>> live from. >> good morning, i'm carolyn tyler on sunday, september 29th. let's start with a quick first look at the weather with meteorologist frances dinglasan in for lisa argen. >> good morning. live doppler 7hd picking up the extra cloud cover already falling in the northern parts of the state. that's moving our way. here's what you can expect for today. we have cloudy conditions, as well as thick, patchy fog along the coast. this afternoon increasing clouds and temperatures a few degrees cooler compared to yesterday. low 60s to upper 70s. and then we've got the chance of

rain moving into the north bay as we drop down to mid-50s to mid-60s by 7:00 this evening. more rain in in seven day forec. >> thank you. the budget battle is heating up in washington, d.c. last night they voted to avoid a partial government shut down but also delay the healthcare law. the overall legislation will be vetoed but the bill may never reach president obama because senate majority leader harry reid said has chamber will reject the measure first. that means both sides of edging one step closer to a shut down of many services tuesday morning. on tuesday californians will be able to comparison shop for insurance plans included in the affordable care act. and to help sort through all the information, a new state agency has been created to field all

those questions. abc7 news anchor amma dates has the details. >> the restaurant in concord keeps growing, the owner says he will need the affordable healthcare act to provide health insurance for his employees. >> we need to be educated. >> health insurance is expensive and he said he will need help shopping for the right plan. >> thank you for calling. is that your first time calling? >> a new state agency called cover california is prepared to help individuals and small business owners shop for the right plan. call centers are opening in concord and cordova. >> the first thing i suggest is look at the cost comparison on the website together. that way they can see what plans are offered side by side. >> right now the call center takes 4,000 to 5,000 calls but they are expecting a lot more once open enrollment begins on october 1st and there are a lot of questions. >> for people that are still on

>> one man is dead and others injured after a shooting. officers found two men, 20 and 24 years old, suffering from multiple gunshot wounds. the older man was pronounce dead at the hospital. the second has undergone surgery. his condition this morning is not known. no word yet on motive or suspects. >> new details in the stabbing of a dodgers fan near at&t park. the suspect is now free, but that does not mean the case is closed. johnathan denver's family now plans to make a public plea today. abc7 news reporter lisa amin gulezian has the latest. >> marty montgomery wouldn't talk about his son, michael, who was released from jail late friday. but the father did post this on his face book page at 11:00 last night. quote, i'm on my way to pick up michael. i can't wait to hug him and tell him i love him.

michael montgomery is accused of killing johnathan denver neared third and harrison streets. the men's paths crossed after the giants and dodgers game. he was dressed in dodgers gear and montgomery was with his friends, who are giants fans. words were exchanged and then a fight started. this man was montgomery's cellmate and he talked about what happened. >> he was severely outnumbered and had to defend himself. he seemed confident he was doing self-defense and he would be coming through it okay. >> the district attorney george gascon decided not to charge montgomery until the case was fully investigated and all witnesses were interviewed. he's also asking businesses with cameras in the area to hand over their video. in the meantime denver's parents and brother will speak publicly for the first time to ask anyone who knows anything about that night to please come forward. >> this case isn't over because he walked out of custody. >> former prosecutor jim hammer

admits, claiming self-defense adds a tricky layer to the case. >> prosecutors in the self-defense case have to prove it's not just a wrongful killing, but that it was in self-defense and that can be hard in some cases. >> one more thing, when the suspect told his father that denver his him over the head with a chair while they fought on the sidewalk and that's why he stabbed him. abc7 news. happening today, the giants are holding another fundraiser for brian stow. he's the giants fan beaten while leaving a dodgers game in l.a. more than two years ago. the team is selling special tickets for today's 1:05 game against the san diego padres. it's the giants final game of the season. ten dollars from each ticket goes to the brian sew fund. stow's insurance company recently stopped paying for full-time care at a rehab center. his family is suing the dodgers to help pay for medical costs. a fire broke out last night

in the giants' clubhouse at&t park. just after 7:30 witnesses saw smoke coming from the king street side of the stadium. a large commercial dryer burst into flames in the laundry room. there was some smoke and water damage, but giants officials say everything is okay. new this morning, authorities are investigating a two-alarm fire in oakland that broke out overnight. it happened at a house on 79th avenue just before midnight. the fire was brought under control about 20 minutes later. authorities say no one lived in that house, but they did find a squatter inside. no injuries have been reported. while the cause of the fire is unknown, investigators say it appears it started in the garage. a new report suggests radio problems may have led to the death of 19 firefighters killed fighting an arizona wildfire. the crew died while responding to that fire back on june 30th.

