poly's father said he's never forgotten or forgiven the man who took his daughter's life. >> i will witness that execution with great joy, yes. i will drink champagne after he is snuffed. >> after polly's death, marc klaas started the kids foundation that works to prevent crimes against children.

>> a man tackled by a parking control officer san francisco has died. police say the man started punching and kicking a woman on thursday afternoon. a parking control officer saw it happening and tackled the man. the man suffered an injury and was taken to the hospital and he died thursday night at 10:15. the transportation agency is waiting for a police report before commenting on the incident. bart and their two largest unions have negotiations scheduled for this morning at 10:30. the two sides remain $112 million apart. transportation officials are already planning ahead in case there is a strike. they released a $21 million strike plan this week. it includes free charter buses extra carpool lanes and limited transbay services run by bart managers. there are negotiating sessions scheduled almost every day through the end of the cooling-off period. dates with the hash marks are dates bart plans to meet with one of the two unions. the 60-day cooling-off period ends october 10th, and that is

honey! ♪ . >> right now developing news out of pakistan where there was a 6.8 magnitude earthquake just this morning. we are learning the quake hit in the same area where a quick earlier this week killed more than 350 people. pakistani officials say it was an aftershock from the earlier quake. no word on injuries or deaths yet. president obama made history when he spoke with the newly elected president of iran. it's the first time in more than 30 years a u.s. president has done so. the two spoke by phone. >> the very fact that this was the first communications between an american and iranian president since 1979 underscores the deepness for us between our

countries, but it also indicates the prospect of moving beyond that difficult history. >> the president of iran was in new york for the u.n. general assembly. before he boarded his flight to tehran he tweeted president obama wishing him a good day. president said thank you and good-bye. there's an investigative report into the wildfire that killed 14 firefighters earlier this year. the firefighters part of an elite firefighting team was battling the fire in june when the winds blew the fire out of control, overtaking them. today's report will provide a report of what happened and along with recommendations to avoid a similar incident. fright night is a month away. halloween hiring is getting started. theme parks and theme stores are gearing up for the spending spree that goes along with october 31. we have more from great america

[screaming] >> it's the howling good time at great america's halloween haunt. frightening creatures scare guests inside this haunted maze. >> it was pretty scary. the 3-d glasses added a good effect to it. >> the maze is bringing in people from all over the bay area. >> halloween hunt is a major part of our business. >> the manager said halloween is huge for them. it's so big they load up on seasonal workers. >> we beef up to about 2500 employees, but we add another 500 just for halloween hunt. >> great america isn't the only employer giving a boost to our economy. this store in cupertino hires a lot of college students. >> getting the merchandise and making it look nice for customers. >> according to a national retail survey halloween sales are expected to

website. wal-mart is apologize to go customers who may have been offended by the names. >> activists are hold a rally and concert protesting the sale of a historic berkeley post office. today's rally kicks off at noon on the steps of the post office on austin way. it will feature guest speaker peter burns. the author of "going postal." todd protest is the latest in recent weeks of that been staged to convince the postal service not to sell the property. officials in san jose are considering lifting the city's ban on fireworks. this comes after firefighters and police say they have been overwhelmed by residents complaining about illegal fireworks. city officials hope lifting the ban will dampen interest in the more illegal rockets and explosives. they say illegal fireworks has become a growing concern statewide as officials see a much more organized movement toward their use. boyle mountain resort has

already switched on their snow making equipment. they are hoping to start up the lifts just before halloween if it sticks. i can't decide if i should have my winter clothes out or summer clothes out. >> we are in that range. but tomorrow it all changes when we see increase clouds and maybe a little bit of rain visiting the sierra nevada by monday and for parts of the bay area. live doppler 7hd not pickping anything in the way of cloud cover. in fact, we are cloud free. here's a look outside the exploratorium camera at 7:03u see how clear it is out there. 55 downtown and 58 in oakland with 40s still at the coast. you will get some fog later on today in pacifica and half moon bay. emeryville it's clear. 45 in novato and 50 concord.

51 livermore. the forecast calling for sunny and warm conditions inland today. today the warmer day of the weekend. tomorrow we could see some sprinkles as soon as the evening hours. then light rain mainly focusing in the north bay with a chance of showers, just a chance. san francisco and oakland on monday. the likelihood will be sonoma and marin county looking at light showers, anywhere from a ten together quarter of an inch. here's why. we have a huge storm system to the north of us. high pressure is keeping it to the north. we are looking at a chance of rain as it continues to push its way in to the pacific northwest. it is the remnants of an old typhoon. lots of water with some. we are looking at two to four inches of rain in the pacific northwest. perhaps trace amounts here. we will take you through the weekend with sunny skies today. but as we go into sunday, increasing clouds. this is monday now where we are looking at the chance of showers from the mendocino coast from sonoma, even drizzle along the san mateo county coast tomorrow

night. then by the afternoon we are looking at much more in the way of cloud cover and cooler temperatures for the rest of the bay area. so after that we get behind the system, we are talking dry and sunny and warm again. 84 in morgan hill today. 78 santa clara with low 80s around los gatos. upper 70s for redwood city. there's the salsa festival here. we are looking at low 70s for milbrae. nice and sunny to start out. we will look for plenty of sunshine, but then the fog rolls in in the afternoon. 56 daly city. look for 80 today. you head to the east bay, numbers really coming up into the upper 70s today for hayward and oakland. 78 newark. you head inland, warmer than yesterday. low to mid-80s with 84 in antioch and livermore checking in in the mid-80s, as well. plenty of sunshine on tap today for the padres and giants. it's going to be a beautiful day at at&t park. in fact temperatures will climb through the 60s.

