"i'm on my way to sf to pick up michael. i can't wait to hug him and tell him i love him."

michael montgomery is accused of killing denver outside a dodgers's game. denver was with his family and friends and dressed in dodgers gear. montgomery was with his friends who were giants fans, words were exchanged, and then a fight started. this man was montgomery's cell mate, and talked about it. >> he seemed confident that he was doing self-defense and he would come through it okay. >> reporter: the district attorney decided not to charge montgomery until the case was fully investigated. and all witnesses were interviewed. he is also asking businesses with cameras in the area to hand over their video. in the meantime, denver's parents and brother will speak publicly for the first time to ask anybody who knows anything about that night, to come forward. >> this case is not over because he walked out of the courthouse. >> reporter: the district attorney says it is difficult to prove.

>> the prosecutors have to prove not just that it was a wrongful killing, a homicide, but that it was not self defense, and that can be hard sometimes. >> and one more thing, we've learned that the suspect told his father that denver hit him with a chair over the head while fighting on the sidewalk, and that is why he stabbed him. abc 7 news. thank you, lisa, a man has been hospitalized after being stabbed while trying to break up a fight, happening at about 4:30 near golden gate near the ten r tenderloin district, police say a man was trying to help a person being assaulted by a group of people. the group then attacked the man, stabbing him several times, there are no suspects in custody. and two men were arrested after police say they tried to rob a bay area news crew at lasalle avenue. they demanded the man's equipment. the security guard with him opened fire, hitting one of the

sunshine, 74 in san francisco, a lot cooler temperatures tomorrow, the forecast is coming up. all right, thank you, lee, a new report suggests that radio problems may have led to the deaths of 19 firefighters who were killed in a fire on june 30th. the 116-page report cited technical problems with the firefighters' radios plus poor communication between the men and their support staff. the fire topped 2,000 degrees in some spots which is the same temperatures as lava, the families were allowed to review the report before it was made public. >> it was everything you would have expected. anger, frustration, and just overcoming sense of loss. it was a very emotional meeting, both for the families and actually for us, as we were there to try and respond to their questions. >> the fire destroyed more than 100 homes and burned 13 square miles.

firefighters in mendocino county are trying to put out a fire fanned by wind gusts, these are pictures of the fire, right now it is 25% contained out of 100 acres, two buildings have been destroyed. and a fire in yolo county has been contained. the firefighters have gotten the upper hand on the fire that burned nearly 100 tons of hay. it burned four buildings. the fire started late thursday night near winters, about 20 miles north of vacaville. dramatic new video from the terrorist attack in kenya, the video shows the customers being questioned by the terrorists. 67 people died in the attack by the somali terrorist organization. 61 people remain unaccounted.

live from the kgo tv broadcast center, this is abc 7 news. good evening, tonight's headlines, the family of a man stabbed to death near at&t park will speak to the public tomorrow, and will ask any witness to the death of jonathan denver to come forward. and police say three people turned on a man and then stabbed him, then stealing from his car. the victim is expected to survive. the mountain view police have a strong presence at this weekend's beyond wonderland area. 22,000 people are expected to attend the events, police will be enforcing all drug laws in and around the event. back to our news tonight, the house of representatives has voted on a financial bill that could almost lead a shutdown for
