good morning. the federal mediator who is in oakland for the bart talks announced 15 minutes ago that both sides are taking a much needed rest break but, again, the trains will keep running today. we are joining them from oakland. >> talks ended 20 minutes ago. both left the caltran building with "no comment." the federal mediator left his talks. here is what he said. >> it is now 5:45 a.m. and at the mediator's request, we will be taking a recess until early this afternoon. that is all i will have to say at this moment. negotiations are continuing. we will be back at it this afternoon. >> i asked the federal mediator if he was recommendation no strike tomorrow and he reiterated that trains will run

normally dead and three was asked how the talks were going and he said no comment. the union said they could not leave until a deal was done because they were close. no deal has been reached but bart put forward the last best and final offer open sunday and the unions counter proposed yesterday and both sides have been at it since 1:yesterday and will enback today at 1:00 o'clock p.m. >> we were afraid what this would do to the commute but so far so good. >> so far so good. there is a sig-alert before the altamont pass on westbound 205 and one lane everyones blocked because of an overpushed vehicle and minor injuries are reported and backups from before tracy boulevard as we take you to hayward we have this brand new accident on the transition from southbound 880 to westbound 92 and that is causing some delays as you come away from 238.

we have a report of a water main break in castro valley with more on that in a little bit. as far as bart is concerned we have delays in both directions on richmond and fremont lines at 15 minutes. this is because of an equipment malfudge. hopefully we will get that wrapped up. outside, the bay bridge toll plaza shows the metering lights are on and we have heavy backup away from the maze and into the tolls. >> that is different from yesterday. a constant today is the weather. good morning, everyone, here is live doppler 7 hd with no radar runs, very dry air and no clouds to speak of and temperatures today above average everywhere, and no matter where you go today, the beach, the bay, inland, we are going to be warmer than we should be. starting off cool, day planner around the bay at 50 degrees and sunny by noon, and milder this afternoon and not so heavy a coat needed as last night.

east bay. the 3.2 earthquake hit 1:07 a.m. in the berkeley hims. it was centered three miles east of berkeley with two smaller after shocks. people reported feeling weak to light shaking from san francisco to pittsburg and from vallejo to sunnyvale. it did not do any dam. >> also, san jose firefighters say downed power lines created a hazardous situation that hampered their efforts to put out a barn fire. the large barn wassen gulfed in flames when the firefighters got this at 10:45. it was a workshop for furniture. the tire brought doubt power lines and firefighters had to stay clear. the barn bushed to the ground but there are no reports of injuries and the fire was declared under control after two hours. >> a triple shooting in san

francisco has turned into homicide. these people were shot last night with one dying overnight. police spent the evening talking to witnesses and gathering evidence. no arrests have been made. >> work will resume today at the stadium in santa clara following the death of a worker. 60-year-old edward lake jr. died after a rebar he was unloading fell on him. he was a truck driver in napa. we have a view of the accident scene. the project managers say they will hold a meeting this morning with the crews to discuss the accident and safety measures. also, grief counselors are available. >> it is tragic. we had a fellow co-worker lose their live and that sank in quickly and it is emotional. >> this is the second deadly accident of the stadium site in four months. in june a worker died when three

growing in washington a new budget plan could re-open the government and raise the debt ceiling soon. democrats and republicans spent all yesterday negotiating a deal to keep the agencies open until mid-january and raising the debt ceiling until mid-february. that gives the house of representatives and senate time to negotiate a long-term budget. republican lawmakers will be briefed this morning about the deal. it is unclear whether house speaker boehner will allow a house vote on the possible deal. >> "new york times" is lifting the pay wall on the website and mobile devices. the paper announced this morning users can read unlimited stories for free. the move is to help sole bright the day because of the international "new york times" which used to be the international herald tribune. the unrestricted access is in place through the end of the week. >> from high fashion to high tech, apple is bringing the head of burbury on board.

>> officials are considering a proposal to install surveillance video around the city and police are asking the city council to install the cameras in low-to-mid income areas in response to a recent rise in home burglaries. not intended to target specific group of people. if approves up to 20 cameras go up and census data is used to choose where to mount the cameras. >> our media partners, the "contra costa times", reports the city council is voted in favor of the ordinance classifying illegal drug sales, storm, and manufacturers as public nuisance. if approved that gives the city authority to pursue legal action against landlord whose look the other way and retuesday to address drug activities. the council is expected to milk a final decision on that ordinance at the october 28 meeting. >> bart is not the only bay area trance it agency dealing with a strike throat, coming up.

>> good morning, everyone, just about 6:45, pictures outside the caltran building in oakland, bart negotiations went on for 14 hours and they are taking a break now and will resume this afternoon. the trains are running. >> bart trains are running. but there is a threat and a.c. transit workers now say they plan to strike on thursday after rejecting two contract offers. >> abc7 news reporter, nick smith, has more on that. >> because the start of the bart strike continues to loom, volunteers of ab transit have been handing out flyers to let commuters know how they can get around the bay area using a.c. transit, but a.c. transit may themselves strike at midnight on thursday. on monday, a.c. transit issued a 72-hour strike notification to

let their riders know they may walk off the job. the strike is never convenient the timing is particularly bad because it could mean a double strike if a deal between bart management and their unions is not reached. the a.c. transit union which represents bus drivers and mechanics and dispatchers says that that it is the districts turn to move. the district is not commenting. >> unless there is change we are not aware of that is for the coming, 12:01 a.m. on thursday the buses will cease to service the community. >> i am disabled and i have to get...that is the only transportation i have. >> their decision to strike came as a surprise because the bus line and the union had two agreements after the contract expired in june but bus drivers in other unions rejected both of those deals. a.c. transit buses provide a critical lynch across the bay and now a.c. transit carries more than 100,000 people each

day and was expected to pick up most of the weight of displaced riders during bart shut down. we do not know whether bart management and the unions will make a deal. we do not know whether or not a.c. transit are actually negotiating with their unions today. we will find out more and have a report today at 11:00. >> another website glitch allowed united airlines customers to buy oversees tickets for $50 but this time they will not get to use them. it is reported that customers set up mileage plus accounts and use frequent flying miles they did not really have. united says they will not honor the tickets because the buyers manipulated the system. last night they accidentally sold tickets for nothing and the company honored those tickets because they were caused by human error. >> google could be working on a new gadget.