the 160 page report cites technical problems with the firefighters's radio, plus poor communication between the firefighters and their support staff. the fire topped 2,000 degrees in some spots, which is the same temperature as lava. the firefighters families were allowed to review the report before it was made public. it is everything you would have expected, anger, frustration and just an overcoming sense of loss. it was a very emotional meeting, both with the families and actually for us as we were there to try to respond to their questions. >> the fire destroyed more than 100 homes and burned 13 square miles. huge crowds are expected for the second day of a rave today. it's called "beyond wonderland bay area." it has a large police presence this year as mountain view police enforce zero tolerance for drugs. abc7 news reporter sergio has

more with how day one went. >> plenty of partyers dressed up in costumes or dressed down for a night of extended dancing poured into "beyond wonderland." just after sun sight the lights spectacle for a crowd. the concern for one resident was traffic. >> it's hard to get to the dog part. there is only one access basically. >> he and his dog, sophia, made it to the park so he's not concerned about the party crowd. >> i'm sure there will be bizarre people walking around but i've been to burning man so this is really nothing that out of the ordinary for me. >> gates opened just after 1:00 for an event that will stretch on until sunday night. biggest safety concern for promoters is heat exhaustion and dehydration. >> drinking water is very, very important. we provide free water refill stations here to help encourage fans to hydrate when they are out there dancing, especially in the sun. it's easy to get dehydrated.

the syrian opposition has repeatedly said it will not take part in any transition government that includes him. happening today, grease will hold the flame-lighting ceremony ahead of the four-month torch relay for the 2014 olympics. they carried out a successful torch-lighting rehearsal. actresses dressed as ancient priestesses took part. the russian leg of the torch relay is set to cover more than 40,000 miles before the february winter games. anti-virus software pioneer john mcafee says his new creation will make the internet hack-free. mcafee spoke at the first annual

c2sv conference. his new company is described as a place where you can exchange information that can't be accessed by the nsa or anyone else. mcafee also talked about his trouble, his legal troubles with the belize government and described one of the places where he hid from police. >> a little tiny box on top of that where i could put my head. on top of that, i filed a wood, paint cans, garbage of every sort. i was there for 24 hours while the police were no more than 25 feet from my head. >> mcafee is still wanted as a person of interest in a fatal shooting last year in belize. microsoft has a deal for you. the company is offering owners of an apple iphone 4 or an apple

iphone 4s a trade. the company is counting on owners not being thrilled with the iphone fingerprint scanner and the ios-7 operating system. this morning, bart will meet with one of two employee unions in their labor dispute. negotiations with seiu representatives are set to begin at 9:30. yesterday, representatives from the transit union met with bart officials at the cal-trans building in oakland. one of the reps telling abc 7 news there is nothing new to report. bart says the two sides remain $112 million apart. there are negotiating sessions scheduled almost every day through the end of the cooling off period. the dates with hash marks are days bart plans to meet with just one of the two unions. the 60-day cooling off period ends october 10th. that is the last day talks are scheduled. happening today, the

half-moon bay international marathon. this event features a full 26.2-mile marathon, a half marathon, and a free 5k fun run. the full marathon starts at 7:00. the half at 7:30. the 5k at 7:45. the race starts and ends at eq fitness on princeton avenue. will they be rained on a bit there? >> they might get a little drizzle. there's a lot of fog. it will stay throughout the morning. temperatures will be in the low 60s. but it looks like you can give your umbrella a break for most of us around the bay area. although we will be using it very soon. a look from live doppler 7hd, showing you the radar satellite image, increasing clouds coming in from the north. there's also rain already being reported far north right now. and here is a look at what you can expect for the day. so we've got the patchy dense fog during the morning hours. and then we have cloudy

conditions throughout the afternoon and a chance of rain this evening. i just wanted to move to my next forecast to show you what you can expect throughout the day as well. there is also a red flag warning in tahoe. if you're headed there, keep in mind it's going to be pretty gusty with winds up to 50 miles an hour. so do be careful driving through the area. also a view from our emeriville camera shows low clouds over parts of the bay. it is currently 56 in san jose. a nice shot of the bay bridge. we're seeing clouds move in, though, especially along the coast. it's currently 56 in santa rosa. here's some of that thick fog along the coast. you can see it with this golden gate bridge camera. we've got the fog, the cloudy

and cooler conditions today with light rain coming in from the north bay. and look for a few showers for tomorrow morning for all of us. here's the radar satellite image showing you this cold front. that's going to bring us the chance of very light rain. we're talking less than a tenth of an inch for most locations. the forecast animation shows that even by 1:00 today, most of the light rain is going to be north of santa rosa and throughout the day, although we might get a spotty shower along the peninsula coast as well. then look out for tomorrow morning's commute. we could see some wet roads. only san francisco and around the bay area. the system will leave monday night, leaving us dry conditions tuesday into the weekend. enjoy the sunshine, especially in the south bay. you'll get more sunshine the farther south you are. look for low 70s through palo alto. san francisco right around 64