>> good morning katie. we are starting out nice and clear. no fog to speak of. just cool temperatures along the bay, especially the north bay. low 40s half moon bay, 58 the warm spot in oakland. upper 40 necessary the san ramon valley. with the clear sky and the longer nights it's certainly feeling like fall this morning. but by this afternoon we are warmer than we've been the past several days with 70s across the bay. in fact, we are going to go into the upper 70s around the bay. bring up the numbers a little bit. mid-and upper 60s. starting out sunny but the fog returns by late afternoon. in the inland we are talking low to mid-80s today. it's going to last. second half of the weekend cooler and cloudier. we will look at some rain visiting parts of the bay before we usher in october, which is looking even dryer by the end of the upcoming work week. we will talk about all of that in a few minutes. katie. >> lisa, thank you. breaking news out of san francisco where a man has been taken to the hospital after being stabbed this morning.

it happened around 4:30 in the area of larkin and golden gate. the man was acting as a good samaritan, trying to help another person who was being assault bid a group of people. those people then turned on the man and he was stabbed multiple times. he was taken to the hospital. we are told he's in stable condition. there are no suspects in custody right now. if we get more information during the newscast, we, of course, will bring it to you right away. obamacare survived a vote in the senate that keeps the government running through mid-november. the senate amend add bell and put funding back in for obamacare. republicans say they will not accept the bill as it's been return to them. now its up to boehner to come up with a plan to avoid a government shut down by tuesday. meanwhile, there is new word about health insurance marketplaces. in president obama said starting tuesday americans can go online

and use the health insurance marketplace in their states to shop for coverage plans. >> this is a website where you can compare insurance plans side by side, the same way you would shop for a tv or plane ticket. you will see new choices and new competition. many of you will see cheaper prices and many of you will be eligible for tax credits that bring down your costs even more. nearly six in ten uninsured americans will be able to get coverage for $100 or less. >> the president says it's disturbing that republicans are willing to shut down the government to kill the affordable care act. he case health insurance marketplaces will open tuesday no matter what. happening today, kaiser will kickoff their flu shot campaign with a drive-through flu clinic in fremont. more than a thousand people are expected to get their annual flu shot at the drive-through. last year more than 2,000 people took advantage of the clinic at kaiser. today's flu shot clinic will run from 9 to 5 at the fremont

medical center. happening today, the 11th annual avon walk for breast cancer. it will put thousands of people in pink on the streets of san francisco. opening ceremonies kick off at 7:00 a.m. at fort mason. participants will walk a route of either 13-mile or 26.2, full marathon, until they reach the end. they will make the return trek tomorrow raising millions of dollars for breast cancer research. berkeley high school students are being told it stay away from the school's swimming pool. this after students reported strange side effects after being in the water. tests show a chemical imbalance in the water from a high ph level and ten times the acceptable amount of chlorine mixture. parents said water polo players suffered burning eyes, bleached hair and even loss of body hair. the school district down played the effect. >> i don't think you saw a list of things that happened, you saw a list of potential things that

could happen with a chemical imbalance. the only complaint i know of is from a parent specifically saying he was concerned about that happening with students. >> the chemical imbalance was traced back to a broken carbon dioxide tank. the replacement has been ordered and the pool should reopen sometime next week. there are now six confirmed cases of ecoli in marin county. four are children. the cases are reported in tibiron and other places. they are trying to pinpoint the source of the outbreak. e. coli infection usually happens by eating food that's contaminated. we have links to information on ecoli, including symptoms to watch out for, on our website under "see it on tv." one of the world's biggest construction and engineering firms is giving a major boost to the effort to redevelop the presidio. the san francisco-based company is donating $25 million to help fund what's being called the tunnel top parkland.

here's abc7 news reporter johnathan bloom on what that means for the park. >> from far away the sidewalk along the these historic buildings in san francisco's presidio appears to go all the way to the bay. only when you get closer do you realize it doesn't. for decades a freeway separated the hills and trees of the presidio from the meadows and marshes of crissy field. now with the mesh of rebar rising up from the roadway, that will change. >> it will be the place that will be the centerpiece for the whole presidio, i think. >> they have long envisioned a ten-acre park build on top of the tunnels carrying the new approach to the golden gate bridge. it once sat in the shadow of a crumbling freeway, but now with the tunnel it's the freeway's turn to be in the shadows on a new national park with panoramic views forecast golden gate. it's a $50 million project and now half of it is paid for. >> it's the largest cash gift ever given to the national park system in the history of the

country. it's an amazing act of generosity on part of the becktoll foundation. steven becktoll is giving the gift that will join it together. his engineering firm built hoover dam and the bay bridge. >> we will create overlooks a visitor tub or a visitor center for the presidio will be in that space. along with building the physical landscape, part of the gift will go to crissy field center that sits at the foot of the plan to help programs for kids. >> we do environmental education, we have high school level programs that help young people develop their leadership skills, their speaking skills, their sense of civic engagement. >> the center moved to a temporary home by the beach during the road construction. now it plans to turn its original home into a new youth campus. >> we have thoughts about a wellness center that focuses on the health of kids and young people and health of communities in general. >> work on the park could start sometime in 2016. in san francisco, johnathan bloom, abc7 news.

>> a silicon valley tech pioneer is claiming he can make the internet hack proof. mcafee escaped from belize where police still want to talk to him about a homicide, but now he's launched this new website and it's promising a solution to internet security called decentral. he plans to unveil it this afternoon. abc7 news business and technology reporter david louie looks at the buzz mcafee is now generating at a south bay tech conference. >> john mcafee was, and apparently still is, a person of interest in belize after a neighbor was found shot to death.
