>> live from the kgo-tv broadcast center this is abc7 news, this is abc7 news. >> the 49ers new stadium in santa clara is the scene of a deadly workplace accident this morning. good morning, i am eric thomas. all work has stopped at the future home of the 49ers after a truck driver decided. it is the second fatal accident at the construction site. our reporter is on the scene. >> this happened at 6 cologne 45 a.m. as the steel contractor was making a delivery here to the stadium. a load of rebar he was handling

broke loose and struck the driver of the truck. the sky 7 was overhead with pictures of the accident scene moments later and this happened on the south side of the stadium site, yellow tape marks the accident site. the driver was taken to the hospital where he died of his injuries. we do not know how the rebar broke loose or any other details. the identification of the truck driver has not been released. the state industrial safety agency says the employees worked for american steel or a subcontractor. turner development, the joint venture contractor did not make anyone available to answer our questions. however, the same is true for the 49ers. turner put out a statement saying and i quote, "we are deeply saddened to confirm that the driver has passed away as a result of the injuries. our thoughts and players go out to his family during this very difficult time."

this is the second fatal accident at the 49ers stadium construction site this year. back in june, an employee of the elevator was killed while working on a ladder at the bottom of a shaft and struck and killed by an elevator counterweight. at the scene, now, as kristen indicated, all construction activity has stopped. all the workers have been sent home and the santa clara police and fire department and cal osha begin their investigation. we are in santa clara at the stadium for abc7 news. eric? >> thank you, david. happening now, bart riders and union members are in the same boat trying to figure out what to do now that bart has a take-it-or-leave-it contractor offering with leaders urging the transit agency to take it back. matt keller has more from oakland. matt? >> negotiators and leaders are expected here at any moment at the building in oakland and you can see the media has set up in

more for pension and 9.5 percent more for medical. >> the bay area is tired of going do bed at night and not knowing if bart is open. it has been long enough. >> leaders were disappointed by the final offer saying it did a lot of damage to negotiation process. negotiators for the union want the proposal rescinded and if they do not reach an agreement by tonight they will strike tomorrow. we have given the district at least four different extensions trying to get this deal done. at some point you have to say "enough is enough," you have to let people know, look, we can do the deal if you don't want to you are pushing us in a corner. that is where we are. >> bart management says it will give the unions two weeks to consider the offer and take it to a vote for the members. >> now, bart has chartered 200 buses if there is a strike tomorrow to run from these nine stations: el cerrito, concord,

this afternoon, president obama will meet with congressional leaders and urge them to act. lawmakers have three more days to raise the $16.7 trillion debt ceiling or the government i don't default on paying its bills for the first time ever. >> san francisco police are investigating a murder that happened overnight in the mission district. they got the call at 4:30 this morning of several shots fired at 2st and bartlett. a man was found shot but it was too late to save him. it is too we usually to tell the motives but residents can't help but wonder if it is gang related. >> in this neighborhood you cannot put it past, we are at the cross of the gangs. >> the gentleman lit a candle outside the crime scene for the victim. police have made no arrests and they have not released any information about the man who was killed.

>> richmond police are vetting a man found dead inside a badly damaged car last night when responding to gunfire pick the up by "shot spotter" technology. it led them to the accident scene near 7th and ohio avenue. they believe the victim crashed the car after being shot. >> happening now, police in london are holding a man who tried to enter the palace with a knife. guards found the knife as he tried to pass influence a -- through a gate. three was arrested and charged with possession of a weapon. last month, london police arrested two men who broke into the palace. >> in san jose, a former catholic schoolteacher accused of sexual misconduct is suing a group of parents and young girls after three was cleared by police. our media partner reports that he was fired from holy spirit catholic school, the former p.e. teacher says in 2009 and 2010 two girls made fall claims and

>> we are having a hard time understanding if things are going well, we hear all day, why did bart come in with the best and final or were things not going well. >> i will tell you honestly, we are about $16 million apart, don't hold me to the exact number, we are about $16 million apart over four years. now, when bart has $110 million surplus on its books it doesn't make any sense for them to have issued a last, best, and final offer they knew in advance we would be unable to exempt because it does not adequately address the issues at hand. they have separated the parties for the last 90 days. their offer was pretty much the same as it has been for the last 60 days. i hope today they will have reconsidered a couple of hours sleep, some coffee. i don't take this lightly and i don't take it slightly. it is very, very serious.

that happened near hunter hill rest area this morning. the c.h.p. says the truck came to a stop on the dirt before it reached homes. the big rig rested 100' from vanessa street. the driver lost control after he pulled over to check his truck. no one was hurt. >> the san carlos city council meets to discuss what and next for the pg&e pipeline shut down over safety concerns. the california public utilities commission has ordered the pipeline to remain shut down although a court injinx was lifted. the order to close the line came after an internal pg&e memo expressed concern that the pipeline could explode like the one in san bruno that killed eight people three years ago. >> macy's will do more than the annual thanksgiving day parade. they are breaking tradition and will open some of the stores on thanksgiving. this is a first in macy's did 55-year hit. the store will be open for 24

notice which way the winds are blowing out from the northeast to the southwest, that is the offshore wind developing and it will bring us the warming trend today and for the next couple of days. we will start with the morning lows: napa and novato and half moon bay, 39 degrees, those are all the cool spots and santa rosa 40 and san ramon 41 and the rest of us in the mid-to-upper 40's and san francisco around 50 to 53. right now, look how far we have come, compared to yesterday, 1 degrees warmer at half moon bay and nine in san san carlos and the rest of us flee to five, so temperature-wise, all of us are in the 60's but for live more and fairfield at 70 and half moon bay at 72 and san francisco is coolest at 60 right new. as we take a beautiful picture from is tremendous tower back to the marin head lands, we will talk about a warming trend that begins today, clear, cool tonight, and watch out over the hills the temperatures are up because the breezes are faster

but not fast enough for fire danger. temperatures are above average all week but it will be cooler this weekend and why see any real rain in the forecast. from mount tamalpais, it looks clear as we look back to the south and temperatures today are at or three degrees above average and this is just the beginning, sun will set at 6:43. watch the high pressure while we are sleeping move aexplore and to the northeast of us, with that clockwise flow we will get the offshore wind and the temperatures are going to rise. how about your neighborhood in the south bay? near 80 in los gatos and morgan hill. mid-to-upper 70's on the pens what and we go from 72 in millbrae and 77 in mountain view. low-to-mid 70's downtown and south san francisco and sausalito and 80 in santa rosa for the warm spot and the beaches near 70 and the east way shore will be mainly mid-70's like oakland, 75 and into the east bay valleys upper 70's to

near 80. tonight the temperatures are as cool and maybe not so much, 40's and 50's rather than 30's, foreclosures and 50's. the seven-day forecast i put together for you, the warm east-west is tuesday and wednesday and the cooling hits the coast on thursday, and extra clouds over the weekend but they are not going to bring us the much needed rain but they will temper the temperatures. enjoy the next couple of days it will be around for a while. back to you. >> this morning's san francisco 49er c.e.o. is expressing his disappointment with the reactions of fans at candlestick park. espn is reporting some fans were cheering and doing the wave after arizona defensive end cam bet was hurt during the game yesterday. several 49ers gestured to the crowd to stop. york tweeted his disapproval saying, to safer i am disappointed in fans that they did this wave while campbell was down is an understatement. hope you get well soon.
