thanks for joining us, i'm eric thomas. let's begin with breaking news off the coast of italy a massive rescue operation under way after a ship packed with hundreds of immigrant sinks here sicily with deadly results. >> kristen, there are different numbers coming out right now. there are reports of 78 bodies being recovered at the scene there but one italian official says 94 people are dead. we know some 160 people have been rescued and that rescue operations do continue right now. helicopters and rescue boats are continuing to search the accident scene and also local fishing boats have pitched in. more than 260 people are missing. the boat is actually thought to

have been carrying 500 people immigrants from africa seeking refugee status on the closest italian island to africa. the coast guard believed it launched from libya. the boat apparently capsized and then caught fire. rescue workers report that someone lit a fire to report the boat was sinking and that caught the ship on fire. it's the second dead crash this week, 13 people drowned last week trying to reach sicily. >> katie, thank you. 5:01. time for a look at the weather in the bay area, mike? >> it's a little different when you step outside this morning. notice no high clouds. we've got a lot of clear conditions out there and the air is starting to dry right now as the winds are picking up. in fact, we have a red-flag warning from the central valley, our north bay and santa cruz mountains, the east bay hills and diablo range starts at 6:00 through saturday 6:00 in the morning so we've got quite a stretch of high fire danger

above 1,000 feet. here's your forecast for the afternoon hours. check out all this sunshine, 68 at half moon bay, low to mid-70s for most of the bayshore. fremont the exception at 77. we'll have upper 70s in the north bay. near 80 in the east bay valleys. how about that morning commute? here's laila. >> we tried to contact chp to see if there was an accident on southbound 880 as you come away from the maze at 14th avenue. it appears there's no accident, construction in the area is wrapping up but that's it. this just in, this crash in campbell has cleared southbound along 17 coming to camden avenue. we had a little bit of delays coming away from hamilton avenue but it looks like that's all cleared up, all lanes have reopened. here's a peek at our drive time traffic 680 from walnut creek to dublin is a 14-minute drive and 101 southbound from san jose to san francisco, 17 minutes a s a live look outside from the emeryville camera bouncing around out there as mike was

telephoning us gusty conditions but looks like traffic's moving smoothly into treasure island. just about 5:03. palo alto police are putting out the unwelcome matt for the car burglars because of the huge spike in thefts. and matt keller live in palo alto to explain, matt? >> reporter: yeah, eric, it doesn't matter the time nor the place, cars are being targeted here in palo alto. including at this city garage here on bryant street. police say 61 auto burglaries were reported in september making it the worst month in the city since at least 2008. so far this year, 260 auto burglaries have been reported, more than the annual total for each of the past three years. police say the majority of the crimes have taken place during the evening hours but many also happened during the day and overnight. some of the hot spots include cars parked on california avenue and the oak creek apartments along sand hill road. >> cost of living in this apartments is actually pretty

steep so people living here must be pretty wealthy as you can see the cars are very nice so it makes some sense that people would target the area as maybe a place to steal things. >> reporter: police believe several auto burglary crews are coming into palo alto and rental cars are attractive to thiefs, some of the items include laptops and backpack purses and luggage. police say this is a regional problem. so far this year officers here in palo alto have made five arrests related to auto burglaries. reporting live in palo alto, matt keller, abc 7 news. extra security this morning at a habitat for humanities site in oakland after an armed robbery where former president jimmy carter is scheduled to visit next week. eight habitat staff members and americorps workers were robbed of their cell phones and wallets at eads avenue on tuesday. one of the victims was also shot at and pistol-whipped. had is a look from sky 7 hd

where you can see the extra security at the construction site. president jimmy carter and former first lady rosalynn carter are visiting oakland and san jose on monday to highlight habitat home building projects. governor jerry brown is expected to sign historic legislation to allow undocumented immigrants to get driver's licenses. the governor will sign the bill this morning at events in l.a. and fresno. the bill allows anyone who passes the written and driving test to get a california license regardless of immigration status. growing number of states are passing their own laws frustrated by the lack of reform at the federal level. 1.4 million drivers are expected to apply for the licenses after they become available in january of 2015. it's day three of the government shutdown and a top-level meeting with congre congressional leaders at the white house brought little progress. on the horizon a potentially catastrophic government default set to happen in two weeks. we've got the latest from