live from the kgo tv broadcast center, this is abc 7 news. >> welcome back, everybody. let's start this half-hour as we always do with a quick look at the weather. francis is in this morning for lisa. >> hi, carolyn. good morning, everyone. just about a half-hour away from the sunrise. temperatures in the 50s to near 60 degrees. 56 in san francisco. there's some very thick fog along the coast. and you'll notice today that it's going to be cooler with increasing clouds. so around the bay, it will be mostly cloudy with temperatures

in the mid 60s to mid 70s. along the coast, the clouds are going to stick around all day. low 60s for you. inland temperatures also coming down. only in the 70s today with increasing clouds from the north bay. a chance of rain for the north bay as well. and for everybody tomorrow. i'll have all the details coming up. carolyn? >> francis, thank you. the house of representatives has voted on a financial bill that could almost certainly lead to a government shutdown by midnight tomorrow. abc news report eer karen trave has the latest. >> reporter: the federal government inched closer to its first shutdown in nearly two decades. house republicans took a hard line. they pushed for a one-year delay of president obama's health care law as a condition to keep the government running after the fiscal year ends on monday at midnight. >> the house amendments would make important steps to ensure that obama care does not have the opportunity to hurt american jobs and drag down our economy.

>> the majority has tried any way they can to repeal, defund, undermine, delay, whatever the historic health care law. >> reporter: and the finger pointing over who should bear the blame is in full swing. >> to talk about a republican bill to shut down the government is obviously nonsense, mr. speaker. >> i want to let america know that house republicans are shutting down the government. they're doing it intentionally. >> reporter: and in his weekly address recorded earlier, president obama insisted once again the time for negotiating is over. >> no one gets to threaten the full faith and credit of the united states of america just to extract ideological concessions. >> reporter: there's little hope that the differences between the republican-controlled house and the democrat-controlled senate can be resolved before midnight on monday. shortly afterwards, some federal services will stop and some nonessential government employees will be forced to stay home. karen travers, abc news,

washington. so here are just a few of the effects from a government shutdown. social security payments could be delayed. and new claims may not be processed. services like medicare and veterans benefits will continue. but new filers may have problems with agencies being under staffed. federal government offices could close. national parks, museums, and zoos would probably close. the state department would have to halt new passport and visa applications in all likelihood. and hundreds of thousands of federal workers could expect to be furloughed without pay. abc's george stephanopoulos will have more. he goes one on with former president bill clinton this morning at 8:00 on this week here on abc 7. a new poll finds most voters want to put the brakes on california's high speed rail project. the usc "l.a. times" survey found that 52% of voters say the

$68 billion project linking l.a. to san francisco should be halted, only 43% think it should go forward. now, that number is higher in the bay area with 51% of voters supporting the project. all in all, the majority of voters want this project to go back on the ballot. san francisco mayor ed lee has 90 days to make an offer to host the next america's cup. and he says he plans to do that. the "san francisco chronicle" reports location, though, could be a concern with the golden state warriors hoping to build a waterfront arena at piers 30 and 32, which were launching sites for the cup teams. there are also concerns over the cost with san francisco expected to be left between 3 million and $5 million in the red from hosting this year's race. oracle ceo larry ellison has not committed yet to a location saying it will be a group decision. tests are under way to determine just how dangerous

electronic devices are to a plane's system. cell phones can sometimes interfere with an airplane's smoke alarm and laptops could disrupt pilot radio communications. but engineers say no electronic device has brought down a plane. >> it's not necessarily that a phone can bring down an airplane. that's not really the issue. the issue is interfering with the airplane and causing more work for pilots during critical phases of flight. >> new planes are being designed with technology that can counter any interference. this month, a government industry group studying the subject will give its findings and recommendations to the federal aviation administration. new this morning, a new report finds scores on the s.a.t. college entrance exam remain steady, but many students are unprepared for college. the report finds average scores in reading, math, and writing were the same this year as last. but only 48% of test takers reached the s.a.t. benchmark

score of 1550, which indicates their likelihood to enroll in a four-year school and complete their degree. the report also finds 46% of those who took the test this year are minorities, the highest minority representation in history. and in california, 57% of graduating seniors took the exam, and that's the highest number ever for the state. happening today, three young swimmers from arizona will compete in the 18th annual alcatraz invitational and they are blind. they're the first blind team to compete in the one and a half-mile swim from alcatraz island to high street pier. they'll have guides. the trio is trying to raise money and awareness for the foundation for blind children. today's race begins at 9:00 this morning and we wish them luck. coming up, uncovering mysteries deep under the ocean.

