unions say if no agreement is reached by today they will strike tomorrow. bart's latest offer was $7 million more than the last offer on friday. they say it is the last, best, and final offer. general manager says it is $7 million more than it was on friday. state lawmakers were at the negotiations and voiced concerns about bart management putting down the final offer. >> bart management cut off negotiations today by putting forward a final offer at 4:00 p.m., we were disappointed. we felt it did a lost damage. >> we put out a good proposal. they have to decide good that meets their needs. >> the federal mediation service joins the talks. he was appointed by president obama and is an indication that washington is paying close attention to the talks.

bart spoke person says management will move on the issues but will talk to the unions of the side issues. management says the unions have two weeks to take this deal before it will be retracted. >> matt, thank you very much. >> the trains are rolling. leyla gulen? >> 18 trains are rolling with quiet conditions on the roads. lots of green is out there so we moving along at top speed. we have a couple of areas with construction. first is in san jose if you are traveling northbound and southbound along 880 between forest avenue and 280 you will find construction crews and this will last until 6:00 with slow-and-go traffic toward 101, as well, but other than that, you are accident free. i can tell you we have a construction project in fairfield affecting eastbound 80 between 680 and highway 12.

>> commuters could be relieved there is no bart strike but many are on pins and needles after the latest developments. abc7 news reporter amy hollyfield is at walnut creek. >> the gate is open. the trains are running. today is a holiday. the thought among commuters is a strike would be bad but today would not have been as painful as it could be. some people have to work and they were glad to wake up and see the news. do not put your plan "b" away yet you still could need it. tomorrow they could go on strike and so it is starting to feel like ground hog day waiting and wondering is becoming part of their routine. that is abc7 news. >> in the event of a strike the transit age has chartered 200 buses to run from these nine stations walnut creek,

breaking developments on twitter >> 4:34. uc berkeley police are warning students to watch out of their surroundings after two women were assaulted in a 14-more span. the latest happened when a 19-year-old student was waiting for the bus on thursday and a man shoved her from behind and took her cell phone. that morning, a 57-year-old woman was robbed near berkeley way and a man with a gun took her purse and pushed her to the ground. new this morning in san francisco, a woman had to be rescued after falling into the chilly waters of pier 33. she was conscious and breathing when they arrived. they took her to san francisco general hospital but she is expected to be okay. according to firefighters she was sitting on a rail outside a restaurant and she slipped and goal into the water. >> records show oakland marian kwan's travel tab is higher than

that of other bay area mayors. the san francisco chronicle reports that the mayor is currently on her way to china, her 34th trip and 5th overseas since taking office in john of 2011. she bills the city for 21 of the 33 previous trips at a cost of $34,000 and she was entitled to $4,000 in meals no 83 days on the road. but that is no match of her predecessor who racked up more than $630,000 in one year including thousands in limousine services and a $4,000 stay at the ritz in washington, dc. san francisco mayor lee who is supposed to go to china himself has billed the still over $15,000 for 11 of the 24 trips since being sworn in and san jose mayor has billed his city $24,000 for 19 of his trips.

mudslide along highway 17 if you are traveling both in the northbound and southbound direction you just might find it and this is south of the lexington reservoir if you are traveling in both directions it could affect your commute. watch out for rock slides along highway 17. this is the big moodiy curb south of the reservoir, so we are already seeing volume building in the southbound direction and northbound side, though, does not appear to be affected. now a look at the golden gate bridge we have clear traffic right now and we had commute northbound direction with cones being picked up but southbound side will take you about eight minutes to ahead away from sausalito through the waldo tunnel and into san francisco. now our warm-up, here is mike nicco. here is a look at the day planner over the next 12 hours, it is cooler when you step outside this morning with a slightly heavy sweatshirt or

san jose that would extend the stat houston limitations for some childhood victims sexual abuse. he vetoed a measure sponsored by senator hill of san mateo that would require pharmacists to notify prescribing doctors when they substitute generic for brand name drugs. the governor rejected an effort by a senator leno to give the prosecution an option of reducing heroin and cocaine possess charges from a felony to a misdemeanor. today the cupertino city council will approve a plan for the new space shift-like headquarters for apple. the commission has approved the building and it will be four stories tall and offer three million square feet of work space and is expected to house 14,000 employees. >> as we mention, it is columbus day. we will see how that is affecting traffic. leyla gulen? >> we have 18 trains running on time. ace train is now starting to roll.

