a bart strike has been pushed back by the unions. there is a delay though tonight. the two sides remain in a standoff. good evening. i'm ama dates. we begin with breaking news on the bart contract talks. just minutes ago the union announced they will delay a strike for 24 hours. during that time they want bart to withdraw the contract of oner and return to the bargaining table. bart made its, quote, final offer around 4:00 p.m. ending face-to-face talks. local politicians spoke out less than an hour ago and they want bart to get back to the bargaining table. f a strike.so asking for the we have live team coverage with more on some new options if there is a strike come tuesday. first to oakland where sergio has details on this delay.

sergio? >> a lot of the details have developed in the last 15 minutes. as you mentioned the union said they are not happy with this deal. they have said they will not go on strike tonight, but they are planning on going on strike in 24 hours. that is midnight tuesday if there is no movement from the management of bart. bart's general manager said the numbers they have offered and the deals they have given is the best the system can give. >> these folks are given a 3% raise each year and it is a 12% package, 4% for pensions and 9.5% for medical. it is good for them and good for us. >> our members and our riders deserve better than this. we are not going to go on strike because the public deserves to have a system that works. >> local lawmakers voice concerns over negotiations. >> so when bart management

cutoff negotiations by putting forward a final of oner at 4:00 p.m., we were disappointed and we felt that it did a lot of damage. >> a group of bart employees came to rally and offer support to their negotiating team. >> what do you want? >> when do you want it? >> they wanted to know if they should show up for duty or hit the picket lines. through most of the night, most of the information came from bart management's lead negotiator. >> we have and can put out a good proposal. >> bart's team returned after a two-hour break. we were told we would be summoned back if they had questions or comments of the deal on the table. he is the chief of the federal mediation service and he is any. obama uh .y. appointee. washington is paying close attention to the talks. lieu

tenant govern -- lieutenant governor gavin newsom has been het would be preposterous at this stage when you are getting this close to put at risk your reputation and the economy of the entire region. >> so here is the bottom line if you plan to take bart tomorrow morning, the trains will continue running. however, i was talking with a spokesperson for bart and they say that bart management is not going to move at all on the numbers. they say they will return tomorrow, and they will continue talking with the unions. however, that will be some of the side issues that will be on the table. they cannot move on any of the money numbers. if you are going to be using bart on tuesday it is probably a pretty good idea to start looking at will turn tiff -- looking at alternative plans. i can say that the unions have two weeks to consider this

again. >> for those who can't tele commute, the ferry will be expanding service. 12 boats will be in operation instead of the usual eight. ac transit will increase bus service as needed. bart riders are not thrilled about the prospect of taking the bus. >> i haven't ever taken the bus to san francisco. i don't know how that works. >> those who experienced it in july remember that long lines, crammed buses and short tempers. >> that was bad because we were waiting an hour for the bus. i guess we will be catching the bus. >> casual carpool was a popular option last time and is expected to be again if the bart trains stop running. with so many more cars expected on the freeway, the carpool lanes will be enforced from 5:00 a.m. until 7:00 p.m. on interstates 80, 880 and 680. all of the uncertainty is too much for michelle whose doctors are in san francisco. >> i need an mri and i need an uh -- an appointment with my

gave a thumbs up. his family greeted him after the rescuers pulled him from a deep canyon. he went hunting in the mendocino national forest on september 24th. he says he fell and knocked himself out. he came to alone, cold and hungry. >> he ate squirrels with whatever he could catch. he ate lizards and frogs and snakes and survival mode kicked in. when you have no food for 18 days, whatever protein you can get, he did. >> the marin county search-and-rescue team assisted in the search. when they couldn't find him two days after he disappeared, authorities called off the search. 16 days later the search was reactivated and rescue dogs were used. teams go the a call from a group of hunters who heard somebody yelling for help and he was found shortly after. and now the shutdown going

into the second week. protesters hit the streets of washington, d.c. >> you work for us. you work for us. >> a group of veterans protested outside the white house over the closure of the world war ii memorial over the shutdown. some vets carried barricades that sur rounded the memorial and stacked them outside the white house as you can see. a mile away the senate delayed taking any further action on the crisis until tomorrow. >> i have had a productive conversation and our discussions were substantive and we qil continue those discussions -- and we will continue those discussions. >> a bipartisan group planned to reopen the government and extend the debt limit. >> and the democrat leadership squashed it. we were ready to go to the press gallery. the leadership said no. >> republican senator john mccain told obama to take a