thun-year-old actor died of mixed drug toxicity as a result of shooting heroin and drinking alcohol. he was found dead alone in his hotel room in vancouver on july 13th. according to the coroner investigators found drug paraphernalia including a spoon with drug residue and a used hypodermic needing along with an empty champagne bottle and ghasve glaghas glasses. a meat processing plant is recalling its beef for the second time in a month and for the same reason. the central valley meat plant in hanford is recalling 90,000 pounds of ground beef meant for the national school lunch program because it may contain small plastic pieces. the beef was packed in a 40-pound case or many 40-point cases and shipped to distribution centers around the country. the company is the agriculture department say there are no reports of anyone getting sick. starbucks is about to make it easier for the blind and visually impaired to buy their

morning lattes all year around. the braille gift card they offer in the fall will now be sold at registers every day of the year. the seasonal card was originally created two years ago at the urging of disability advocates, but it was made permanent at the request of a mom whose blind daughter likes the independence the card gives her. you know, as parents we hope that our kids won't be begging for noisy toys, right? >> yeah. >> okay, now imagine one that makes gross sounds. >> oh, good luck with that. here's jane king with that and more impact from the government shutdown in this morning's bloomberg business report. >> reporter: as many as 5,000 workers at whitney and other units facing furloughs because of the government shutdown and the helicopter and jet maker says the temporary cuts may be bigger if the shutdown continues into november. and get ready for a lot of toys that burp and pass gas. toys "r" us selling gross noise making toys for the holidays. the uglys can make dozens of

rude sounds. the sound of passing gas is the sound of profit they say and consumers may buy $100 million worth of gross holiday gifts. toys "r" us plans to roll out monster 500 toys including a cross pot vehicle and a turbochain car massacre. at the new york stock exchange i'm jane king with the bloomberg business report. on the heels of mcdonald's introducing its lower-fat fries burger king is enjoying a wave of social media buzz from a supposed name change to fries king. burger king's website shows a company logo with the word fries king and the company's facebook page showing some buildings with the name change. this publicity stunt comes as the company rolls out revamped fries that it says are healthier than the original. a key economic forecast will be released later this morning and it predicts a moderate increase for holiday gifts this year over lasts but analysts say that could all change if the government shutdown drags on.

the shutdown has forced the furloughs of 800,000 federal workers and analysts worry it could cause shoppers to lose confidence in the economy. the report today from the national retail federation forecast that sales in november and will rise 3.9% compared to a 3.5% increase last year. i wouldn't mind having a wind blocker this holiday season and could come in handy this weekend or today, right? >> definitely, it will be breezy but it brings a fire danger with it also. the winds right now are up a little bit especially some areas we don't normally see them like around santa rosa 12 miles per hour, novato the same. 18 in fairfield but it's coming out of the north instead of coming out of the west. where it would be bringing in some cooler weather. no marine layer out there to deal with this morning. everybody else less than that, but look what happens as we head to 16 th 6:00 this evening, shaded in tan, that's where the wind

advisories are. this is continues through 3:00, east to northeast winds around 20 to 35 miles per hour with gusts up to 50. this is the way it looks from the east bay hills this morning. every once in a while you'll see the camera bounce around. winds 15 miles per hour, gusting up to 23 and we've seen gusts up to 20 in santa rosa and they are developing starting to develop in some areas. let's talk about the three highlights in the fire danger today, tomorrow and saturday, keep your guard up for that especially above 1,000 feet where it will be worst. above-average warmth comes with the winds and it will last longer friday, saturday and sunday. it will be cooler next week but the system that brings us the cooler weather unfortunately does not have rain with it. the low pressure is accelerating to the east on the jet stream. a cool pocket of air. notice the distance between that low and this high it's not very much because it's so chose together that's what's going to push the winds up to be faster, the tight pressure gradient. 80 in morgan hill and near that

area off the central freeway in san francisco blocking off guerror at dubos. it's 5:26 now. a judge has appointed an attorney to represent former santa clara county supervisor george shirakawa jr. at taxpayer expense. he said he can't afford legal fees as he fights charges involving a phony campaign mailer. according to the "san jose mercury news" the attorney is one of the attorneys that handled his corruption. shirakawa re-signed in march after pleading guilty to corruption and misusing funds. the public defender's office couldn't take the case because of conflicts. oracle is fighting new criticism that larry ellison makes too much money, who made $76.9 million last year. that's down from $96 million in the previous year. and oracle shareholders group has publicly criticized the pay package in a letter to the

you all morning a frantic rescue operation under way off the coast of italy right now after a ship packed with hundreds of immigrants sinks near sicily. dozens are dead. a we're live in the newsroom with more. >> the numbers are starting to solidify, both cnn and the associated press reporting an italian official reporting 94 bodies have been recovered, there are reports that pregnant women and children are among the dead. a top health official expects the number to rise as the frantic search operations continue. between 150 and 160 people have been rescued. this is new video of the italian coast guard bringing survivors ashore, but more than 200 people are unaccounted for. the coast guard said the ship was trying to smuggle as many as 500 africans into europe, that the ship caught fire and caps e capsized. it's the italian island closest to africa, the boat is thought to have left from libya.