we are looking at quiet conditions on the roads. this is columbus day. we could have folks taking the day off. those who are not, you will be in good shape if you plan on driving. as we take you to highway four if you are coming from concord to bay point you will never we have construction there and eastbound side from port chicago highway to willow pass road westbound commute quiet right now we are at top speeds as we make it out of antioch to pittsburg. over the altamont pass you have top speeds in the westbound direction with eastbound slowing because of a project out there until 9:00 this morning. outside, you can pick out san jose, and this is the commute along 280 and we will check out the drive along the san mateo instead with traffic moving find out of hayward to foster city and we have the half moon bay art and pumpkin festival weigh in today. you could expect to see heavy

traffic there. mike? >> thank you very much. 41 degrees at half moon bay right now and at 7:00 it will still probably be about 41 degrees. dress the kids repeatedly if you are down to watch the weigh in. radar and satellite show neither, it is bone dry outside right new. check out the temperatures, 41 degrees at half moon bay, 42 in napa, 43 in santa rosa and 45 in novato and 46 in san ramon and 47 in los gatos and fremont 48, and san jose and live more 49, and 50 in concord, oakland, hayward, mountain view, san carlos and 54 in san francisco. from the east bay hills you can see how calm it is and the reflection, new bay bridge lights on the bay gives an idea of high pressure dominating the weather and that is cooler but warmer this afternoon and it will be clear tonight but the breezes will pick up in the hills and they will not be fast enough for a high fire danger with above-average temperatures for the better part of the week

and a cooling trend for the weekend. from sutro tower glistening lights and livermore at 79 where you should be for this time of the year and 72 in san francisco and san jose at 77, and 77 in redwood city, and two degrees warmer and live more is 81 and oakland at 75, three degrees warmer than what we should be for this time of the year, sunrise is 7:18 setting at 6:33. half moon bay is up to 68 degrees and we will be near 90 in santa cruz and morgan hill, and near 80 at concord and fairfield and 81 in antioch and livermore and today in richmond, 72 and san rafael at 77, and tonight the temperatures will fall back into the 40's in most inland neighborhoods and maybe 50 in antioch and a lot of upper 40's to low 50's around the bay. while you were sleeping, high pressure moves from over the identification to near the great bay with the offshore wind the next 72 hours.

that is why the temperatures in the seven-day forecast are rising. all the way to the coast through wednesday. we will be in the mid-70's and low-to-mid 80's for the rest of us. cooling on thursday and spreads across the neighborhoods friday, saturday, and sunday and right now i am more conservative in the molds going a little bit warmer for the weekend but we will watch it for you. here is kristen and eric. >> for the first time former arizona lawmaker congresswoman gabrielle giffords attended a gun show. she and her husband who are both gun owners toured a show in new york this weekend, pushing for a federal law requiring background checks on buyers at the gun shows. >> stopping guns might take courage. the courage to do what is right, the courage of new ideas. i have seen great courage when my life was on the line. now is the time to come together.

got everyone so excited: this guy is from oregon. the honors went to him for his pumpkin which weighed in at 1,775 pounds and at $6 a pound, a cash prize of $10,650. the two contenders are from napa that could break the record of 2,032 pounds a whole lot of pumpkin. the weigh off takes place this morning at half moon bay and it is the prelude to the art and pumpkin festival on friday and saturday. cash prices will be offered for the heaviest grown in california and the heaviest in san mateo and by audience applause, the prettiest. the kickoff starts at 7:00 a.m. until 11 a.m. and it is a fun family event. what i do is speak to the guy whose have been growing pumpkins