recognize san francisco's alamo square and now the landmark is due for a makeover. locals and tourists admire the view that has the famous painted ladies. it has a long to do list. they plan to repave walkways and there will be restrooms and install a new watering system for the lawns. the work is due to begin in july of next year. the alamo square renovation should be finished by december of 2014. an ma rights activists -- animal rights activists have taken steps from being -- from black bears from being killed in lake tahoe. the game warden sets traps when they loiter around a homes, businesses and camp sites. some bears end up being killed. the sacramento bee reports

the one weather system that brought the northern region of the state some showers moved on toward the east. nice ridge. we will show you the ridge really building in. and it will be with us for at least the next several days. it brought a littleactivity andy activity and all of this is shifting toward the east. high pressure is building in. we have had on shore winds the past couple days and now the winds hillary verse to more offshore. the winds will be shifting and the winds going from land to sea and down sloping winds and compressed close to the surface and the temperatures begin to ride. especially at the coast. here is an example of what we are talking about. we will go with 75 tomorrow. check out wednesday. the warmest day of the week is up to 80 degrees and even san jose you will be in the 80s as well as you get into tuesday and wednesday.

77 tomorrow, but how about 84 for wednesday. elsewhere we will look for temperatures in the 50s. here is a look at your highs for your monday. we come up a few more degrees. san jose 77 and check out los gatos at 79. half moon bay, 68. you will be in the mid70s. san francisco tomorrow and 72 in the north bay. a lot of 70s. petaluma 75 and novato 78. 80 for santa rosa. on the peninsula -- not the peninsula, but the east bay shoreline will be 74. up and over the east bay hills, very mild for this time of year. lots of sunshine with concord 80 and antioch 81 and 81 for livermore. shear a look at my seven-day forecast. breezy over the hills as the offshore winds develop on tuesday. go ahead and take the day off. beach day on wednesday with temperatures near 80 degrees at the coast.

vernon says i don't know if he likes it, but that's what i am calling him. next week we will have another edition of vernon's view only on abc7. ama? >> thank you, larry. and now back to our breaking news. a bart strike has been delayed by 24 hours by the unions. abc7 news reporter with more on the announcements made by both sides. sergio? >> the bottom line is if you are planning to ride bart tomorrow, the trains will be running. but as you mentioned it is a delayed strike because there is no deal reached tonight. the unions say they are delaying that strike for 24 hours in hopes of actually reaching a deal. >> through the -- throughout the weekend there was progress, but we learned that bart management offered their last best final offer at 4:00 p.m. this afternoon and in negotiation language is means take it or leave it it. the union leaders say they are not happy about the terms of the deal and they want to continue talking.

announcements, there was also a group of local politicians who came out and basically blasted bart management for the last offer. local politicians say they hoped negotiations would continue. one more day and then if there is not any changes in this last deal, the unions say they will hit the picket lines. reporting live in oakland, abc7 news. >> and we will monitor the on going labor disputes and will have anything on-line and on twitter. the abc7 morning news begins a half an hour early tomorrow at 4:00 a.m. a florida woman could be facing legal action after being stuck on a draw bridge. the 55-year-old woman wearing a pink shirt after participating from a cancer walk was dangling 22 feet off the ground yesterday above railroad tracks. she held on with her feet and her arms and never let go of her purse. after 20 minutes firefighters got her down with a ladder. authorities wanted to know why

she was trespassing on a bridge closed to pedestrian traffic. a 9-year-old boy was returned home to minnesota after he was stowed away on a flight to las vegas. the boy captured worldwide attention after he bypassed three layers of security to board a flight in minneapolis. he remains in the custody of a child welfare agency. a court hearing will take place on tuesday. his father pleaded for help, but officials told him they couldn't do anything until his son did something more serious than running away from home. a message from courage from gabby giffords. and the one simple bedtime change that parents could make that could improve their child's behavior. >> and it looks like temperatures across the bay area will be heading up as we head into the first part of our workweek. back east though you will need the
