the breaking news, no strike tomorrow. happening now, both sides, bart and the unions are at the bargaining table, and while trains will run in the morning, there is no deal in place. good evening. i'm dan ashley. >> i'm carolyn johnson. let's get to abc7 news reporter john alston live where the negotiations continue. >> the strike has been averted for one more day. let's be very clear. there is still no deal, and the talks are continuing in the building behind me on the 13th and 15th floors of the cal trans office in oakland. the big announcement was less than an hour ago. it followed a tweet from atu local 1515 that there would be no spriek in the morning. the federal mediator came down and made a brief announcement which brought thousands of bay

area commuters one more day of relief. >> the parties have made some progress, and the parties authorized me to advise you that behalf of themselves and in support of the public interest and all of the riders in this area, there will be train service operating all day tomorrow. >> both sides have been at it since 1:00 this afternoon and that includes the federal mediators as well as the bart gm. there was a small dust up after the bart spokesperson discussed some of the negotiations or the issues around it. the head of the atu said that was a violation of the gag order, but that was a small sideshow in the greater talk. they are expected to continue through the evening, but the bottom line x there will be trains all day tomorrow. we will be here through the evening to bring you updates in the newscast on on our twitter page. live in oakland, abc news.

>> thank you. we will keep you posted on any developments throughout this newscast. >> meantime, ac transit workers are still on the brink of a strike tonight. there is a little more than 24 hours before a threatened walkout. ac transit managers asked governor brown to impose a 60-day cooling off period to delay a strike as he did for bart. brown's office is still reviewing the request. >> we have had two tentative agreements. we have not heard anything from the union since the rejection in terms of what they want. >> i feel sorry to our passengers. i apologize to them. we are at a point where our backs are against the wall. >> the two sides disagree on how much bus drivers and mechanics should pay for their medical benefits. ac transit wants them to pay $283 per family per month. the union claims that is too much. >> commuters who would be tingly hard hit if transit workers strike are those

living with a disability. the independent resource center plans to hold a rally at the trans bay terminal to highlight how much people with disabilities rely on bart and ac transit. an employee says it was devastating for so many people that was disabled. >> they had to wait a longtime for transportation. at least i know one person who had to wait for several hours. >> peter men mendoza says it is not always an option. under the americans with disabilities act says those with disabilities who can use public transit cannot use the paratransit program. >> although there is no strike tomorrow there is no deal in place. if there is a strike in the coming days, bart has 200 buses that will run from nine stations, el cerrito, del norte, concord, dublin, san leandro and fremont. you need to get a round trip

where the kids were taken. alan, they are okay, right? >> they are okay, and the stolen car is registered to a san francisco couple that lives near the castro. i am told the parents were reunited with their children here at san francisco general tonight. now police are searching for the person who stole their car and likely abandoned it after realizing there were two kids in the backseat. >> someone was blocking my driveway. >> first he was annoyed and then he was alarmed after he saw two toddlers alone in the backseat of this suv. it was about 6:30 and they were strapped into their car seats and the engine was still running. >> a boy and girl were scared and crying a little bit. >> i was talking to 9-1-1 and they said don't touch anything, don't do anything. this is a kidnapping. >> the neighbors found out the volkswagen suv was stolen from 22nd and folsom streets in the mission a half hour earlier. >> it is horrifying. i have a 6 and 3-year-old.

to imagine that somebody would, one, take my child, and deposit them somewhere and i have no control over the situation, that's awful. >> police say the father was with his 3-year-old daughter and 1-year-old son when the car was stolen, but they did not say what happened. >> they seemed fine. they put them in the ambulance. >> as a precaution they were taken to sf general to be checked out and reunited with their parents. >> alan wang, abc7 news. >> developing news, state authorities confirmed a preschool teachers and neither fremont inappropriately touched a child. the preschool has been cited. the department of social services says it happened on mission boulevard in august. a male staff member touched a child inappropriately during nap time. child protective services admitted to rubbing her stomach and then moving too far down her body. parents gathered to ask questions about the incident. a spokesperson told us the school took action after receiving a complaint. >> we did pro actively reached

out to licensing and removed the teacher from the situation. the teacher was later terminated. the police department was also brought in to conduct an investigation and that was done in a timely manner. >> they will have to inform parents. social services report for the next 12 months. fremont police did not charge the employee. five people went to the hospital after a bus and truck collided. it happened on 680 in mill pea dis. you can see from sky 7hd that the bus is blocking the southbound lanes after the crash. the crews eventually had to shutdown all lanes to get traffic in that area flowing again. >> we now know how an america's cup sailor died during a training race earlier this year. he was killed when his 72-foot catamaran capsized in may out on the bay. he died of blunt trauma with drowning. he did not say whether he was unconscious when he went into

the water. he stayed below the surface for 10 minutes. >> a major setback on capitol hill pushes the government shutdown for the 16th day and edges the nation closer to default tonight. the house suddenly canceled a vote over a plan to reopen the government and raise the debt ceiling. speaker john boehner was able to gather enough votes with tea party republicans against the plan. that puts a compromise or a possible compromise in the hands of the senate where work continues on a bipartisan deal. >> we will continue to work with members of both sides of the aisle and make sure that there is no issue of default. >> insanity. i have confidence and i am optimistic and believe that at the end of the day they will do the right thing. >> with the nation set to reach the debt limit, they put the triple-a credit rating under review for a down grade. a down grade would make it much more expensive to barrow money. we are following bart talks happening right now.

francisco. if bart goes on strike, i won't be able to see my little brother in the homecoming parade this weekend in martinez which is a once in a lifetime opportunity. so please don't go on strike. >> and you can share your videos as well on twitter or instagram. just use the hash tag dear bart and you can send videos to our abc7 news facebook page. new at 11:00, a ground service employee at los angeles international airport has been arrested in connection with dry ice explosions. investigators think the dry ice packed in plastic bottles may be part of an on going labor dispute. he was accused of setting them off near an aircraft. one device exploded on sunday and another last night. two girls in florida now face charges after a 12-year-old girl committed suicide. the local sheriff said the two bullied the girl to death and now their parents could be charged as well. abc7 news reporter matt

goodman has the story. >> the sheriff's message was clear, words can kill. >> there were statements such as you should drink bleach and die. nobody likes you. >> the polk county sheriff's office is charges a 14-year-old and in an unprecedented move 12-year-old for aggravated felony stalking. charged as juveniles they terrorized rebecca sedgwick who committed suicide last month. >> was this a contributing factor of her jumping off the cement towers that day? we believe it did. >> naming the minors and brandishing their pictures, the tipping point for the arrest were these comments one of the suspects posted on saturday. >> yes, i bullied rebecca. she killed herself, but i don't give a -- and you can add the last word yourself. >> sedgwick's family says at first the abuse was physical and started here at this

school. when sedgwick's mother pulled her from the school the abuse came on-line. up to 15 girls ganging up on rebecca. >> she should be here. she should be here to see justice getting served. >> the sheriff is sending a message to would be bully yes, sirs and their parents. >> if you don't discipline your children and if it rises to the level of a violation of the law, don't worry, we will discipline for you. >> abc news, lakeland, florida. a soldier's gesture brought battle tested warriors to tears and now the photo has gone viral. look at this. a wounded army ranger salutes from his hospital bed moments after emerging from surgery. he was wounded when a suicide bomber targeted his unit in afghanistan earlier that day. four other rangers died. he saluted when his commander gave him the purple heart.