expedition to explore tornados. as dan ashley shows us in this morning's assignment 7 report, it's making the research available to us here in the bay area. >> this university of washington video shows a research ship heading for one of the world's deepest construction sites. >> they're putting in a cabled ocean observatory on the bottom of the ocean right on an active volcano. >> 60% of the earth's volcanic eruptions happen underwater, deep in the open ocean. this robotic vehicle is being lowered into one of those hot spots 300 miles off the oregon coast. it's part of the ocean observatory's initiative. the coalition of researchers launching a new era of ocean exploration. they provided this underwater video. mary miller with the exploratorium was on that expedition blogging and doing live updates to tell the public what was going on. >> you're seeing octopuses and

shrimp and fish, and these amazing underwater features where you get this hot fluid from under the ocean floor and it's feeding microbes and these whole communities of life that we didn't even know existed 30 years ago. >> this is the top of an active volcano. you can see the different types of lava flows and parts of a collapsed lava basin. even in this desolate environment, there is life. the national science foundation is spending almost a quarter billion dollars to cover this area with a network of sophisticated cameras an instruments. the system is being built by a remotely operated submarine controlled from the ship above. it takes three to four people from the canadian scientific submersible facility to run it. along with a team of scientists and engineers. >> making sure that everything is getting laid out properly, there's no kinks in the cable. the electricity is flowing and they're testing and monitoring all the time.

a mile under the ship. >> they will eventually lay 575 miles of wire and cable to send live pictures and data back to laboratories on land. the system is expected to be fully operational in early 2015. during this mission, scientists tested some of the equipment, including size mommer thes and they worked. >> there was a pretty significant earthquake that was recorded so that was a really happy moment on the ship. everybody was super excited about that. >> once everything is in place, scientists are eager to study both the geology of the ocean and the life that depends on it. dan ashley, abc 7 news. >> the ocean observatory's initiatives have half a dozen research sites in oceans all over the world, but this is the only one that includes a cable system on the sea floor. we have a link to more video and details of the mission at a aab abc7news.com. you can click on "see it on tv."

in sports, developing news. former raiders head coach lane kiffin has been fired from the same position by usc. kiffin was reportedly told the news last night by athletic director pat haden after the trojans were beaten 62-41 against arizona state. usc has lost seven of its last 11 games. the trojans are 3- this year, but 0-2 in the pac-12. this afternoon the raiders host washington at the oakland coliseum. kickoff is at 1:25. last night, fifth-ranked stanford traveled to seattle to play washington state on the same field where the 49ers were bumped by the seahawks a couple weeks ago. >> fifth-ranked stanford put the rest of the nation on notice that they are a national title contender, facing washington state at century link field in seattle, and what a performance.

i'm mike schouman. have a great day. >> will they get a little rain on them? >> looks like it will be dry. just cloudy for the most part, for both games today. but rain is headed our way, and live doppler 7hd will be tracking it for you as it sweeps around the bay area. you notice the clouds coming in from the north bay. those areas of green will head up to the northern part of the state. rain already being reported in crescent city and eureka and that's going to make its way towards the bay area. i did want to mention a red flag warning in the tahoe area, so gust y winds up to 50 miles per hour. do be careful driving, especially in the higher elevations. the view shows you some of the low clouds. and a little bit of a pink from the sunrise. that's coming in about ten minutes right now. it's currently 56 in san francisco. 61 in oakland. and san jose 56 as well. cool in half-moon bay with some thick fog on the coast.

and check out this exploratorium camera. winds are light, but you see some of the pink in the clouds. really pretty. also some blue skies still out there. in santa rosa, it's 56. nevada 54. antioch 61. a live shot from golden gate bridge camera shows you some of that thick fog you'll encounter. especially near the coast. so just be careful driving through that area as well. patchy, dense fog with us for the morning hours. closer to the coast cloudy and cooler today with light rain possible. mainly in the north bay. and then a few showers for everyone. most everyone monday morning. the radar satellite image shows an approaching cold front that's going to bring us a chance of light rain this afternoon. but our forecast animation shows most of the light rain staying north of santa rosa, even by lunchtime and through the evening. but you notice increasing clouds around the bay area.

we could see a wet commute monday morning with sprinkles around san francisco, parts of the peninsula, and even in the east bay. the rain starts to taper off, and by the evening, it's almost all gone as the system continues to move east. so for today, you can still expect a nice day in the south bay. 76 in san jose. 73 in sunny vail. low 70s on the peninsula. 73 in palo alto. for the giants game today, right near 64 degrees with some cloudy conditions, 62 sunset district for. low 70s through sonoma, nappa. in the north bay, a lot of clouds there as well. more sunshine the farther south you go. 72 in union city. 73 in hercules. some upper 70s in this interior east bay valleys with some mid 70s as well through san ramon and walnut creek. also just want to give you a heads up, the fog has returned to pacifica just in time for fog