the u.n. refugee agency estimates 8,400 migrants and asylum seekers landed on the coast of italy and malta in the first six months of this year, 8,600. the agency recorded some 40 deaths in that same time period based on interviews with survivors of the crossing, but as we know this accident alone appears to have claimed more than twice that. live in the newsroom. traffic tie-up in the area around guerrero and dubose. >> as we take you into san francisco, this is just off of the central freeway. right in the mission district. the clinton park area to be exact. dubose avenue at guerrero street blocked off by san francisco police, who are investigating a possible shooting in the area. it doesn't sound like anyone could have been hit but they are injured due to a crash the shooting has caused. again, information is filtering in to the newsroom as we speak. dubose at guerrero shut down right now and detours will be in place.

let's go outside and take a quick live look at your drive in the east bay. southbound along 680 as you come away from highway 4 and you can see the traffic building as you approach the 24 junction, so a little bit extra congestion now this morning as we head out to work. here's mike with a look at the weather. good morning. >> thank you very much. good morning, everybody. and let's look at the dry gusty winds coming out of the north to northeast. the area you see in red the north bay mountains. the diablo range and the santa cruz mountains all above 1,000 feet on to that high fire danger or red-flag warning through 6:00 this evening and 6:00 saturday morning and an extended period of time. northeast winds gusting 35 to 45 miles per hour and humidity levels around 10% to 20%. here's where it looks from mt. tam gusting 23 to 25 right now. as far as the forecasts we'll have warming and drying wind shift today. temperatures 75 to 80 inland. and low to upper 70s around the bay and mid to upper 60s at the coast. have a good day. 5:32, developing news in the

east bay where the chp is investigating an apparent road rage shooting that sent a woman to the hospital. it ended in richmond off potrero avenue but it started on 880 in hayward. two young women in a black honda got into a road rage incident with someone in a white pickup truck shortly before 10:00 last night. one woman was shot in the leg. they called 911 and pulled over in richmond where the shooting victim was taken to the hospital. she's expected to be okay. the driver of the white pickup truck kept going. the chp is asking any witnesses to come forward. new developments in the b.a.r.t. strike threat. there appears to be some movement towards a new contract for workers with only a week to go before the cooling-off period ends. abc 7 news reporter amy holyfield is live in berkeley, amy? >> reporter: both unions have two press conferences scheduled for this morning but we are sensing a real fatigue from b.a.r.t. riders here this morning.

about all of this. the unions have made a third counterproposal to the b.a.r.t. management. and b.a.r.t. has responded by saying it appreciates the movement and is studying the numbers, but riders are telling us that they are growing tired of these negotiations that seem to be inching along. >> make a deal already. that's all. get over it. we just had enough i think. >> they're going back and forth, so i just -- i just wait for it to be done and then to go from that. yeah. >> reporter: how are you feeling about it all? >> i really don't have any thoughts, yeah. i'm just hoping for the best. >> reporter: the two sides will be back at the table today. they only have a week left to reach a deal. if they can't reach an agreement a strike could start next friday. and b.a.r.t. does have shuttle buses on reserve just in case there is a strike and they'll run people between the east bay and san francisco. live in berkeley, abc 7 news.

>> amy, thank you. adding to commuters' fears a strike is now looming for ac transit. union workers have rejected the transit agency's contract offer for the second time. the latest proposal included a 9.5% pay raise over 3 years. union leaders had encouraged workers to accept the offer. they will now meet to consider their next step. 5:35, the federal government shutdown enters its third day this morning with no end in sight. president obama held a white house meeting with the top four congressional leaders last night but it only produced more bickering. house speaker john boehner left the gathering saying the president refuses to negotiate any changes to obama care. senate majority leader harry reid said democrats won't change the three-year-old health care law as a ransom to reopen the government. we'll have a live report from washington coming up at the top of the hour. meantime, more bay area residents are feeling the impact from the shutdown. the latest having to do with canceled weddings. weddings have been canceled for this weekend at sutro heights,

