good afternoon, i'm dan ashley. >> i'm carolyn johnson. a news conference just wrapped up in santa clara involving a general contractor of the new 49ers stadium where a truck driver was killing this morning while delivering construction materials. >> sky 7 was over the scene of the accident after it happened. abc 7 news is live at levis stadium with the latest on how this happened. >> reporter: well, the co-director of the $1.3 billion stadium project met with reporters and says he does not know what caused this accident, this fatal accident in which a truck driver was struck by falling rebar. the driver has within identified as a 60-year-old

edward lake junior of vacaville. the death left everyone in shock. >> first it was shock, then, tragic. a fellow co-worker lost his life that. sank in quick. it's emotional. i mean... it's banged up in there. >> the driver was struck about 6:45 in the morning. sky 7 gives you view of the scene. the driver later died at the hospital. investigators will be looking into where he was stand whgt rebar broke loose. a sign at the yard warns to stay in the truck or far it from when loading or unloading. the driver worked for one of the largest makers of rebar, rebar used in construction to strengthen concrete. cal osha will be investigating

the accident. this is the second fatal accident of the stadium this year, in june, an employee of shindler elevator was killed by a counter weight. the joint venture contractor working on the stadium issued a statement saying quote we're saddened to confirm the driver passed away as a result of his injuries. our thoughts and prayers go out to his family during this very difficult time. the 49ers organization issued a message of condolences to the driver's family. >> reporter: the company indicated cal osha told them the job site is now safe, there was no criminal activity here. so the job site reopens tomorrow morning with workers coming back on the job and they will be offered a support network and counseling to deal with the death of a co-worker. >> that will be a tough day.

thank you very much. contract talks underway to avoid a bart strike at midnight. bart says it's willing to negotiate as long as necessary for a settlement. yesterday, bart submitted what it calls it's last, best, and final offer. union members say they're committed to strike if there is no progress. union reps pushed back the deadline 24 hours to midnight tonight in efforts to get bart back to the bargaining table. commuters say they're just frustrated. >> this is about 5:00, if you're going to hit the strike or not. so the yo-yo sfekt not enjoyable. >> we're surprised, stunned to get the last offer. it's not an adequate offer. it does not address our safety concerns or meet economic requirements that the workers have and so we have to get back to the table.

>> bart says the offer includes a 12% increase. the unions say two sides are about $16 million apart. >> the negotiations drag on, people around the bay area depend on bart are making alternate plan autos ready to scram skpbl getting ready to spend more time getting to, and from work. wayne freedman is live with that part of the story. >> commuters are fed up at this point with uncertainty of not knowing what is going to happen tomorrow, how they're going to get to work and find that transportation. do they really want to take a ferry boat? carpool? stay home and telecommute? not really. let's begin with austin hahn. >> it's aggravating actually. we're looking at deciding what is going on. they don't tell you until 12:30 in the morning so i set

it's not attainable. it's not smart, it's not good for the american people. so let america default. >> we've had an opportunity over the last couple days to have some very constructive exchanges of views about how to move forward. >> republicans blame the president for the lack of progress saying he's been unwilling to negotiate on spending cuts and health care law. it's not yet known how house republicans will react to any senate deal. >> the government shut down is keeping most irs workers at home, but that does not mean you're off the hook for taxes. the agency says tuesday deadline for filing taxes if you request saichld-month exnengs april still stands. but the irs says it won't issue refunds until normal government operations resume. so don't expect your money quite as quickly. the agency won't have workers to take calls or help taxpayers in person. more than 90% of ars staff is on a furlough because of the

a special celebration yesterday is marked by sadness today. the three sisters from georgia decided to get married and hold the ceremony on the same day so their mom could be there. becky has cancer but wanted to live to see her daughters walk down the aisle before she died. >> kind of bittersweet. because we're happy she's here but we're sad that this will probably be the very last big

thing we do with her. >> the ceremony went off just fine in large part because of the donations pouring in to help give them the wedding they dreamed of having. sadly becky passed away today but not before her dream came true as well. >> a venezuelan man is living proof you don't have to finish first to be a true winner. a big crowd waited at the finish line at chicago marathon until 1:30 this morning. the 38-year-old completed the course in 16 hours, 46 minutes. really amazing show of perseverance, specialsly when you consider he has muscular dystrophy. he says if you dream it, you can make it happen. he's kmet competed in berlin and new york as well. congratulations. >> that is amazing. >> yes. >> halloween may be for kids