struck and killed by a truck making a right turn at 6th and fullsome streets in august, and they did not cite the truck driver until surveillance video was discovered by a member of the san francisco bicycle coalition. police later concluded the truck driver was at fault. today's hearing will look at police protocol for these investigations. the city recently also announced plans to add a new bike lane along fulsome between 4th and 11th streets. a san francisco man will be in federal court to answer charges that he ran a massive online black market for drugs. fbi agents arrested 29-year-old ross olbrick accused of running silk road. they say criminals used the website to trade drugs and offer illegal services like forgery. and he's accused of using the site to try to hire someone to kill a former silk road employee who thought he was stealing. and his online handle was dread pirate roberts. the fbi said olbrick made tens of millions of dollars from drug

sales alone. jean kwan is facing a tougher battle for re-election based on a new poll. it shows she's less popular than her one-term predecessor ron dellums near the end of his tenure. "the oakland tribune" reports two out of three people viewed her unfavorably. 46% say they would definitely not vote for kwan next year. only 5% say they would definitely vote for her. still, at this point, the mayor doesn't have a big-name challenger. port commissioner brian parker and san francisco state professor joe toomen are her main contenders at this point. 5:38, continuing problems in the clinton park area of san francisco. >> the mission district in san francisco off of the central freeway at dubose and guerrero street a crash is reported due to a possible shooting. we're trying to get some more information from san francisco pd, but again this is right at the intersection of dubose avenue at guerrero street

after a pregnant german shepherd was left tied to a park bench while she was giving birth to puppies. a police officer took the dog and her seven surviving pups to a fremont vet all eight are doing well this morning and that's a big relief to officer jennifer bloom who spoke to us via facetime about the unusual situation she found herself in. >> you know, we go through training on how to if we ever have to help a woman deliver a baby but we've never had to deal with puppies. >> she's grateful for the help she got from the central veterinary hospital. if nobody claims the dogs, they'll go up for adoption as a family. two pit bulls that attacked a martinez boy will be put down, they mauled 10-year-old hunter kilborn while he was visiting a friend in antioch in august. the dogs' owners have decided not to appeal the city's decision to euthanize them. the lawyers say the owners are upset but it's taking too much out of them to keep fighting for the dogs. >> palo alto-based tesla is pond

i responding to a viral video that show one of its sedans on fire. firefighters had a hard time extinguishing the fire, they say it kept reigniting. this morning tesla said the fire was the result of an accident and not a spontaneous event. however, what happened did send shares of tesla plunging about 6% yesterday in trading. tesla says the flames were contained to the front of the $70,000 vehicle because of its design and construction. as the oakland a's get ready to open the postseason at home tomorrow night so are officials at the coliseum. the tarp will be removed in areas to allow seating for 48,000 fans, that's double the number of people who normally attend an a's game during the regular season. coliseum officials have also made upgrades that include the use of security entrances with metal detectors. they also completed a full review of the recent plumbing problems at the coliseum. they say the incidence with leaking sewage were manmade not

it may take two to three weeks before they decide to file criminal charges against a san francisco firefighter in the death of an asiana crash survivor. the autopsy obtained by the abc 7 news i-team shows 16-year-old mengyuan ye died when a fire truck driven by elyse duckett ran her over. prosecutors tell the i-team they are considering an involuntary manslaughter charge. the family's attorney tells the i-team he's preparing to file a claim with the city and county of san francisco. that's the first step to a lawsuit. lawyers for boston marathon bombing suspect dzhokhar tsarnaev are asking a judge to lift prison restrictions on the 20-year-old arguing they're overly harsh and have left him completely isolated. tsarnaev's attorneys say he's been confined to his cell except for visits from them and limited access to a small outdoor enclosure. an internal justice department memo was released to justify the restrictions. it says he told fbi agents when he was arrested that he remains committed to jihad and hopes his

and that breaking news is out of san francisco where police are investigating an attempted carjacking of a limousine town car. >> this is video just in that you are looking at, clinton park near valencia is shut down. the driver said somebody tried to carjack that limo and began shooting. the driver actually escaped unharmed but crashed into a parked car. the shooting happened near guerrero street and dubose avenue around 4:20 this morning. the driver complained of pain from that crash. good morning, 6:00 a.m. on this thursday. we'll talk more about that in a second and right now mike is monitoring the increasing winds for us. >> that will be the big story as we head throughout the evening, tomorrow, and saturday. the high fire danger that comes with it. right now all is quiet on live
